Setting Hearings. og-.3g,~ (1) CONSIDER A RESOLUTION FIXING DATE (OCTOBER 8) FOR A MEETING ON THE PROPOSITION OF THE ISSUANCE OF NOT TO EXCEED $1,'155,000 GENERAL OBLIGATION BONDS (FOR AN ESSENTIAL CORPORATE PURPOSE) OF IOWA CITY, IOWA, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF. Comment: This resolution sets a public hearing for October 8 to receive public comment regarding the issuance of an additional $1,155,000 General Obligation Bonds, and authorizes the City Clerk to publish notice of hearing. This additional amount brings the total General Obligation issue up to an amount not to exceed $10,980,000. These bonds are refunding the General Obligation Bonds series 1994, 1995, and 1996 and Capital Loan Notes, Series 1992. Our financial advisors (Evensen Dodge, Inc.) have calculated debt service savings of $463,351. (2) CONSIDER A RESOLUTION SETrlNG A PUBLIC HEARING FOR .3~, , OCTOBER 8 ON AMENDING THE FY2003 OPERATING BUDGET. Comment: This resolution sets a public hearing for October 8, 2002, to amend the I~Y2003 budget to carry over budget authority from FY2002 to FY2003 for capital improvement projects and other expenses that were either in process in FY2002 and not completed by FY2002 year end, or budgeted in FY2002 and delayed until FY2003. The City's policy is to amend the current budget at the beginning of each fiscal year for the continuation of projects from the prior fiscal year. (3) CONSIDER A MOTION SE'I-rING A PUBLIC HEARING FOR OCTOBER 8 REGARDING AMENDMENTS TO THE FY03 ANNUAL ACTION PLAN BUDGET, THAT IS A SUB-PART OF IOWA CITY'S 2001-2006 CONSOLIDATED PLAN (CITY STEPS) AS AMENDED, AND AUTHORIZING THE CITY MANAGER TO SUBMIT SAID AMENDMENTS AND ALL NECESSARY DOCUMENTS TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE CONSOLIDATED PLAN. Comment: At their May 16, 2002, May 29, 2002 and September 12, 2002 meetings, the Housing and Community Development Commission made recommendations to the Council that would recapture funds from an unsuccessful FY02 project and reallocate those funds to two new projects as part of the FY03 Annual Action Plan. A public hearing is required by the U.S. Department of Housing and Urban Development. A memorandum describing the proposed budget amendments is included in Council packet. Resolutions. 3~.~- (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO Al-rEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 629 DIANA COURT, IOWA CITY, IOWA. Comment: The owner of the property located at 629 Diana Court received assistance through the City's Downpayment Assistance Program totaling $2,500. The financing was in the form of a declining balance loan. The balance of the loan has been paid off; thus the lien can now be released. -~,9.~ (2) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN EMERGENCY VEHICLE ACCESS EASEMENT AGREEMENT WITH EDWARD JONES FOR LOTS 66 AND 67, sco'l-r BOULEVARD EAST, PART III, IOWA CITY, IOWA. Comment: Pursuant to Title 14, Chapter 5, Article H of the Code of Ordinances of the City of Iowa City, Iowa, a site plan has been submitted on behalf of the owner of Lots 66 and 67, Scoff Boulevard East, Part III. City staff has approved the site plan subject to the adjacent property owner/developer granting an emergency vehicle access easement. Said easement is needed to provide City fire apparatus vehicles with a means of passage over the private property designated on the easement plat, as well as a turn-around area for emergency vehicles. Said easement area will be posted as a "No Parking Area" and will authorize the Iowa City Police Department to ticket, tow or cause to be towed, pursuant to the Code of Iowa, as amended, any vehicles parked or placed on the easement area. Consider a motion setting a public hearing for October 8 on an ordinance changing the zoning designation from Low-Density Multi-Family (RM-12) to Sensitive Areas Overlay Low-Density Multi-Family (OSA-12) on 1.06 acres to allow a 14-unit multi-family building located on the west side of First Avenue south of Stuart Court. Comment: At its September 5 meeting, by a vote of 6-0 (Koppes absent), the Planning and Zoning Commission recommended approval of the proposed rezoning subject to staff approval of a landscaping plan at the time of site plan review. A PURCHASE AGREEMENT BETWEEN THE CiTY OF IOWA CiTY AND THE UNIVERSITY OF IOWA FOR THE OLD WATER PLANT PROPERTY LOCATED ON MADISON STREET IN IOWA CITY AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I-rEST ANY DOCUMENT OF CONVEYANCE REQUIRED BY SAID AGREEMENT. Comment: In accordance with City Council direction following staff discussion at the City Council work session of September 10, 2001, staff have negotiated a purchase agreement with The University of Iowa for the old water plant property for a purchase price of $1,106,000. a. PUBLIC HEARING ~'P' -g'~ b. CONSIDER A RESOLUTION APPROVING ITEM 6. CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 14, ENTITLED, "UNIFORM DEVELOPMENT CODE," CHAPTER FIVE, ENTITLED, "BUILDING AND HOUSING," ARTICLE E, ENTITLED, "HOUSING CODE" TO REQUIRE THAT ALL LANDLORDS AND TENANTS EXECUTE A LEASE ADDENDUM AND BY DELETING THE REQUIREMENT THAT THE CITY PROVIDE WRITrEN NOTIFICATION OF HOUSING VIOLATIONS BEFORE ISSUING A MUNICIPAL INFRACTION. (FIRST CONSIDERATION) This ordinance amends the Housing Code to require a lease addendum for all rental property which sets out maximum occupancy limit of a dwelling unit; acknowledgement by owner/operator, and tenant regarding responsibility for occupancy limits; identification of non-habitable spaces /rooms; acknowledgement regarding no parking on grass or public sidewalk; trash and recycling requirements; notification of Code language concerning the crime of Disorderly House; acknowledgement that all substantial rental agreement provisions have been initialed by the owner and tenant; City website address; contact information for the Neighborhood Association; information regarding the Iowa Residential Landlord/Tenant Law; and responsibility for snow removal and lawn mowing. Staff anticipates it will take approximately three years to determine the maximum occupancy for every rental dwelling unit (approximately 15,000). In addition, the proposed ordinance allows oral notification of Housing Code violations to permit the City to act on Housing Code violations in a more timely manner. Both of these amendments were recommended by the Neighborhood Housing RelationsTask Force. Action: /.//',~'~Z_-,~/,/~ September 24, 2002 Cit~/of Iowa City Parle 10 ITEM 7. CONSIDER AN ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 7, ENTITLED "VEHICLE SIZE, WEIGHT AND LOAD," TO RESTRICT LARGE TRUCK TRAFFIC ON FIRST AVENUE FROM THE INTERSECTION OF SCOTT BOULEVARD TO THE INTERSECTION OF D STREET. (SECOND CONSIDERATION) Comment: This ordinance would ban large trucks from the portion of First Avenue between Scott Boulevard and D Street. The ordinance exempts commercial vehicles that have no other means of access to their destination, school buses, and City emergency and service vehicles. If approved, signage will be erected indicating that no trucks over 16 tons gross weight are allowed on First Avenue between Scott Boulevard and D Street. ITEM 8. CONSIDER AN ORDINANCE AMENDING CERTAIN CHAPTERS OF CITY CODE TITLES 6, 7, '10, AND 14 TO INCREASE THE MUNICIPAL INFRACTION CIVIL PENALTIES FOR VIOLATING NUISANCE PROVISIONS, SNOW REMOVAL REQUIREMENTS, BUILDING CODE, HOUSING CODE, ELECTRICAL CODE, MECHANICAL CODE, PLUMBING CODE, FIRE CODE, AND UTILITIES' USE OF RIGHT-OF-WAY REQUIREMENTS. (SECOND CONSIDERATION) Comment: The Neighborhood Housing Relations Task Force recommended Code amendments to increase fines for municipal infractions for code violations that impact on Neighborhoods. Passage of the ordinance would increase he fines for first violation to $250, $500 for second offense, $750 for third offense. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING OJ,- ~, O THE MAYOR TO SIGN AND THE CITY CLERK TO ATI'EST A CONTRACT FOR CONSTRUCTION OF THE TRANSIT RE-ROOFING PROJECT. Comment: The bid opening for this project was held on September 12, 2002 and the following bids were received: Dryspace, Inc. Cedar Rapids, IA $112,228 West Branch Roofing West Branch, IA $127,925 Moss Roofing West Union, IA $129,400 Cedar Service Roofing Cedar Rapids, IA $133,978 Academy Roofing Cedar Rapids, IA $156,815 Jim Giese Roofing Dubuque, IA $164,776 Engineer's Estimate $147,000 Public Works and Engineering recommend award of the contract to Dryspace, Inc. of Cedar Rapids, Iowa. This project will be primarily funded with a Federal DOT grant. Action: / ITEM 10. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING 0~- _~,~ THE MAYOR TO SIGN AND THE CITY CLERK TO AI-I'EST A CONTRACT FOR CONSTRUCTION OF THE 2002 CURB RAMP PROJECT. Comment: This project consists of constructing ADA compliant curb ramps at various locations throughout the City. The bid opening for this project was held on September 17, 2002 and the following bids were received: Base Bid Alternate Knish Corporation Lonsdale, MN $ 66,402 $ 58,554 All American Concrete West Liberty, IA $ 84,626 $ 68,930 Engineer's Estimate $ 71,438 $ 68,168 Public Works and Engineering recommend utilization of the alternate, which involves grinding the curb instead of removing and replacing the curb, and award of the contract to Knish Corporation of Lonsdale, Minnesota. CONSIDER AN ORDINANCE AMENDING TITLE 6, PUBLIC HEALTH AND SAFETY, CHAPTER 7, SMOKING IN FOOD ESTABLISHMENTS, SECTION 5, EXCEPTION, TO CLARIFY THAT EACH ESTABLISHMENT SHALL BE ALLOWED ONLY ONE TEMPORARY ONE-YEAR EXCEPTION. (FIRST CONSIDERATION) Comment: The City Clerk has received inquiries about the temporary one-year exception allowed under Section 5-7-5(B) of the City Code concerning whether subsequent one-year exceptions can be obtained. The proposed amendment clarifies that each establishment shall be allowed only one temporary one-year exception under the ordinance, and consecutive exceptions are not available. Action: ] /, ~~ / /2~zZ~. / ITEM 12. CONSIDER A RESOLUTION RESCINDING RESOLUTION NO. 01-353 AND ~.~g. THEREBY TERMINATING THE NEIGHBORHOOD HOUSING RELATIONS TASK FORCE. Comment: The Neighborhood Housing Relations Task Force has submitted its report, and the City Manager has appointed a Housing Relations Committee to implement the proposals contained in the report. This resolution rescinds Resolution No. 01-353 that created the Task Force. The Task Force has completed the goals established in Resolution No. 01-353. Action: ITEM 13.
