Corrine Suter appeared cont. questions she had in reference to a letter from Asst. City Atty. Ryan re 902 N. Dodge St. rezoning mat- ter. Council advised her to contact Asst. City Atty. Ryan for an interpretation of the letter. Wayne Begley appeared conc. disclosure of information on the rezoning issue. ..Mayor Neuhauser indicated Council :.:.would not be releasing all the information ;to the public due to the pending litigation. Several Councilmembers suggested that those "interested seek legal counsel and intervene :.;if they,.were `not satisfied with the infor- ,mation provided. '.,at the informal session yesterday. She 'asked Council to consider only the ord.'s .,' merits. Councilman Balmer stated he had °`said homosexuals had the same rights as any other person except that they could not im-pose their standards on other people. He further stated that, in his opinion, the -ord. in its present form would set a danger- 7-ous precedent. City Clerk Stolfus stated 2 persons had taken out nomination papers for the next Council election. City Mgr. Neal Berlin reported that the University will pay the sewer rate estab- lished by the City under an interim contract which will expire 7/1/18. Through this pe- riod the City & the University can negotiate specific terms for a long-term contract. City Atty. Hayek announced that initiative proceedings on a tenant -landlord ord. had b0en filed today. Iowa City City Council, regular session, 2/1/77, at the Civic Center. Councilmembers present: Balmer, deProsse, Foster, Neuhauser, Perret, Selzer, Vevera. Absent: none. Mayor Neuhauser presiding. Ralph Oxford, Yellow Checker Cab and Super Cab, appeared asking Council approval of licensing of 24 taxicabs, and questioned what the future plans were regarding his cab stand on Dubuque St. The Mayor advised there was no way to answer at this time. It was moved by Selzer, seconded by Foster to direct the Legal Staff to investigate the license applications and procedures to be used. Motion carried, unanimously, 7/0. _ Bill Terry, 206 W. Park Road, appeared concerning 70° temperature required in the minimum housing code, and urged Council to recommend that citizens keep their thermostats at 680. It was moved by Selzer, seconded by Vevera, to recom- mend that citizens conserve energy by lowering thermostats to .680. during the day and lower at night if possible, this recommendation to apply to all municipal buildings. Motion carried unanimously, 7/0. City Attorney Hayek announced that initiative proceed- ings on a tenant -landlord ordinance had been filed today. It was moved by Foster, seconded by Perret, to receive and file letters of January 26 and February 1, 1977, from Mary Howsare, 900 N. Dodge, concerning construction at 902 N. Dodge. Motion carried unanimously. Wayne Begley, 804 Ronalds, asked several questions about Council's decision that the 1967 rezoning was a valid rezoning, and procedures for citizens to object to rezonings. Attorney Hayek explain- ed the procedure, and Council directed that the information presented be made available in written form. Corrine Suter, 609 Brown, asked if the 1967 petition was a valid petition. The staff was instructed to investigate and publicly announce the answer. Chadwick, re construction of apartment buildings, referred to Legal Dept. Affirmative roll call vote was unanimous, all Councilmembers present. It was moved by deProsse, seconded by Selzer, to set a public hearing on 2/22/77 at 7:30 P.M. to rezone the Kennedy tract of land located S. of Winebrenner-Dreusicke Ford from R1A to C2 as recommended by the Planning and Zoning Commis- sion.. Motion carried, 7/0. Council noted the Planning and Zoning Commission's recom- mendations for Council to approve the preliminary and final Large Scale Non -Residential Development plan of Howard John- son 's.Motor Lodge and to approve the final plat of Village Green, Part IX, both with several contingencies. The River - front -Commission's recommendation to amend their by-laws con - 41 cerning'the time regular meetings are to be held was also noted. It had been decided at informal session to defer the Resolution Adopting Phase II of the Iowa River Corridor study,, and discuss the matter with the Riverfront Commission at an informal ses- sion. Mayor Neuhauser announced there was a vacancy on the Air- port Commission with term expiring March 1, 1983; three vacan- cies on the Committee on Community Needs with terms expiring March 1, 1979; and one vacancy on the Human Relations Commis- sion.with term expiring January 1, 1978. The appointments to these commissions will be made on March 8, 1977. In answer to questions from Councilmembers, the City Man- ager explained that (1) he had not received the information from University Heights regarding the services contract, (2) Consultant Don Zuchelli would be in Iowa City on February 21st _(a City holiday) and could discuss the College Block Building and Dottie Dunn Hat Shop properties, (3) the November letter from IPIRG concerning Freeway 518 had been answered, (4) the Sasaki firm would be a subcontractor to Associated Engineers for design services, (5) the letter had been drafted concern- ing attendance by members at Board and Commission meetings, Page 3 Council Activities February 1, 1977 (6) concerning historic preservation designation of Old Post Office, he had informed the Park Service that the City was not requesting the designation, but was considering all financial alternatives, and (7) Scott Kelly, representing Zuchelli, Staff, and Halprin representatives will discuss the Library site on February 7 and 8. The Mayor commented that (1) the Showalter memo concern- ing 100' easement along the river would be discussed with the Riverfront Commission at the informal meeting, (2) that the Revenue Sharing and Block Grant programs had almost no paper- work, unlike the FAUS program, (this was in regard to the article in Government Executive on how much time is used ad- ministratively for paperwork), (3) she could attend the fact- finding session on the Firefighters contract (deProsse and Foster might also), (4) the letter from Senator Clark con- cerning the post office had been written before her visit to Washington,_ D.C., (5) that in regard to the letter from Nate Ruben, he had advised her to get preapproval of sites; this " had also, been told to Councilman Foster by Ruben's staff, A6)11 it should be determined through the Johnson County Policy and Technical Committees whether or not a need for Freeway 518 is indicated by the Area Transportation Study. - It was moved by deProsse and seconded by Perret that the Mayor be authorized to sign the contract for State Transit Assistance Funds in the amount of $107,37, from the Depart- ment of Transportation. Motion carried unanimously, 7/0. It was moved by'deProsse and seconded by Selzer to in- vestigate establishment of an Energy Commission as an advisory body, to Council, and that the Rules Committee draft an appro- priate document for the establishment of this Commission and report back to the Council in one month. Motion carried unani- mously, 7/0. council decided to not discuss the proposed Human Rela- tions Ordinance until all Councilmembers can be present, speci- fically to discuss -Sec. 10.2.3. Attorney Hayek stated that he wished to be present also. Traffic Engineer Jim Brachtel was complimented on his courteous and well -researched letter answering questions of Robert Welsh concerning the proposed Traffic Ordinance. City Attorney Hayek advised that the Campaign Finance Ordinance was awaiting his review. City Clerk Stolfus stated that two persons had taken out nomination papers for the next Council election. Page 4 Council Activities February 1, 1977 City Manager Neal Berlin reported that the University will pay the sewer rate established by the City under an interim contract which will expire on July 1, 1978. Through this period the City and the University can negotiate speci- fic terms for a long-term contract. He asked that the Tenant Landlord Ordinance be referred to the City Attorney for re- view and comment. It was moved by Selzer and seconded by Balmer to so refer the Ordinance. Motion carried unanimously. Attorney Hayek pointed out that this is the first time for an ordinance to be initiated by the citizens, and he would need to work on how the City is going to respond to it or any future ordinances.. Several questions were asked, and will be answered in the Attorney's report, which should be ready in two weeks. It was moved by Selzer and seconded by Balmer to refer the ordinance to the Housing Comm. for report within 60 days. Motion carried unanimously. Atty. Hayek also advised that the Amerex Lawsuit ruling would be coming by the end of February. It was moved by deProsse, seconded by Balmer, to adopt RESOLUTION #77-28, as recorded in Resolution Book 38, pages 48-54, AUTHORIZING THE MAYOR TO SIGN A DESIGN AGREEMENT WITH HANSEN LIND MEYER, INC., FOR DESIGN OF THE ARCHITECTURAL BAR- '''' RIER REMOVAL PROGRAM. This project provides for preliminary design, final design, and construction inspection of certain City -owned property. Affirmative roll call vote was unanimous, all Councilmembers present. A motion was made by Perret, seconded by deProsse, to adopt RESOLUTION #77-29, as recorded in Resolution Book 38, page 55, ADOPTING THE "NEIGHBORHOOD REDEVELOPMENT PLAN" DE- VELOPED TO MEET REQUIREMENTS OF CHAPTER 403 OF THE CODE OF IOWA. Mayor Neuhauser advised that her signature was needed this afternoon on the IDOT Grant for operating assistance. Assistant Attorney Bowlin explained the City's obligations. This contract is in effect from July 1, 1976 thru June 30, 1977. $86,000 can be used for operating expenses and $20,000 for purchase of the buses. The Council cannot reduce services or reduce fares. There were no objections to the Mayor signing the �a Itan 4b.(2) Resolution. Council decided to review Phase II of the Iowa River Corridor Study with the Riverfront Commission. It was suggested that the study be received and filed, and the item added to the pending list.. Councilman Balmer advised he would be absent from the February 7th and 8th meetings. Several disbursements were questioned. The City Manager advised he would check into then. An article on Zero -Based Budgeting in the "Government Executive" magazine was pointed out. _,.._..grant:...,.. ZONDZ .APPLICATIONS Senior Planner Don Schmeiser was present for discussion. Kennedy. 7ract - Planning and Zoning Commission has instigated a rezoning of this 25 acres from RIA to C2. Kennedy approves, and has advised he will be phasing out the salvage yard in three years. Howard Johnson - This LSNRD is not ready for Council action. Village Green - Will be on the agenda next week. The Homeowners Associa- tion will own the private open space and maintain it. The require- ment for six off-street parking spaces was discussed. AGENDA City Manager Neal Berlin explained why the City was contracting with Associated Engineers instead of the Ralprin firm regarding design for public improvements in the urban renewal project. The previous memo from the legal department was pointed out. The City Manager called attention to his mneao, and requested that before he authorizes any expenditure for the contract with Associated Engineers, any problems should be resolved. The next Council decision point on urban renewal will be toward the end of February. Councilman Balmer called attention to definition (a) in the Human Relations proposed Ordinance regarding 'affectional preference', and stated that he would be completely opposed to the ordinance if this remains in the Ordinance. Councilmen Vevera and Selzer agreed. Neuhauser pointed out _ that it doesn't even say "adult" persons. It was also questioned if the time limit (120 days) in 10.2.10 was in the line with State law. The City Manager pointed out two changes: (1) appointment by the Cannission of legal counsel, and (2) selection of personnel. 10.2.11 and 10.2.19 were discussed. Councilman Selzer reported that he had received information from Regional Planning Director Plnil Brandt, from the 1964 Origin Destination Survey, concerning destination of vehicles caning into Iowa City from the South. He stated that after 12 years, destinations have changed. The Iowa Department of Transportation will provide other information in three weeks. Mayor Neuhauser asked that Dick Plastino's camnents on Draft Report #3 of the Area Transportation Plan be distributed. Councilman Perret outlined procedure steps for the ATS. The Mayor ccnmented that she would like to hear the University make the statement that they agree with the.West Campus Bypass. She added that the City would have to decide if the easterly—southerly part would be something the City is r - going to want to do. + BUDGET (Kraft, Jones, Vann, and Vitosh present for discussion) Finance Director Rosemary Vitosh explained the questions raised about Cumnnity Development on Thursday about the revenues and personnel. She distributed corrected infornation regarding pages 165 and 167 in Proposed budget. It was explained why salaries for two housing inspectors have to stay in the General funds. In the proposed budget, planning means current planning. Comprehensive comes under Community Block Grant; Housing and Code Enforcement is under Camgunity Block Grant and General Funds; Urban Renewal is under HCDA and U, R. Grant; Rehab is Comnmity Block Grant; and Leased Housing is under HMA, Section 8, Section 23 and Mid -States contract. Engineering is in Public Works. Currently there is one person in current planning and there are two vacancies. It was suggested that another nano be found for 'current' planning, and that some things could have been made clearer for Council to understand. 'There was no consensus to reduce salaries, dues or travel. PARKING REVENUES The City Manager pointed out that to reduce the fine from $2 to $1 would reduce receipts by $70,000. The problem is caused by employees of downtown businesses feeding the meters throughout the day. Don Akin, Parking Supervisor, and Nancy Heaton, Treasurer, were present for discussion of alternatives and problems encountered. The Mayor suggested checking shopping figures, to see if people are shopping downtown. People are feeding the meters, and parking lots are having better percentage of use. It was also suggested that each individual business downtown be sent a letter asking that employees not park where spaces have been planned for individual shoppers. An observation was made that any change in parking might affect building of the parking ramp. One alternative mould be to reduce the fine to $1, but if a car is chalked after two hours, the fine could be more: The staff asked for more time to look at ` this. AIRPORT - It is self-supporting. REFUSE FEE An information sheet was distributed. The landfill fee could be 780 for two months and would be billed thru the water/sewer bill. This includes land acquisition. For private haulers the fee mould be $9.62 per ton, as the access road was deleted. Although there are 11,000 residences, the figures were based on 10,000 residences, allowing for some exemption for low income elderly. The Mayor noted need for consideration of alternatives for accommodating refuse, possibly thin the East Central Iowa Regional Planning Commission. It was the consensus of Ccmcil to fund refuse from revenue sharing. This is with the understanding that there is going to be $100,000 in revenue sharing in transit switched with $100,000 of property tax, and the $100,000 of property tax put in the refuse collection. There will be it charge of 390 for landfill and the property tax lid will, remain at 7�, The private hauler will pay $4.62 a ton, This will do away with most of the inequity between the commercial and residential persons. Tro It was suggested that the Councilmarbers meet again with the Legislators. For Fiscal Year 79 a 5% lid is being proposed, based on assessed valuation of agricultural land and residential land. This does not apply to most apartments, which would create problems for Iowa City. LInw Kiln Farm Estates - This addition is within the extra -territorial jurisdiction of the City. The developers waived all rights to protest against public improvenents assessments. Attorney Charles Mullen for the developer objected to the provision of waivers, but requested the Resolution approving to be on tomorrow's agenda. There were no objections to having the Resolution on the agenda, but no Councilmembers wanted to waive the agreement. Commissioner Ton Scott presented a written minority report and explained it. Civil Rights Specialist Linda Ragland asked that, as a minimum, Council bring the Ordinance up to State Code. Councilmen Balmer and Vevera noted concerns and reservations and called attention to Attorney Hayek's meso. Ccamissioners Barbara Woodard, Clara Olesen and Niece Braverman were also present for discussion, along with Hannah Weston for the American Civil Liberties Union and Linda McGuire from the Women's Resource and Action Center. Observations made were that (1) in employment waren have had to face, for many years, harassment and solicitation, (2) the 120 days after the facts, allowed for filing a claim in according to State law, Federal law allows 180 days, (3) the Comiissi.oners favor a three year term, as an individual can be reappointed. Something could be added so that if a Commissioner was in the middle of a conciliation, the term could be continued to a logical stopping point, (4) there were some funds in the budget to provide for hearing officers for the Commission and for the Civil Service Commission, (5) 10.2.15G and 10.2.17C are from the State Code, and (6) the name suggested for the Ordinance is the 'Human. Rights Ordinance'. The Mayor questioned if there was a particular problem in Iowa City with 'marital status' in housing. Those present for discussion noted several complaints. Fredine Branson called attention to the fact that in the Federal law for rent projects you have to show a legal relationship between the applicants. The Mayor suggested setting a public hearing on the Ordinance in three weeks. Chairman Sam Fahr and Conmissioner Brandrup were present for discussion. This study is a proposal for the core of the development of the entire corridor, submitted after consulting with several agencies. The proposal is not binding, but gives the citizenry a general idea of the policies that will probably be adopted. The Counission would like to see the $42,000 which was spent on this Study by the Stanley Consultants, lead to action. All three phases of the Study have been furnished to the people in tho peninsular area. Mayor Neuhauser called attention to the proposal for land -banking. The City Manager advised that Attorney Meardon had filed something at the Court House concerning this case. Council decided, unanimously, that Councilman David Perret would be their representative on the Regional Planning Executive Ccmnittee.
