Item Noll 12 - CONSIDER AN: ORDINANCE AMENDING ZONING ORDINANCE 2238 BY CHANGING THE USE
!,
REGULATIONS OF CERTAIN PROPERTY FROM RIA ZONE TO C2 ZONE (second consideration).,;
Comment: Mr. Paul Kennedy, Jr., has submitted an application to rezone the subjectr
tract from an RIA Zone.to an Ml Zone which the Commission had recommended
be denied. The Commission, however,' instigated consideration to rezone
t}ieltract of :land to'a C2 Zone. At ' -a regular meeting held on January 20,
977, the Commission recommended by,a 7-0 vote that the subject; property
i, be rezoned toga C2 Zone. This property was rezoned RIA upon annexation
into,'.the City,and reestablshed as RIA in3974 with the'readoption of the I.
rezoning map primarily to place the auto salvage operation'' ocated on the
property ,in<a nonconforming 'status. i:Since an auto salvage yard is permitted
on) y in an 1 M2: Zone, the auto 'salvage operation'would still be nonconforming
in!a C2 Zone. This recommendation is consistent with the staff's recom-
mendation.
