Councilmembers present: Balmer, deProsse, Foster, Neuhauser, Selzer, Vevera. Absent: Perret. Mayor Neu- hauser presiding. After the Resolution was read, it was moved by Vevera, seconded by Selzer, to adopt RESOLUTION #77-68, as recorded in Resolution Book 38, page 119, OF COMMENDATION for the 27 years and 8 months of service given by Raymond M. Hess with the Iowa City Fire Department. Affirmative roll call vote was unanimous, 6/0, with Perret absent. 41X2 - Mayor $2 Mayor Neuhauser proclaimed March 8, 1977, as Working Women's y g s Day and the week of March 13 - 19, 1977, as a week of recogni- tion for the boys basketball team of West High School. 4 g y Council deleted Items 3b(2) & (3), minutes of Civil Service Commission meetings of February 15 and March 1, 1977. It was moved by Foster, seconded by deProsse, that the following items and recommendations in the Consent Calendar be approved and/or adopted as amended: Approval of official actions, regular Council meeting, 2/22/77, subject to correction, as recommended by the City Clerk. In reference to the Civil Service Commission minutes de- leted, Councilman Vevera noted concern that the position of Dep- uty Chief in the Police Department would not be a civil service position. He further suggested that the list for the position of Sergeant was not complete and took exception to the state- ment that no one was qualified for the position of Captain. Coun- cil discussed the possible authority of the Council in these mat- ters. City Attorney Hayek will report on issues raised at a future meeting. It was moved by Vevera, seconded by Selzer, to defer action on the Civil Service Commission minutes of 2/15/77 and 3/1/77 and discuss informally. Motion carried, 6/0, with Perret absent. It was moved by Vevera, seconded by deProsse, to defer action on the Civil Service recommendations concerning lists for Sergeants and Captains. Motion carried, 6/0, with Perret absent. SOO City Manager Berlin stated the bushes had been removed on Iowa Avenue for safety reasons. He further stated Council would be receiving a memo from staff concerning the house relocated in the Tanglewood Drive -Ventura Avenue area owned by Max Yocum. SO/ Mayor Neuhauser announced that there was a vacancy on the Committee on Community Needs with an unexpired term ending June 30, 1977, and three vacancies on the Housing Commission with terms expiring May 1, 1980. Appointments for these commis- sions will be made on April 12, 1977, at the regular Council meeting. Mayor Neuhauser asked that the sentence which extended the term for two years for the Committee on Community Needs posi- tion be deleted. There were no objections by Councilmembers. SO 2 It was moved by Foster, seconded by deProsse, to accept the recommendation of the Project GREEN Steering Committee for the reappointment of Bernadine Knight for a three-year term as Proj- ect GREEN Trustee. Motion carried unanimously, 6/0, with Perret absent. 150 3 Council discussed the penalty for defacing buildings. City Manager Berlin stated the Magistrate or District Court Judge would make the decision as to the penalty for each case. Sd Page 3 Council Activities March 8, 197'7 Mayor Neuhauser reported on the National League of Cities Meeting in Washington, D.C., and action contemplated by the Community Development Committee. A Dissidents Committee has been formed by people from cities which have populations under 50,000. These cities will lose hold -harmless funding after 1980, but can apply for discretionary funding. This would have a substantial adverse impact on the Ralston Creek project. The Mayor requested permission to serve on a Steering Committee to possibly change the League's policy. There were no objections to having the Mayor serve and the City paying the expenses. Councilwoman deProsse discussed briefly the items her Transpor- tation Steering Committee is working on. 50115- City oS City Manager Berlin explained the memo he presented to Council concerning request by the Fire Union for Arbitration Fire Impasse, and stated the City had notified PERB that the City will only accept a single arbitrator. in The public hearing on the final Planned Area Development of Village Green, Part 6, was held. Richard McCreedy, Iowa City Development Company, appeared and asked that Council give all three considerations of the Ordinance at this time. Public hear- ing closed. It was moved by Selzer, seconded by Balmer, that the rule requiring that ordinances must be considered and voted on for passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, that the first and second consideration and vote be waived, and that the ordi- nance be voted upon for final passage at this time. Affirmative roll call vote was unanimous, 6/0, Perret absent. It was moved by Selzer, seconded by Vevera, that ORDINANCE n77-2825, as recorded in Ordinance Book 11, pages 4 and 5, ESTABLISHING A PLANNED AREA DEVELOPMENT, VILLAGE GREEN PART VI, IN IOWA CITY, IOWA, be finally adopted at this time. Affirmative roll call S O 7 vote was unanimous, 6/0, with Perret absent. It was moved by deProsse, seconded by Foster, that the ORDINANCE AMENDING THE HOME RULE CHARTER FOR THE CITY OF IOWA CITY, IOWA, TO MAKE SECTION 6.01 CONFORM WITH THE SUPREME COURT DECISION OF BUCKLEY V. VALEO be passed and adopted. City Man- ager Berlin stated that Councilman Perret had asked for one week's delay on this ordinance and the ORDINANCE AMENDING ORD. NO. 75-2783 TO DELETE SECTION VII (B), (C), AND (D) WHICH ' PLACED LIMITATIONS ON A CANDIDATE's EXPENDITURES OF HIS PERSONAL FUNDS, A CEILING ON OVERALL CAMPAIGN EXPENDITURES AND INDEPEND- ENT EXPENDITURES. Councilwoman deProsse and Councilman Foster withdrew their motion to adopt the ordinance. It was moved by Vevera, seconded by deProsse, to defer both ordinances (Items s C3g 10 and 11). Motion carried, 6/0, with Perret absent. 0 0 Page 4 Council Activities March 8, 1977 A motion was made by Foster, seconded by Vevera, that the ORDINANCE AMENDING ZONING ORDINANCE 2238 BY CHANGING THE USE REGULATIONS OF CERTAIN PROPERTY FROM R1A ZONE TO C2 ZONE (Kennedy tract) be considered and given second vote for pass- age. Affirmative roll call vote was unanimous, 6/0. City Manager indicated that Councilman Perret wished to have the recorAs show that if he were present he would have voted in SD favor of this ordinance. City Manager Berlin explained changes he had included in the final printing of the FY 78 Budget as follows: (1) addi- tion.of the $3,600 back into the Recreation funding for the Boys and Girls Softball and Baseball Programs, (2) leaving in $600 in Recreation budget for Sunday night swimming at the Recreation Center, but eliminating open swimming on Saturday afternoon. There can be a budget amendment later to allocate the $3,600 from Revenue Sharing. It was moved by Foster and'seconded by deProsse to replace $3,600 in the Recreation Department Fund for the softball and baseball programs. Motion carried, 6/0, Perret absent. It was moved by Foster and seconded by deProsse that the budget reflect an additional $600 for Sunday night swimming at the Recreation Center. Motion carried, 6/0, Perret absent. -11 Councilman Balmer noted concern over the cut in funding for the PALS Program. City Manager Berlin stated that he would send information to Council concerning increasing amount allo- cated to the PALS Program by amending the Aid to Agencies. It was moved by Foster, seconded by deProsse, to adopt RESO- LUTION #77-73, as recorded in Resolution Book 38, pages 124- 125, ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR ENDING JUNE 30, 1978. Roll call: Ayes: Vevera, deProsse, Foster, Neuhauser. Nays: Balmer, Selzer. Motion carried, 4/2, with Perret absent. City Manager Berlin stated Councilman Perret indicated that, if present, he would have been in favor of adopting the Resolution for the Budget. Councilman Selzer explained his "no" vote, stating that he was opposed to many items in the budget and several items could have been cut. _571Z A motion was made by deProsse, seconded by Vevera, that RESOLUTION #77-74, as recorded in Resolution Book 38, pages 126-128, AUTHORIZING CORRECTION OF SPECIAL ASSESSMENT FOR 1968 PAVING AND SEWER PROJECT FOR PROPERTY OWNED BY JOHN H. Affirma- tive roll call vote was unanimous, 6/0, with Perret absent. This Resolution authorizes City staff to apply for Bureau of Outdoor Recreation funds for 50% ($25,000) of the total cost for park shelters in Wetherby and Willow Creek Parks. Councilman Balmer asked about alternatives to the present policy on the overtime parking tickets. City Manager Berlin stated that he would ask the Finance Department and Parking Division to prepare a written report. 5�5� It was moved by Selzer, seconded by Foster, to adjourn the meeting.
