HomeMy WebLinkAbout1977-01-25 Ordinance•ORDINANCE NO. 77-2823 0 AN ORDINANCE ESTABLISHING THE MUNICIPAL CEMETERIES OF THE CITY OF IOM CITY AS NONPERPETUAL CARE CEME1 'S AND AMENDING SECTION IV OF ORDINANCE W. 2331. SECTION I. PURPOSE. The purpose of this ordinance is to establish the cemeteries awned by the City of Iowa City as nonperpetual care cemeteries and to amend Ordinance No. 2331 which created such cemeteries as perpetual care. SECTION II. AMENDMENT. Section IV of Ordinance No. 2331 is hereby amended to read as follows: Section IV. Nonperpetual Care. All municipal cemeteries shall be nonperpetual care cemeteries and all lots sold after the effective date of this ordinance shall be maintained as such. The establishment of the cemeteries as nonperpetual care shall in no way alter any rights of purchasers under perpetual care as established by Ordinance No. 2331. SECTION III. REPEALER. Section IV of Ordinance No. 2331, Municipal Code of Iowa City, is hereby repealed and all ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION IV. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and publication as required by law. City Attorney RE: Nonperpetual Care If the Council passes the ordinance and resolution changing municipal cemeteries to nonperpetual care, we will be obligated to ccnply with Section 566A.5, Iowa Code: "Each nonperpetual care cemetery shall post in a conspicuous place in the office or offices where sales are conducted a legible sign stating, 'This / is a nonperpetual care cemetery I,, the letting of this sign shall be of suitable size so it is easily read at a distance of fifty feet. Each nonperpetual care cemetery shall also have printed or stanped at the head of all its contracts, deeds, statements, letterheads and advertising material, the legend: 'This is a non - perpetual care oenetery', and shall not sell any lot or intenrent space therein unless the purchaser thereof is informed that the cemetery is a nonperpetual care cemetery." 16,46
