b. Consider recamiendation by Parks and Recreation Commission.
To approve S-7639, preliminary large scale residential develop-
ment plan, planned area development plan, and preliminary
plat of ly'n Cae addition located east of Mormon Trek Blvd.
and north of the City Limits with the following stipulations.
(1)that at the time of Final PAD is approved, the petitioner
has met the requirements of the Iowa City Tree Ordinance
and the Stom Water Setention Ordinance;
(2) that waivers be granted so that:
(a) buildings need not be separated by a horizontal
distance ,equal >to the height of the highest building,
and
(b) aturn-around on Cambria Court need not meet the require-
ments of the Subdivision Code with respect to the,
diameter ofl,the turn -around;!
(3) that a covenant be attached to the plan which describes the
general 'size and',characteristics of duplex units; and
'thata completion schedule is attached to`the plan.'
The Council should take special note of the minutes of the
Park.'and Recreation Comnission` meting held on'February ,9, 1977,
which,minutes are attached to this agenda. Therrecoamendation
`
is'.that "exploration be encouraged of,a trade of land south
of ,Willow Creek Park for use as a neighborhood park as payme t
for use of a'portion of Willow Creek Park as a'water detention '
area." This item is now being presented to the City Council
for,review'at the informal neeting on February 28th, at which
time the staff will be present to discuss this; item with the
City Council.
A resolution to.approve the subject plan and,plat will later
be presented to the City Council for consideration at the same
meeting the City Council considers the third!'reading and
adoption of an ordinance to rezone the site from RIA Zone to
an RIB Zone.

and east of Village Green Boulevard,' subject to the sub-
mission,'of a dedication', document granting a perpetual
easement to,the City fon the water ncLim located in Old
Farm Apartment lot.

C<xmnnt: The Planning and &mini; Gnmissi.on at a regular
meeting held on February 17, 1977 reccxm,ended by a 4-1
vote approval of the subject subdivision located 'south of
Muscatine Avenue and east of Village Green Boulevard
subject to the submission of a dedication document granting
a perpetual easement to the City for a water main to be
located 'in Old'Farm Apartment lot. Since the 'end of the
60 -day limitation period within which the City must approve
the plat is March 4, 1977, it is necessary that',the City
Council consider the plat at this meeting, deny', the plat
'
if the necessary dedication document has not been submitted;
or defer action if the applicantsubmits a waiver of
'
the 60-day;'limitation-period. A staff 'analysis ofthe
subject addition was presented in Staff;Report dated
January 20,1977, which is attached to this agenda: The
Commission's "recommendation is consistent with the staff's
recomnendation presented in said report.
In conjunction withz this', item, a final Planned Area
Developient plan has been submitted to convert an existing
"barn located on the site°of a five-unit'condaninium apart-

south of Melrose Avenue and east of West High School,
subject to the following contingencies:

(1) the City accept the sanitary sewer plan as most

(3)" that the left -turn traffic lane on Melrose Avenue be
provided at the expense of the developer,
(4) that the storage lane, or right -turn lane, on Westwinds
Avenue be dedicated, but not constructed at this time';
but that a waiver of future' assessment be granted,
and
that all requirements of the Storm Water Detention

A resolution will be presented to the City,Council at

Comment:
The Municipal Campaign Fainance Ordinance retains its reporting require-
ments'and the limitations on campaign contributions by persons but the
sections limiting independent expenditures, limiting a candidate's
expenditures from his personal funds, and the ceiling on overall
campaign expenditures are deleted.

REPEALING ARTICLE XXXI.OF ORDINANCE NO. 2238 AND ENACTING NEIY PRO-
VISIONS IN LIEU 1HI7iDOF (first consideration).
Comment:
This public hearing was adjourned from the meeting of, February 8,
1977; and held February 15, 1977. The Planning and Zoning`Co mission
on January 6, 1977, recommended byla 7-0 vote approval of the proposed
ordinance' amending Sections 8.10.20.F, 8.10:20.G, and 8:10.32A of
M,
'the Zoning Ordinance. The changes being made are essentially as

follows:

(1) The ordinance would increase the time period within which the
Commission must consider a;rezoning application and a planned
area 'development, 'plan from 45 to 60 days.
(2) ',The ordinance would',alter the procedures for amending the Zoning'

(first consideration).

'Mr. Paul Kennedy, Jr., has sutmit.Led an app] ication to reran the
subject tract frau an RIA Zone to an MI. Zone which the Commission
had recogmended be denied. The Commission, however, instigated
consideration to rezone the tract of land to a C2 Zone. At a
regular meeting held on January 20, 1977, the Cemnission recommended
by a'':7-0 vote that the subject property be rezoned to a C2'Zone. `
This property was rezoned RIA upon annexation into the City and
reestablished as R1A in 1974 with the readoption of the rezoning
map primarily to place the auto salvage operation located on the
property in a non-conforming status.- Since an auto salvage yard
is permitted only in an M2 Zone, the auto salvage; operation would
;still be non-conforming in a C2 Zone. This reconmendation''is

URBAN RENL3YAL PROPERTY.
Comment:
(Regulations oflthe U.S. Department of Housing and Urban Development
require,ahat reuse values.be established on UrbanlRenewal nand.

If appraisal evidence is over 18: months old,l, new appraisal'evidence
is required, and, the re-use values must be updated. The City has
'
obtained new appraisals and had theseappraisals reviewed by a third
,{
appraiser. The reviews appraiser has provided a report stating the
Opinion 'of Value. ' This resolution establishes the'Fair Re Use
values consistent with the review: appraisers openions of value and
!
will allow the City to purchase the property and close out the
project with HUD.

to execute an application from IIG&E to the State Highway'ICannission
for construction of overhead power lines to serve the airport. This

power supply is actually lw request from the FAA sol that they would
be able; to install' a NASI for one of the runways atYthe 'airport.

The VASL;is a safety system'of lights for the runway which the FAA
:intends to instalt at their cost., Although the system is necessary,
