RESOLUTION NO. 07-118
RESOLUTION SETTING A PUBLIC HEARING ON MAY 1, 2007, ON PLANS,
SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF THE 2007 PCC PAVEMENT REHABILITATION PROJECT -
BENTON STREET, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID
HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE
FOR PUBLIC INSPECTION.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF IOWA CITY, IOWA:
1. That a public hearing on the plans, specifications, form of contract, and estimate of cost for the
construction of the above-mentioned project is to be held on the 1st day of May, 2007, at 7:00 p.m. in
the Emma Harvat Hall, City Hall, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting
of the City Council thereafter as posted by the City Clerk.
2. That the City Cierk is hereby authorized and directed to publish notice of the public hearing for the
above-named project in a newspaper published at least once weekly and having a general
circulation in the City, not less than four (4) nor more than twenty (20) days before said hearing.
3. That the copy of the plans, specifications, form of contract, and estimate of cost for the construction
of the above-named project is hereby ordered placed on file by the City Engineer in the office of the
City Clerk for public inspection.

WHEREAS, on April 29, 1996, the owner executed a Mortgage with the City of Iowa
City; and
WHEREAS, the terms of the loan has been satisfied; and
WHEREAS, it is the City of Iowa City's responsibility to release this lien.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA that the Mayor is authorized to sign and the City Clerk to attest the attached Release of

RESOLUTION ACCEPTING THE WORK FOR THE HOUSING INSPECTIONS
REMODELING PROJECT
WHEREAS, the Engineering Division has recommended that the work for construction of the
Housing Inspections Remodeling Project, as included in a contract between the City of Iowa City
and City Construction Group, L.C. of Iowa City, dated November 20, 2006, be accepted; and
WHEREAS, the Engineer's Report and the performance and payment bond has been filed in the
City Clerk's office; and
WHEREAS, the final contract price is $51,186.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT said improvements are hereby accepted by the City of Iowa City, Iowa.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK
TO ATTEST A RENEWAL OF A LICENSE AGREEMENT FOR TEMPORARY
USE OF PUBLIC RIGHT-OF-WAY BETWEEN THE CITY OF IOWA CITY,
LANDOWNER MARC MOEN, AND TENANT STARBUCKS CORPORATION
D/B/A STARBUCKS COFFEE #2855-IA, FOR A SIDEWALK CAFE
WHEREAS, the City of Iowa City is the custodian and trustee of.the public right of way within
the City; and
WHEREAS, Marc Moen, as landlord, and Starbucks Corporation, d/b/a Starbucks Coffee
#2855-IA, as tenant, applied for a renewal of a temporary use of the public right-of-way at 228
S. Clinton St., Iowa City, Iowa for a sidewalk cafe and anchored fencing thereon; and
WHEREAS, City staff has reviewed the application, location, and specifications for the proposed
sidewalk cafe and found these to be in compliance with City Code 10-3-3; and
WHEREAS, such use of the public right-of-way is compatibl~ with the public use thereof; and
WHEREAS, it is in the public interest to set forth the conditions regarding such use of the public
right-of-way, as enumerated in the License Agreement for Temporary Use of Public Right-of-
Way (hereinafter "license agreement").
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA
THAT:
1. The Mayor and City Clerk are hereby authorized and directed to respectively sign and
attest said license agreement, copy of which is on file with the Public Works Department.
2. The Public Works Department is hereby directed to record this Resolution and license
agreement with the Johnson County Recorder at Applicant's expense.

The Deer Task Force is comprised of nine (9) individuals. With the resignation of four (4)
members, Gene Szymkowiak (resigned March 1, 2005) and more recently, Linda Dykstra
(verbal resignation), Jan Ashman, and Pat Farrant (see enclosure), the Deer Task Force is
currently operating with five members. At its March 27 meeting, Task Force members agreed
they would like to proceed with its current membership instead of adding new members at this
time. Therefore, the City Council is asked to consider the Deer Task Force as a five-member
Task Force with a quorum of four. Final minutes of the March 27 meeting are included in the
April 12 Information Packet.

"animal welfarists" from the Iowa City Urban Deer Task Force. Although the last couple of years have been
a trial, I consider my time spent rewarding, and of course I find the plight of urban deer worth the effort.

RESOLUTION NO. 07-123
RESOLUTION CHANGING THE DEER TASK FORCE TO FIVE (5) MEMBERS AND
RESCINDING RESOLUTION NO. 07-56.
WHEREAS, Resolution No. 98-87 approved a long term deer management plan that
referenced the formulation of a citizen committee to assist the City Council in implementing said
plan; and
WHEREAS, Resolution No. 01-80 established the Deer Task Force and also provided for the
Deer Task Force to sunset on March 15, 2004;
WHEREAS, after the Deer Task Force did sunset, Resolution No. 04-225 re-established the
Deer Task Force and also provided for the Deer Task Force to sunset on March 15, 2007;
WHEREAS, the Deer Task Force at its meeting on February 6, 2007 voted to recommend to
City Council that that Deer Task Force be extended for another three (3) years;
WHEREAS, City task forces are generally of limited purpose and duration, in contrast to boards
and commission, which are more formal and permanent; and
WHEREAS, the Deer Task Force still remains necessary to address issues and concerns
relating to the long term deer management plan, and it is in the publiC interest to continue the
Deer Task Force for one more year.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA:
The Deer Task Force shall fulfill the requirements assigned to the Deer Committee in Resolution
No. 98-87.
The Deer Task Force will be comprised of five (5) individuals, and four (4) members shall
constitute a quorum.
The individuals, who are currently serving as members on the Deer Task Force, will continue to
serve throughout the tenure of the task force or until they choose to resign.
The Deer Task Force will sunset on March 15, 2008, at which time: a) the Task Force will
recommend to Council whether a permanent and formal board should be established to
continue its work and to address deer management; and b) Council will consider whether to
continue the work of the Deer Task Force and to address deer management by establishing a
permanent and formal board.
The Deer Task Force and City Council will review the existing Long Term Deer Management
Plan prior to March 15, 2008.

RESOLUTION AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME
LOCATED AT 938 LONGFELLOW PLACE.
WHEREAS, the City Council of the City of Iowa City functions as the Iowa City Housing
Authority; and
WHEREAS, on September 14, 1993, the City Council considered and passed Resolution No.
93-255 approving the Section 5(h) Implementing Agreement for the conversion of public
housing to private ownership, also known as the Tenant-to-Ownership Program; and
WHEREAS, under this agreement the proceeds from such sales must be used to expand
affordable housing opportunities in Iowa City; and
WHEREAS, the proceeds from such sales are used to provide affordable housing under the
City's Affordable Dream Home Program ("ADHOP"); and
WHEREAS, the Iowa City Housing Authority owns a single family home located at 938
Longfellow Place, Iowa City; and
WHEREAS, the City has received an offer to purchase 938 Longfellow Place for the principal
sum of $147,000; and
WHEREAS, this sale would provide the opportunity for a low-income family to obtain ownership
of their own home; and
WHEREAS, on April 3, 2007, the City Council adopted a Resolution proposing to convey its
interest in 938 Longfellow Place, authorizing public notice of the proposed conveyance, and
setting the date and time for the public hearing; and
WHEREAS, following the public hearing on the proposed conveyance, the City Council finds
that the conveyance is in the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, that:
1. Upon the direction of the City Attorney, the Mayor and the City Clerk are authorized to
execute a warranty deed conveying the City's interest in 938 Longfellow Place, legally
described as Unit 938 Longfellow Place of Lot 12, Longfellow Manor Condominiums, Iowa
City, Iowa. The Mayor and City Clerk are further authorized to execute a second mortgage
agreement and resale agreement with said family in an amount not to exceed $36,500.

The Mayor announced that this was the time and place for the public hearing and
meeting on the matter of the issuance of not to exceed $6,695,000 General Obligation
Bonds in order to provide funds to pay costs of the construction, reconstruction, and
repairing of improvements to public ways and streets; the reconstruction, extension and
improvement of the existing Municipal Airport; the reclamation of properties from flood
and construction of flood control improvements; the construction, reconstruction and
repair of water mains; the rehabilitation, improvement and equipping of existing city
parks; and equipping of the fire and police departments, essential corporate purposes, and
that notice ofthe proposed action by the Council to institute proceedings for the issuance
of the bonds, had been published pursuant to the provisions of Section 384.25 of the City
Code ofIowa.
The Mayor then asked the Clerk whether any written objections had been filed by
any city resident or property owner to the issuance of the bonds. The Clerk advised the
Mayor and the Council that no written objections had been filed. The Mayor then
called for oral objections to the issuance of bonds and none were made. Whereupon,
the Mayor declared the time for receiving oral and written objections to be closed.

The Mayor announced that this was the time for meeting on the matter of the

to pay costs ofthe construction, reconstruction and improvement of Fire Station #2, a
general corporate purpose, and that notice of the proposal to issue the bonds and the right
to petition for an election had been published as provided by Section 384.26, of the City
Code of Iowa; and, the Mayor then asked the Clerk whether any petition had been filed in
the Clerk's Office, as contemplated in Section 384.26 ofthe City Code ofIowa, and the
Clerk reported that no such petition had been filed, requesting that the question of issuing
bonds be submitted to the qualified electors of the City.
Whereupon, the Mayor declared the hearing on the issuance of the bonds to be
closed.

to pay costs of improving low income housing facilities for the Greater Iowa City
Housing Fellowship to provide affordable housing within the City and contributions to

water mains; the rehabilitation, improvement and equipping of existing city parks; and

CONSIDER A RESOLUTION AUTHORIZING SUPPORT OF AN APPLICATION FOR
FINANCIAL ASSISTANCE FROM THE IOWA DEPARTMENT OF ECONOMIC
DEVELOPMENT'S COMMUNITY ECONOMIC BETTERMENT ACCOUNT (CEBA)
FOR $400,000 AND A LOCAL MATCH OF A THREE-YEAR, NO INTEREST $100,000
LOAN FOR FUNDS TO ASSIST PREP SPORTS ONLINE.
WHEREAS, the City's Economic Development Strategies and Policies include attracting new
business in selected industries and Prep Sports Online is a communications services company
which is one of those industries, and
WHEREAS, the City Council Economic Development Committee has reviewed and approved
support for a Community Economic Betterment Account (CEBA) application to the State of Iowa on behalf
of Prep Sports Online, which requires a local match, and
WHEREAS, the City Council Economic Development Committee supports a local match in the
form of a three-year $100,000 no interest loan secured by an irrevocable letter of credit from a recognized,
FDIC insured financial institution, and
WHEREAS, Prep Sports Online will agree to create 79 new full time jobs with wages averaging
above 130% of the average county wages,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA, THAT:
1. The City Manager is authorized to submit an application to the Iowa Dept. of
Economic Development for a $400,000 Grant from the CEBA on behalf of Prep
Sports Online.
2. The local match in the form of a three-year $100,000 no-interest loan shall be
secured by an Irrevocable Letter of Credit from a recognized, FDIC insured financial
institution.
3. Upon approval of the terms of the loan agreement by the City Attorney, the City

WHEREAS, the City of Iowa City is the custodian and trustee of the public right of way within
the City; and
WHEREAS, Marc Moen, as landlord, and Graze Iowa City, LLC, d/b/a Graze, as tenant, applied
for a temporary use of the public right-of-way at 115 College Street, Iowa City, Iowa for a
sidewalk cafe and anchored fencing thereon; and
WHEREAS, City staff has reviewed the application, location, and specifications for the proposed
sidewalk cafe and found these to be in compliance with City Code 10-3-3; and
WHEREAS, such use of the public right-of-way is compatible with the public use thereof; and
WHEREAS, it is in the public interest to set forth the conditions regarding such use of the public
right-of-way, as enumerated in the License Agreement for Temporary Use of Public Right-of-
Way (hereinafter "license agreement").
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA

TION ON BEHALF OF THE CITY OF IOWA CITY WITH THE DEPARTMENT OF
TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT UNDER
SECTION 5307, 5309, 5310, 5316, AND 5317 OF CHAPTER 49, US CODE OF
FEDERAL REGULATIONS, FOR FY2007 TRANSIT OPERATING AND/OR
CAPITAL ASSISTANCE FUNDING, AND DESIGNATING THE CITY MANAGER

APPLICATION.
WHEREAS, the City of Iowa City has a municipal transit system; and
WHEREAS, the Secretary of Transportation is authorized to make grants for mass transportation
projects; and
WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant,
including the provision by it of the local share of projects costs; and
WHEREAS, it is required by the U.S. Department of Transportation, in accordance with the
provisions of Title VI of the Civil Rights Act of 1964, and in conjunction with the filing of
applications for assistance under Chapter 49, Code of Federal Regulations - Section 5307, that
the applicant give an assurance that it will comply with Title VI of the Civil Rights Act of 1964 and
the U.S. Department of Transportation requirements thereunder; and
WHEREAS, it is the goal of the applicant that disadvantaged business enterprise be utilized to the
fullest extent possible in conjunction with this project, and that definitive procedures shall be
established and administered to ensure that disadvantaged businesses shall have the maximum
feasible opportunity to compete for contracts when procuring construction contracts, supplies,
equipment contracts, or consu~ant and other services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY,
IOWA, AS FOLLOWS:
1. That the City Manager is authorized to execute and file an application on behalf of the City
of Iowa City with the U.S. Department of Transportation, to aid in the financing of
transit operations pursuant to Section 5307, 5309, 5310, 5316 and/or 5317, Code of
Federal Regulations - Chapter 49.
2. That the City Manager is authorized to execute and file with said application an assurance
or any other document required by the U.S. Department of Transportation effectuating the
purposes of Title VI of the Civil Rights Act of 1964.

RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE WASTEWATER DIVISION
OF THE PUBLIC WORKS DEPARTMENT AND THE AFSCME PAY PLAN
WHEREAS, Resolution No. 06-73, adopted by the City Council on March 7, 2006, authorized
permanent positions in the Public Works Department for FY07; and
WHEREAS, Resolution No. 04-131 adopted by the City Council on May 4,2004, established a
classification/compensation plan for AFSCME employees; and
WHEREAS, a review of the activities and tasks in the Wastewater Division indicates that a
restructuring of current positions will allow the Division to provide better services to the City and
the public; and
WHEREAS, current vacancies in the Division offer the opportunity to make these changes.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA THAT:

RESOLUTION ESTABLISHING CLASSIFICATION/COMPENSATION PLANS
FOR CONFIDENTIAUADMINISTRATIVE EMPLOYEES AND EXECUTIVE
EMPLOYEES FOR FY08, FY09, and FY10
WHEREAS, the City of Iowa City employs certain employees referred to as Confidential,
Administrative, and Executive personnel;
WHEREAS, it is necessary to establish position classifications and compensation ranges for
said personnel;
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA
CITY, IOWA THAT Confidential/Administrative and Executive employees shall receive
compensation as established by the FY08, FY09, and FY10 Confidential/Administrative and
Executive Classification Compensation Plans as attached.
