AUTHORitY
To the officers and members of the Police Department of the City of iowa City, Iowa.
In accordance with the authority vested in the undersigned by the ordinances of the City
of iowa City. the following rules and regulations are hereby promulgated for the information and
guidance of all officers and members of the Iowa City Police Department.
All rules and regulations and previous orders in conflict are hereby abrogated and
repealed.

INTRODUCTION
This manual is adopted pursuant to the Statutes of the State of Iowa and the Ordinance of
the City of Iowa City for the government, discipline, administration and operation of the Police
Department and its members.
The success of a Police Department in the performance of its duties is measured largely by
the degree of support and cooperation it receives from the people of the community it serves.
Acknowledging this, the law enforcement officer must conduct his official life in a manner
that will inspire confidence and trust. Thus, he will be neither overbearing nor subservient,
es no individual citizen has an obligation to stand in awe of him nor a right to command him.
The officer, that reflects ability, honesty, and morality in his private life cannot but reflect the
same qualities as a police officer.
These rules and regulations muse. not be construed as final and exhaustive. Periodic written
directives will provide supplementary guides to meet changing conditions. In this respect, the
administration of the Department encourages the suggestions and involvement of members.
Above all, the manual must be considered as a means to an end, not as an end in itself. It
is essential that all. members of the Department proceed in the same direction toward goals
and objectives dedicated to the safety and protection of the community. Be mindful that
protection of life and property, and the absence of crime and disorder are common goals we
must all strive to attain. Our mutual interest in attaining these goals will reflect a better
service to the people we serve.

CHAPTER 100
DEFINITIONS AND TERMINOLOGY
For the purpose of understanding this manual and the official language of the Iowa City Police
Department, the following title words shall be used:
SECTION
100.01 DEPARTMENT: Police Department, Iowa City, Iowa.
100.02 DIVISION: The major, formal, functional parts of a department.
100.03 SECTION: A primary functional element of a division.
~100.04 UNIT: Specialization, of one or any number of members to accomplish a police
purpose, usually a functional element of a section.
100.05 BEAT or AREA: A geographical area of variable size within the city to which one
or more officers are specifically assigned for patrol purposes.
100.06 WATCH (SHIFT): The period of a day (24 hours) during which a complement of
members ars on duty.
100.07 DETAIL: Temporary assignment or project in relation to a specific matter.
100.08 MEMBERS: All persons on the Police Department payroll including sworn officers
and civilian employees.
100.09 OFFICERS: Members of the Police Department who have taken the oath of office,
are empowered to make arrests, and are charged with law enfomement
responsibilities.
100.10 CHIEF OF POLICE: The administrator in full command and control of the Police
Department, with full responsibility for the discharge of the duties of his office.
100.11 DIVISION COMMANDER: The Division Commander shall be immediately
responsible to the Chief of Police and will provide administrative and executive
assistance to the Chief. Subject to the authority and direction of the Chief of
Police, the Division Commander will issue such orders as may be necessary to
promote the effective operations of the Department.
100.12 ACTING CHIEF OF POLICE: In the absence of the Chief of Police, a Command
Officer designated by the Chief of Police will assume this position.
100.13 LIEUTENANT: Designated by the Chief of Police, pursuant to personnel order.
Responsible for the supervision of or commanding the activities of a uniformed
patrol watch or in commanding the activities of a specialized police section.
SECTION
100.14 SERGEANT: Shall have personal direction over all Police Officers assigned to his
command, subiect at all times to the orders of his commander or superior officer.
100.15 OFFICER IN CHARGE {O.I.C.): Police Officer or Supervisor designated by the
Chief of Police to supervise a Unit or departmental function.
100.16 SENIOR OFFICER: A member of the Iowa City Police Department in an.y given
rank with the longest service in that rank.
100.17 SUPERIOR: A Police Officer of higher rank.
100.18 CHAIN OF COMMAND: Levels through which an order must pass. Lines of
authority and responsibility run upward and downward to insure consistent
methods of operation.
100.19 ' CIVILIAN EMPLOYEES: Members who have not taken the Oath of office and are
not authorized to make an arrest.
100.20 ORDER: An instruction given by a supervisory or command officer to a
subordinate employee.
100.21 RULE: A prescribed guide governing conduct or action.
100.22 DIRECTIVE: An authoritative instrument issued by the Chief of Police or
commanding officer that serves to direct, guide, and move toward an action,
attainment, or goal.
100.23 PROCEDURE: Manner or method of proceeding in a process or course of action.
Usually in the form of a General Order.
100.24 GENERAL ORDER: Is issued to announce adoption or revision of policies and to
direct procedures fqr the indefinite future.
100.25 SPECIAL ORDER: Written order, issued by the Chief of Police or a Division'
Commander, relating to some specific cimumstances or situation, usually of a
temporary nature, that ordinarily does not affect the entire department.
100.26 PERSONNEL ORDERS: Announce the following in the order listed:
a. The appointment of new personnel.
b. The assignment or transfer of members from one unit or section to another.
c. The promotion or demotion of personnel.
d. Suspension, dismissal, and restoration to duty.
e. Termination by resignation or retirement.
f. Assignment to training sessions.

SECTION
100.27 MEMORANDUM: A written communication issued by the Chief of Police or his
designate for the purpose of keeping members informed and aware of situations
and matters that affect the Department in general.
100.28 LAWFUL ORDER: Any written or oral directive issued by a supedor officer to any
subordinate or group of subordinates in the course of police duty which is not in
violation of any law, ordinance, or any departmental rule or regulation.
100.29 POLICY: A code by which all people'in the organizatioh may be guided in making
decisions and in taking action in a situation.
100.30 INCOMPETENCE: Incapable of satisfactory performance of police duties, lacking
the qualities necessary to take effective independent action.
100.31 INSUBORDINATION: Failure or deliberate refusal of any member or employee to
obey a lawful order given by a superior officer shall be insubordination. While on
duty ridiculing a superior officer's orders, whether in or out of his presence, and/or
disrespectful, insolent, or abusive language toward a supervising officer is
insubordination. Constructive criticism of a supervisor's direction discussed
privately with the supervisor shall not be construed to be insubordination.
100.32 TOUR OF, DUTY: That pedod of the day (24 hours) during which an officer is
assigned to active duty.
100.33 ON DUTY: An officer is on duty during that period when he is actively engaged
in the performance of his assigned duties.
100.34 OFF DUTY: An officer is off duty during the period when he is free. from the
performance of specified duties. This also may be known as day off or annual
leave.
100.35 DAYS OFF: Those days, determined by the Chief of Police and/or by Labor
Agreements, on which a given member is excused from duty.
100.36 ANNUAL LEAVE: Vacation period granted to all members annually.
100.37 SICK LEAVE: The period of time during which a member is excused from active
duty by reason o{ illness or injury incurred while off duty.
100.38 MILITARY LEAVE (ACTIVE DUTY): The period of time during which an officer is
excused from duty by reason of serving in the Armed Fomes of the United States
in an active capacity as provided by law.
100.39 PROBATIONAL PERIOD: Each member shall be required to serve a probationan/
period of twelve months prior to permanent appointment to the Department.
100.40 LEAVE OF ABSENCE: That period of time during which an officer is excused
from active duty and during which time he receives no pay.

100.41 LEAVE: Any pedod of time during which an officer is excused from active duty,
but is still drawing pay.
100.42 SUSPENSION: Suspension is the act of being temporarily relieved of active duty,
generally without pay.
100.43 DEPARTMENT VEHICLES: Ail marked or unmarked vehicles assigned to the
Police Department.
100.44 WORDS - 'SHALL/WILL': Mean that action is mandatory.
100.45 WORD - 'MAY": 'May" is permissive.
100.46 WORD -. 'SHOULD': 'Should' is advisory.
100.47 GENDER: Use of the masculine gender herein shall also include, where
applicable, the female gender.
100.48 TENSE OF WORDS: The words used in the present tense include the future.
100.49 PLURALITY OF W.ORDS: The singular includes the plural and the plural includes
the singular.
100.50 PRELIMINARY INVESTIGATIONS: The initial investigation conducted by the
Department upon the report of discovery of an incident, crime, Or attempted cdme.
100.51 FOLLOW-UP INVESTIGATION: A supplementary investigation following the
preliminary, designed to record additional facts directed to. wards the clearance of
the particular incident or cdme, and the recovery of property.
100.52 INTERNAL INVESTIGATION: A departmental investigation into complaints against
members of any allegation or suspected violation of departmental orders, rules and
regulations, statutes, or ordinances. Such investigation to be made thoroughly to
clear the innocent, establish guilt and to determine, if necessary, suitable
disciplinary action.
100.53 EVALUATION: Objective review used to improve and to encourage individual
performance and attitude to gain response to organizational objectives.

CHAPTER 200
FUNCTIONAL RESPONSIBILITIES AND AUTHORITY
210 CHIEF OF POLICE
210.02 AUTHORITY: The Chief of Police is the chief executive officer of the
Department and the final departmental authority on all matters of policy, opera-
tions, and discipline. He is responsible for the planning, directing, coordinating,
controlling and staffing of all activities of the Department; for its continued and
efficient operation; for the enforcement of rules and regulations within the
Department; for the Department's relations with the citizens of the City of Iowa
City, the City Government, and other agencies; and for the successful
accomplishment of the mission of the Department.
220 COMMANDING OFFICERS
220.02 COMMAND: The leadership, direction, and control of personnel, assuring the
proper pedormance of duties and adherence to established rules, regulations,
policies and procedures.
220.04 AUTHORITY AND RESPONSIBILITIES: Subject to direction from higher
command, a commanding officer has direct control over all members and
employees within his command. He will lead, direct and control personnel and
resources within his division, watch or section and have the responsibility for
the proper performance of duties and the adherence to established rules,
regulations, policies and procedures. He shall work diligently to cooperate with
all segments of the organization in coordinating activities and resources to
accomplish department goals anti objectives in the most cost-efficient manner,
230 DIVISION COMMANDER -- FIELD OPERATIONS: Designated by the Chief of Police,
pursuant to personnel order. The title of Captain is assigned to this position.
230.02 AUTHORITY: The Division Commander is empowered to act with full authority
and responsibility over all personnel within his division in the name of the Chief
of Police. He will issue such orders as may be necessary to assure effective
service to the community, especially those in the general areas of police
concern; apprise effectiveness of techniques used and interpret department
policies and rules as set down by the Chief of Police.
240 DIVISION COMMANDER -- SUPPORT. SERVICES: Designated by the Chief of Police,
pursuant to personnel order. The title of Captain is assigned to this position.
240.02 AUTHORITY: The Division Commander is empowered to act with full authority
and responsibility over all personnel within his division in the name of the Chief
of Police. He will issue such orders as may be necessary to promote the
effective operation of the division. He shall have knowledge of current
developments and research in the field of police technical services and police
, administration.

250 LIEUTENANTS: Lieutenants are supervisors of a uniformed patrol watch or in command
of a specialized police section. Lieutenants are assigned by the Chief of Police pursuant
to personnel order.
250.02 RESPONSIBILITY: Lieutenants are responsible for the supervision of police
patrol and headquarters activity, and/or for performing a specialized duty of the
department.
250.04 AREAS OF RESPONSIBILITY:
A. Supervise and conduct roll cell and roll call training.
B. Assign personnel.
C. Inspect personnel and equipment.
D. Read special orders and issue special instructions.
E. Supervise police officers and community service officers in the field.
F. Maintain good order, to include proper discipline, conduct, field training
and efficiency of officers of his command.
G. Prepare reports and records as required by a commanding officer or an
existing procedure.
H. Inquire into any allegation or complaint against member(s) under his
command in accordance with the provisions of this manual, Department
general orders, City Ordinances, and State law.
I. Supervise the Criminal Investigations Unit.
J. Assign ceses for follow-up investigation or initial and/or special cases
with special instruction and advice.
K. Review progress of work on original or follow-up investigations.
L. Review and evaluate investigation reports as submitted.
M. Assist in the preparation of the Department budget, and in the adminis-
'tration of budget allocetions.
N. Conduct staff studies as directed.
O. Respond personally to any emergency or occurrence of a serious or
'unusual nature which arises dudng his watch,
P. Report to a commanding officer any homicide, civil disturbance, other
grave crime or serious incident.
Q. Evaluate and counsel subordinates.
260. SUPERVISORY OFFICERS ~ AUTHORITY AND RESPONSIBILITIES:
260.02 SUPERVISORY OFFICERS: (Sergeants and/or Officers in charge) are those
members given authority over one or more members and/or employees or a
function of the departments. In addition to the general and individual
responsibilities of all members and employees, each supervisorY officer has the
same responsibility as a Lieutenant and is specifically responsible for the
following:
A. Supervision, A supervisory officer may be assigned to field or office
duties. During his tour of duty he must closely supervise the activities
of his subordinates, making corrections where necessarY, and
commending where appropriate.
B. Leadership. Effective supervision demands leadership. Provision of
leadership shall include on-the-job training as needed for efficient
operation, and coordination of effort when more than one member or
employee is involved.
C. Direction. Supervisors must exercise direct command in a manner that
assures the good order, conduct, discipline and efficiency of subordi-
nates.
D. Enforcement of Rules~ etc. Supervisors must enforce departmental
rules and regulations and insure compliance with departmental policies
and procedures. Failure to do so will be considered dereliction of duty
requiting disciplinarY action.
E. Inspection. Supervisors are responsible for the inspection of activities,
personnel and equipment under their supervision and initiation of
suitable action in the event of a failure, error, violation, misconduct, or
neglect of duty by a subordinate.
F. Assistinf:l Subordinates. A supervisorY officer shall have a working
knowledge of the duties and responsibilities of his subordinates. He
shall observe contacts made with the public by his subordinates and be
available for assistance or instruction as may be required. Field
supervisors shall respond to all calls of major consequence and sedous
emergencies, unless actively engaged in a police incident. He shall
take active charge when necessarY.
270 POLICE OFFICER: A police officer ts responsible for the accomplishment of the police
mission.
270.02 PATROL PHILOSOPHY: The heart of any police organization is the patrol
officer on the street; the patrol officer who intermingles with the Community;
who deals in a positive manner with its citizens. It is this officer that we call on
to pedorm the'stated police functions and it is he who is the instrument used
to attain the police goals. All other units within the Department assist this field
officer, either in a support or a staff capacity. It is the patrol officer who has the
responsibility to accomplish the police mission.

270.04 RESPONSIBILITIES:
A. Patrol of designated area to prevent and discover the commission of
crime and to enfome traffic and parking regulations.
B. Answer cells and complaints, taking necessary police action.
C. Function as the pdmary public relations representative cf the Depart-
ment.
D. Take proper police action at scene of crime; administer first aid, gather
evidence, locate witnesses and make arrests.
E. Maintain patrol of his assigned zone or beat; except to perform a police
function, to take a proper lunch pedod, or for personal necessity;
confine his patrol within the limits of his zone or beat except when
making any arrest or making any urgent investigation, or when ordered
elsewhere by a supedor officer.
F. Furnish information and assistance to anyone Properly requesting or
needing it, if not inconsistent with his work.
G. Responsible for the enforcement of all laws and departmental orders.
If for any reason he is unable to take proper and/or appropriate action,
he shall submit an oral or written report as soon as possible directly to
his commanding officer.
H, Promptly report all dangerous street conditions and any damaged or
defective City property.
I. Carry required equipment, forms, etc., as prescribed by current
procedure.
J. When on duty appear in uniform of the day at all formal hearings unless
assigned in plainctothes or otherwise excused by his commanding offi-
cer.
K. Responsible for all departmental property during the time it is used by
him, and shall report any damage or defects prior to acceptance or use.
L. Promptly report any emergency, extraordinary or unusual incident,
serious crime or sedous accident, to headquarters as rapidly as the
situation permits.
M. Remain courteous at all times, and approach all phases of his work in
a professional manner.
I~1. Inform and advise his immediate supervisor of any significant or unusual
condition existing within his area of responsibility.
O. Perform other related duties as directed.

280 EMPLOYEE SUPERVISORS: Employee supervisors are employees who are assigned
to positions requiring the supervision of other employees or members, by specific
designation from the Chief of Police.
280.02 AUTHORITY: Employee supervisors have the same authority over their
subordinates that police supervisory officers have over all subordinate members
and employees.
280.04 RESPONSIBILITIES: Employee supervisors are subject to the authority or
command of supervisory officers of the Department in the same manner as any
other member or employee.
290 UNIFORM NON-SWORN EMPLOYEES:
290.02 COMMUNITY SERVICE OFFICERS: Non-sworn uniformed members of the
Police Department who are assigned vadous duties within the Police
Department.
290.04 ANIMAL CONTROL OFFICERS: Non-sworn uniformed members of the Police
Department who are assigned to the Animal Control Unit of the Police
Department.
290.06 EMERGENCY COMMUNICATIONS OPERATORS: Non-sworn uniformed
members of the Police Depa, b.ent who were assigned to the Emergency
Communication Unit of the Police Depafb.ent.
290.08 RECORDS CLERKS: Non-sworn uniformed members of the Police Department
who are assigned to the Records Section of the Police Department.
CHAPTER 300
RULES & REGULATIONS FOR ALL DEPARTMENTAL EMPLOYEES
The purpose of these regulations is to provide a basis for the orderly and disciplined performance
of duty; to develop organizational relationships; and to continuously build a mutual respect and
confidence which is essential to attain our goals and objectives.
305 OBEDIENCE TO LAWS AND REGULATIONS: All members, sworn officers and civilian
employees shall observe and obey all laws and ordinances, and all rules, regulations and
orders of the Department.
310 .P..ROFESSIONAL CONDUCT AND RESPONSIBILITIES:
310.02 STANDARD OF CONDUCT: Members shall conduct their private and
professional lives in such a manner as to avoid bringing the Department into
disrepute. Members shall not engage in conduct which constitutes conduct
unbecoming an ofr~cer or neglect of duty.
310.04 DEPORTMENT: Members, whether on duty or off duty, shall be gevemed by
the ordinary rules of good conduct and behavior, and shall not commit any act
that would bdng discredit to the Department.
310.06 LOYALTY: Loyalty to the Department and to associates is an important factor
of departmental morale and efficiency. Members and employees shall maintain
a loyalty to the Department and their associates as is consistent with the law,
Department policy, and personal ethics.
310.08 SERVICE: A member shall serve the Department with zeal, courage, discretion
and fidelity, being cognizant of his responsibilities as a police officer at all times,
and respond to service demands regardless of duty status.
310.10 INTEGRITY: The integrity of the law enforcement officer must be above
reproach. The dishonesty of a single officer may impair public confidence and
cast suspicion on the entire Department.
310.12 RESPECT FOR THE LAW: No person has the constitutional fight to violate the
law. When an officer exceeds his authority by unreasonable conduct, he
violates the sanctity of the law which he is sworn to uphold.
310;14 GENERAL RESPONSIBILITIES: Within the City of Iowa City, Police officers
shall at all times take appropriate action to:
A. Protect life and property
B. Preserve the peace
C. Prevent crime .
D. Detect and arrest violators of the law

E. Aid the public
F. Enforce all Federal, State and local laws and ordinances coming within
Departmental jurisdiction.
310.16 ATTITUDE TOWARD PROFESSION: All officers and members of the
Department shall regard the discharge of their duties as a public trust and
recognize their responsibility as a public employee.
315 DUTY RESPONSIBILITIES: Officers of the Department are always subject to duty. They
shall at all times respond to the lawful orders of superior officers and other proper
authorities as well as requests for police assistance from citizens. Proper police action
must be taken whenever required. The delegation of responsibility for the enforcement
of certain laws and ordinances to particular units or. Sections of the Department does not
relieve members of other units or sections from the responsibility of taking prompt,
effecti~/e police action pertaining to those laws and ordinances when the occasion so
requires. Members assigned to special duties are not relieved from taking proper action
outside their specialized assignment when necessary.
315.02 COOPERATION: Cooperation between the ranks and units of the Police
Departments is essential to effective law enforcement, Therefore, ail members
are strictly charged with establishing and maintaining cooperation within the
Police Department and with all other City Departments.
315.04 ASSISTANCE: All officers are required to take appropriate police action toward
aiding a fellow law enforcement officer exposed to danger or a potentially
dangerous situation or when requested.
315.06 QUESTIONS REGARDING ASSIGNMENT: Members in doubt as to the nature
or detail of their assignment shall seek such information from their supervisors
by going through the chain of command.
315.08 KNOWLEDGE OF LAWS AND REGULATIONS: Every member is required to
develop and maintain a thorough working knowledge of all laws and ordinances
in force in the City, and the rules, policies, and orders of the Department. In
the event of improper action or breach of discipline, it will be presumed that the
member was familiar with the law, rule, policy or order in question.
315.10 MAINTENANCE OF DEPARTMENT MANUALS: Officers and employees
issued Department Manuals shall maintain them in good condition and shall
make appropriate changes or inserts therein as directed, and provide them for
inspection at the discretion of a supervisory or command officer.
315.12 PERFORMANCE OF DUTY: All members shall perform their duties as required
or directed by law, departmental rule, policy order, or by order of a superior offi-
cer. All lawful duties required by competent authority shall be performed
promptly as directed, notwithstanding the general assignment of ctuties and
responsibilities.
315.14 INCOMPETENCE: Officers of all ranks and employees shall perform their
duties in a competent and acceptance manner. General incompetence in the
performance of their duties shall be grounds for demotion or dismissal.

315.16 REPORTING VIOLATIONS OF LAWS OR ORDINANCES, RULES O'R
ORDERS: Members knowing or having reason to believe of other members
violating laws, ordinances or rules shall report same in writing to the Chief of
Police via official channels. If the member believes the information is of such
gravity that it must be brought to the immediate personal attention of the Chief
of Police, official channels may be bypassed.
315.18 CONDUCT TOWARD SUPERIOR AND SUBORDINATE OFFICERS AND
ASSOCIATES: Members and employees shall treat all other members with
respect. They shall be courteous and civil at all times in their relationships with
one another and referred to one another by title.
315.20 INSUBORDINATION: Insubordination will not be tolerated. Insubordination is
disrespectful, insolent or ab[Jsive language and/or acts toward a supervising
officer, and failure or deliberate refusal to obey a lawful order given by a
superior officer or ridiculing the orders of superior officers whether or not in his
presence.
315.22 CRITICISM OF ORDERS: Members shall not p. ublicly criticize instructions or
orders they have received.
315.24 MANNER OF ISSUING ORDERS: Orders from superior to subordinate shall
be in clear and understandable language, civil in tone and issued in pursuit of
departmental business.
315.26 UNLAWFUL ORDERS: No command or supervisory officer shall knowingly
issue any order which is in violation of any law, ordinance or departmental rules
without reasonable justification.
315.28 OBEDIENCE TO UNLAWFUL ORDERS: Obedience to an unlawful order is
never a defense for an unlawful action; therefore, no member Or employee is
required to obey any order which is contrary to Federal or State law or local
ordinance. Responsibility for refusal to obey rests with the member. He shall
be strictly required to justify his actions.
315.30 OBEDIENCE TO UNJUST OR IMPROPER ORDERS: Members who are given
orders they feel to be unjust or contrary to rules and regulations must first obey
the order to the best of their ability, and then may proceed to appeal as
provided below.
315.32 CONFLICTING ORDERS: Any member receiving an order conflicting with any
previous order or instruction will advise the person issuing the conflicting order
of this fact. Responsibility for countermanding the original instruction then rests
with the individual issuing the conflicting order. If so directed, the latter
command shall be obeyed. Orders will be countermanded only when
reasonably necessary for the good of the Department.
315.34 REPORTS AND APPEALS OF UNLAWFULT UNJUST~ IMPROPER ORDERS:
A member receiving an unlawful, unjust or improper order shall, at first
opportunity, report same in wdting to the Chief of Police through official
channels. This report shall contain the facts of the incident and the action
taken. Appeals for relief from such orders may be made at the same time. Any

action regarding such appeal shall be conducted through the office of the Chief
of Police.
315.36 GRIEVANCES: Any member who feels that he has been injured, or discredited
by a superior officer through unreasonable, unjust, arbitrary or tyrannical con-
duct, or abusive language shall have the dght to submit his grievance for review
as provided by Department policy, City ordinance, State law and/or labor
contract.
315.38 OTHER TRANSACTIONS: Every member is prohibited from buying or selling
anything of value from or to any complainant, suspect, witness, defendant,
prisoner, or other person involved in any case which has come to his attention
or which arose out of his departmental employment except as may be
specifically authorized by the Chief of Police.
315.40 REWARDS: Members shall not accept directly or indirectly, any gift, gratuity,
fee or reward in money or any other consideration for services rendered in the
line of duty to the community or to any person, business or agency except
lawful salary.
315.42 GIFTS, GRATUITIES, FEES, LOANS, ETC., SOLICITING: Members and
employees shall not under any cimumstance solicit any gift, gratuity, loan or fee
where there is direct or indirect connection between the solicitation and their
departmental membership or employment.
315.44 ACCEPTANCE OF GIFTS~ GRATUITIES. FEES, LOANS, ETC.: Members and
employees shall not accept any gift, gratuity, loan, fee or other thing of value,
the acceptance of which might tend to influence directly or indirectly the actions
of said member or employee or any other member, or employee in any matter
of police business; or that might tend to cast an adverse reflection on the
department. Members and employees shall not accept any gift or gratuity from
other members or employees junior in rank without the express permission of
the Chief of Police.
315.46 DISPOSITION OF UNAUTHORIZED GIFTS, GRATUITIES, ETC.: Any
unauthorized gift, gratuity, loan, fee, reward or other items falling into any of
these categories coming into the possession of any member shall be forwarded
to the office of the Chief of Police together with a written report explaining the
circumstances connected therewith. The Chief of Police, or his representative,
shall return or dispose of any of the above with an appropriate letter.
315.48 DEBTS: Members shall pay promptly all just debts and shall not incur liabilities
which they are unable or unwilling to discharge. Failure to comply with this
regulation is grounds for disciplinary action.
320 GENERAL CONDUCT ON DUTY
320.02 DEFINITION: Members on duty shall devote full time and attention to police
business. They are expressly forbidden to sleep, idle, or conduct private busi-
ness. Visiting unnecessarily with citizens or associates, or any other activity not
pertaining to police duty must be kept to a minimum.

320.04 FAMILY MA'I-FERS: Member may handle urgent family matters but only with
permission of the member's immediate supervisor. Handling of urgent family
matters must be kept to a minimum.
320.06 LOITERING: Members on duty shall not loiter in service stations, restaurants
or other public places except for the purpose of transacting police business.
This section does not include time necessary for authorized breaks or meals.
320.08 COURTESY: Members shall be courteous and orderly in their dealings with the _
public. When meeting in public, officers shall conform to normal courtesy
standards. Supervisor/officers shall be addressed by title when conversing in
formal and/or official surroundings.
320.10 CONDUCT OF OFFICERS DURING DISPLAY OF NATIONAL COLORS:
Saluting the national colors by an organized civic or milita~ body is an almost
universal custom. Courtesy to the national colors shall be displayed by police
personnel at appropriate ceremonies, during the playing of the national anthem,
and at parades.
A. Types of Salutes.
(1) When in uniform the officer will stand at attention and salute in
the following described manner: Raise the right hand smartly
until the tip of the forefinger touches the lower part of the
headdress and slightly to the right of the right eye, thumb and
fingers extended and joined, palm downward, upper arm
horizontal, forearm inclined at forty-five degrees, hand and wrist
straight. To complete the Salute, drop the arm to its normal
pOSition by the side smartly and in one motion.
(2) When not in uniform, stand at the position of attention, uncover
head and hold hat in right hand and place over the heart. If not
wearing a hat, stand at the position of attention and hold the
right hand over heart.
B. When to Salute.
(1) Parades. In parades, when the flag is passing the officer, the
officer should take the position of attention and salute when the
flag is approximately six paces before him/her and hold his
salute until the flag is approximately six paces past. He should
then drop the salute in a smart fashion. The officer is required
to render the salute only to the first unit of the parade bearing
the national colors. Thereafter, he may attend to his assigned
parade duties. Officers assigned to parade duty shall at all
times maintain a military bearing and avoid a slouching posture,
hooking thumbs over the belt, or standing with hands in pockets.
(2) Public Ceremonies. When the national anthem is being played
in any public ceremony, the salute shall be given at the first note
of the anthem and held until the last note is completed. If this
is done at a flag raising or retreat ceremony, the officer should
face in the direction of the flag and salute.

320.12 ROLL CALL: Unless otherwise directed, members shall report daily to roll call
at the proper time and at the place specified. They shall be propedy uniformed
and/or equipped. They shall give careful attention to orders and instructions,
conducting themselves in a professional manner.
320.14 RELIEF.: All members are to remain at their assignment and on duty until
properly relieved by another member or employee or until dismissed by
competent authority.
320.16 LUNCH PERIOD: Officers and employees shall be permitted one lunch pedod
during an eight hour watch. A lunch period may be denied, or assigned, by a
supervisory officer as conditions may warrant. However, generally, all
employees shall be granted a thirty (30) minute lunch period between the third
and sixth hours on duty under normal circumstances. Officers and employees
shall not take excessively long meal or coffee .breaks. (Exception:
Classifications of civilian employees that are specifically designated I hour
lunch periods.)
320.18 REPORTING: Members shall promptly submit such reports as are required by
the performance of their duties or by competent authority.
320.20 ABSENCE FROM DUTY: Every member who fails to appear for duty at the
date, time and place specified without the consent of departmental supervisor
is 'absent without leave'. Each member who finds it necessary to take sick
leave shdll notify his supervisor or a supervisor on duty on the watch
immediately preceding his, as soon as reasonably possible, of any sickness or
illness which will cause him/her to miss work and unless such notification is
given within one .(1) hour after the beginning of the work day, the absence will
not be charged to sick leave, but may be charged to accumulated leaves or to
leave without pay. Employees who become sick on duty shall notify the watch
supervisor before leaving duty. Supervisory officers will keep a record of any
violation(s) or incident(s) and report it to their commanding officers when
appropriate.
320.22 SICKNESS AND INJURY: An officer or employee feigning sickness or injury
or otherwise deceiving a commanding officer or a supervisory officer as to
condition while on sick leave shall be subject to stdct disciplinary action.
An officer or employee shall submit a doctor's release to his commanding
officer after an absence of three days or longer due to sickness or injury, or
whenever requested to do so by his commanding officer.
320.24 PHYSICAL FITNESS: All officers of the Department shall maintain themselves
in good physical condition so they will have the ability to manage strenuous
physical contact often required of police officers.
320.26 TRAINING: All members shall attend outside and in-service training classes at
the direction of the Chief of Police or commanding officer. Such attendance is
considered a duty assignment.
320.28 USE OF INTOXICANTS ON DUTY: Members shall not consume intoxicants
or imitation intoxicants unless necessary to pertorrn a police duty and then only
with the specific permission of a commanding officer; neyer in uniform!

Members shall not report for dutY under the influence of intoxicants, or be unfit
for duty because of excessive use of intoxicants. Liquor brought into
departmental premises in furtherance of a police task shall be properly
identified and stored according to current department policy.
'320.30 USE OF DRUGS AND/OR CONTROLLED SUBSTANCES: Possession or use
on duty of controlled substances, except with the approval and guidance of a
licensed physician of Iowa and with the knowledge of a superior, is prohibited.
At no time may an employee of the Department use or be under the influence
of a controlled substance where such use or influence impairs or compromises
the efficiency and integrity of the Department.
325 UNIFORMS, EQUIPMENT AND APPEARANCE
325.02 THE UNIFORM: All officers shall maintain in good order a regulation uniform.
When worn, the uniform will be neat, clean, well pressed and will conform to
departmental specifications. Shoes and other items of leather and brass shall
be polished. In public the uniform is to be worn in the manner specified by
departmental orders.
325.04 MANNER OF DRESS ON DUTY: Normally, officers will wear the required
uniform on duty; however, commanding officers may prescribe other clothing
as is appropriate to a particular assignment. Civilian employees will wear and
maintain an employee uniform when so directed by the Chief of Police.
325.06 OFFICER'S BEARING: Officers shall maintain a military bearing and avoid a
slouchy, slovenly appearance.
325.08 HAIR STYLES: At all times, while on duty, unless expressly authorized by
competent authority, all members and employees of the Department shall be
well groomed and clean in their person.
A. Male members and employees shall conform to the following additional
standards of appearance:
(1) Hair shall be evenly trimmed at all times while on duty. The
maximum extension of the hair outward from the top of the head
will be two inches. The maximum extension from the sides of
the head shall be two inches, provided that hair shall be gradu-
ally tapered such that it does not protrude outward beyond the
top (upper helix) of the ear and such that it otherwise gives an
overall even appearance. The hair shall at no point extend
downward more than ½ inch beyond the hairline at the back of
the neck and in no event extend over the shirt collar in normal
posture,
(2) Sideburns shall not extend below the bottom of the ear. The
maximum width at the bottom of the sideburns shall not exceed
11/~ inches.
(3) Clean shavenness is required except that mustaches are
permitted. Mustaches shall be neatly trimmed and shall not

extend more than ~/4 inch beyond the comers of the mouth nor
more than ~A inch below the comer of the mouth.
(4) Beards shall not be permitted to be worn by Field Operations
Division personnel unless authorized by the Chief of Police.
(5) Personnel with a medical condition which precludes shaving
shall be required to present a wdtten statement, signed by a
medical doctor, verifying such condition.
(6) Jewelry - the wearing of earnings, necklaces and other
ornamental jewelry shall be prohibited while in uniform.
(Exception: this does not apply to Wedding rings, class dngs, o.r
rings worn in conservative style and which will not interfere with
the operation of emergency equipment.)
B. Female officers and uniformed civilian females shall conform to the
following additional standards of appearance:
(1) Hair - the hair shall be worn in a neat and attractive style which
does not include extreme hairdos such as exaggerated or high
styles. In no event should the length of the hair or style of the
hairdo preclude the proper wearing of the uniform cap, helmet,
or gas mask.
(2) Makeup - the use of facial makeup shall be conservative.
Excessive use of lipstick, rouge, mascara, etc., shall not be
acceptable. Fingernails shall be inconspicuous, i.e., neither too
long nor too darkly or flashily colored. The use of strongly
scented cologne and perfume while in uniform is discouraged.
(3) Jewelry - the weadng of earrings, necklaces, and other orna-
mental jewelry shall be prohibited while in uniform. (Exception:
This does not apply to wedding rings, engagement rings, rings
worn in conservative style and number, and post type of
earrings.)
All personnel must bear in mind that they have a responsibility to present an
appearance that offends no one, and allows them to retain the respect of those
they serve.
325.10 INSPECTIONS: From time to time, the Chief of Police may call for full dress
inspections of the Department or any part thereof. Members directed to attend
such inspections shall report in the uniform prescribed, carrying the equipment
specified. Unauthorized absence from such inspection will be considered
"absence without leave".
A. Roil call inspections shall be held by supervisors on each day to insure
proper appearance of all officers reporting for duty.
B. A full inspection of uniform and all personal equipment will be held at
least once a month by supervisors with regard to their watch.

325.12 CIVILIAN CLOTHING AND MANNER OF DRESS: Civilian employees will wear
and maintain an employee uniform when and as directed by the Chief of Police.
Female members of the Department permitted to wear civilian clothing shall
conform to standards accepted and normally worn by office personnel for the
City of Iowa City.
325.14 COMPENSATION FOR DAMAGES SUSTAINED ON DUTY: Members shall not
seek in any way, nor shall they accept from any person, money or other
compensation for damages sustained or expenses incurred by them in the line
of duty without first notifying the Chief of Police of such intent or offer in writing.
325.16 COMPENSATION FOR DAMAGES OFF DUTY: Members who have received
regular sick leave or injured off duty salary, from the City for illness or injury
sustained off duty, shall notify the Chief of Police in writing of any intent to
seek, sue, solicit or accept compensation as damages for such illness or injury.
This notice shall be filed before any legal action is taken. It shall include the
fact of the claim and the name of the respondent.
325.18 SURRENDER OF DEPARTMENT PROPERTY: Members are required to
surrender all Department property in their possession upon separation from the
Department. Failure to do so may cause the person to reimburse the City for
the fair market value of any missing articles.
325.20 DEPARTMENT VEHICLES - USE: Members shall not use any departmental
vehicle without the permission of a commanding officer or supervisory officer.
Department vehicles shall never be used for personal business, except as
specifically authorized by the Chief of Police.
325.22 DEPARTMENT PROPERTY AND EQUIPMENT: Members are responsible for
the proper care of all Department property and equipment assigned to them.
Equipment is to be kept clean, in good working order, and must conform to
departmental specifications.
325.24 DAMAGED/INOPERABLE PROPERTY OR EQUIPMENT: Regardless of
circumstance, accident or carelessness, members shall report immediately to
their supervisory officer any LOSS OR DAMAGE to Departmental property
assigned to or used by them. They also shall report any. defects and
hazardous condition existing in any Department equipment or property. Loss
or damage to Department property due to negligence or inattention to duty shall
be subject to disciplinary action.
325.26 REGISTERING EQUIPMENT WITH THE DEPARTMENT: Officers must
register all handguns which the officers will carry on-duty or off-duty. Only
department issued handguns will be carded on-duty unless authorized by the
Chief of Police.
325.28 CARE OF DEPARTMENT BUILDINGS: All members are charged with
maintaining clean surroundings and shall promptly report conditions requiring
the attention of building maintenance. All discarded waste material will be
placed in trash receptacles. Members and employees shall not mark or deface
the walls in any Departmental building. No material shall be affixed in any way
to any wall in Departmental buildings without specific authorization from a
commanding officer.

325.30 NOTICES: Members and employees shall not mark, alter, or deface any
posted notice of the Department. Notices or announcements shall not be
posted on bulletin boards without permission of a commanding officer. N._~o
notices of a dero,qatory nature will be posted at any time.
325.32 BULLETIN INFORMATION: Members shall acquaint themselves daily when on
duty and immediataly upon returning to work after days off or other absence,
with information in the Daily Bulletin, and other Departmental Orders and
publications.
325.34 TRANSPORTING CITIZENS WHILE ON DUTY: Citizens will be transported in
departmental vehicles only when necessary to accomplish a Police purpose.
Such transportation will be done in conformance with departmental policy and
with the approval of a supervisory officer.
325.36 REPORTING ACCIDENTS: Accidents involving Department personnel,
property, and/or equipment must be reported in accordance with current City
and Departmental procedures.
325.38 PRESUMPTION OF RESPONSIBILITY: In the event that Department propel'bi
is found beadng damage which has not been reported, an investigation shall
be instituted immediately to determine responsibility for said damage. The last
persons using the property before the damage is reported shall be presumed
responsible for the damage.
325.40 IDENTIFICATION: Officers assigned to plainclothes must carry official police
identification and, before taking any police action, properly identify themselves
as police officers, unless such identification is obvious, impractical, or not
feasible.
330 FIREARMS (General m Departm.,ent Issued)
330.02 RULES FOR USE OF THE FIREARM:
A. The wearing of Weapons within the City of Iowa City while off duty is
recommended, but not mandatory. It is not recommended that officers
carry weapons when off duty and out of their jurisdiction.
B. Officers are not authorized to carry a weapon when consuming or
making use of intoxicants.
C. No officer of this Department shall display or discharge a firearm, on or
off duty, except for the following reasons:
(1) As protection of his life or the life of another person.
(2) To effect the capture or to prevent the escape of an individual,
or individuals, known to have committed a forcible felony, and
where resistance to arrest jeopardizes the life of the officer
making the arrest.
(3) When for humane reasons an animal must be destroyecl,
however, extreme precautions must be taken that it is accom-

plished safely'. Permission must be obtained from a command
officer.
(4) To practice on an approved firearms range under supervision of
a range officer with the approval of a Command Officer.
330.04 REQUIRED REPORT: When a weapon is discharged, the officer causing the
same shall report the circumstances immediately to his supervisor and will file
a written report of the incident.
330.06 HANDLING OF FIREA~RMS: Officers shall not handle firearms in a careless,
negligent, or reckless manner.
330.08 SECURITY: Firearms shall be kept out of the reach of the public. When
weapons are removed, they must be placed in a secured area.
330.10 SHOTGUN MAINTENANCE: Members of the Department who have shotguns
and/or other weapons issued by the Department in their custody are responsi-
ble for the care of the weapons. Cleaning and repair is the responsibility of
personnel specifically assigned to that duty.
330.12 USE OF SHOTGUN: Rules and regulations applying to the use of the sidearm
shall also apply to the use of the shotgun.
330.14 LOADING OF THE SHOTGUN: The vehicle shotguns are to be kept loaded,
but WILL NOT have a round in the chamber. The officer requiring the use of
the weapon must remember the shell is to be loaded into the chamber.
330.16 SECURITY: The Shotgun, when issued, shall be kept in the locking device of'
the police vehicle if provided, or otherwise secured in the locked trunk. Except
for exchange, the shotgun will be removed only for possible need. Good
judgment must be used in every case.
335 COMMUNICATIONS, CORRESPONDENCE
335.02 RESTRICTIONS: Members shall not use departmental letterheads for private
correspondence or send correspondence out of the department over their
signatures without the general permission of the Chief of Police.
335.04 FORWARDING COMMUNICATIONS TO HIGHER COMMANDS: Any member
receiving a written communication for transmission to a higher command MUST
FORWARD such communication, by way of chain of command, regardless of
content. If said correspondence is sealed and directed to a higher command
the member receiving such correspondence shall endorse it acknowledging that
he has seen it and may, if an open letter, indicate approval or disapproval.
335.06 DEPARTMENT ADDRESS (pdvate use of~: Members shall not use the
Department as a mailing address for private purposes.
335.08 TELEPHONES: Departmental telephone equipment may not be used
indiscriminately for the transmission of private messages. Long distance calls
may only be made in accordance ~ith departmental procedures, and never for
~ersonal business.

335.10 ADDRESS AND TELEPHONE NUMBERS: Members and employees shall
record their correct residence address and telephone number with the
Depalt,,ent. Members and employees are required to have telephone numbers
at their residence. Changes in address or telephone number shall be reported
to the commanding officer within 24 hours of the change. This shall be done
in wdting within the specified time whether the member or employee is working
or on leave.
335.12 ANSWERING TELEPHONES: Telephones shall be answered promptly.
Response shall be made by giving name of unit, rank and last name. If the
person calling is a member of the Department, he shall identify himself. All
calls must be answered in a courteous business-like manner. Incoming calls
from the public must be given prompt, efficient attention, and if police action is
required, such action shall be taken. In cases where citizens have been
connected with the wrong unit of the Department, the call shall be transferred
courteously to the proper destination. In no case shall the citizen's call be
ignored. In cases of urgency, a member shall take the information, even
though it is for anther command and promptly relay such information to its
proper destination.
335.14 RADIO DISCIPLINE: All members of the Department operating the police radio
or MDT, either from a mobile unit or in the communications section, shall strictly
observe regulations for such operations as set forth in departmental orders and
by the Federal Communications Commission.
335.16 REPORTING AVAILABILITY T0 COMMUNICATIONS SECTION: Field officers
subject to assignment by the Communications Section shall immediately report
their availability to the Communications Section by radio or if justifiably
detained, their location by telephone, at the beginning of each tour of duty and
upon completion of each radio assignment. Radio equipped members assigned
to Patrol, Community Relations, the Investigative Section, and any other sworn
units are deemed field officers for purposes of this regulation.
335.18 RESPONDING TO CA£LS: Members of the Department shall respond without
delay to all calls for police assistance from citizens or other members.
Emergency calls take precedence, however, all cells shall be answered as soon
as possible consistent with normaJ safety precautions and vehicle laws. Failure
to answer a call for police assistance promptly, without justification, is
misconduct. Except under the most extraordinary circumstances, or when
otherwise directed by competent authority, no member shall fail to answer any
telephone or radio call directed to him. Communications will be informed when
leaving the squad car or patrol unit.
335.20 DEPARTMENT BUSINESS CARDS: A personalized card may be used by
members. These cards, imprinted with the individual's name and rank, are
purchased at department expense. Nothing will be entered on any depart-
mental business card which confers special consideration to the recipient.
Such a card will be forwarded to the office of the Chief of Police should a
member come into its possession, together with a report of how he obtained it.

340 DEATH AND INJURY NOTIFICATION
340.02 DEATH OR SERIOUS INJURY: At the death or sedous injury of any member
on or off duty, it shall be the responsibility of the on-duty watch commander to
assure that immediate veri3al notification is made to the Chief of Police, or to
that member acting on his behalf, and to make or arrange for personal
notification to the immediate family of the person involved. This will be followed
by a written report containing all available pertinent information.
340.04 NON-SERIOUS INJURY: In cases where the injuries are other than of a
serious nature, the required forms will be submitted immediately following the
incident, including all available information.
345 INVESTIGATIONS AND ARRESTS
345.02 COMMAND OF SCENE: At the scene of any crime, accident or other police
incident where procedure is not clearly indicated by departmental policy, the
supervisory or ranking officer present shall assume command and direction of
police personnel in a manner as to assume the most orderly and efficient
accomplishment of the police task.
345.04 GENERAL RESPONSIBILITY AND DUTIES OF OFFICERS AT CRI.ME
SCENE: The first officers to arrive on the scene of a crime or other police
incident are responsible for the following actions as they may apply: the
summoning of medical assistance and the administration of first aid as required
to prevent the loss of life or further injury, the arrest of violators and the security
of the scene.
345.06 RESPONSIBILITY OF OFFICERS ASSIGNED TO CONDUCT INVESTIGA-
TIONS:
A. If a violent crime has occurred and the general responsibilities and
duties have been attended to, the watch commander will notify the
proper investigators, i.e., Investigative Section and Crime Scene
Technicians for proper process of the investigation.
B. The assigned beat officer on the scene is still responsible for the
completion of the preliminary investigation or other investigation as
directed by the supervisor in charge. All officers present at the scene
of a serious or violent crime shall submit a written report of their
observations and activities.
C. All officers shall be familiar with investigative techniques in the event
they are called upon to assist in securing of statements and other
information, collecting and preserving physical evidence and preparation
of required supplementary reports which will aid in the successful
completion of the investigation.
345.08 ARRESTS: In making arrests, officers shall strictly observe the Laws of Arrest
and the following procedures: Only necessary restraint to assure safe custody
and the safety of the officer shall be used. The arresting officer is responsible
for the safety and protection of the arrested person while in his custody. He

shall notify the watch commander of any injury, apparent illness, or other
condition which indicates the arrested person may need special care.
345.10 CUSTODY OF PRISONERS: Officers or members charged with the custody
of prisoners shall observe all laws and departmental orders regarding this
activity. Prisoners shall be kept securely, treated fairly and humanely, and shall
not be subjected to unnecessary restraint or verbal abuse. Allowing a suspect
or prisoner to escape custody due to negligence or inattention to duty shall be
subject to disciplinary action.
345.12 PRISONERS' PROPERTY: The arresting officer is responsible for the security
of the personal property in the possession of the person arrested or under his
control at the time of the arrest, He shall see that such property is safely kept
until relieved of that 'responsibility or document its disposal.
345.14 PHYSICAL FORCE: Malicious assaults committed by members constitute
gross misconduct. The use of physical force shall be restricted to circumstanc-
es specified by law when necessary in performance of a police duty. Whenever
a member, on or off duty, is required to stdke or use considerable force against
another person, he shall call a supervisory officer to the scene or contact a
supervisory officer as soon as possible following the incident, and take
whatever action such supervisory officer requires.
345.16 REPORTS AND BOOKINGS: No member shall knowingly falsify any official
report or enter, or cause to be entered, any inaccurate, false or improper
information on the books or records of the Department.
345.18 SECURITY OF DEPARTMENT BUSINESS: Members shall not divulge police
information outside the Department except as is required by law or competent
authority, or as provided by Departmental procedure. Specifically, information
contained in police records, other information ordinarily accessible only to police
personnel, and names of informants, complainants, witnesses and other
persons known to the police are considered confidential. Violation of the
security of this type of information reflects flagrant miSConduct.
345.20 SELF-ASSIGNED POLICE ACTION: (For the purposes of this article, self-
assigned action means action undertaken at the discretion of a member of the
Department under less than emergency circumstances, or action initiated by
any member of the Department without the request, direction or by the
instruction of a superior.) All non-emergency self-assigned police action shall
be reported to a supervisor at the earliest opportunity, but in no event more
than 24 hours after the commencement of such assignment. All emergency
self-assigned police action shall be reported to a supervisor immediately.
345.22 COOPERATION WITH THE PRESS: Members shall cooperate with represen-
tatives of the press consistent with departmental regulations and orders,
provided the successful investigation or prosecution of a police case is not
jeopardized. Information may only be released to the press by the Chief of
Police or that member acting on his behalf or any member specifically
authorized to release information to the press. Questions regarding Department
policy will be answered only by the Chief of police.

345.24 COMPROMISING CRIMINAL CASES: Members shall not interfere with the
proper administration of criminal justice. They shall not attempt to interrupt
legal process except where an unquestionable injustice might otherwise occur,
nor participate in or be concerned with, any activity which might interfere with
the process of law.
Requests to members of this Department, from ANY source, concerning the
extralegal adjustment of ANY criminal proceeding shall be reported to the Chief
of Police. This does not include plea bargaining by the City Attorney's office or
the County Attorney's office.
Any member having knowledge of such action and failing to inform the Chief
of Police thereof shall be subject to disciplinary action.
345.26 ASSISTING CRIMINALS: Members shall not communicate in any manner
directly or indirectly any information which might aid any person to escape
arrest or punishment or which might enable them to conceal evidence,
contraband, stolen properb/or any illegal activity.
345.28 RECOMMENDING ATTORNEYS PROHIBITED: Members shall not suggest,
recommend, or advise the retention of any attorney to any person coming to
their attention as a result of police business.
350 PUBLIC ACTIVITIES
350.02 PUBLICITY: Members shall not seek personal publicity in the course of their
employment. They shall not permit their names or photographs to be used to
endorse any product or service, or to be used in any commercial testimonial
which alludes to police employment without the permission of the Chief of
Police.
350.04 PUBLIC APPEARANCE REQUESTS: All requests for public appearances will
be routed to the Chief of Police or the Division Captain for approval and
· processing. Members directly approached for this purpose shall suggest that
the party submit the request to the Chief of Police in writing.
350.06 OUTSIDE EMPLOYMENT: Prior to engaging in outside business or employ-
ment, the member shall notify the City in advance of the name, address, and
telephone number of any employer, and if the supplemental empioyrnent is
related to or along the lines of police work, to notify the City of the work
schedule, compensation, and specific duties in addition to the above
information.
Other employment cannot conflict with the duty hours of the officer or with the
satisfactory or impartial performance of duties as a police officer for the City of
Iowa City.
350.08 MEMBERSHIP IN ORGANIZATIONS: Members shall not affiliate themselves
with any organization or group, the constitution or bylaws of which in any way
exacts prior consideration, or which would prevent its members from rendering
proper and efficient service to the Department.

350,10 SUSVERSIVE ORGANIZATIONS: No member shall knowingly become a
member or be connected with any subversive organization, except when
necessary in the performance of duty, and then only under the direction of the
Chief of Police.
350.12 POLITICAL ACTIVITY: The formal political activities of members must be
limited to voting. This is not intended to restrict the expression of individual
political view in an informal manner. Members may not solicit money or other
things directly or indirectly on any pretext for any person, committee or
association for political purposes, nor use the influence of their office in any
way. Employees who choose to stand for political election are covered by City
Personnel Procedures.
350.14 OUTSIDE INFLUENCE: No member may seek the influence or intervention of
any person or organization outside the Department for purposes of personal
preferment, advantage, transfer or advancement.
350.16 IMPARTIAL CONDUCT: All officers, while charged with strict enforcement of
the law, must remain completely impartial toward all persons coming to the
attention of the Department. All citizens are guaranteed equal protection under
the law. Exhibiting partiality for or against a person because of race, sex,
creed, or influential position is prohibited. Similarly, unwarranted interference
in the private business of others when not in the interests of justice is pro-
hibited.
350.18 AVAILABILITY ON DUTY: Members shall be immediately and readily available
to the public during duty hours. Concealment may be employed for police pur-
poses only with supervisory approval and not to avoid responsibility,
355 JUDICIAL AND INVESTIGATIVE ACTIONS, APPEARANCES AND TESTIMONY
355.02 COURT ATTENDANCE: All members concerned in cases before the courts are
to be punctual in attendance and shall appear either in full uniform or civilian
clothes consisting of a business suit or sport coat and slacks. The wearing of
part uniform and part civilian clothes shall not be permitted. Clothing must be
neat and clean.
Members shall have the cases in which they are concerned properly prepared,
and all property which is to be used in evidence suitably arranged for presen-
tation in court.
Members shall observe the utmost attention and respect toward the court at all
times.
When giving testimony, members shall speak calmly and explicitly in a clear,
distinct and audible tone so as to be easily heard by court and jury. They shall
not engage in conduct which distracts from the officer's testimony.
Members shall testify with the strictest accuracy, confining themselves to the
case before the court, and shall neither suppress nor overstate the slightest
circumstances with a view of favoring or discrediting any person.

When cross-examined, they shall answer with the same readiness and civility
as when testifying in support of the charge, remembering that the ends of
justice will be observed by showing a desire to tell the whole truth, whether it
be in favor of or against the defendant.
Any member who, because of illness or injury, cannot attend court, shall
immediately inform his commanding officer of the circumstances. His com-
manding officer will notify the Court of the officer's absence. If the officer's
commanding officer cannot be contacted, the watch commander shall be
advised. The watch commander will then notify the Court of the absence.
355.04 CIVIL ACTION, COURT APPEARANCES -- SUMMONS: Members shall not
volunteer to testify in civil actions and shall not testify unless legally summoned.
Members will accept all summons legally served. If the summons arises out of
departmental employment, or if the member is informed that he is a party to a
civil action arising out of departmental employment, he shall immediately notify
the Chief of Police of the service of notification, and of the testimony he is
prepared to give. He shall confer with his commanding officer before giving a
deposition or affidavit on a civil case if the case is of importance to the City or
an employee of the Department. The commanding officer will indicate any
further action which may be necessary.
355.06 CIVIL CASES: Members shall not assist in civil cases without subpoena or
without obtaining the specific consent of the Chief of Police. They shall avoid
entering into civil disputes, particularly while performing their police duties, but
shall prevent or abate a breach of the peace or crime in such cases.

DEPARTMENTAL DISCIPLINE
Final departmental disciplinary authority and responsibility rests with the Chief of Police. Except
for oral reprimands, and some written reprimands and emergency suspensions, all departmental
discipline must be taken or approved by the Chief of Police.

410 THOSE SUBJECT TO DISCIPLINARY ACTION: Any member (sworn or civilian) who
violates his oath of office or who violates the public trust and confidence through
misconduct or conduct unbecoming an officer or member of this Department, or who is
incompetent to perform his duties, and any member who violates any statute, ordinance
or the Rules and Regulations of the Department is subject to appropriate disciplinary
action.
415 COMPLAINTS REQUIRING INVESTIGATION:
A. Those reported to supervising or commanding officers by citizens or members
of the Department, either orally or in writing, by telephone or correspondence.
B. Those referred by the office of the City Manager.
C. Those observed by supervisory or commanding officers.
D. As directed by the Chief of Police.
420 TYPES OF DISCIPLINE DEFINED:
420.02 ORAL REPRIMAND: Verbal reprimand given to a subordinate by a supervisory
or command officer with wdtten documentation flied.
A. Inter-Unit Oral Reprimand: When a command or supervisory officer of
one unit orally reprimands a member or employee of another unit, he
shall notify the supervisor of the member so disciplined as soon as
possible. He shall also submit a WRITTEN REPORT of this action, and

reason therefor, to his commanding officer and also to the commanding
officer of the member or employee.
420.04 WRI'i-i'EN REPRIMAND: A written report of a violation whenever disciplinary
action is taken or recommended with copies submitted immediately to the Chief
of Police through the chain of command and filed in the member's personnel
file.
420.06 EMERGENCY SUSPENSION: Commanding officers and supervisory officers
have the authority to impose emergency suspension (relief from duty) until the
next business day against any officer or employee when it appears that such
action is in the best interests of the Department. Both the relieved parbj and
the officer imposing the removal (emergency suspension) shall report to the
Chief of Police the next business day at 0900 unless otherwise directed by
competent authority,
420,08 SUSPENSION: The act of temporarily denying an officer the privilege of
performing his police duties in consequence of dereliction or other violation of
Department regulation, The suspended officer ordinarily does not receive pay
during the period of suspension,
420.10 DEMOTION: Reduction in rank.
420.12 DISMISSAL: The act of permanent separation from the Department with just
cause.
420.14 AUTHORITY: Authority to discipline members of the Department is found in
state law, City ordinances, and labor contracts.
425 NOTIFYING MEMBER BEING, DISCIPLINED: When the investigation of any misconduct
which requires disciplinary action other than oral reprimand has been completed, a copy
of the facts including the recommended or imposed disciplinary action will be given to the
offending officer. This report must include the rule or regulation the member is alleged
to have violated, and the facts uncovered to substantiate this charge.
430 APPEALS FROM PENALTIES: Appeals from penalties imposed by the Chief of Police
as disciplinary measures against members may be made as defined by state 'law, City
ordinances, and labor contracts.
435 CITIZENS' COMPLAINTS OF POLICE PERSONNEL (NORMAL BUSINESS HOURS):
Complaints by citizens against members received during normal business hours shall be
investigated by the duty supervisor and, if necessary, forwarded to the member's section
commander. Section Lieutenants shall initiate such action as necessary and report the
receipt of the complaint and his findings to the Chief of Police. The gravity and validity
of the complaint shall determine the comprehensiveness of the report.
440 CITIZENS' COMPLAINTS OF POLICE PERSONNEL (OTHER TIMES): Complaints by
citizens against members of the Department received at the Communications Section
during other than normal business hours will be handled by the watch commander. He
will forward a record of the complaint and its assignment to the appropriate watch
commander.

445 SERIOUS COMPLAINTS OR ALLEGATIONS: If in the opinion of the watch commander
or supe~isor, the incident is of sufficient gravity, he may notify the Chief of Police
regardless of the hour. In addition, he shall take any immediate action necessary to
preserve the integrity of the Department until the Chief of Police or his delegate can take
command of the situation.
450 INVESTIGATION OF ALLEGED MISCONDUCT: The officer assigned the investigation
of an alleged act of misconduct on the part of a member of this Department shall conduct
a thorough and accurate investigation. Such investigation shall include formal statements
from all parties concerned, when necessary and pertinent, the gathering and preservation
of any physical evidence pertaining to the case, and all other information beating on the
matter. Members subject to or who have information pertaining to a Department investiga-
tion, are required to cooperate by giving information relative to the incident under
investigation. The results of the investigation must be reduced to a written report sUmma-
rizing the pertinent facts and including a summary of the complaint or alleged act,
statements of all parties to the incident, a description of the incident, physical evidence
and other evidence important to the case, and the observations and conclusions of the
investigating officer.
455 FINDINGS: When the investigation is completed, the final report must bear a classifica-
tion of the case made by the Chief of Police or his designate into one of the following:
A, Unfounded: This must be used when evidence establishes the allegation is
false or not factual, or the action complained of did not involve police persons.
B. Exonerated: This must be used when evidence establishes the incident
Occurred, but was lawful and proper.
C. Not Sustained: This i:lassification must be applied when there is not sufficient
evidence to sustain the allegation.
D. ,Sustained: This must be used when there is sufficient evidence to sustain the
allegation.
NOTE: If more than one member i~ alleged to be involved, a separate finding must be
shown for each member.
