COMPLETE DESCRIPTION OF COUNCIL ACTIVITIES
FEBRUARY 22, 1977
7:30 P, M,
Iowa City City Council, regular session, 2/22/77, at
7:30 P.M. at the Civic Center. Councilmembers present:
Balmer, Foster, Neuhauser, Perret, Selzer, Vevera. Absent:'
deProsse. Mayor Neuhauser presiding.
Emilie Rubriaht, representing Robert Lucas PTA, appeared scoY�t7l
and presented two petitions which requested that the paving L�
installed on American Legion Road east of First Avenue be
constructed of textured concrete or grooving to make it skid -
resistant and to provide a rough surface for safety measures.
It was moved by Foster, seconded by Selzer, to receive and
file the petitions and refer to the Public Works Department. 37
Motion carried, 6/0, with deProsse absent.
Ralph Oxford, representing Su er and Yellow -Checker Cab
Companies, Inc., appeared and presented an application for
renting two existing cab stands for 1977. After further dis-
cussion, Mayor Neuhauser recommended that a copy of the draft
ordinance concerning taxi cabs be sent to Mr. oxford. for his
comments. It was moved by Perret, seconded by Vevera, to re-
ceive and file the application. Motion carried, 6/0, with
deProsse absent.
Mayor Neuhauser proclaimed the week of February 20 -Febru-
ary 26, 1977, as F:Q71ea,oav Week and Btz�Y ,iiatnry Week. Mayor 37
Neuhauser gave her ''tate of the City Messacre oihich included
a summarization of achievements made by the City in 1976 and
future goals for 1977. It was moved by Foster, seconded by
Perret, to receive and place on file as a part of the,perma-
nent record, the Mayor's State of the City Message. Motion 3 7 ii
carried, 6/0, with deProsse absent.
Councilman Selzer moved, Councilman Balmer seconded, to 7 '
amend Item 3.e.(1) to include "interest in property located -
wittiin boundary of Urban Renewal". Motion carried, 6/0, with

Councilman Max Selzer relating to interest in property lo-

lic hearing on 3/8/77 at 7:30 P.M. in the Council Cham-
bers concerning the ordinance amending the Municipal Code,
Chapter 10.2, Human Relations Commission. Motion accept-
ing the Civil Service Commission's list of persons who

City Manager Berlin noted publicly that the public hearing
on the ordinance amending the human Relations Ordinance would
be held 3/8/77, 7:30 P.M. at the Civic Center.
Don Schmeiser, Senior Planner, appeared concerning the
forinu a-t-'on�=Ncommendations to the City of Coralville re-
garding the preliminary plat of Valley View Knoll of River
ileicints, Second Addition. He presented a map of the subdivi-
sion and elaborated on the recommendations made by the Planning
Division and Engineering Division as outlined in a memo dated
2/17/77. He stated the Planning and Zoning Commission rocom-
mended by a 5/0 vote the followings (1) Council recommend to
the City of Coralville approval of the plat contingent on the
first 14 items in the memo, and (2) in lieu of public improve-
ments, the subdivider provide an nsnonnment of waiver for re-
construction of the facilities and dedication of the cul-de=
sacs if annexed. it was moved by renter, seconded by Vevera,
to adopt the recommendation of the Planning and Zoning Commi.s-
sion with the contingencion an outlined. Motion carried, 6/0,

Referring to Item 3.e.(2) on the Consent Calendar, it
was moved by Perret, seconded by Foster, to set the public
hearing on the ordinance amending the Municipal Code, Chapter
10.2, the Human Relations Commission, for March 15, 1977, at
7:30 P.M. at the Civic Center rather than the previous date. 9
Motion carried, 6/0, with deProsse absent.
Mayor Neuhauser requested that Council adjourn to a brief
executive session later in the meeting to discuss the appoint-
ment to the Housing Commission. There were no Council objec-
tions.
John Stratton, representing the County Administration and
Joint Law Facility Bond Issue Committee appeared and urged
Council to endorse and support the bond issue for a Joint Law
Facility. Mr. Stratton explained that it was his understand-
ing that the -parking lot spaces which were not to be used for
the public would be rented to County employees at an equitable
rate comparable to the City's rate. A motion was made by
Vevera, seconded by Selzer, to amend the Resolution to in-
clude ."County Administration Building and..." Motion Car-
ried, 6/0, with deProsse absent. It was moved by Balmer,
seconded by Perret, to adopt RESOLUTION ;77-58, as recorded
in Resolution Book 38, page 101, SUPPORTING THE JOHNSON COUNTY
BOND ISSUE FOR A COUNTY ADMINISTRATION BUILDING AND A JOINT
LAL9 FACILITY, as amended. Affirmative roll call vote was unani-
mous, 6/0, with deProsse absent.
Councilman Selzer reported that University Heights decided
to send an informative letter to their citizens concerning
purchasing a services contract with Iowa City. Several Coun- 396
cilmembers expressed disappointment in this action. fie also
reported that he and Councilwoman deProsse would be present-
ing a Resolution to establish a "Resource Conservation Commis-
sion," in the near future. -327
City Manager Berlin stated City staff had met with down-
town businessmen and felt an agreement had been reached con-
cerning loading zones in the Model Traffic Ordinance, fie fur-
ther stated our Police Chief was working with the University
of Iowa concerning an agreement on bicycle licensing to alleviate
redundancy in registration; and as soon as this was settled,
Council would be receiving the Model Traffic Ordinance. Berlin
indicated he would check on the possibility of eliminating
signs in the downtown area which are in or nqe barrols,nnd he
would check on parking regulations and rerouting of truck-), _-3—n—
City Manager Berlin indicated the City has been notifying;
the public by newspaper concern.inq traffic ticketinq on holi-
days, but will check into other aspects of the matLhr. Coun-

Gilman Balmer requested information on the minutes of the

It was moved by Balmer, seconded by Selzer, to refer the
excerpt from the Jan. - Feb. 1977 issue of NAHRO Newsletter
entitled, "Rental Housing Mediation Service" to the housing
Commission to review and make a recommendation back to Coun-
cil. Mo tion carried, 6/0, with deProsse absent. 4/00
The public hearing was held on the ordinance rezoning a
tract of land located south of Winebrenner Dreusicke Ford
from RIA to C2 zone. Councilman Foster noted the owner, Paul
Kennedy, Jr., was planning to phase out the salvage yard with-
in
ith-in approximately three years. There being no interested per-
sons present to speak, the public hearing was closed. HO /
Mayor Neuhauser opened the public hearing on the proposed
plans, specifications, form of contract, and estimated cost
for the 1977 Tennis Court Lighting Project. It was moved by
Selzer, seconded by Vevera, to adjourn the public hearing for
one week. Motion carried, 6/0, with deProsse absent. 4/O 2
City Attorney Hayek summarized the Supreme Court's action
in the Court case, "Buckley v. Valeo," which caused portions
of the City's ordinance $75-2783 to become unconstitutional.
He pointed out that Council was being presented with two Ordi-
nances: (1) an ordinance which amends the City Charter to
comply with the Supreme Court ruling and (2) an ordinance to
amend the City's existing campaign finance ordinance to elimi-
nate the limit on campaign expenditures from the candidate's
own funds. After further discussion, it was moved bj Selzer,
seconded by Balmer, that the ORDINANCE AMENDING THE HOME RULE
CHARTER FOR THE CITY OF IOWA CITY, IOWA, TO MAKE SECTION 6.01
CONFORM WITH THE SUPREME COURT DECISION OF BUCKLEY v. VALEO
,be considered and given first vote for passage. Counci man
Perrot discussed broadening the scope of the Ordinance to in-
clude limitations on expenditures for initiatives and refer-
ondums. Roll call vote on the first consideration was as
follows: Ayes: Neuhauser, Selzer, Vevera, Balmer, Foster.
Nays: Perrot. Absent= deProsse. First consideration given,
5/1. Len Brandrup, 922 Kirkwood Avenue, appeared conrorning
expenditures on the tenant -landlord initiative. y0 3
It was moved by Selzer, seconded by Vevera, that the ORDI-
NANCE AMENDING ORD. NO. 75-2783 TO DELETE SECTIONS VII (B),
(C), AND (D) WHICH PLACED LIMfTATIONS ON A CANDIDAT'E'S EXPENDI-
TURES OF HIS PERSONAL FUNDS, A CEILING ON OVERALL CAMPAIGN
FXPFNDITURES AND INDEPENDENT EXPENDITURES be considered and
given first vote for passage. A motion was made by Perrot,
seconded by Foster, to amend the ordinance by decreasing the

amount of donation per donor to candidate's fund from $125 to
$50 per City election. Council discussed contributions
by means other than directly to the candidate's general fund.
Len Brandrup, 922 Kirkwood, and Emilie Rubright, 913 Juniper,
appeared. Councilman Perret withdrew his motion to amend the
ordinance and made a motion to set a formal public hearing on
the ordinance, which was not seconded. Since Councilman Foster
did not withdraw his second to the motion to amend the ordi-
nance, it received the following roll call vote: Ayes: Balmer,
Foster, Neuhauser. Nays: Selzer, Vevera. Abstain: Perret.
Motion carried, 3/2/1, deProsse absent. Councilman Perret
stated that although he did favor the reduction in limiting
contributions from $125 to $50, he would prefer to have a pub-
lic hearing so that the public could discuss the merits and
demerits of the ordinance and also to allow time to consider
in terms of other alternatives available. Roll call vote on
the original motion to give ordinance first consideration was
as follows: Ayes: Selzer, Vevera, Balmer, Foster, Neuhauser.
Nays: Perret. First consideration given, 5/1, deProsse absent_.
It. was moved by Foster, seconded by Perret, to adopt RESOD
LUTION ,u,77-59, as recorded in Resolution Book 38, page 102,
AUTHORIZING FILING OF A COMMUNITY DEVELOPMENT BLOCK GRANT APPLI=
CATION IN THE AMOUNT OF $2,061,000 UNDER THE HOUSING AND COMMU-
NITY DEVELOPMENT ACT OF 1974, INCLUDING ALL UNDERSTANDINGS AND
ASSURANCES CONTAINED THEREIN AND DESIGNATING THE CITY MANAGER
AS THE AUTHORIZED CHIEF EXECUTIVE OFFICER FOR THE GRANT. Af-
firmative roll call vote was unanimous, 6/0, with deProsse

It was moved by Selzer, seconded by Foster, to adopt RESO-
LUTION $77-60, as recorded in Resolution Book 38, pages 103-104,
APPROVING THE PRELIMINARY AND FINAL PLAT OF TRACY LANE ADDITION.
Affirmative roll call vote was unanimous, 6/0, with deProsse

RESOLUTION 077-61, as recorded in Resolution Book 38, pages
105-106, PROHIBITING PARKING ON THE WEST SIDE OF SUMitiIIT STREET
FROM THE CENTERLINE OF COURT STREET EXTENDED TO A POINT 75 FEET
NORTH OF THE CENTERLINE OF COURT STREET EXTENDED, to facilitate
movement of buses during the bridge embargo at Court and Musca-
tine. Affirmative roll call vote was unanimous, 6/0, with
deProsse absent. 4/07
After the Mayor read the Resolution, it wan moved by Foster,
seconded by Vevera, that RESOLUTION @77-62, as recorded in Reso-
lution Book 38, page 107, ADOPTING PHASE II OF THE IOWA RIVER
CORRIDOR STUDY,be adopted. Affirmative roll call vote was unani-

It was moved by Selzer, seconded by Foster, to adjourn to
a brief executive session to discuss the appointment to the
Housing Commission and afterwards to reconvene in regular ses-
sion to make the appointment. Affirmative roll call vote was
unanimous, 6/0, with deProsse absent. Meeting adjourned,
9:40 P.M.
Upon Council's reconvening to regular session, it was moved
by Neuhauser, seconded by Foster, to appoint Maynard Tghitebook
14 Glendale Court, to fill the vacancy on the Housin4 o m;c_
sion with term expiring May 1, 1979. Motion carried, 6/0,
with deProsse absent. 41
