Atkins, Task Force Chairperson Sale, and HIS Director Boothroy present for discussion. Majority of Council directed staff as follows: Council Legislative Policy Issues 1. Adopt an ordinance increasing fines for municipal infractions involving nuisance violations. COUNCIL DIRECTION - PROVIDE LIST OF MUNICIPAL INFRACTIONS AFFECTED 2. Establish a citizen committee to advise staff. COUNCIL DIRECTION - CITY MANAGER WILL PROVIDE A MEMO FOR MAKE UP OF CITIZENS COMMITTEE FOR NEXT WORK SESSION 3. Adopt an ordinance amending parking to require cars be parked at least three (3) feet from driveways. COUNCIL DIRECTION - HOLD 4. Adopt a resolution to move all single-family and duplex rental units to a two-year permit review cycle. COUNCIL DIRECTION - HOLD FOR BUDGET DISCUSSION 5. Adopt an ordinance requiring rental permits to be posted on rental propedies. COUNCIL DIRECTION - NOT IN FAVOR OF PURSUING 6. Adopt an ordinance with mandatory lease addenda specifying occupancy limits and other terms. COUNCIL DIRECTION - PROCEED AS OUTLINED 7. Revise the Housing Code notification requirements to allow verbal notification for violations requiring immediate action (e.g., blowing trash). COUNCIL DIRECTION - PROCEED OPERA TIONAL ISSUES/POLICIES 8. Direct City Manager to initiate promotional and educational effods to detail initiatives, emphasizing City Council's suppod and need for cooperation of the City, County and coud officials. COUNCIL DIRECTION - PROCEED 9. Direct City Manager to direct police to issue citations in disorderly house occurrences more frequently, and, where appropriate, on the first call. Direct police to develop program for notifying landlords at the time of violation. COUNCIL DIRECTION - PROCEED Council Work Session August19,2002 Page 2 10. Direct City Manager to develop procedures for police and housing inspection to keep complaint records up to date and keep each other apprised of activities related to properties, particularly disorderly house, criminal activity, over-occupancy and other housing-related issues. COUNCIL DIRECTION - PROCEED 11. Direct City Manager to direct police to consider increased patrols of neighborhoods experiencing disorderly house and criminal complaints. For example, foot patrols in near-town neighborhoods between 2-3:00 a.m. COUNCIL DIRECTION - PROCEED 12. Direct City Manager to direct police to utilize the municipal infraction process to cite properties in violation of zoning and housing codes. COUNCIL DIRECTION - PROCEED AND PROVIDE LIST OF DIFFERENT ISSUES CURRENTED CITED BY POLICE VERSUS THOSE BY HIS 13. Direct City Manager to direct Police, Housing Inspection, and Legal to enforce codes pro-actively, rather than awaiting complaints. COUNCIL DIRECTION - PROCEED 14. Direct City Manager to direct Housing Inspection to develop a process to identify and address properties that are subject to numerous complaints. COUNCIL DIRECTION - PROCEED 15. Direct City Manager to direct Legal staff to work with County Attorney and U.S. Attorney for future actions in appropriate (drug-related) cases. COUNCIL DIRECTION - LOOK AT BUT NOT A HIGH PRIORITY 16. Direct City Manager to direct Legal staff to work with Housing Inspection staff to urge property owners to make use of the clear and present danger provisions of the State Code. COUNCIL DIRECTION - PROCEED 17. Direct City Manager to direct Housing Inspection to develop a policy to alleviate blowing trash problems, including requiring newspaper deliveries to be made to porches or inside multifamily units, and be bound and bagged. COUNCIL DIRECTION - PROCEED 18. Direct City Manager to consider a process for reporting unpaid fines to credit agencies. COUNCIL DIRECTION - PROVIDE COLLECTION AGENCY POLICY PRESENTLY USED FOR UNPAID FEES 19. Direct City Manager to establish an amnesty day for disposal of large appliances and furniture, perhaps twice a year. COUNCIL DIRECTION - PROCEED 20. Direct City Manager to direct Planning and Zoning staff to include mandatory participation in Good Neighbor Policy in zoning code revisions. COUNCIL DIRECTION - DIRECT PCD TO INCLUDE IN ZONING CODE PROVISIONS CURRENTLY BEING PREPARED 21. Direct City Manager to direct staff to develop information packets for landlords/property managers that cover... (variety code enforcement, tenantJlandlord info). COUNCIL DIRECTION - PROCEED WORKING ON 22. Direct City Manager to direct staff to work with University of Iowa administration to create rental information packet for students/tenants. COUNCIL DIRECTION - PROCEED DISCUSSING WITH UNIVERSITY 23. Direct City Manager to direct Housing Inspection staff to revise rental permits to include occupancy limits, name/contact information, and permit posting requirement. COUNCIL DIRECTION - PROCEED MINUS POSTING REQUIREMENTS 24. Direct Planning and Zoning staff to develop pilot residential permit parking program, of three to five years in length, issuance of permits should be tied to occupancy limits and payments of outstanding fines to City. COUNCIL DIRECTION - PROCEED Council Work Session August19,2002 Page 3 OTHER ISSUES 25. Develop a code enforcement web page designed specifically for neighborhood and tenant questions/issues. COUNCIL DIRECTION - PROCEED ADDITION TO CONSENT CALENDAR AGENDA Council agreed to add a resolution approving the Public Housing Assessment System Management Operations Certification of the Iowa City Housing Authority for FY02. JOINT MEETING WITH AIRPORT COMMISSION (IP2 of 8/15 Info Packet) Commission Members Mark Anderson, Rick Mascari, Michelle Robnett, and Alan Ellis present. Airport Mgr. O'Neil also present for discussion. Majority of Council agreed to the following: · Understanding that Finance Department and Airport Commission will work together to ensure airport finances are tapped directly into City's financial system and all controls applied to other City money are applicable to the airport money · Increased communication between the City Manager and Airport Manager · Ask Airport Commission to direct Airport Manager to keep City Manager updated · Prepare timeline for Council on business plan and/or vision plan and/or strategic plan STAFF ACTION: City Manager and Airport Manager will prepare a proposal on the strategic plan, (Atkins) DINNER BREAK PLANNING & ZONING ITEMS PCD Director Franklin presented information on the following items: A. Setting a public hearing for September 10 on an ordinance amending the preliminary Planned Development Housing Overlay (OPDH-12) plan for Lot 259 of Windsor Ridge, Part 15, Glen Brook Condominiums, a 46-unit residential development at the intersection of Court Street and Camden Road. (REZ02-00011) B. Setting a public hearing for September 10 on an ordinance amending the Zoning Code, Section 14-6H-1, General Industrial Zone, to allow repair of commercial and industrial trucks as a provisional use. C. Ordinance changing the zoning designation from Medium Density Single Family Residential, RS-8, to Planned Development Housing Overlay, OPDH-8, for Windsor Ridge, Part 16, a 31.1-acre, 10-lot subdivision located north of Camden Road and south of Lower West Branch Road. (REZ02-00006) D. Ordinance changing the zoning designation from General Industrial, I-1, to Intensive Commercial, C1-1, for 1.14-acres located west of Riverside Drive south of Commercial Drive. Ordinance changing the zoning designation from Low Density Single Family, RS-5, to Planned Development Housing Overlay, OPDH-5, to allow 23 single-family lots and 13 townhouse-style units in Village Green, Part XXII, a 9.31-acre 24-1ot residential subdivision located west of Scott Boulevard and north of Wellington Ddve. (REZ02-00008) (First Consideration) F. Ordinance changing the zoning designation from Medium Density Single Family, RS-8, to Historic Preservation Overlay-Medium Density Single Family, OHP-RS-8, designating 3 acres of property located at 747 West Benton Street a Historic Landmark. (REZ02-00005) (Second Consideration) G. Ordinance amending the Planned Development Housing (OPDH-12) preliminary plan for Silvercrest to allow four 4-unit townhouse style buildings and four 24-unit independent living buildings for elderly residents on 12.18 acres located east of Scott Boulevard and south of American Legion Road. (REZ02-00002) (Second Consideration) H. Ordinance vacating 32,710 square feet of frontage road right-of-way along the front of the property at 801 Highway 1 West. (VAC02-00001) (Pass and Adopt) PCD Director Franklin and City Atty. Dilkes recommended Council defer final reading on the vacation until later in the formal meeting after the public hearing and conveyance (item #8). I. Ordinance changing the zoning designation from Medium Density Single-Family, RS-8 and Low Density Multi-Family, RM-12 to Planned Development Overlay, OPDH-20 to allow 43 elder congregate housing units on 2.12 acres Of property located north of Benton Street and east of George Street. (REZ02-00009) (Pass and Adopt) J. Ordinance changing the zoning designation from Neighborhood Conservation, RNC-20, to Sensitive Areas Overlay-Neighborhood Conservation, SAO-RNC-20, for a 0.41-acre properly located at 341 N. Riverside Drive. (REZ02-00004) (Pass and Adopt) K. Ordinance changing the zoning designation from Low Density Multi-Family Residential, RM- 12, to Sensitive Areas Overlay-Low Density Multi-Family Residential, SAO-RM-12, for Lot 2 of First and Rochester subdivision, Part 1, a 38,041 square-foot property located west of First Avenue, north of Rochester Street. (REZ02-00003) (Pass and Adopt) L. Resolution approving the amended pretiminary plat and final plat of Wild Prairie Estates, Part Four, a 35.86-acre, 24-1ot residential subdivision located north of Goldenrod Drive and west of Duck Creek Drive. Council Member Vanderhoef encouraged the Committee to send a copy of their report to the University and Coralville. 2. (Consent Calendar Item #3b(14) - Senior Center Commission minutes of June 18) In response to Council Member Kanner, the City Mgr. reported that it was his intention to have Council Wo[k Session August19,2002 Page 5 the City cover the cost of the insurance for Kirkwood instructors and independent contractors teaching at the Center as incidental expense. 3. (Consent Calendar Item #3b(1) - Historic Preservation Cq _remission minutes of May 23) In response to Council Member Kanner, the City Mgr. stated he would find out more information about the national versus the local differences discussed regarding the proposed College Hill historic district. 4. (Item #17 - Resolution authorizing application ... grant funds ... widening of the bridge near Van Buren Street ...) Asst. PCD Director Davidson present for discussion. Council Member Kanner requested a summary of accidents in the area of the bridge. 5. (Item #19 - Resolution awarding ... towing and storage services contract ... Big 10 University Towing) City Mgr. Atkins reviewed the history of the contract. 6. (Item #15 - Resolution approving call to artists ... sculpture ... Iowa City Water Plant Site) PCD Director Franklin present for discussion. COUNCIL APPOINTMENTS Airport Commission (1) - Baron Thrower Airpod Zoning Bd. of Adjustment (1) - No applicants, readvertise Airport Zoning Commission (2) - No applicants, readvertise Historic Preservation Commission (1)- Mark McCallum Housing and Community Development Commission (2) - Mark Edwards (3 year term) Morgan Hoosman (unexpired term) FIRE STRATEGIC PLAN (IP3, 4, 5 of 8/15 Info Packet; Consent Calendar #3c(2)) Fire Chief Rocca present for discussion. Majority agreed to proceed. ICPD TRAFFIC STOP PRACTICES (IP14 of 8/8 info Packet) Police Chief Winkelhake and Dr. Angela West, University of Louisville present information. After discussion, a majority of Council requested Dr. West prepare a written response to concerns expressed in a handout from Professor David Baldus on the study. STAFF ACTION: Provide written response from Dr. West to Council. (Winkelhake) COUNCIL PARATRANSIT COMMI'I-I'EE City Mgr. Atkins and Committee Member O'Donnell and Vanderhoef updated Council on negotiations, and requested approval to pursue the design of a City paratransit system.
