Washington ~ ~ ,~ 1 f~~~8lt: ::: ..aa.~ _..A&.. -- CiTY OF IOWA CiTY www.icgov.org .u.. . } 'U- CALL TO ORDER Roll Call ITEM NO.2 CONSIDER AN ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "USE OF PUBLIC WAYS AND PROPERTY," CHAPTER 3, ENTITLED, "COMMERCIAL USE OF SIDEWALKS, "SECTION 3, ENTITLED" USE FOR SIDEWALK CAFES," TO ALLOW SIDEWALK CAFES TO ENCOMPASS RAISED PLANTERS IN CITY PLAZA UNDER LIMITED CIRCUMSTANCES. (SECOND CONSIDERATION) Comment: Presently, sidewalk cafes cannot encompass raised planters in City Plaza. Additionally, the width of a sidewalk cafe is limited to the width of the cafe owner's building. In the agenda packet for the June 19, 2007, meeting, the owner of the Saloon at 112 E. College Street outlined his plans for a sidewalk cafe to be located on top of two raised planters. Both planters in his proposal extend beyond his building line, that is they are located in front of adjacent businesses. This ordinance grants City Council the discretion to enter into an easement agreement for a sidewalk cafe that encompasses the planters even when the planters are located beyond the building lines of the cafe owner. This ordinance does not amend the other requirements for sidewalk cafes; it just creates an exception to allow cafes to encompass raised planters in limited circumstances. Applicant has requested expedited action. If this ordinance is not adopted at this time, items 3 and 4 should be deferred. This item was deferred from the July 24th Council meeting. Action: ~~~~.m~~ ~;(2/~ tV!!e'r ~ ~ v/~ r!J;t2 % Special Agenda August 2, 2007 Page 2 ITEM NO.3 CONSIDER A RESOLUTION RESCINDING RESOLUTION NO. 06-16 AND ADOPTING A FEE SCHEDULE AND DEPOSIT REQUIREMENTS FOR USE OF PUBLIC RIGHT-OF-WAY FOR SIDEWALK CAFES. Comment The fee schedule for sidewalk cafes needs to be amended to include fees for cafes that utilize elevated planters. Staff recommends that the fee be $10.00 per square foot for the portion of cafe located on the planter and $5.00 per square foot for the portion not on the planter. This is consistent with the current of fee of $10.00 per square foot on platforms (e.g., the 126 cafe) and $5.00 per square foot elsewhere. Additionally, staff recommends a deposit of $1000 for a cafe that utilizes a planter due to the potential damage to the limestone and trees. All other fees remain the same. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIG~ ~ CITY CLERK TO ATTEST A LICENSE AGREEMENT FOR TEMPORARY USE OF PUBLIC RIGHT-OF-WAY AMONG THE CITY OF IOWA CITY, LANDOWNER MAUREEN MONDANARO, AND TENANT SALOON OF IOWA CITY, L.C. D/B/A THE SALOON FOR A SIDEWALK CAFE. Comment: Staff and the owner of the Saloon have negotiated the proposed sidewalk cafe agreement for a cafe to be located on two elevated planters in City Plaza. Paragraphs 14-22 of the agreement. which is attached to the resolution, are unique to the use of the elevated planters, and the remaining paragraphs are identical to those sidewalk cafe agreements that do not utilize a planter. A draft of the plans was included in the July 24 meeting packet. This item will need to be deferred if item 2 is not adopted. This item was indefinitely deferred at the July 24th Council Meeting.
