PROPERTY LOCATED AT 1526 ABER AVENUE, IOWA CITY, IOWA.
Comment: The owner of the property located at 1526 Aber Avenue
received assistance through the City of Iowa City's Housing
Rehabilitation Program. The loan has been paid off; thus the liens need
to be released.

DECLARATION OF CONDOMINIUM REGIME FOR LOT 10,
LONGFELLOW MANOR CONDOMINIUMS.
Comment: The City is buildina ~ 2-unit residential condominium
structure at 983 Longfellow Place and 985 Longfellow Court. In order to
sell the units as condominiums, the owner must record a declaration of
condominium regime that sets forth details such as a description of the
units and the elements shared by the owners in common. Because of the
length of the declaration, it is not in the packet but is available in the City
Clerk's office for review. Also on the consent calendar is a motion to set a
public hearing on the City's intent to convey both units. Note that a
similar resolution is on the consent calendar for the condominium on Lot
11.

provide the opportunity for a low-income family to obtain ownership of
their own home.

Comment: This project will replace the old and inadequate

increased to better serve these programs.

Comment: It is anticipated that the Planning and Zoning Commission will vote

a staff report dated June 21 and a memo dated July 12, staff recommended
approval subject to conditions to ensure that the proposed church can be
integrated successfully into an area intended for a residential neighborhood
with interconnected streets and a public square as a neighborhood focal point.
Approval will allow the possibility for development of a new St. Patrick Church

Comment: At its June 7 meeting, by a vote of 6-0 (Plahutnik absent), the
Planning and Zoning Commission recommended approval of the vacation,
subject to the retention of any necessary utility easements. Staff recommended

consistent right-of-way by eliminating a jog in the North right-of-way line along

CONSIDER AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED
"USE OF PUBLIC WAYS AND PROPERTY," CHAPTER 3, ENTITLED,
"COMMERCIAL USE OF SIDEWALKS," SECTION 3, ENTITLED" USE FOR
SIDEWALK CAFES," TO ALLOW SIDEWALK CAFES TO ENCOMPASS RAISED
PLANTERS IN CITY PLAZA UNDER LIMITED CIRCUMSTANCES. (SECOND
CONSIDERATION)
Comment: Presently, sidewalk cafes cannot encompass raised planters in City Plaza.
Additionally, the width of a sidewalk cafe is limited to the width of the cafe owner's
building. In the agenda packet for the June 19, 2007, meeting, the owner of the Saloon
at 112 E. College Street outlined his plans for a sidewalk cafe to be located on top of
two raised planters. Both planters in his proposal extend beyond his building line, that
is they are located in front of adjacent businesses. This ordinance grants City Council
the discretion to enter into an easement agreement for a sidewalk cafe that
encompasses the planters even when the planters are located beyond the building
lines of the cafe owner. This ordinance does not amend the other requirements for
sidewalk cafes; it just creates an exception to allow cafes to encompass raised planters
in limited circumstances. Applicant has requested expedited action. If this ordinance is

CONSIDER A RESOLUTION RESCINDING RESOLUTION NO. 06-16 AND
ADOPTING A FEE SCHEDULE AND DEPOSIT REQUIREMENTS FOR USE OF
PUBLIC RIGHT-OF-WAY FOR SIDEWALK CAFES.
Comment The fee schedule for sidewalk cafes needs to be amended to include fees
for cafes that utilize elevated planters. Staff recommends that the fee be $10.00 per
square foot for the portion of cafe located on the planter and $5.00 per square foot for
the portion not on the planter. This is consistent with the current of fee of $10.00 per
square foot on platforms (e.g., the 126 cafe) and $5.00 per square foot elsewhere.
Additionally, staff recommends a deposit of $1000 for a cafe that utilizes a planter due to
the potential damage to the limestone and trees. All other fees remain the same. This
item will need to be deferred if item 9 is not adopted.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST A LICENSE AGREEMENT FOR TEMPORARY USE OF
PUBLIC RIGHT-OF-WAY AMONG THE CITY OF IOWA CITY, LANDOWNER
MAUREEN MONDANARO, AND TENANT SALOON OF IOWA CITY, L.C. D/B/A
THE SALOON FOR A SIDEWALK CAFE.
Comment: Staff and the owner of the Saloon have negotiated the proposed
sidewalk cafe agreement for a cafe to be located on two elevated planters in City
Plaza. Paragraphs 14-22 of the agreement, which is attached to the resolution, are
unique to the use of the elevated planters, and the remaining paragraphs are
identical to those sidewalk cafe agreements that do not utilize a planter. A draft of the
plans is in the packet. This item will need to be deferred if item 9 is not adopted.

Comment: This agreement memorializes the financial responsibilities between the

CONSIDER A RESOLUTION TO ADOPT THE IOWA CITY HOUSING AUTHORITY'S
AMENDED PUBLIC HOUSING ADMISSIONS AND CONTINUED OCCUPANCY
POLICY (ACOP).
Comment: The Iowa City Housing Authority is proposing changes to our policies
regarding tenant selection and admission. Specifically, for the purpose of increasing
security for residents of public housing units, the Iowa City Housing Authority may
allow police officers who would not otherwise be eligible for occupancy in public
housing, to reside in a public housing unit. Staff memorandum included in Council
Packet.

CONSIDER A RESOLUTION APPROVING FUNDING FOR LA REYNA, INC. FROM ~
Action:
IOWA CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT - ECONOMIC
DEVELOPMENT FUND AND AUTHORIZING THE CITY MANAGER TO ACT AS
CHIEF ADMINISTRATIVE OFFICER AND SUBMIT ALL NECESSARY
DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT.
Comment: On July 10 the City Council Economic Development Committee
recommended $60,000 in funding for this project. The Council Economic Development
Committee has recommended that these funds be as a loan at 3.2% interest for a term
of 7 years. Due to high owner commitment to the business, the owner's history of
paying loan obligations and the business providing services in a low-to-moderate
income census tract, the committee recommended funding this business without
security. Said project will retain two full-time equivalent positions and create three
positions for low-moderate income persons.

CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE
TRANSIT DIVISION OF THE PARKING AND TRANSIT DEPARTMENT BY
INCREASING THREE MAINTENANCE WORKER I - TRANSIT POSITIONS FROM
.75 TO FULL TIME POSITIONS.
Comment: Due to the increase in fixed bus routes to serve City and West High
Schools as well as new housing development the bus fleet has expanded by four
buses. To ensure that all buses are clean and well maintained they must be serviced
daily and current staffing levels need to be expanded to provide for that servicing.
Currently three part time employees service these buses; increasing these positions to
full time will allow Transit to adequate clean and maintain the bus fleet on a daily basis.
Annual cost of the increase is approximately $25,000.

Comment: The required forms have been submitted by Mediacom. Upon review it has

CONSIDER AN ORDINANCE AMENDING CITY CODE TITLE 7, ENTITLED FIRE
PREVENTION AND PROTECTION, AND TITLE 17, ENTITLED BUILDING AND
HOUSING TO ESTABLISH FIRE AND LIFE SAFETY REQUIREMENTS FOR NEW
AND EXISTING GROUP A-2 AND B OCCUPANCIES. (PASS AND ADOPT)
Comment: On March 5, 2007 The Board of Appeals recommended, by unanimous
vote, to approve the proposed amendments to the international Building/Fire Codes
that requires existing A-2/B Occupancies with State of Iowa Alcoholic Beverage
Division License (ABDL) to be retrofitted with a fire sprinkler system and a fire alarm
system with voice alarm capabilities. Also, the Board recommended that all new A-2
Occupancies, when the occupant load is 100 or more, have a fire sprinkler system, a
fire alarm system with voice alarm capabilities, and exit widths that will accommodate
two-thirds (2/3) of the occupant load. The recommendations are contingent on a City-
supported financial incentive program. The Council, at its 6/19/07 meeting, made the
following changes to the ordinance; voice alarms not required in existing or new uses;
illumination to 10 foot candles not required for existing uses; and existing A2/B
occupancies required to be sprinkled not other occupancies within the same building.
