Notice is hereby given that a public hearing
will be held by the City Council of Iowa City,
Iowa, at 7:00 p.m. on the 16th day of July, 2002,
in Harvat Hall, 410 E. Washington Street, Iowa
City, Iowa, or if said meeting is cancelled, at the
next meeting of the City Council thereafter as
posted by the City Clerk; at which hearing the
Council will consider:
1.) An ordinance changing the zoning
designation from Medium Density Single
Family, RS-8, to Historic Preservation
Overlay-Medium Density Single Family, OHP-
RS-8, designating 3 acres of property located
at 747 West Benton Street an Historic
Landmark. (REZ02-00005)
2.) An ordinance changing the zoning
designation from General Industrial, I-1, to
Intensive Commercial, C1-1, for 1.34-acres
located west of Riverside Drive south of
Commercial Drive. (REZ02-00007)
3.) An ordinance changing the zoning
designation from Medium Density Single-
Family, RS-8 and Low Density Multi-Family,
RM-12 to Planned Development Overlay,
OPDH-20 to allow 43 elder congregate
housing units on 2.12 acres of property
located north of Benton Street and east of
George Street. (REZ02-00009)
4.) An ordinance amending an OPDH-12
plan for Silvercrest to allow four 4-unit
townhouse style buildings and four 24-unit
independent riving buildings for elderly

The public hearing was previously before the council at its meeting on July 16, 2002.
The public hearing was continued at that time for the sole mason that the parties
Gary J. Schmit were working on minor modifications to the Conditional Zoning Agreement. The
only public input at the council's July 16th meeting was from Gary Watts on behalf
Margaret R Winegarden of the applicant.
Julie L. Pulkrabek The final details of the Conditional Zoning Agreement have now been worked out
and we anticipate the Agreement to be in final form by the council's meeting on
John E. Beasley August 20th. Because the public hearing was continued for the sole mason of
finalizing the Conditional Zoning Agreement, the applicant, Arlington, L.C.,
Michael J Pugh* respectfully requests that the council also have its first reading of this matter after
closing the public hearing to avoid an unnecessary delay of this project. We do not

Re: Diane Williamson - Offer to Purchase Right-of-Way
Located adjacent to Highway 1 West in Iowa City, Iowa
Dear Members of the Council:
As you are aware, Diane Williamson has made an offer to acquire the right-of-
way located between the real estate owned by her upon which Carousel Motors
operates and Highway 1. While the offer does not provide for cash payment to the
City, we believe it confers a benefit upon the City substantially in excess of any value
that such right-of-way has. Since 1991, the City has discussed with Williamsons the
vacation of the subject right-of-way. During that period of time Carousel Motors has
maintained the road by plowing snow. It is truly a road that the City does not need nor
want. The road goes nowhere and serves no property other than that owned by
Mrs. Williamson. The City staff has expressed concerns for a number of years about the
safety of the intersection where this road adjoins Highway 1 and Ruppert Road and
clearly would prefer that the entrance to Carousel Motors and the proposed Nissan
building be located farther south on Ruppert Road.
In consideration of the vacation of the right-of-way and transfer of it to
Mrs. Williamson, she, Autohaus, Ltd. (Carousel Motors) and Williamson Nissan are

agreeing to move the entrance to the auto dealerships south on Ruppert Road to a
location that the City staff has approved. They also have agreed to extensively
landscape the front of the property. Those landscape plans have also been submitted to
the City. As shown by the attached letter from Knutson Construction Services, the cost
of this proposal is in excess of $100,000.00.
The right-of-way in question has no value to anyone other than Mrs. Williamson
and her tenants. It cannot be built upon or used for any purpose by any third party. If
the right-of-way is not vacated and conveyed to Mrs. Williamson, it will continue as a
public street servicing Carousel Motors and the new Nissan store. Access to both of
those businesses will remain as it is currently.
The assessed value of the Williamson property (land only) is $831,500.00. The
total area of that real estate is 279,655.2 square feet. This translates into a value of $2.97
per square foot. The right-of-way proposed to be vacated has an area of 32,710 square
feet. If one uses the assessed value of the current Williamson real estate to value the
right-of-way, the result is 32,710 square feet times $2.97 which equals $97,148.00. We
believe, however, that grossly overvalues the property.
Within the past year this Council considered and approved the vacation of a
portion of Benton Court to Christian Retirement. An appraisal was prepared by Hal
Kleinsmith in connection with that vacation. Like the current right-of-way, the Benton
Court right-of-way was not buildable. In connection with his appraisal, Kleinsmith
reviewed other right-of-way sales that the City has made. The range of values reflected
was from 2 to 34 percent of the value of adjacent land. He opined that the portion of
Benton Court being vacated was in the bottom range of 2 to 10 percent of the indicated
fair market value because of size, location and appeal. We strongly believe that the
same factors place this property in the bottom range of those values.
Thus, if we assume the property is worth 10 percent of the value of the adjacent
land, that value would be $97,148.00 times 10 percent which equals $9,715.00. If it is
2 percent, the value would be $1,943.00. Even if one assumes the value to be 34 percent
of the adjacent property, the value of the right-of-way would only be approximately
$33,000.00. Under any of these valuations, the City is clearly receiving more benefit
from the improvements that Mrs. Williamson has agreed to make than the value of the
right-of-way.

vacation and accept the offer of Mrs. Williamson to acquire the right-of-way.

Dear Kylc,
Knutson Constxucdon Services is pleased to submit our proposal for hh¢ work involved with
vacating the frontage road.
We propose to perform the work for a price of $100,420.00.
This proposal is based on MMS site plan dated 0,:/26/02 ami the Suburban Landscape plan dated
June 2002.
Summary of work: Closing off the existing en~xance off of Ruppert Road and creating the new
entrance to the south of thc existing entrance; removing the existing island between the paxkmg
lot and thc frontage road and installing a new island for landscaping and installing new paving.
The work includes saw cutting existing paving, removal of existing curbs and pavement,
excavation, site fill, grading, backfill behind curbs and in planters, new curbs and pavement,
striping, and landscaping.
