I001A Staff Report June 20, 2005 Historic Review for 619 N Johnson Avenue District: Brown Street Historic District Classification: Contributing Applicant, Doug Berner, is requesting approval of Certificate of Appropriateness for proposed alterations at 619 North Johnson, a contributing property in the Brown Street Historic District. Proposed work includes demolition of wood porch stairs and reconstruction with concrete stairs, installation of wood railing. The project also includes removal of wood decking of the porch to be replaced with concrete slab. Applicable Regulations and Guidelines: 4.0 Iowa City Guidelines for Alterations 4.9 Porches Recommended: Historic porches ■ Repairing historic porches and conserving as much of the historic material as possible. ■ Replacing badly deteriorated components with new ones that match the historic components in design and material. Custom fabrication of columns, brackets, pedestals, and moldings may be necessary, but many porch components can be ordered through lumber yards. ■ Using vertical -grained fir porch flooring for its resistance to weathering. ■ Constructing or replacing missing balustrades and handrails using historic photographs or in a style that is consistent with both the building and neighborhood (See section 4.10 Balustrades and Handrails for more details). ■ Using wood steps for a wood porch and tile, brick, or concrete steps for a masonry porch. ■ Leaving exposed the support piers below the porch columns. Skirting must be added to fill the space below the porch floor and grade if this space is 24 inches or greater. The skirt must be located between the porch piers. ■ Constructing porch skirting using a 3-6 inch wood frame with slats fastened to the back of the frame in a vertical or lattice pattern. Disallowed: New materials ■ Using unpainted treated wood for elements that would have been painted in their historic applications. ■ Using precast concrete steps on the front or side elevation if the steps will be highly visible from the street. They are acceptable on the rear elevation. Exceptions: Applies to: Historic District —Noncontributing Conservation Districts —All Properties New materials ■ Porch floors may be concrete if the floor is no more than 18 inches above grade. Porches with floors that are more than 18 inches above grade must be built using traditional porch construction with wood joists and wood flooring. ■ Pretreated porch decking or dimensional lumber may be used for decking provided the gaps between the floorboards do not exceed 1/8 inch. Staff Comments The applicant originally proposed removing the wood stairs for front porch and reconstructing the stairs with concrete. The original proposal also included replacing the wood porch decking with concrete slab and replacing the siding on the side walls of the porch with. The structure is unusual in having an integrated porch within the main mass; however this configuration appears to be original. Using concrete for stairs is not recommended per the guidelines as it would compromise the character and style of the house. Replacing the siding with brick would compromise the character of the structure. Staff discussed these issues with the applicant and suggested use of alternative material for the replacements. Applicant has agreed to consider using wood for stairs and porch decking. Staff recommends use of tongue and groove type wood porch decking or tongue and groove type wood alternative decking material. The existing vinyl siding on the porch side walls is damaged and applicant has agreed to consider repair for the siding instead of replacing it with brick. The applicant has not provided design for the railing. If the hand rails and guard rails are installed guidelines from section 4.9: Porches, 4.10: Balustrades should be referred to. Existing railing, if intact, may be replaced. Recommendations Staff recommends approval of Certificate of Appropriateness provided, 1) wood or wood alternative is used for stairs and porch decking to match the style and appearance and the existing siding is repaired, and 2) appropriate railing is replaced to march the existing in style, material and appearance. The project includes replacement wood platform of the rear deck, replacement of screens, replacement of gutters and downspouts, repair of soffit and fascia. Applicable Regulations and Guidelines: 4.0 Iowa City Historic Preservation Guidelines for Alterations 4.3 Wood Recommended: Historic wood ■ Repairing historic wood elements rather than replacing them. • Using epoxy products, such as Wood Epox and Liquid Wood by Abatron, to consolidate deteriorated wood components, and fill or reconstruct missing wood. ■ Duplicating and replacing historic wood elements when they cannot be repaired. ■ Replacing damaged wood components with new or salvaged wood components that match the historic ones. ■ Monitoring wood surfaces for signs of excessive water damage, rot, or pest infestation. Keeping all surfaces primed, painted and appropriately caulked in order to prevent wood deterioration. ■ Eliminating excessive moisture problems such as leaky roofs, gutters, and downspouts. The improper venting of baths, kitchens, basements, and dryers may cause moisture problems. ■ Removing vegetation that is growing against the wood elements or siding. Wood substitutes ■ Substituting a material in place of wood only if the substitute material retains the appearance and function of the original wood. The substitute material must be durable, accept paint, and be approved by the Historic Preservation Commission. For many applications, fiber cement board is an approved substitute for wood. Disallowed: Historic wood ■ Covering original wood siding, soffits and eave boards with another material such as vinyl or aluminum siding. ■ Using destructive and dangerous paint removal methods such as sandblasting, water blasting, or burning with a propane or butane torch. ■ Removal of historic wood elements such as trim, porches, cornices, and decorative elements. Wood substitutes Substituting a material in place of wood that does not retain the appearance, function, and paintability of the original wood. 4.11 Gutters and Doumspouts Recommended: Original built-in gutters ■ Repairing original built-in gutters. EPDM rubber sheeting is an economical replacement material for the original tin flashing. ■ Covering original built-in gutters and applying exterior gutters only if the roof slope at the gutter is not altered. This can be accomplished with horizontal blocking and flashing above the old gutter. New downspouts ■ Installing metal downspouts placed vertically near the corners. They should be painted to match the background wall color. Disallowed: Roof slope ■ Altering the roof slope near the gutter when covering historic built-in gutters. 9.0 The Secretary of the Interior's Standards for Rehabilitation The Secretary of the Interior's Standards for Rehabilitation (Standards) were originally written to determine the appropriateness of proposed project work on properties that were listed on the National Register of Historic Places. The Standardr are accompanied by instructions concerning methods, materials, historical character, and other considerations that relate to the historical significance of the particular property and its surroundings. The Standards have been widely accepted by state, county, and city governments. The Iowa City Historic Preservation Commission uses the Standards to determine the appropriateness of exterior changes to historic landmarks and properties located in historic and conservation districts. The Iowa City Guidelines are based on and comply with the Standards, and were written to provide more specific guidance for owners, contractors and consultants in Iowa City as well as the Historic Preservation Commission. The Secretary of the Interior's Standards for Rehabilitation (1990) are listed below. 1. A property shall be used for its historic purpose or be placed in a new use that requires minimal change to the defining characteristics of the building and its site and environment. 2. The historic character of a property shall be retained and preserved. The removal of historic materials or alteration of features and spaces that characterize a property shall be avoided. 3. Each property shall be recognized as a physical record of its time, place, and use. Changes that create a false sense of historical development, such as adding conjectural features or architectural elements from other buildings, shall not be undertaken. 4. Most properties change over time; those changes that have acquired historic significance in their own right shall be retained and preserved. 5. Distinctive features, finishes, and construction techniques or examples of craftsmanship that characterize a property shall be preserved. 6. Deteriorated historic features shall be repaired rather than replaced. Where the severity of deterioration requires replacement of a distinctive feature, the new feature shall match the old in design, color, texture, and other visual qualities and, where possible, materials. Replacement of missing features shall be substantiated by documentary, physical, or pictorial evidence. 7. Chemical or physical treatments, such as sandblasting, that cause damage to historic materials shall not be used. The surface cleaning of structures, if appropriate, shall be undertaken using the gentlest means possible. 8. Significant archeological resources affected by a project shall be protected and preserved. If such resources must be disturbed, mitigation measures shall be undertaken. 9. New additions, exterior alterations, or related new construction shall not destroy historic materials that characterize the property. The new work shall be differentiated from the old and shall be compatible with the massing, size, scale, and architectural features to protect the historic integrity of the property and its environment. 10. New additions and adjacent or related new construction shall be undertaken in such a manner that if removed in the future, the essential form and integrity of the historic property and its environment would be unimpaired. Staff Comments There are no particular guidelines to address issues such as existing decking replacement or screen replacement in the guidelines. Most of the proposed work will replace the existing elements and features with material, style and appearance to match. In staffs view, the proposal takes into consideration the significance of the property and is sympathetic toward its architectural character. Iowa City Historic Preservation guidelines for new addition of Decks and Ramps and Secretary of Interior's Standards for Rehabilitation should be referred to for guidance. Recommendations Staff recommends approval of Certificate of Appropriateness. Proposed work includes removing the asphalt siding to replace it with vinyl siding and cover up the window and door trim with aluminum. Applicable Regulations and Guidelines: 4.0 Iowa City Guidelines for Alterations 4.9 Siding Recommended: Historic .riding ■ Repairing historic wood siding and trim. ■ Replacing deteriorated sections of wood siding with new or salvaged wood siding that matches the historic wood siding. ■ Removing synthetic siding and repairing historic wood siding and trim. Wood substitutes ■ Substituting a material in place of wood siding only if the substitute material retains the appearance and function of the original wood. The substitute material must be durable, accept paint and be approved by the Historic Preservation Commission. In many applications, fiber cement board is an approved wood substitute. Synthetic siding ■ Matching synthetic siding may be used to repair damage to existing synthetic siding. Disallowed: Historic trim ■ Removing historic trim pieces such as door and window trim, skirt and frieze boards, and corner boards. ■ Covering historic trim such as door and window trim, skirt and frieze boards, and corner boards. Synthetic siding ■ Applying synthetic siding such as aluminum, vinyl, or false masonry siding. Staff Comments The original structure, built in 1900, is of American Foursquare style. Apart from low maintenance and some later alterations, its main features and mass are intact. Asphalt siding was applied to the exterior surface of the structure at an unknown date. The siding has been damaged and replaced in some areas. This application is for removing this siding to replace with vinyl siding and the use of aluminum coil stock to cover the door and window trim. Use of synthetic material for siding and trim work is not allowed as per the guidelines. If the original wood siding has been removed or is in poor condition replacement with wood or fiber cement board siding to match style, appearance of the period, should be appropriate. Recommendations Staff recommends denial of Certificate of Appropriateness. Alternatives should be explored. Wood or fiber cement board should be used to be consistent with the guidelines. Proposed work includes installation of two double -hung wood windows, aluminum trim for windows and doors, aluminum siding for garage, replacement of soffit with aluminum soffit. Applicable Regulations and Guidelines: 4.0 Iowa City Guidelines for Alterations 4.3 Wood Recommended: Historic wood ■ Repairing historic wood elements rather than replacing them. ■ Using epoxy products, such as Wood Epox and Liquid Wood by Abatron, to consolidate deteriorated wood components, and fill or reconstruct missing wood. ■ Duplicating and replacing historic wood elements when they cannot be repaired. ■ Replacing damaged wood components with new or salvaged wood components that match the historic ones. ■ Monitoring wood surfaces for signs of excessive water damage, rot, or pest infestation. Keeping all surfaces primed, painted and appropriately caulked in order to prevent wood deterioration. ■ Eliminating excessive moisture problems such as leaky roofs, gutters, and downspouts. Unless severely deteriorated, historic wood siding must not be removed. ■ To the extent possible, the synthetic siding appears similar to the original wood siding in exposure, texture and design. ■ Trim boards extend in front of the face of the siding. 4.7 Windows Recommended: Replacement windows ■ Replacing badly deteriorated windows with new ones that match the type, size, sash width, trim, use of divided - lights, and overall appearance of the historic windows. ■ Using new wood windows and sashes, if necessary, to replace historic wood windows and sashes. The use of metal - clad, solid -wood windows is acceptable. Replacement windows and trim must accept paint. Divided -lights may be created with muntins bars that are adhered to both sides of the glass, but not with snap -in muntin bars. New windows ■ Adding windows that match the type, proportions, trim, and appearance of the historic windows. The sash width must be similar to that of the original windows. ■ Adding new windows in a location that is consistent with the window pattern of the historic building or buildings of similar architectural style. Disallowed: New and replacement windows ■ Installing metal, vinyl clad or vinyl windows when they were not original to the building. ■ Using snap -in muntin bars to achieve the appearance of divided -lights. Staff Comments Multiple applications received for the proposed work request approval for the use of vinyl siding on the garage, use of aluminum trim for certain windows and doors. The guidelines do not allow the use of synthetic material. Existing wood shiplap siding appears to be in a condition to be repaired and painted. It is common to have different exterior finish on an outbuilding than the house. In fact, the garage (possibly converted from a small barn or carriage house) appears to have always had different siding pattern than the house. The soffit on the garage may not be original material. However, covering the soffit with aluminum would be counter to the guidelines. The original house would have had wood clap board as a typical feature of the American Foursquare. The applicant has also requested approval for installation of wood double -hung windows to replace the fixed pane openings on the south and north gables on the garage. The windows should be designed to match the style, material and proportions of a barn or carriage house of the period. In staffs view proposed windows would not be consistent with the character of the structure. Recommendations Staff recommends denial of Certificate of Appropriateness. Staff Comments The applicant is requesting to add a dormer to increase the number of bedrooms to this rental structure. To convert the attic space into a bedroom the dormer and an egress window are proposed. This will change the roof and massing of the structure. It is unclear from the applicant's sketch whether the dormer would be consistent in size, scale and proportion with the architectural style. Though some additions have compromised the integrity of this Vernacular Late Victorian house is in a contributing structure in the conservation district. Recommendations A dormer to increase the headroom in the attic can be designed to fit in the size, scale and proportion. The new dormer should have the design features such as frieze board, trim for windows that exist on the original house. However, staff can not provide a recommendation based on the information provided in the application as the sketch is unclear. Staff would recommend approval of Certificate of Appropriateness if such drawings are provided. Proposed work includes installation of replacement and new windows. Applicable Regulations and Guidelines: 4.0 Iowa City Guidelines forAherations 4.7 Windows Recommended: Replacement windows ■ Replacing badly deteriorated windows with new ones that match the type, size, sash width, trim, use of divided - lights, and overall appearance of the historic windows. ■ Using new wood windows and sashes, if necessary, to replace historic wood windows and sashes. The use of metal - clad, solid -wood windows is acceptable. Replacement windows and trim must accept paint. Divided -lights may be created with muntins bars that are adhered to both sides of the glass, but not with snap -in muntin bars. ■ Replacing a bedroom window, if required for egress by the Building Code, with a new one that matches the size, trim, use of divided -lights, and overall appearance of the previous bedroom window or other windows in the house. New windows ■ Adding windows that match the type, proportions, trim, and appearance of the historic windows. The sash width must be similar to that of the original windows. ■ Adding new windows in a location that is consistent with the window pattern of the historic building or buildings of similar architectural style. Disallowed: New and replacement windows ■ Installing modern types of windows including sliding, awning, casement, and bay windows when they were not original to the building, consistent with the architectural style, or required for egress. ■ Installing metal, vinyl clad or vinyl windows when they were not original to the building. ■ Using snap -in muntin bars to achieve the appearance of divided -lights. Staff Comments The original structure, built in the 1920s is American Foursquare. Many additions and changes have compromised the integrity of the structure. Proposed windows are required to meet egress regulations. Two of the proposed windows will be installed on the east and west of an enclosed porch. The windows will be installed by enlarging the existing openings used for air-condition units. South walls of these rooms have large fixed pane windows, which have similar proportions of the windows on the original structure. In staffs view these openings should be considered for installing operable windows. Applicant may also consider the option to design and place the openings such that an enclosed porch appearance would be achieved. This would be more sympathetic toward the original integrity the structure. Applicant has proposed to install a third window on the original structure. In Staffs view, the proportions and placement described by the applicant would further compromise the integrity of the structure. Creating opening on the enclosed porch will also contribute to this, however, in the future reopening the porch to its original would relatively easier than removing a window opening from the house. The applicant has proposed to use vinyl casement windows. Guidelines do not allow use of vinyl (material) or casement (type) windows. The applicant proposes to use match the trim on existing structure for the new windows. Staff would recommend use trim to match with original structure. Recommendations Staff recommends denial of Certificate of Appropriateness and suggests consideration of alternatives for window placement and type. MINUTES HISTORIC PRESERVATION COMMISSION JUNE 9, 2005 — 7:00 P.M. LOBBY CONFERENCE ROOM DRAFT MEMBERS PRESENT: Michael Brennan, Richard Carlson, Mark McCallum, Jim Ponto, Jan Weissmiller, Tim Weitzel MEMBERS ABSENT: James Enloe, Michael Gunn, Justin Pardekooper STAFF PRESENT: Sunil Terdalkar CALL TO ORDER: Chairperson Weitzel called the meeting to order•at 7:04 p.m. PUBLIC DISCUSSION OF ANY ITEM NOT ON THE AGENDA: There was none. ITEMS FOR CONSIDERATION: Certificate of Appropriateness: 934 Iowa Avenue. Terdalkar said that the applicant proposes to remove the stairs that are part wood and part concrete block masonry. He said the applicant will then replace the wood stairs but will not reconstruct the masonry stairs. Terdalkar said that the applicant needs to add a parking spot at the back of the house and is therefore required by HIS to replace the driveway. He said that the applicant wants to widen the concrete driveway, and the masonry stairs have already been demolished. Weitzel asked if the applicant had permission from HIS to begin the work. Terdalkar said he did not believe so, because the applicant was referred to the Commission by HIS. Weissmiller asked if this has always been a rental property. Terdalkar said it has been a rental property for the past few years. He said that HIS requires the owner to add a parking spot because of the number of renters. Weitzel said that one option is to replace the stairs, and, given the grade, a railing will probably be required. He said that will probably be based on new requirements for riser height and tread depth, which will probably be more than four steps and therefore require a railing. Weitzel said the intent was to demolish the concrete, but if the stoop is over three feet high in the back, it would also require a safety railing on the back. Weitzel said that one thing the owner could do would be to regrade so that a railing is not required, but there may still need to be a handrail if there is sufficient height to require four or more stairs. He asked Terdalkar if he checked with HIS to see how far back the owner would have to extend the grading to be compliant. Terdalkar said that even if it is one foot or two feet, the applicant needs a railing because it is a significant drop. Weitzel said the need for a railing will be determined by how many treads the owner is required to have by HIS. He said that four risers triggers the requirement by HIS for a handrail, which the Commission can then review. Weitzel said that additionally, if the back of the platform for the stoop is over three feet tall, there will need to be a safety rail, which the Commission can review. Carlson said the applicant has not submitted a plan to show what will be here. Weitzel responded that the applicant will need to either do grading so that he does not need a handrail or will need to install a pipe rail. He said that a black pipe rail would be the least obtrusive and least expensive way to have a railing here. MOTION: Ponto moved to approve a certificate of appropriateness for either: 1) if this is such that the City does require a handrail and safety rail, a black hand rail is approved, or 2) the change of the grade resulting in a shorter height so that a railing is not required by City Code, compliant with HIS inspection and to approve a certificate of appropriateness for the demolition of the concrete steps. McCallum seconded the motion. Historic Preservation Commission Minutes June 9, 2005 Page 2 Weitzel said it is possible that the stairs were original to the building, although it is a moot point now, since the owner has demolished them. He added that this is a prairie -style foursquare house built around 1920. The motion carried on a vote of 6-0. MINUTES: May 26, 2005. Weitzel said that on page one in the fourth paragraph, last sentence, the word "considered" should be changed to "recorded," and the word "landmark" should be changed to "site." He stated that in the next paragraph on the same page, the word "remnant" should be added to the last sentence after the word "bridge." Carlson stated that in the last paragraph on the first page, in the first sentence, the word "impact" should be changed to "protection." Carlson stated that in the second paragraph on page one, in the last sentence, the word "posts" should be changed to "columns." He said that in the first motion on page one, the word "raised" should be deleted. Carlson said that the last sentence on page one should show him as being voted Vice Chair. He said that in the last paragraph in the 503 Melrose Avenue section on page two, after the first sentence should come a comment to state, "Carlson clarified that the top of the sign would be four feet high." Carlson said that on page three in the fourth paragraph, "dwarves" should be changed to "dwarfs." Terdalkar said that regarding sign regulations, the Commission has complete authority over how the signs are regulated. He said the Commission could ask to move the sign or change the size. He said it is not written in the guidelines, but the Code and the sign regulations say that the Commission has complete authority to regulate the signs in the districts. MOTION: Carlson moved to approve the minutes of the June 2, 2005 Historic Preservation Commission meeting, as amended. Brennan seconded the motion. The motion carried on a vote of 6-0. OTHER: 2005 Work Plan. Weitzel said that the work plan spells out the Commission's goals for the year. Weitzel said that so far the Commission has mailed 1,100 notification letters to owners of properties in the historic and conservation districts and to owners of local landmarks. Weitzel said that the directive from the senior planner is to continue to do other things besides review the certificates of appropriateness. He said that one of the directives from City Council is to coordinate with Friends of Historic Preservation in educating the public about the benefits of historic preservation, including financial incentives and requirements. Conference. Weitzel said there is a conference sponsored by the State Historical Society coming up that will allow one Commission member to attend with staff. He said the conference will discuss tax credits and also Historic Preservation Commission Minutes June 9, 2005 Page 3 rehabilitation projects and building code issues. Weitzel asked if anyone wanted to attend. Seeing no volunteers, Weitzel said that he and Terdalkar would attend the conference June 23 and 24th HRDP Grant. Weitzel said the CLG coordinator informed him that the HRDP grant was approved. He said the project was to rewrite the Iowa City Historic Preservation Plan, which is a companion document to the City's Comprehensive Plan. Weitzel said the current plan was written in 1992. He said there is now a new focus on what the Commission will be doing, with less emphasis on new historic districts and more emphasis on certificates of appropriateness and education. Weitzel said there will continue to be more districts, especially as neighborhoods propose them to the Commission. Weitzel said the Commission would like to see a survey done as part of the Central District Planning process. He said the Historic Preservation ordinance needs to continually be updated. Weitzel said some money was earmarked in the grant for reproducing the 1992 map of historic resources in Iowa City. Weitzel said this will be about a yearlong project, and Terdalkar will be looking for a consultant to do the work. Weitzel said an outside consultant will result in an impartial document. Weitzel asked if there has been any progress on the website, and Terdalkar said there has not. Weitzel said that the neighborhood brochures have been an ongoing project. He said he believes the brochures are at the point of final editing and are about ready to go to the printer. Terdalkar said he would check on that. Weitzel said that Goosetown continues to be a concern, and downtown has been part of the planning process too, to get a central business district or downtown historic district. He said that critical points for a downtown district are finding local support and finding a landowner willing to sit on the Commission, which is required by State law. Weitzel asked Terdalkar to find out if the downtown representative would have to reside in the district or if it could be a business owner or property owner. Weitzel asked for opinions regarding what the Commission's priorities through December should be. Terdalkar said that the first big thing would be the Preservation Plan update, and work can start on that right away. He said that besides the consultant, he will be able to hire an intern for the project. McCallum said he has attended some of the meetings on new zoning. He said that there have been some improvements, but he does not think they are aggressive enough. McCallum said he believes the Commission is missing a big opportunity through the Zoning Code to add more incentives for historic structures. Weitzel said one problem is that historic properties are located in a multitude of differently zoned areas. McCallum said that the standards to receive financial incentives to preserve historic buildings are so high, that the incentives have no practical effect. He suggested having some kind of special review process to allow flexibility for historic structures. Weitzel asked McCallum to draft something for the Commission to review. McCallum agreed to come up with specific proposals. Weitzel suggested having Karen Howard talk to the Commission about whether such a proposal would be appropriate, and, if so, why and how it would work. Terdalkar said he would arrange a session with Howard. Ponto asked if the Commission wanted to pursue reducing the fee for building permits for projects in districts that would not otherwise require a permit if the property was not in a district. Weitzel said the fee for that has been reduced to a flat fee of $30, the minimum fee. He said that HIS needed to at least cover the staff time for the filing of the permit. Weitzel stated that there is already a need for some rewriting of the guidelines. He said that the point system for multi -family design review has been revoked since the guidelines were written, so that section Historic Preservation Commission Minutes June 9, 2005 Page 4 on design review will need to be rewritten to reflect the new multi -family design review process. Weitzel said the Commission also needs to write guidelines for signs and stair rails, among other things. Carlson asked about the annual preservation awards. Weitzel stated that Friends of Historic Preservation will be granting the awards. He said that nominations will be accepted through July 1st Regarding Goosetown and the North Side, Weitzel said the City Council has directed the Commission to wait a year or so to educate people and to contact people who might be interested. He said the Commission could contact people in Friends of Historic Preservation and the North Side area to let them know that the Commission is essentially waiting for them to do something. Terdalkar asked for a consensus on the date of the next meeting; he said that there is one application pending. Weitzel scheduled the Commission's next meeting for June 30tn Discussion of Quorum Requirements and Meetinq Attendance. Weitzel suggested some options for dealing with the difficulty in having a quorum at Commission meetings. He said one possibility is approaching those members who do not routinely attend the meetings and asking them to resign. Weitzel said another idea is to wait until the terms of those who do not attend expire and then try to recruit someone else. Weitzel said another option might be to change the Commission's by-laws to set a quorum at some number, although he did not know the legalities of that. Terdalkar suggested having the number of members required for a quorum decrease if there is a vacancy on the Commission. He said the City Attorney has told him that in the absence of a specific number in the Commission's by-laws, a quorum requires a majority of the total number of Commission terms available. Terdalkar said he would ask Mitch Behr what the possibilities are. McCallum said the by-laws should take into account vacant positions, because the Commission has no control over that. Weitzel noted that after three consecutive unexcused absences from Commission meetings, the Commission may ask the Mayor to remove a Commission member from office and appoint a new Commission member. Weitzel said that he is reviewing a due process pamphlet put out by the National Trust and Roberts' Rules of Order to try to adjust them to the by-laws. He said he plans to put his thoughts together for Terdalkar and Behr to look over so that they can be added to the by-laws and/or procedures.
