Dear council,
My name is Kirby Lackman. I am a junior at West High School in Iowa City. I am taking a goverment
class and we are studying local problems, how they are dealt with by government, and how citizens can
participate in their government.
The problem I am studying is Iowa's lack of a motorcycle law. Some of the problems associated with
this are: serious injury, limits money intake, insurance premium rises, and its burden on tax payers.
I am responsible for finding out information about the problem to share with my class. I was wondering
if you could answer a few questions for me by Friday, June 1st by 11 :OOam. If you are not able to I
would appreciate a reply.
Here are some questions I would like you to answer for my project and you do not have to answer all if
you do not have time, but a few would be helpful:

Dear Mr. Wilburn,
We are writing this letter asking you to reconsider the decision regarding opening
Buckingham Lane for through traffic.
Our homes are located on Buckingham Lane in the Windsor Ridge subdivision. It is a
short and quiet, no outlet street, with 17 single-family houses. Buckingham Lane
starts at Arlington Street and dead ends right where the former Fairview Golf course
was. Residents on our street are very concerned about the City of Iowa City's
decision to continue Buckingham Lane to American Legion Road. Each household
has on average 2-3 young children, and most of them are elementary school students.
At present, Buckingham Lane is a nice and safe zone for them to run, play and ride
their bikes and scooters. There are also pleasant and non-polluted walking trails
enjoyed by many in the Windsor Ridge neighborhood. Former Fairview Golf Course
was (and still is!) a beautiful and calm place to enjoy Mother Nature in relative
distance from traffic and pollution. It has gorgeous hills and trees.
We understand that due to the purchase of the golf course homes will be built there
someday. When the residents of Buckingham Lane either built or bought their houses
on this street just a few years ago, they had no idea that negotiations were occurring
to purchase the golf course. Our decision to live on Buckingham Lane was because it
was a no outlet street and would be a safe place for children. Taking into
consideration the proximity to the place that can be treated as a "park zone", it would
be nice to keep it as a small park in contrast to turning it into a busy street.
It was a big surprise for many of us to find out that according to the new plan
Buckingham Lane will soon become a "short cut" street connecting with American
Legion Road. We don't recall being asked to comment on the proposal to connect
Buckingham Lane at a meeting or public hearing. On January 16, 2007 at its annual
meeting Windsor Ridge Home Owners Association voted not to include Windsor
West as a part of the original Windsor Ridge Homeowners Association. We are a
separate community from Windsor West and therefore our question is: Why our street
has to be extended to connect Windsor Ridge with Windsor Ridge West?
Iowa City is known as a nice and safe place to live and raise children. We are greatly
concerned that increased traffic through our street might compromise our safety and
security, escalate cases of burglary and motor-vehicles accidents and increase
pollution of this area.
We strongly believe that opening our street (Buckingham Lane) for through traffic
will not bring any major benefits to Iowa City or to the Windsor Ridge community,
and will instead jeopardize our neighborhood's safety and well being. We do not want
to see buses or speeding cars going trough our quiet street.
We therefore ask you to reconsider previously made decision to open Buckingham
Lane for through traffic.

Dear Mr. Millsap and Mr. and Mrs. Usachev:
I have received your letter of May 29, 2007 expressing your desire to not have
Buckingham Lane opened to through traffic from American Legion Road.
The development known as Windsor West was brought before the City in 2005 for
annexation, zoning, and plat approval. On two occasions, in August and in
September of 2005, the following people on Buckingham Lane were notified first of
the annexation and zoning proposal, and subsequently of the plat consideration:
Yuriy and Marina Usachev, Steven and Joanne Young, Scott and Patricia
Hansche, Roger and Cheryl Rossetti, Dale and Lynette Arens, and Bart and Julie-
Jean Floyd. These notifications are sent to enable neighbors to voice their
concerns as a development proposal is being considered at the earliest stages by
the City. There are then public meetings and hearings before the Planning &
Zoning Commission and the City Council.
Our records indicate the only public input received was from residents of Far
Horizons, who supported the RS-5 zoning of the property.
At this point in time the owners of the land have relied upon the actions of the City
to zone this property for single-family development and approval of the preliminary
and final plat. For the City Council to refuse to open the road now or to require
replatting of the streets would put the City in a precarious legal position.
Regardless of these issues of notice and legal constraints, Buckingham Lane was
one of two streets that could provide continuity in the street pattern in your
neighborhood. Buckingham Lane and Cumberland Lane were stubbed to the west
boundary of Windsor Ridge when it was platted to indicate the intention to
continue these streets to the west.
The Buckingham Lane configuration in Windsor West was selected by the
developer based on the topography of the area and the ability to develop the
remainder of the parcel. Cumberland Lane also connects to Buckingham and
ultimately to American Legion Road. With the platting of Windsor West, the City
required additional streets to be stubbed to the west on that plat to provide
continuity of streets in the neighborhood and interconnections with the property to
its west.
Buckingham Lane is designed as a local street and should carry traffic
generated by the neighborhood. Although the Windsor Ridge Homeowners
Association has chosen not to include Windsor West in your association,
geographically Windsor West and Windsor Ridge are all in the same
neighborhood. Connectivity within and between neighborhoods is a basic
principle in our adopted Comprehensive Plan for the city. Given that most of the
traffic on this road will be from residents of the neighborhood, as a staff we
can not recommend terminating Buckingham Lane such that it does not provide
continuity within your neighborhood.
Although we do not believe volumes or speed on Buckingham Lane will exceed
expected local street conditions, I have enclosed a copy of our brochure on the
Council's neighborhood traffic calming program.

I am writing to bring a dangerous traffic situation to your attention. It involves Market
Street between Governor and Clinton during the single hour from 7:30-8:30 AM, Monday
through Friday. As you know, Market Street is the major route to work for a large
fraction of the east side population. Unfortunately, many commercial vehicles currently
park in the roadway to make deliveries or conduct other business (e.g., construction)
during the peak traffic hour
thereby causing traffic to change lanes repeatedly to avoid them.
Over the past few months, I have witnessed many near collisions between cars, motorcycles
and pedestrians caused by these parked vehicles. I predict that a fatality will occur in
the coming year as a result of this situation.
This fatality could be avoided by an ordinance that prohibits parking in the roadway of
these blocks of Market Street for the hour between 7:30 and 8:30 AM Monday through Friday.
Alternatively, an ordinance that allows parking during this hour but only on one side of
the street (perhaps alternating each day) would at least prevent the numerous lane changes
that are currently necessary to traverse this series of blocks each morning.

I wholeheartedly concur with Ed's recommendation. I drive this every day at around this
time. There is frequently a Pepsi truck blocking the right lane of Market by Mercy
Hospital. Frequently the left lane is blocked by a commercial vehicle next to the
Pappajohn building.
It would be nice if drivers were always calm and patient (as I aspire to be). But the
reality is that I sometimes notice over caffeinated driving around these obstructions.
Statistics, of course, confirm that a disproportionate number of accidents occur at this
time. Pedestrians in Iowa City, of course, wander across the streets more or less at
random, adding to the potentially lethal mix.
I hope Ed is wrong in his prediction, but he has accurately identified a very real risk.

This message was forwarded to me for response. As I stated in my email corresponse on June
1, 2007, in City Code, chapter 9-4-3 Bi 2-b., it states that it is legal for those
vehicles to park there for loading and unloading. I recommended at that time if you would
like a change in City Code to contact your City Councilors which is why we have this
request again.
I have also checked the collision data for the segment of Market Street between Dodge
Street and Madison Street. There have been 8 sideswipe collisions which indicate a vehicle
not merging safely around a parked vehicle in 2004-2006(the latest data available). This
does not indicate a safety issue on this street with vehicles parked for
unloading/loading. I understand this may be inconvenient during peak hours but the rest of
the day is typically fine.
If a majority of City Councilors would like to change the City Code to disallow
loading/unloading during peak hours, we would be happy to do that. Thanks again for your
request and let me know if you need anything else.

Bob: Very refreshing to here your comment in Ch. 9 news Monday night, something to the effect that "you do
not like to be in the business of protecting people from themselves". Of course, the discussion was the
amateur fighting thing. Anyhow, I couldn't agree more.
Also very curious that neither newspaper picked up the comment at all! Ch 9 must not have been editing
very carefully.
When are governmental bodies going to come to some realization that we all have a "right" to do stupid
things, and as long as they don't harm others, its none of their *&^% business! Its not your job too protect me
from myself.

Here is some SOLID facts regarding the Okhlahoma based, wild animal "company, not
sanctuary"
that is performing their stupid, inhumane tiger show at the Sycamore Malll.

To think that a city, as progressive, socially conscious, and liberal as Iowa City is
would allow a company like this to have an event here, during ArtsFest weekened
nonetheless is tacky, socially incorrect, and un-ethical Cruelty towards animals has no
place in Iowa City.
My children were horrified yesterday when we drove through the parking lot and saw a
large, black, semi-trailer, with tigers on it, and some minor crappy air vents and I
informed them, that the tigers were kept in cages....
it made us wonder what it's like to live and spend days in a dark, hot semi trailer? Where
do they use the bathroom? Are stuck in there with their own urine and feces?
How exactly is this helping save endangered animals?
This is an abomination.
I'm disappointed that this has been allowed to occur here.

The USDA has repeatedly cited GW for violating the minimum standards of care set forth in
the Animal Welfare Act (AWA) , and in April 2005 the agency filed a 20-page complaint
against GW with numerous charges, including the
following:
Failure to provide adequate veterinary care Failure to handle animals so that there was
minimal risk of harm to the animal and to the public An incident in which a tiger escaped
from his enclosure and attacked and seriously wounded a camel Transportation of 15 tigers
and lions in a manner that allowed urine, feces, or both to contaminate the animals caged
below Lack of potable water for 18 lions, 23 tigers, 15 bears, 20 cougars, three leopards,
and a pig Lack of employees present to provide care to 80 large, dangerous cats Lack. of
knowledge by employees about how often the animals were fed Filthy, wet, unsafe, and
dilapidated enclosures Failure to handle animals in a manner that does not cause trauma,
behavioral stress, physical harm, or unnecessary discomfort Failure to provide animals
with minimum space To avoid going to court, GW paid a $25,000 fine in January 2006 and was
placed on an l8-month probation period with the USDA. Failure to comply with the AWA
during the probation period will result in license revocation.

This correspondence will become a public record.
Dear Council Members: At a recent meeting of the Northside Neighborhood Association, several residents
expressed frustration over the hours of operation of some of the private garbage collection services. Some of
these garbage trucks are clanging their back-up bells and making a whole lot of noise at 4:00 or 5:00 in the
morning, waking people up and disturbing the tranquility of the early morning hours. Neighbors have tried
contacting the garbage collection services, some of which are from out of town, to little avail.
According to Code 6-4-3-A-1, "No person shall so load, unload, open, close or handles boxes, crates. . . garbage
cans or similar objects outdoors between the hours of 10 PM and 6:00 AM." These operators are clearly violating
Code, but it is more than an enforcement issue.
The Code goes on to state in 6-4-3-A-2 that "No person shall operate construction equipment before 7 AM and
after 10 PM" unless a permit has been obtained by the city engineer. In 6-4-3-B, the Code says that "No person
shall operate or permit the operation of powered model vehicles in a residential zone. . . or in a public place
between the hours of 10 PM and 7 AM the following morning."
Since the City begins its pick-up at 7:00 AM, and since all the other noise producing equipment isn't to operate
before 7 AM, we recommend that the 7 AM start time apply to garbage collection as well. Iowa City has many
neighborhoods where single family homes are adjacent to apartment complexes that require non-city garbage
pick-up. Whether one's sleep is being disturbed by the ding-ding-ding and roar of a garbage truck or the noise of
a lawn mower is irrelevant to the resident, whether in a single-family house OR an apartment building. Making this
small change to the Code would make our mixed neighborhoods more livable. We urge Council to recommend
that garbage trucks not be allowed to operate before 7:00 AM.

Re: Petition to initiate traffic calming study of200-508 Kimball Road
The undersigned, residents along the 200-508 block section of Kimball Road, ask that the
city initiate a traffic calming study of this portion of Kimball Road. The configuration of
the street as well as the steep incline from 7 to 400 Kimball Road makes the street
particularly dangerous. Traffic along the street is heavy at the beginning and end of the
day. We are concerned about the safety of pedestrians and cyclists traveling along
Kimball Road as well as residents entering and exiting their properties.

Dear Iowa City Council:
We all know that we have a serious jail-overcrowding problem in this county. I recently
read an article that over 60% of all drug arrests are for marijuana possession - I
couldn't believe it!
Do we really send that many people to jail for simply possessing a relatively harmless
plant?
I would like to suggest to you alternatives to our current way of dealing with those who
use marijuana, which I believe will fix our jail predicament. Either pass an ordinance
that would make marijuana possession the city's lowest law enforcement priority, or pass
an ordinance that allows for the citation and release of offenders, rather than
incarceration.

Nothing wastes taxpayer money quite as efficiently as jailing someone for the possession
of marijuana.
Consider the Dutch response to the same situation - they tax retail marijuana sales. Are
they crazy? Or is it Iowa lawmakers that are crazy?
Fairly obvious in this case, it seems.
Consider the Spanish response to the same situation - they ignore people who possess or
use marijuana, even in public. Are they crazy? Or is it Iowa lawmakers that are crazy? Not
a lot of doubt in this case, either.
Consider the Danish response to the same situation - they give marijuana users a public
place where they can congregate, in order to keep them from bothering non-marijuana users.
Are they crazy? Or is it Iowa lawmakers that are crazy? Seems clear in this case, also.
So - will the Iowa City council decide to act sanely, as have the Dutch, the Spanish, and
the Danish lawmakers? Or will they pick an insane solution, instead? Like most Iowa
lawmakers have.

Please start to have priority to address the long view- start looking out 25-50 years. you all seem to be
consumed by tactical short term issues. Where is your vision? Where should IC be in 10 years, 30
years- need much more forward thinking. I have no idea where this council wants to take this City,
where are we headed? The premiere city in central US? second tier dusty 01' college town? where are
we going folks?
No offense, but some of the council comes off as pretty short sighted.
Make all of IC smoke free- NOW, not tomorrow, next week, next year- no delays. Yes I know state doesn't allow
it, but pass it again anyway, show some vision, leadership.
IC should be at the front of the line for all forward thinking initiatives- that's why I moved here in the first place, but
quite honestly I travel for my work and I see lots of cities doing innovative and 'forward thinking' (there is that
phrase again) activities. IC can't rest on history/laurels- world is passing us by.
Now that City Mgr is stepping down (I thought he was OK) it is perfect time for some serious regime change within
entire City Admin- IC has some 'business/city as usual' department heads that are really slowing down
advancement of this city.
I hope you all can avoid regime change (your own) by being the agents of change. Status quo will not work in
21st Century.
Partner with C'ville, NL, Cedar Rapids, County, U of 1- good governance demands this.

Dear Members ofthe City Council:
I am writing to bring you up to date on conversations I have had with City personnel regarding the
possibility of the Saloon utilizing two islands on the College Street pedestrian mall for outdoor patio
seating. Through conversations with Eleanor Dilkes, Terry Trueblood and Rick Fosse, and the
professional assistance of Neumann Monson Architects, we have developed what we believe is a
great plan to bring added outdoor dining to the Iowa City downtown area.
* Enclosed are a DVD and computer generated pictures of the two islands located in front of the
Saloon. As you will see from the visuals, it is proposed that the islands be connected to the Saloon
by way of an overhead trellis. The two islands will have fencing appropriate for outdoor dining.
Each island will have its own entry, with the east island also having a ramp for handicap
accessibility.
We believe it is of substantial benefit to the City to proceed with this plan. The Saloon proposes to
"adopt" the islands and take on responsibility for the ongoing care and maintenance of the entire
island areas, even though only a portion of each island would actually be enclosed with the fencing.
The benefits to the City include revenue from the renting of outdoor patio space (approximately
$2,850 per year at the current $5 per foot rental rate), maintenance ofthe islands coming from private
money and the enhancement ofthe downtown pedestrian mall through an additional outdoor dining
venue.
I look forward to meeting with the Council at your work session on June 18 to discuss our proposal
in more detail and to address any questions you might have.

Dear Members of the Iowa City Council:
For the past few years the Jaycees have arranged to have the 4th of July fIreworks
launched from Terrill Mill Park on the east side of the Iowa River, very near the
Mayflower Dorm and Ridge Road. For years and years before that they were launched
from locations in City Park on the west side of the Iowa River. I wrote to the Jaycees a
year ago in March and asked if the site for igniting the fireworks could be changed back
to somewhere west ofthe Iowa River in City Park. They did not reply nor did they make
any changes.
Our house and my neighbor's houses on the SW side of Ridge Road are at about the same
level as the 8th floor of the Mayflower Dormitory. The colored fIrework explosions do
not seem to shake the windows and other house parts nearly as much as the occasional
very, very loud noise only explosions. The problem is that these explosions go off at a
height only slightly higher than our houses. And when the wind is from the west they are
even closer. I don't think any other area of housing would like to have highly noisy
explosive devices set off25 to 50 feet above their homes. When the launching site was
west of the river the challenges to my house were not quite as severe.
A copy of a portion of the map of the city is enclosed. I have marked on it to try to
illustrate the locations I describe.
Thank you very much for considering my request. I do not know the reasons the
launching location was changed in the fIrst place. Surely it wouldn't cause too many
difficulties to move it west in the Park, further away from residences that are situated
higher than the river level on the bluff.

River in City Park as far west of Dubuque Street as possible. The west riverbank was
used for many years.

fireworks with the "big bang." The colored displays are not a problem. Our houses were
constructed on the hill just east of the Iowa River and Dubuque Street in the nineteen
fifties and some even before that. They are at an elevation just above the Mayflower
Donnitory. I watched the fireworks display from the front yard of 1675 Ridge Road for
the July 4 celebration in 2005. Most other years I have walked to the park and watched
there.
It seemed as though the fireworks were exploding at about the level of our yards,
dangerously rattling windows and moving books on the shelves in bookcases at 1645
Ridge Road. The windows in our house are now 48 years old. I am certain they are in a
less sturdy condition than they were when the house was built. The noisiest explosions
are damaging on them.
I wish I could tell you precisely the height the explosions occur. I know it is affected by
the humidity and wind conditions.
Don't you think the Mayflower windows are also badly affected by the closer
detonations? Moving the launch site west of the river will not truly solve the problem
because they are still very close. But we would truly appreciate anything the Jaycee
Chapter can do to make the problem as smaIl as possible. You are impacting only a small
portion ofIowa City. But you have chosen a location for the launching that definitely is
causing problems with buildings.
