COMMENT: City and University staff is finalizing the lease for the boathouse facility. The University plans to present the plans for the facility to the Council on July 23 and is hopeful that the lease will be approved by the Council on July 24. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BY THE CITY OF IOWA CITY WITH JOHNSON COUNTY PERMANENT SUPPORTIVE HOUSING LIMITED PARTNERSHIP. Comment: The City loaned Johnson County Permanent Supportive Housing Limited Partnership $275,000 in HOME funds to assist with the construction of 16 units of affordable housing at 4435-4455 Melrose Avenue and secured the loan with a mortgage. The owner subsequently recorded mortgages with Hills Bank and the Iowa Dept. of Economic Development (IDED) and has requested that the City subordinate its loan to Hills Bank and IDED. Staff supports this request, and there is sufficient value in the property to secure the City's loan. 2. CONSIDER A RESOLUTION AUTHORIZING AND DIRECTING THE FILING OF AN APPLICATION ON BEHALF OF THE CITY OF IOWA CITY WITH THE DEPARTMENT OF TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT UNDER SECTIONS 5307, 5309, 5310, 5316, AND 5317 OF CHAPTER 49, U.S. CODE OF FEDERAL REGULATIONS, FOR FY2007 TRANSIT OPERATING AND/OR CAPITAL ASSISTANCE FUNDING, AND DESIGNATING THE CITY MANAGER AS THE CITY OFFICIAL AUTHORIZED TO EXECUTE AND PROCESS SAID APPLICATION. Comment: A similar resolution was passed on April 16. Since that time the Federal Transit Administration has requested changes to the resolution. The changes include the removal of two paragraphs that are no longer necessary for inclusion in the resolution. The intent of the resolution has not changed. JCCOG has completed the funding application for FY07 Federal Transit Administration operating and capital assistance. The operating assistance amount is $705,033. This project is consistent with the FY07 JCCOG Federal Transit Administration program of projects. 3. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING AN AGREEMENT, A PROMISSORY NOTE, AND A MORTGAGE FOR PROPERTY LOCATED AT 1153 - 1155 HOTZ AVENUE, IOWA CITY, IOWA. Comment: The owner of the property located at 1153 - 1155 Hotz Avenue, Iowa City, Iowa received assistance through the City of Iowa City's Community Development Block Grant (CDGB) funds. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE PARTIAL RELEASE OF MORTGAGE FOR THE PROPERTY LOCATED AT 2814 IRVING AVENUE, IOWA CITY, IOWA. Comment: The City sold a public housing unit to the owners in 1999 as part of the Affordable Dream Home program. As part of the financing, the City loaned the owners $27,800.00. The City took out a mortgage to secure the note and to secure the repayment agreement. The owners have paid off the note, but the repayment agreement is a 15-year agreement to assure affordability for that period of time. This resolution only releases the note; the repayment agreement requirements will remain a lien until 2014. 5. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING EIGHT CONDITIONAL GRANT AGREEMENTS AND FOUR PROMISSORY NOTES, FOR PROPERTIES LOCATED AT 8, 11, 16, 19, 24, 27, 32, 35 CONEFLOWER COURT, 2160-2162 TAYLOR DRIVE, 913-913 % NORTH GOVERNOR STREET, 424 AND 441 DOUGLASS COURT, IOWA CITY, IOWA. Comment: The owner of the properties located at 8, 11, 16, 19, 24, 27, 32,35 Coneflower Court, and 2160-2162 Taylor Drive, 913-913 ~ North Governor Street, 424 and 441 Douglass Court, Iowa City, Iowa, received grants through the City of Iowa City's Community Development Block Grant (CDGB) funds. These grants are scheduled to be forgiven in 2008 and 2009, but the owner has requested that the grants be released now. Staff approves of this because these properties are part of the Berry Court Limited Partnership Low Income Housing Tax Credit Project (City Council approved a loan agreement as part of this project on June 19, 2007) which means these properties will have 30 more years of affordability; thus the liens should be released. City of Iowa City Page 8 CONSIDER AN ORDINANCE AMENDING TITLE 4, ENTITLED "ALCOHOLIC BEVERAGES" TO PROHIBIT POSSESSION OF OPEN ALCOHOLIC BEVERAGES ON PUBLIC PROPERTY. (FIRST CONSIDERATION) Comment: City code currently makes it illegal to possess any alcoholic beverage on public property, be it unopened or opened. The original intent in drafting this ordinance was to make it illegal to possess opened or unsealed alcoholic beverages. This amendment clarifies this distinction. (SECOND CONSIDERATION) Comment: The current City Code allows businesses to get two permits per year for the commercial use of sidewalks for up to three days each. Businesses, for example, participating in "sidewalk" days apply for this type of permit. The Downtown Association of Iowa City has requested that the duration of the permit be increased from three to four days. Staff has no objection to this request and recommends expedited action. (SECOND CONSIDERATION) Comment: This ordinance prohibits amateur fighting and boxing in establishments with a liquor license or beer/wine permit. It also prohibits a person from participating in or promoting such an event. The penalties are the maximum allowed. Correspondence included in Council packet. Staff recommends expedited action. City of Iowa City Page 9 CONSIDER AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "USE OF PUBLIC WAYS AND PROPERTY," CHAPTER 11, ENTITLED "FARMER'S MARKET," TO ALLOW FARMERS MARKET VENDORS TO PREPARE AND SELL FOOD IN CHAUNCEY SWAN PARK. (SECOND CONSIDERATION) Comment: The current City Code allows the Farmers Market only to operate within Chauncey Swan ramp. The Farmers Market Advisory Committee, comprised of current vendors, would like to expand the market to the adjacent Chauncey Swan Park to allow up to four (4) vendors to grill and prepare food and beverages (such as lemonade). Staff supports this expansion of the market. Unlike other vendors who operate in the ramp, those in the park will need to obtain insurance just as mobile vendors who operate in City Plaza and on Iowa Avenue. Staff recommends expedited action. (FIRST CONSIDERATION) Comment: Presently, sidewalk cafes cannot encompass raised planters in City Plaza. Additionally, the width of a sidewalk cafe is limited to the width of the cafe owner's building. In the agenda packet for the June 19, 2007, meeting, the owner of the Saloon at 112 E. College Street outlined his plans for a sidewalk cafe to be located on top of two raised planters. Both planters in his proposal extend beyond his building line, that is they are located in front of adjacent businesses. This ordinance grants City Council the discretion to enter into an easement agreement for a sidewalk cafe that encompasses the planters even when the planters are located beyond the building lines of the cafe owner. This ordinance does not amend the other requirements for sidewalk cafes; it just creates an exception to allow cafes to encompass raised planters in limited circumstances. Comment: Pursuing consulting services was previously approved by the City Council and the Parks and Recreation Commission. A request for qualifications was advertised and nine submittals were received. Four of these firms were selected for interviews. Following the interviews, the selection committee decided that GreenPlay, LLC was the most appropriate choice to develop a master plan for Iowa City. The selection committee was comprised of four members of the Parks and Recreation Commission, three members of the Parks and Recreation staff and one representative from the Planning staff. The cost for their services will be $70,325, and the source of funding is the Parkland Acquisition Fund. FROM IOWA CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT - ECONOMIC DEVELOPMENT FUND AND AUTHORIZING THE CITY MANAGER TO ACT AS CHIEF ADMINISTRATIVE OFFICER AND SUBMIT ALL NECESSARY DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. (DEFERRED FROM 6/19) Comment: On June 21 the City Council Economic Development Committee recommended $35,000 in funding for this project. The Council Economic Development Committee has recommended that these funds be as a loan at 3.2% interest for a term of 7 years. Due to high owner commitment to the business, a strong recommendation from their commercial lender and the owner's history of paying the obligations entered, the committee recommended funding this business without security. Said project will retain one full-time equivalent position for a low-moderate income person. Staff memorandum included in Council packet. (:.7 ~1. c ,J, City of Iowa City Page 11 CONSIDER A RESOLUTION AUTHORIZING THE INSTALLATION OF SPEED HUMPS ON KIMBALL ROAD BETWEEN N. GOVERNOR STREET AND WHITING AVENUE. Comment: The residents of Kimball Road between N. Governor Street and Whiting Avenue have successfully completed the City of Iowa City approved traffic calming program. This resulted in a survey of the neighborhood yielding 72% majority of respondents in favor of speed humps on Kimball Road between N. Governor Street and Whiting Avenue. Comment: The Library Director negotiated a lease agreement for the basement commercial space in the Iowa City Public Library Building with the University of Iowa for a term of three (3) years with two (2) options to renew for one (1) year each. The University intends to use the space for office use. This resolution authorizes the Mayor and City Clerk to sign and attest this lease agreement, which was approved by The Iowa City Library Board of Trustees at their June 28, 2007 meeting and is approved by staff. Comment: City Council held an executive session on July 2 to evaluate the City Attorney and City Clerk. A 6% increase was made in the compensation paid to each as a result of the evaluation. Other City department acting appointments over the last 10 years has resulted in increases of between 10% and 25%. After discussing potential salary adjustment with Dale, the Mayor recommends $148,000 (a 21% increase), and that amount has been included in the resolution. City of Iowa City Page 13 CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 7, ENTITLED FIRE PREVENTION AND PROTECTION, AND TITLE 17, ENTITLED BUILDING AND HOUSING TO ESTABLISH FIRE AND LIFE SAFETY REQUIREMENTS FOR NEW AND EXISTING GROUP A-2 AND B OCCUPANCIES. (SECOND CONSIDERATION) Comment: On March 5, 2007 The Board of Appeals recommended, by unanimous vote, to approve the proposed amendments to the international Building/Fire Codes that requires existing A-2/B Occupancies with State of Iowa Alcoholic Beverage Division License (ABDL) to be retrofitted with a fire sprinkler system and a fire alarm system with voice alarm capabilities. Also, the Board recommended that all new A-2 Occupancies, when the occupant load is 100 or more, have a fire sprinkler system, a fire alarm system with voice alarm capabilities, and exit widths that will accommodate two-thirds (2/3) of the occupant load. The recommendations are contingent on a City- supported financial incentive program. The Council, at its 6/19/07 meeting, made the following changes to the ordinance; voice alarms not required in existing or new uses; illumination to 10 foot candles not required for existing uses; and existing A2/B occupancies required to be sprinkled not other occupancies within the same building.
