Comment: In accordance with City Council direction following staff
discussion at the City Council Work Session of September 10, 2001,
staff have negotiated a purchase agreement with The University of iowa
for the old water plant property for a purchase price of $1,106,000. See
memorandum (Item IP3 in September 6, 2001, Information Packet).

Comment: This Resolution sets the time, date and place for hearing on a
proposed civil penalty of $300.00 against The Summit, 10 S. Clinton
Street, as authorized by Iowa Code section 453A.22(2). Iowa Code
section 453A.22(2) authorizes a $300.00 civil penalty against a retail
cigarette permit holder whose employee has been convicted of or pled
guilty to selling or providing tobacco to a minor. It also authorizes a 30-
day suspension of the retail cigarette permit if there is a second such
violation within a two-year period.

(3) CONSIDER A RESOLUTION AUTHORIZING THE CITY MANAGER TO
~j.~- SIGN A FIRST ADDENDUM FOR A LEASE AGREEMENT FOR
PUBLIC PROPERTY WITH HAWKEYE LUMBER COMPANY FOR
RENTAL OF THE VACATED PORTION OF ALLEY RIGHT-OF-WAY
BETWEEN LAFAYE'I-FE STREET AND BENTON STREET IN IOWA
CITY, IOWA FOR PURPOSES OF STORAGE AND SECURITY.
Comment: On July 28, 1998 the City of Iowa City, Iowa passed an
Ordinance vacating the northern 200 feet of the alley right-of-way
between LaFayette Street and Benton Street, west of Dubuque Street.
Hawkeye Lumber who owns the surrounding property requested that
they be allowed to use and control the subject property ( a 200' x 16'
parcel) for the purposes of storage and security. Resolution No. 98-258
authorized the mayor to sign and the city clerk to attest a lease
agreement for public property with Hawkeye Lumber Company for rental
of the vacated portion of alley right-of-way for a term of three years
ending July 31, 2001 at $200.00 per year, with extensions under the
same terms for additional three year periods upon mutual consent of
both parties. Hawkeye Lumber has requested to extend the lease
agreement. This Resolution authorizes a first addendum to the lease
agreement for a three year period under the same terms as the original
lease agreement (see attached) and further authorizes the City Manager
to execute said addendum and any subsequent addenda.

DEPARTMENT OF TRANSPORTATION FOR
STATE TRANSPORTATION ENHANCEMENT FUNDS.
Comment: This fall, JCCOG, on behalf of the City of Iowa City, is
applying for a grant from the Iowa Department of Transportation's State
Transportation Enhancement program. If funded, this would help fund
the streetscape portion of the Near Southside Transportation Center
project.
(5) CONSIDER A RESOLUTION AUTHORIZING THE

DEPARTMENT OF TRANSPORTATION FOR
STATE TRANSPORTATION ENHANCEMENT FUNDS.
Comment: Last fall, JCCOG, on behalf of the City of Iowa City, applied
for a grant from the Iowa Department of Transportation's State
Transportation Enhancement program to help fund the Dubuque Street
Entranceway Beautification Project. At that time, our project was not
approved for funding. This resolution is a resubmittal of the grant
application.

STATEMENT OF LIFE LIEN FOR THE PROPERTY LOCATED AT
1005 NORTH SUMMIT STREET, IOWA CITY, IOWA.
Comment: The owner of the property located at 1005 North Summit
Street received assistance through the City's Housing Rehabilitation
Program in the amount of $2,000. The financing was in the form of a
conditional occupancy loan. The loan has been paid off; thus the lien
can now be released.
(7) CONSIDER A RESOLUTION ACCEPTING PAYMENT OF $300.00

& GO STORE #51, 323 E. BURLINGTON STREET, IOWA CITY,
PURSUANT TO IOWA CODE SECTION 453A.22(2) (2001).
Comment: This Resolution accepts payment of a $300.00 civil penalty,
authorized by Iowa Code section 453A.22(2), from Kum & Go Store #51,
323 E. Burlington Street, Iowa City. Section 453A.22(2) provides that a
$300.00 civil penalty will be assessed to a retail cigarette permit holder
when and if that permit holder's employee is convicted of or pleads guilty
to selling or providing tobacco to a minor. By making this payment and
signing the appropriate waiver Kum & Go Store #51 waives its statutory
right to have a hearing on whether the civil penalty should be assessed.

Comment: Bill Milhalopoulas, as landowner, and Atlas World Grill, Inc.,
d/b/a Atlas World Grill, seek a license agreement for temporary use of
public right-of-way at 127 Iowa Avenue, Iowa City, Iowa for a sidewalk
cafe. City staff and Design Review have reviewed the plans and
specifications and required submittals and recommend approval of said
agreement.

OF A SANITARY SEWER EASEMENT AGREEMENT
LOCATED ON PROPERTY GENERALLY LOCATED WEST
OF RIVERSIDE DRIVE SOUTH OF COMMERCIAL DRIVE.
Comment: The City possesses a Sanitary Sewer Easement on property
owned by Gringer Feed and Grain, Inc., located west of Riverside Drive
south of Commercial Drive. The City Public Works Department has
determined that the location of the easement needs to be changed to
more accurately match the actual location of the City's sanitary sewer
line on the property. The owner of the property has executed a new
permanent sanitary sewer easement agreement acceptable to the City
Public Works Department and approved by the City Attorney's Office.
The City Public Works Department and the City Attorney's Office
recommend the release of the currently held sewer easement. This
resolution authorizes the release of the 2,606 square foot easement.

amending the Comprehensive Plan to adopt the Southwest District Plan for
the area located generally south of Melrose Avenue, west of the Iowa River,
north of Highway 1 West and east of the Iowa City Landfill.
Comment: At its August 15 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of the Southwest District Plan.

ordinance vacating Grand Avenue Court from Melrose Avenue to a line 295

Comment: At its August 15 meeting, by a vote of 6-1 (Shannon voting no),
the Planning and Zoning Commission recommended approval of the
proposed vacation, subject to the creation of utility easements where
necessary, and subject to agreement by the University of Iowa that it will
comply with the Iowa City Historic Preservation Ordinance regarding the
Cannon-Gay House, a National Register-listed house at 320 Melrose
Avenue. Staff recommended approval in a report dated August 15.

Comment: At its June 20 meeting, by a vote of 7-0, the Planning and Zoning
Commission recommended approval of this preliminary plat. Staff
recommended approval in a memorandum dated June 20. Approval will
allow the redesign of Silvercrest Residential Retirement Community to
comply with the amended OPDH Plan which was approved by Council on
August 20.

NOT TO EXCEED $10,000,000 WATER REVENUE BONDS
Comment: This public hearing is being held to receive public comment
regarding the issuance of up to $10,000,000 Water Revenue Bonds. Bond
proceeds will pay for costs associated with the new Water Treatment Plant,
Bloomington Booster Station, Iowa River Power Dam, and extension of
watermains. The resolution authorizes staff to proceed on behalf of the City
with the sale of the bonds, and to take all action necessary to permit the sale of
said bonds on a basis favorable to the City and acceptable to the City Council.

ITEM 8. CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 1821 B
i~ ?~~~,~ STREET.
Comment: The Iowa City Housing Authority proposes to sell 1821 B Street. The
amount of the sale is $210,000, which is the appraised value of the home. The
home is a Universal Design house, which is an accessible and barrier-free
! design that meets the needs of everyone, notwithstanding age, size, ability or
· disability throughout their life span. Staff is recommending selling the home to
two Iow-income individuals who can immediately benefit from the design

ITEM 12. A $300.00 CIVIL PENALTY AGAINST K-MART, 901 HOLLYVVOOD BLVD,
PURSUANT TO IOWA CODE SECTION 453A.22(2).
Comment: This hearing is the time designated for the Council to consider
whether a Resolution should be adopted assessing the $300.00 civil penalty
authorized by Iowa Code section 453A.22(2) against K-Mart, 901 Hollywood
Blvd. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty
will be assessed to a retail cigarette permit holder when and if that permit
holder's employee is convicted of or pleads guilty to selling or providing tobacco
to a minor. As a part of the hearing, the Council will be provided with
information establishing an employee of permit holder K-Mart was convicted of
or pled guilty to a charge of selling or providing tobacco t o a minor. The permit
holder's representative will then have the opportunity to provide the Council with
information s/he deems appropriate. The Council will then decide whether to
assess the requested civil penalty and, if it decides to do so, will adopt an
appropriate Resolution. The hearing will not provide the opportunity for public
comment.

Comment: This ordinance would ban large trucks from the portion of First
Avenue between Scott Boulevard and D Street. The ordinance exempts
commercial vehicles that have no other means of access to their destination,
school buses, and City emergency and service vehicles. If approved, signage
will be erected indicating that no trucks over 16 tons gross weight are allowed
on First Avenue between Scott Boulevard and D Street. Correspondence

REMOVAL REQUIREMENTS, BUILDING CODE, HOUSING CODE,
ELECTRICAL CODE, MECHANICAL CODE, PLUMBING CODE,

REQUIREMENTS. (FIRST CONSIDERATION)
Comment: The Neighborhood Housing Relations Task Force recommended
Code amendments to increase fines for municipal infractions for code violations
that impact on Neighborhoods. Passage of the ordinance would increase he
fines for first violation to $250, $500 for second offense, $750 for third offense.
This ordinance only increases municipal infraction fines for the code amendments
listed in the ordinance.

Comment: There has not been an increase in fees since April 26, 1994. The
minimum fee for any permit will increase from $25 to $35. Total fees for a
$150,000 single-family dwelling will remain below those charged by neighboring
jurisdictions, as shown in a staff memorandum included in Council packet.
Payments of fees for plumbing, electrical, and mechanical permits for single-
family dwellings have been simplified in response to contractor requests. The
Greater Iowa City Homebuilders Association has been sent a copy of the
proposed fees for their comment. The revised fee schedule would be in effect
October 1, 2002.
