City Mgr. Berlin explained the memo he pre-

stated City had notified PERB that the City
will only accept a single arbitrator.

of Village Green, Pt. 6, was held. Richard
McCreedy, Iowa City Dev. Co., appeared. Pub-

Court's action in the Court case, "Buckley
v. Valeo," which caused portions of the

Iowa City City Council, regular session, 2/22/77, at
7:30 P.M. at the Civic Center. Councilmembers present:
Balmer, Foster, Neuhauser, Perret, Selzer, Vevera. Absent:
deProsse. Mayor Neuhauser presiding.
` Emilie Rubright, representing Robert Lucas PTA, appeared
and presented two petitions which requested that the paving
'.- installed on American Legion Road east of First Avenue be
constructed of textured concrete or grooving to make it skid -
resistant and to provide a rough surface for safety measures.
It was moved by Foster, seconded by Selzer, to receive and
file the petitions and refer to the Public Works Department.

Ralph Oxford, representing Super and Yellow -Checker Cab
`Companies, Inc., appeared and presented an application for

Councilman Selzer reported that University Heights decided
to send,an.informative letter to their, citizens concerning
purchasing a services contract with Iowa City. Several Coun-
" cilmembers expressed"disappointment in this action. He also
reported.that he and Councilwoman deProsse would be present-
ing a: Resolution'to'establish a "Resource Conservation Commis-
'' sion';" in the near' future.
City.Manager Berlin stated City staff had met with down-
town businessmen and felt an agreement had been reached con-
cerning'loading zones in the Model Traffic Ordinance. He fur-
ther, -stated our. Police Chief was working with the University
". of'Iowa'concerning an agreement on bicycle licensing to alleviate
redundancy in registration; and as soon as this was settled,
r' Council would be receiving the Model Traffic Ordinance. Berlin
indicated he,would check on the possibility of eliminating
signs in the downtown area which are in orange barrels,and he
would check on parking regulations and rerouting of trucks.
City Manager Berlin indicated the City has been notifying
the public by newspaper concerning traffic ticketing on holi-
days, but will check into other aspects of the matter. Coun-

cilman Balmer requested information on the minutes of the
United Action for Youth Board concerning their ski trip.
It was moved by Balmer, seconded by Selzer, to refer the
excerpt from the Jan. - Feb. 1977 issue of NAHRO Newsletter
entitled, "Rental Housing Mediation Service" to the Housing
Commission to review and make a recommendation back to Coun-

The public hearing was held on the ordinance rezoning a
tract of land located south of Winebrenner Dreusicke Ford
from R1A to C2 zone. Councilman Foster noted the owner, Paul
Kennedy, Jr., was planning to phase out the salvage yard with-
in approximately three years. There being no interested per-
sons present to speak, the public hearing was closed.
Mayor Neuhauser opened the public hearing on the proposed
plans, specifications, form of contract, and estimated cost
for.the.,1977_Tennis Court Lighting Project. It was moved by

City Attorney Hayek summarized the Supreme Court's action
in the Court; case, "Buckley v. Valeo," which caused portions

Lime Kiln Farm Estates This addition is within the extra -territorial
.;jurisdiction of the City.,'The.developers waived all rights to

Mullen for the developer objected to the provision of waivers, but
requested the Resolution approving to be on tcm orra's agenda.
There were no objections to having the Resolution on the agenda,
but no Councilmembers wanted to waive the agreement. When the
proper; legal papers are signed, the Resolution will be added to the
'agenda.

Council discussed Item #8, the Ordinance concerning addition of time for
the Planning and Zoning Commission to hold public hearings. The Planning

holding the public hearing on a preliminary planned area development
instead of a final PAD.. Council will await P & Z's recommendation.

HUMAN RELATIONS ORDINANCE
Carmissioner Barry Matsumoto sumnarized changes in 10.2.4, 10.2.5,
10.2.6, and 10.2.12. Comnissioner Tan Scott presented a written minority
report and explained it. Civil Rights Specialist Linda Ragland asked
that, .as a minimum, Council bring the Ordinance up to State Code.
Councilmen Balmer and Vevera noted concerns and reservations and called
attention to Attorney Hayek's memo. Cannissioners Barbara Woodard,
Clara Olesen and Mace Braverman were also present for discussion, along
with Hannah Weston for the American Civil Liberties Union and Linda
McGuire frau the Warren's Resource and Action Center.
Observations made were that (1) in employment women have had to face,
for many years, harassment and solicitation, (2) the 120 days after the
facts, allowed for filing a claim in according to State law, Federal law
allows 180 days, (3) the Commissioners favor a three year term, as an
individual can be reappointed. Something could be added so that if a
Commissioner was in the middle of a conciliation, the term could be

continued.to a logical stopping point, (4) there were some funds in the
budget to provide for hearing officers for the Comnission and for the
Civil Service Commission, (5) 10.2.15G and 10.2.17C are frau the State
Code, and (6) the new suggested for the Ordinance is the 'Human Rights

The'Mayor.`,questioned if there was a particular problem in Iowa City with

'marital status'. in housing. Those present for discussion noted several
complaints. Fredine.Branson called attention to the fact that in the

the Ordinance in three weeks.
RIVER "ODRRIDOR S=
Chairman Sam Fahr and Commissioner Brandrup were present for discussion.
this study is a proposal for the core of the development of the entire
corridor, submitted after consulting with several agencies. The proposal
• `'is not binding, but gives the citizenry a general idea of the policies
that will probably be adopted. The Comtission would like to see the
$42,000 which was spent on this Study by the Stanley Consultants, lead
to action.
All three phases of the Study have been furnished to the people in the
peninsular area. .Mayor Neuhauser called attention to the proposal for
land=banking:, Chairman Fahr pointed out that the Riverfront Commission
mission
did not get any HC1DA funds, He explained the need for a River Corridor
Management. Corporation (page. 52) and for a River Corridor Management
District <(page,36)-to coordinate plans by Iowa. City, Johnson County, the
University and the Army Engineers, and called attention to page 19 and
pages 6 and 7 of the Study. Control of erosion was discussed. Fahr
asked for sane Council discussion to help then to know in which direction
their -legislation to allow the Commissioners to work in the areas discussed.

The City Manager explained that regarding Item 3.d.1, the project at the
City Park has some problem. Ile advised that the IICDA budget application
mightbe ready next week.
COUNCILTIME
Councilman Perret advised he would be presenting a bill concerning
recycling of cans. The Mayor stated that the Council Legislative Ccmnittee,
(John;, David and Pat) should meet and decide which legislation the
Council is going to lobby for this session. She advised that the State
legislators do not want to meet on Saturday mornings with Council as a
group, only wish to meet with the 'public'.
Mayor Neuhauser called attention to Councilman Selzer's possible conflict
of interest concerning the rezoning on North Dodge. Selzer advised that
he and IaVerne Shay own the building where he (Selzer) has his office.
The legal department will be asked to decide if it is a conflict, because
it would make a differencein voting if an extraordinary vote was needed.

Ryan's letter to Chadwick.

Iowa City City Council, regular session, 3/15/77, 7:30 P.M.
at the Civic Center. Councilmembers present: Balmer, deProsse,
Foster, Neuhauser, Selzer, vevera. Perret arrived at 7:40 P.M.
Mayor Neuhauser presiding.
Mayor Neuhauser announced that Item 8 would be taken up at
this time and declared the public hearing on the proposed Human
Relations Ordinance open. Human Relations Commissioner Clara
Oleson explained the proposed changes as follows: (1) addition
to prohibitive criteria for discrimination the protective classes'
of marital status, homosexuality, age, and disability, (2) addi-
tion of sex discrimination in area of housing, and (3) addition
of a new area of credit. Persons appearing who supported the
adoption of the new ordinance were as follows: Jo Mastrey; Gene
Gronewold; John Smith; Neil O'Farrell; Ann Knight; Joan Zug;
Valerie Wilk,. presenting a statement from the Protective Associa-
tion of Tenants; Ellen Findley; Allen Keller; David Smithers; .
Winston Barclay; Charles Ryan; Jeanne Smithfield; Linda McGuire,
representing Women's Resource Action Center; Jane Vanderbasch;
Loche Williams; Dick Leonard; Clements Urdahl, presenting a state-
ment from Tenants United for Action; Susan Burden, reading a
statement signed by fifteen members of the Association of Campus
Ministers. Mayor Neuhauser thanked everyone for their comments
and advised that Council would discuss this ordinance at the in-
formal session on March 21. It was moved by deProsse, seconded
by Foster, to receive the correspondence and statements and make
them a part of the public hearing. Motion carried, 7/0. Letters
received by Council which support the ordinance included those
from Jane Vanderbosch; Jean Bott; Linda J.Yanney; Gene Gronewold,
Neil O'Farrell; Charles Ryan; and Joan Liffring Zug./ A letter
was received from E. Robert Petersen, Bethany Baptist Church, S3
which was noted opposition to the ordinance.
Harry Baum presented a statement on behalf of the Tenants
United for Action concerning the proposed Tenant/Landlord Ordi-
nance and requested that Council schedule an informal discussion
on this matter. It was moved by deProsse, seconded by Ferret,
to request the Housing Commission to meet with the Tenants
United for Action and other groups to discuss the proposed Ten-
ant/Landlord initiative ordinance and be prepared'to discuss
the differences between that ordinance and the suggestions from
the Housing Commission at the March 28th informal session. Mo-

to receive and file the statement from the Tenants United for

Council noted the Planning and Zoning Commission's recom-
mendation to approve the final plat of Oakridge Estates Addition.
After discussion of whether or not the following action was
appropriate for a Board or Commission to take, it was moved by
Vevera, seconded by deProsse, to consider the Human Relations
Commission's recommendation to have Council write a letter to
President Carter requesting that he declare January 15 of each
year a national holiday commemorating the birthday of Dr. Martin
Luther King, Jr. Then it was moved by Foster, seconded by
Selzer, to table this motion. Motion carried, 4/3. 45G
It was moved by deProsse, seconded by Perret, to reappoint
Ira Bolnick and Jim Hall, and appoint Curtis Purinaton, 416
Summit, to the Committee on Community Needs with terms expir- SS'7

741 Dearborn, to the Airport Commission for a six-year term SS`s
expiring March 1, 1983.. Motion carried, 6/1. The Mayor stated
that Council did not reach a consensus for an appointment to
the Human Relations Commission; therefore, the vacancy will
be readvertised for another 30 -day period. SS9
Councilman Vevera called attention to City. Attorney Hayek's
memo dated March 15 which states that the position of Deputy
Police Chief is a Civil Service position. Human Relations Dired-
tor Candy Morgan advised that the Commission had gone through'
the required steps for the position of Deputy Chief and Council
had approved the appointment. Vevera noted concern regarding
the Civil Service Commission's statement on eligibility for
Captains. He asked that this matter be brought to the atten- .
tion of the Civil Service Commission. The four items deferred
from the March 8th agenda will be added to the March 22nd
agenda. S60
It was moved by deProsse, seconded by Balmer, to refer to
the Planning and Zoning Commission for review, the present ,CEI
zoning of a tract of land near Mormon Trek Blvd. for recommen-
dation and report back to Council with all due haste. Motion

Councilman Perret thanked Council for deferring the third
consideration of the two ordinances concerning financial expendi-
tures of candidates. He advised that he would be unable to have
a report to Council. Mayor Neuhauser stated that she and Linda
Schreiber would not be attending a training meeting for Mayors
and staff in Columbus, Ohio, because Councilwoman deprosse had
objected. Councilman Balmer pointed out the traffic projection
figures for the University hospital as stated in an.October,
1976, letter from Emil Brandt to City Manager Berlin and asked
if they were included in the Area Transportation Study. Coun-
cilman Perret responded with information on the present status
of the A.T.S. and advised he would check on the matter. S62
Acting City Manager Linda Schreiber asked for items for
the agenda for the meeting with local legislators. Suggestions
included discussion of proposed bills regarding: land use,
beverage containers, road use tax, financing of pensions, collec-
tive bargaining, risk pool for liability, taxes on alcoholic
beverages.
