CONSIDER A MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $7,483,279.80 FOR THE PERIOD OF APRIL 1 THROUGH APRIL 30, 2007, AND PURCHASING CARD DISBURSEMENTS IN THE AMOUNT OF $1,981,520.38 FOR THE PERIOD OF JULY 1, 2005 THROUGH APRIL 30, 2007 AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. PURCHASING CARD DISBURSEMENTS WERE INADVERTANTLY EXCLUDED DUE TO SOFTWARE UPGRADES. CONSIDER A RESOLUTION DISSOLVING THE DEER TASK FORCE AND RESCINDING RESOLUTION NO. 07-123. Comment: This past spring Council extended the sunset provision for the Deer Task Force for one (1) year and directed the Task Force to recommend whether a permanent board or commission should be established to address deer management. At its meeting on May 16, 2007, the Task Force voted not to recommend that a permanent board be established. Minutes from the May 16 meeting were in the May 31 information packet. 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING A MORTGAGE AND A PROMISSORY NOTE FOR THE PROPERTY LOCATED AT 1112 WYLDE GREEN ROAD, IOWA CITY, IOWA. Comment: The owner of the property located at 1112 Wylde Green Road received assistance through the City of Iowa City's Downpayment Assistance Program. The terms of the loan have been satisfied; thus the lien needs to be released. 3. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING TWO MORTGAGES FOR THE PROPERTY LOCATED AT 62 REGAL LANE, IOWA CITY, IOWA. Comment: The owners of the property located at 62 Regal Lane, Iowa City, Iowa received assistance through the City of Iowa City's Housing Rehabilitation Program. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONDITIONAL ZONING AGREEMENT WITH TYLER ROGERS, THE OWNER OF PROPERTY LOCATED IN JOHNSON COUNTY, IOWA Comment: Tyler Rogers, owner of approximately three acres on Kansas Road in Johnson County, Iowa, has applied to Johnson County for a residential rezoning and subdivision of the property. The City of Iowa City owns nearby property which is intended for use as an expansion of the landfill. As development of the property will require the installation of a well, and, under IDNR regulations, all landfill operations must be located beyond 1000' of any well, the City and the property owner agree that, upon the City's application for use of the abutting property as landfill, the well will be closed and the City will provide an alternative source of potable water. While the City only acts in an advisory capacity on rezonings in this fringe area, the City is a party to this Conditional Zoning Agreement for enforcement and tracking purposes. This Resolution authorizes the execution of the Conditional Zoning Agreement with Tyler Rogers. f) Correspondence. 1. '07- 1'79 ITEM 7. 0'7- Lfd-.&,5 ITEM 8. o 7-'f:}..b~ City of Iowa City Page 7 APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE MERCER PARK AQUATIC CENTER ROOF REPLACEMENT PROJECT ESTABLISHING AMOUNT OF BID SECURITY, DIRECTING CITY CLERK TO PUBLISH ADVERTISEMENT FOR BIDS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will involve removing the existing roof membrane and replacing with a new roof membrane on the existing aquatic facility at 2701 Bradford Drive. (SECOND CONSIDERATION) Comment: The precinct boundaries affected by this ordinance are those of Precinct'8 and 16. Precinct 8 is to correct an error in the previous ordinance and Precinct 16 is to reflect the annexation of the subdivision known as Windsor Ridge West. Staff recommends expedited action. ~% , 7/0 , CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC" TO DEFINE THE MEANING OF VARIOUS PEDESTRIAN CROSSING SIGNALS. (SECOND CONSIDERATION) Action~:~ IV ~J,'::d;f/ Comment: City code does not currently define the meaning of various pedestrian crossing signals. Staff recommends defining such signals to better inform pedestrians of such signals' meanings and the action pedestrians should take when such signals are present at a crossing. The definitions stated in the proposed amended ordinance are based on the definitions found in the Manual on Uniform Traffic Control Devices, published by the U.S. Department of Transportation. City of Iowa City Page 8 CONSIDER AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "USE OF PUBLIC WAYS AND PROPERTY, " CHAPTER 3, ENTITLED "COMMERCIAL USE OF SIDEWALKS," SECTION 4, ENTITLED "TEMPORARY USE OF SIDEWALK PERMITS" TO INCREASE THE DURATION OF THE TEMPORARY SIDEWALK PERMITS FROM THREE (3) DAYS TO FOUR (4) DAYS. (FIRST CONSIDERATION) Comment: The current City Code allows businesses to get two permits per year for the commercial use of sidewalks for up to three days each. Businesses, for example, participating in "sidewalk" days apply for this type of permit. The Downtown Association of Iowa City has requested that the duration of the permit be increased from three to four days. Staff has no objection to this request. Action: ~~~ ;.51- C- t/ -/, P I r~ 7.,6 / CONSIDER AN ORDINANCE AMENDING TITLE 8, ENTITLED "POLICE REGULATIONS," CHAPTER 5, ENTITLED "MISCELLANEOUS OFFENSES," BY ADDING A NEW SECTION 9, ENTITLED "AMATEUR FIGHTING AND BOXING" TO PROHIBIT AMATEUR FIGHTING AND BOXING AT ESTABLISHMENTS THAT ARE LICENSED TO SERVE ALCOHOL. (FIRST CONSIDERATION) Comment: This ordinance prohibits amateur fighting and boxing in establishments with a liquor license or beer/wine permit. It also prohibits a person from participating in or promoting such an event. The penalties are the maximum allowed. Correspondence with Mayor Wilburn's response included in Council packet. ..Iee ~ Action ~ ~~~~$I' ~ v//: 1Y:,.(2 ~ Ot,(J( ~ ?/'Z' CONSIDER AN O~DINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "USE OF PUBLIC WAYS AND PROPERTY," CHAPTER 11, ENTITLED "FARMER'S MARKET," TO ALLOW FARMERS MARKET VENDORS TO PREPARE AND SELL FOOD IN CHAUNCEY SWAN PARK. (FIRST CONSIDERATION) Comment: The current City Code allows the Farmers Market only to operate within Chauncey Swan ramp. The Farmers Market Advisory Committee, comprised of current vendors, would like to expand the market to the adjacent Chauncey Swan Park to allow up to four (4) vendors to grill and prepare food and beverages (such as lemonade). Staff supports this expansion of the market. Unlike other vendors who operate in the ramp, those in the park will need to obtain insurance just as mobile vendors who operate in City Plaza and on Iowa Avenue. ITEM 13. 01.-) ~D City of Iowa City Page 9 CONSIDER THE FOLLOWING ORDINANCE PROPOSED BY CITIZEN INITIATIVE PETITION: Whereas, it is in the public interest to provide, unless otherwise exempted by law or ordinance, that a person shall have attained legal age (currently 21 years of age or more) to lawfully be on the premises between the hours of 10:00 p.m. to closing of any Iowa City establishment holding a liquor control license, a wine or beer permit, that authorizes on premises consumption. Now, therefore, be it resolved, that Article 4, Chapter 5, Section 8 of the City Code of Iowa City - entitled Persons Under 19 Years of Age in Licensed or Permitted Establishments - shall be modified to replace "nineteen (19) years of age" wherever and however it appears within such Section 8 with "the legal age". (FIRST CONSIDERATION) Comment: On May 30, 2007, the City Clerk certified the sufficiency of the initiative petition proposing a modification of Article 4, Chapter 5, Section 8 of the City Code of Iowa City as set forth above. Pursuant to Article 7 of the City Charter, the City Council must, by July 29, 2007, adopt the proposed ordinance or submit the proposed ordinance to the voters at the regular city election on November 6, 2007. City of Iowa City Page 10 CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE TRANSIT DIVISION OF THE PARKING AND TRANSIT DEPARTMENT AND THE AFSCME PAY PLAN BY DELETING ONE MAINTENANCE WORKER I - TRANSIT BLDG/MAINT POSITION AND CREATING ONE MAINTENANCE WORKER II - TRANSIT BLDG/MAINT POSITION. Comment: The increased level of responsibility and technical skills require to maintain the transit facilities and equipment require a more skilled worker than a Maintenance Worker I position. It is recommended that this position be replaced by a Maintenance Worker II position with hiring requirements commensurate with the level of skill needed. The Maintenance Worker I position is currently vacant which offers the opportunity to make this change prior to filling the position. Addition annual cost for FY08 is $2,000. Action: ~/~~ ~7/C / CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CLERK TO ATTEST TO AN AGREEMENT TO LEND BERRY COURT LIMITED PARTNERSHIP $320,000 TO PRESERVE 14 UNITS OF AFFORDABLE HOUSING Comment: At the April 16, 2007 Council meeting, Resolution 07-128 was passed that authorized the issuance of General Obligation Bonds to provide a loan to The Housing Fellowship to preserve 14 units of affordable housing as part of a Low- Income Housing Tax Credit project. To meet the requirements of the tax credit program, The Housing Fellowship set up a for-profit entity. Berry Court Limited Partnership was formed with The Housing Fellowship as the General Partner. Berry Court Limited Partnership will acquire, substantially rehabilitate and maintain a 30-year affordability period for the 14 units. Action: ~/~~~~ CO~~ ;7/b / June 19,2007 ITEM 16. FROM IOWA CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT - ECONOMIC DEVELOPMENT FUND AND AUTHORIZING THE CITY MANAGER TO ACT AS CHIEF ADMINISTRATIVE OFFICER AND SUBMIT ALL NECESSARY DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Comment: On May 29 the City Council Economic Development Committee recommended $35,000 in funding for this project. The Council Economic Development Committee has recommended that these funds be as a loan at 3.2% interest for a term of 7 years. Due to high owner commitment to the business, a strong recommendation from their commercial lender and the owner's history of paying the obligations entered, the committee recommended funding this business without security. Said project will retain one full-time equivalent position for a low-moderate income person. Staff memorandum included in Council packet. Agreements are also being signed with University Heights and the University of Iowa. City of Iowa City Page 13 AMENDING CITY CODE TITLE 7, ENTITLED FIRE PREVENTION AND PROTECTION, AND TITLE 17, ENTITLED BUILDING AND HOUSING TO ESTABLISH FIRE AND LIFE SAFETY REQUIREMENTS FOR NEW AND EXISTING GROUP A-2 AND B OCCUPANCIES. Comment: On March 5, 2007 The Board of Appeals recommended, by unanimous vote, to approve the proposed amendments to the international Building/Fire Codes that requires existing A-2/B Occupancies with State of Iowa Alcoholic Beverage Division License (ABDL) to be retrofitted with a fire sprinkler system and a fire alarm system with voice alarm capabilities. Also, the Board recommended that all new A-2 Occupancies, when the occupant load is 100 or more, have a fire sprinkler system, a fire alarm system with voice alarm capabilities, and exit widths that will accommodate two-thirds (2/3) of the occupant load. The recommendations are contingent on a City- supported financial incentive program. A memo and revised summary of the proposed ordinance as discussed at the Council meeting of 6/5/07 is included in the Council packet.
