(2) CONSIDER MOTION APPROVING FIRE STRATEGIC PLAN.
Comment: A copy of the plan was distributed to the City Council in their
informational packet of June 27, 2002. The 10-Year Strategic Plan
represents the culmination of the department's three-phase planning
process that began in 1997. The plan contains goals that will provide
direction for the delivery of community fire protection and emergency
response services. A discussion of the plan was held at Council's work
session on August 19.

(SEPTEMBER 10) AND PLACE FOR HEARING ON PROPOSED
CIVIL PENALTY OF $300.00 AGAINST K-MART.
Comment: This Resolution sets the time, date and place for a hearing on
a proposed $300.00 civil penalty, authorized by Iowa Code section
453A.22(2), against K-Mart, 901 Hollywood Blvd. Iowa Code section
453A.22(2) authorizes a $300.00 civil penalty against a retail cigarette
permit holder whose employee has been convicted of or pled guilty to
selling or providing tobacco to a minor.

FOR A MEETING ON THE PROPOSITION TO ISSUE NOT TO
EXCEED $10,000,000 WATER REVENUE BONDS.
Comment: This resolution sets a public hearing for 7:00 p.m. on
September 10, 2002, to receive public comment regarding the issuance of
$10,000,000 Water Revenue Bonds and authorizes the City Clerk to
publish the Notice of Hearing. Proceeds from the bonds will pay for costs
associated with the new Water Treatment Plant, Bloomington Booster
Station, Iowa River Power Dam, and extension of watermains.

FAMILY HOME LOCATED AT 1821 B STREET AND SETrlNG A
PUBLIC HEARING FOR SEPTEMBER 10, 2002.
Comment: The Iowa City Housing Authority proposes to sell 1821 B
Street. The amount of the sale is $210,000, which is the appraised value
of the home. The home is a Universal Design house, which is an
accessible and barrier-free design that meets the needs of everyone,
notwithstanding age, size, ability or disability throughout their life span.
Staff is recommending selling the home to two Iow-income individuals who
can immediately benefit from the design features. The individuals have
received a written commitment for a mortgage from a local bank in the
amount of $110,000. The City will provide second and third mortgages to
ensure the affordability of this home for the remaining $100,000.

FAMILY HOME LOCATED AT 3410 SHAMROCK DRIVE TO THE
TENANT AND SETTING A PUBLIC HEARING FOR SEPTEMBER 10
Comment: The Iowa City Housing Authority, under its Tenant-to-
Ownership Program, proposes to sell 3410 Shamrock Drive to the
present tenant. The amount of the sate will be the appraised value of
the home, which is $124,000.00. The family has participated in the
public housing program since 1998, has lived in this unit since January
2000, and has taken excellent care of the home during this time. The
family has received a written commitment for a mortgage from a local
bank in the amount of $99,200.00. The City will provide a second
mortgage for the remaining $24,800.00. This sale will provide the
opportunity for a Iow-income ramify to obtain ownership of their own
home.

(5) CONSIDER A RESOLUTION OF INTENT TO CONVEY A SINGLE
FAMILY HOME LOCATED AT 244 AMHURST STREET TO
A PUBLIC HOUSING PROGRAM TENANT AND SETTING
A PUBLIC HEARING FOR SEPTEMBER 10.
Comment: The Iowa City Housing Authority, under its Tenant-to-
Ownership Program, proposes to sell 244 Amhurst Street to a public
housing program tenant. The amount of the sale will be the appraised
value of the home, which is $120,000.00. The family has participated in
the public housing program since 1996. Due to a recent inheritance, the
family will be making a down payment of $25,000.00 and has received a
written commitment for a mortgage from a local bank in the amount of
$65,000.00. The City will provide a second mortgage for the remaining
$30,000.00. This sale will provide the opportunity for a Iow-income family
to obtain ownership of their own home.
(6) CONSIDER A RESOLUTION OF INTENT TO CONVEY A
SINGLE FAMILY HOME LOCATED AT 2409 ASTER AVENUE AND
SETTING A PUBLIC HEARING FOR SEPTEMBER 10.
Comment: The Iowa City Housing Authority, under its Affordable Dream
Home Program, proposes to sell 2409 Aster Avenue. The amount of the
sale will be $95,000, which is the appraised value of the home. The family
began receiving Section 8 rental assistance through the Iowa City Housing
Authority in December 2000. The family will be contributing $1,400 for the
down payment and has received a written commitment for a mortgage
from a local bank in the amount of $85,500. The City will provide a second
mortgage for the remaining $8,100. This sale will provide the opportunity
for a Iow-income family to obtain ownership of their own home.
f. Resolutions.
(1) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE
CONSTRUCTION OF THE RIVERSIDE FESTIVAL STAGE SEATING
PROJECT.
Comment: On September 25, 2001, a contract was entered into with All
American Concrete Company of West Liberty to construct a concrete
floor with drainage and electrical conduit at the Riverside Festival Stage
in City Park in preparation for permanent seating to be installed. The
total contract amount is $105,000. All work covered by the contract has
been completed, all required paper work has been submitted and all
invoices have been paid, other than a 5% retainage.
(2) CONSIDER A RESOLUTION ACCEPTING THE WORK FOR THE
HIGHWAY 1 AND SUNSET STREET INTERSECTION IMPROVEMENTS
PROJECT.

OUTLOT N TO THE CITY OF IOWA CITY AS PLATI'ED IN WINDSOR
RIDGE PART NINE, IOWA CITY, IOWA.
Comment: The Developer's agreement for Windsor Ridge Part Nine
contemplated the dedication of Outlot N to the City of Iowa City for public
use upon completion of construction on 90% of the lots surrounding the
outlot, the installation of ADA compliant walkways, landscaping and
groundcover within the area, and other public improvements. As these
requirements have now been met, the Parks and Recreation Department
recommends acceptance of the property for public use.

Comment: The owner of the property located at 2316 Hollywood
Boulevard received assistance through the City's Housing Rehabilitation
Program totaling $15,715. The financing was in the form of conditional
occupancy loans. The loans have been paid off; thus the lien can now
be released.

Comment: The owner of the property located at 631 North Dodge Street
received assistance through the City's Housing Rehabilitation Program
in the amount of $15,300. The financing was in the form of a Iow
interest loan. The balance of the loan was paid off July 31, 2002; thus
the lien can now be released.

Comment: The owners of the property located at 420 East Jefferson
Street received assistance through the City's Rental Rehabilitation
Program in the amount of $15,678.78. The financing was in the form of
ten-year declining balance loans. The balance of the loans has been
paid off; thus the lien can now be released.
(8) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN
REGARDING TWO STATEMENT OF LIFE LIEN PROMISSORY
NOTES AND A MORTGAGE FOR THE PROPERTY LOCATED AT

Comment: The owner of the property located at 2124 Western Road
received assistance through the City's Housing Rehabilitation Program
in the amount of $11,630. The financing was in the form of two
Statement of Life Lien Promissory Notes and a Mortgage. The loans on
the property are being consolidated into one Mortgage for the same
amount; thus the lien can now be released.
(9) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN

Comment: The Design Review Committee reviewed the application for

ITEM 5. PLANNING AND ZONING MATTERS.
a. Consider a motion setting a public hearing for September 10 on an
ordinance amending the preliminary Planned Development Housing Overlay
(OPDH-12) plan for Lot 259 of Windsor Ridge, Part 15, Glen Brook
Condominiums, a 46-unit residential development at the intersection of
Court Street and Camden Road. (REZ02-00011)
Comment: At its July 18 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of the amended OPDH-12 plan. The
amended plan will allow the addition of 4 townhouse style units on lot 259.
Staff recommended approval in a report da, ted July 18.
Action:
b. Consider a motion setting a public hearing for September 10 on an
ordinance amending the Zoning Code, Section 14-6H-1, General Industrial
Zone, to allow repair of commercial and industrial trucks as a provisional
use.
Comment: At its August 1 meeting, by a vote of 6-0, the Planning and
Zoning Commission recommended approval of this amendment to the
Zoning Code. Staff recommended approval in a report dated August 1.
Action:
c. Consider an ordinance changing the zoning designation from Medium
Density Single Family Residential, RS-8, to Planned Development Housing
Overlay, OPDH-8, for Windsor Ridge, Part 16, a 31.1-acre, 10-lot

Comment: As part of the original approval of the water plant project, the City
Council directed that a public art component should be part of the project and
funded by the project. $50,000 has been designated for the public art. The
Public Art Advisory Committee, at their meeting of August 1, 2002 authorized
the drafting of a Call to Artists soliciting artists from the state of Iowa to submit
qualifications and proposals for a sculpture on the water plant site.

Comment: At their July 16 meeting, the Deer Task Force, by a vote of 7-0 (1
absent, 1 vacant), recommended approval of the 2002-2003 Deer Management
Plan. The Plan consists of continuing to gather data as well as educational
initiatives. The result of three consecutive years of sharpshooting is a
substantial decrease in Iowa City's deer population. The number of deer, the
stabilization of deer-vehicle accidents, and a significant decrease in resident
complaints led to the recommendation in this year's plan of no deer kill.

BUREN STREET FROM FOUR TO FIVE LANES ON BURLINGTON STREET.
Comment: Burlington Street between Gilbert Street and Van Buren Street has
been identified as a high collision area in Iowa City. This project will add a two-
way left turn lane between Gilbert Street and just west of Johnson Street. It will
also provide funding to also widen the bridge near Van Buren Street from 4 to 5
lanes. The Engineering Division has estimated the cost of the project to be
$201,000 and the Iowa DOT has safety funds for which this project qualifies. If
the grant is not awarded, the bridge will be reconstructed at the same width and
no two-way left-turn lane will be added.

Comment: This resolution approves the FY2003 agreement for provision of
fixed route transit service within the corporate limits of the City of University
Heights. The total cost of the FY2003 contract is $27,411. This is a 4.6%
increase from the FY2002 agreement. Future agreements will be determined by
whatever the amount that the national consumer price index [CPI] is at the end
of the calendar year. The City of Iowa City's Finance Director has agreed to use
the CPI as the index for determining the cost increase for transit service for the
City of University Heights in future years.

the three-year contract. Big 10 University Towing, Inc. will provide towing and
storage services for vehicles impounded due to traffic violations, abandonment,

in the best interests of the citizens of Iowa City, the University and the City had
previously negotiated an agreement for the sharing of costs associated with
maintaining the system. The prior 28E agreement has expired, and a new
agreement has been negotiated on similar terms with a provision to address
increased costs. This Resolution authorizes the execution of the Chapter 28E
Agreement for emergency radio communications between the City and The

Comment: The City of Iowa City must acquire permission from the Iowa
Interstate Railroad, CRANDIC Railroad, and the State of Iowa to allow
placement of copper and fiber optic conduit within their property in connection
with the Voice Communications Upgrade project. This resolution authorizes the
Mayor to sign the necessary permits/agreements.
