ORDINANCE NO.
AN DESIGNATION FROM MEDIUM SINGLE FAMILY
TO OVERLAY HISTORIC PRESERVATION, DESIGNATING THE
3 AT 747 E. BENTON STREET AS AN IOWA (
WHEREAS, The ' owner, William Buss, has filed with the City a no ~r the designation of
said property as an Iowa Landmark; and
WHEREAS, the Historic Commission has reviewed and the significance of the
building located on said has determined that it meets the: uirements for designation as an
Iowa City Historic Landmark; and
WHEREAS, at its public hearing 23, 2002 the Historic Pr )n nominated the
subject property for designation as ' Historic Landmark; ~
WHEREAS, at its meeting of June the Zoning Commission recommended
approval of the proposed landmark nomination
WHEREAS, the State Historical of said nomination and concurs with the
assessment of the Historic Preservation subject properly meets the criteria for
designation as a historic landmark; and
WHEREAS, the designation of the subject property Jld be consistent with the goals and objectives of
the City's Historic Preservation Plan, which is an amendn to the City's Comprehensive Plan.
NOW, THEREFORE, BE IT ORDAINED BY OF THE CITY OF IOWA CITY,
IOWA:
SECTION I. APPROVAL. The following is hereby designated as an Iowa City
Historic Landmark pursuant to Title 14, Cha 4, Land ~nd Development, Article C, Historic
Preservation Regulations:
Commencing at the southeast corner of Section 16, North, Range 6 West of the
5thP.M., thence North 341 feet to th west along the center of the
public highway 166.5 feet, thence of the line of the SWl/4 of said
Section 16, thence east parallel line of said SW1/4, thence
north along the east line of saic point of beginning.
SECTION II. ZONING MAP. Building Inspector is hereby authorized a~N, directed to change
the
zoning map of the City of Iowa Iowa, to conform to this amendment upon the fi. nal passage, approval
and publication of this ordinan, provided by law.
SECTION III. C AND RECORDING. Upon passage and approva],.of the Ordinance,
the City Clerk is hereb and directed to certify a copy of this ordinance and torecord the same
at the office of the County County, Iowa, all as provided by law.
SECTION IV. REPE __ All ordinances and parts of ordinances in conflict with the provisions of
this Ordinance are here , repealed.
SECTION V. ',ABILITY. If any section, provision or part of the Ordinance shall be'adjudged to
be invalid or such adjudication shall not affect the validity of the Ordinance as'~ whole or
any section, provisi judged invalid or unconstitutional.
SECTION VI. DATE. This Ordinance shall be in effect after its final passage, approval
and publication law.

On the assumption that a short message on the lighter side in your packet would not be amiss, I come back
to Mr. Kanner's question.
As I understood it, the question, "Why did Cyrus Ranck die in Michigan?" was prompted by the statement
in our application (in the Tallgrass report) that Ranck had experienced failing health and an inability to work in
the last two years of his life and died at the Battle Creek Sanatorium in Battle Creek, Michigan. The answer to
the question, my wife informs me, is because the Battle Creek Sanatorium was then in fashion as a place where
people went when they were ill.
That general point is reinforced, albeit obliquely, by an entry in the 2002 Old Farmer's Almanac.
According to the entry, the Chief Engineer in charge of building a tunnel under the Hudson River into New
York City "worked obsessively, going in and out of pressurized chambers, day and night, with an already-weak
heart. By early October, it was clear he needed a rest,.., and he retreated to a sanitarium in Battle Creek,
Michigan" where he died the day before the two ends of the tunnel came together, October 28, 1924. 2002 Old
Farmer's Almanac, page 202. That was Clifford Holland, after whom the Holland Tunnel was named.

Dear Karin:
As you suggested, I am writing to request that you initiate action
required to have the City Council accelerate its consideration of our
application for historic landmark designation.
I cannot claim any great hardship, but it would be very convenient if we
could have the status of our property settled as soon as possible. There
does not now appear to be any controversy affecting our application.
Therefore, I hereby request that, if it is appropriate and consistent with
the City Council's treatment of such applications, our application for
historic landmark designation be acted upon in the fewest possible separate
City Council meetings.

Following the public hearing on the rezoning for the amended OPDH-12 plan for
Silvercrest to allow four 4-unit townhouse style buildings,and four 24-unit independent
living buildings on Tuesday July 16,2002. Dial Land Development would like to request
that the rezoning be put on a fast track and that the remaining meetings be
consolidated as much as possible.

Re: History of Frontage Road at 801 Highway 1 West (Carousel Motors Property)
In 1985, when the property at 801 Highway 1 West (the Carousel Motors property) was
first platted, the City required a frontage road to be dedicated along the north side of the
property, parallel to Highway 1. At the time, it was practice to use frontage roads for
access to commercial properties adjacent to highways. The frontage road was required to
extend from a preexisting frontage road on the east side of Ruppert Road. To accomplish
this, the developer was required to purchase Highway 1 right-of-way from Iowa DOT,
dedicate it to the City as public right-of-way, and pave a 28-foot wide frontage road.
Since that time, the use of frontage roads has been discontinued, due to the conflicts that
can occur in the space between highway and frontage road intersections from the turning
movements of vehicles. Therefore, the frontage road at 801 Highway 1 West was never
continued to the west as subsequent commercial properties were developed. The frontage
road, though public right-of-way, is used solely for access to the business at 801 Highway
1 West.
The request to vacate the frontage road right-of-way at 801 Highway 1 West is unique in
that the property was required to be purchased and dedicated to the City. Though the
frontage road right-of-way was required to be purchased and dedicated to the City, under
State law, the City is required to obtain compensation for property being disposed of to
private property owners. The applicant has agreed to close the existing frontage road
access point and move it south from Highway 1, and plant landscaping along the Highway
I frontage. Staff feels the public benefit of shifting the access point further south from
Highway I and planting landscaping along the frontage to improve the entranceway
aesthetics of the Highway 1 corridor is fair compensation for the right-of-way in this unique
circumstance.

Dear Members of the Council:
The above referenced rezoning request under the Sensitive Areas Ordinance is scheduled for
second consideration by the City Council at your August 20th formal meeting. The purpose of this
letter is to respectfully request that this matter be given expedited consideration, by voting on both
the second and third considerations at your next informal and formal meetings, scheduled for August
19th and August 20th, 2002.
As you know, City Planning staff fully supports the project; the P & Z Commission
supported it unanimously after three considerations; public hearing before the Council was held on
July 2nd; and on July 16, 2002 the Council unanimously voted to approve the first consideration.
In view of:
* the staff support for and the unanimous votes in favor of the rezoning thus far;
* the length of time this matter has been under review (the rezoning application was
made in April), first by the P & Z Commission, and now by the Council; and
* the altered summer schedule of Council meetings with only one formal meeting
scheduled during August;
we feel that expedited consideration is warranted. While there have been some neighborhood
objections to the project, those objections have related primarily to broad issues such as density and
traffic, rather than the limited issues under the Sensitive Areas Ordinance which are properly before
you for consideration.
We would greatly appreciate your expediting the second and third considerations, so that
we may receive final approval at your August 20, 2002 meeting. We can then proceed with the
additional engineering needed in order to apply for a building permit.
