Condowa, Inc. is requesting the City to vacate the north 25 feet of an cast -
west 60 -foot street right-of-way (ROW) running the full length of Lot 30,
Conway's Subdivision as platted. This request is for only that portion of
the ROW previously dedicated by Conway's Subdivision. It is the developer's
intent to use the land area obtained to develop saleable lots within the
proposed resubdivision of Lot 30 (see S-7715).
The Engineering Division and the Parks and Recreation Department do not consider
the 60 feet of dedicated street ROW very usable for either vehicular or pedestrian
traffic from Prairie du Chien Road to Ouklown Avenue. This determination was
based on the severe topographic limitations which would be encountered in the
eastern portion of the dedicated ROW. School officials were contacted as to
whether they perceived a need for a dedicated walkway to the Shimek School
property which adjoins to the west. After studying the locution, they
indicated little or no interest in any such walkway.

In general, the planning staff has agreed with these findings. It is felt,
however, that any recommendation for vacation should be accompanied by a
recommendation to retain a 10 -foot walkway along the center of the 60 -foot
ROW. According to the general requirements set forth in Chapter 9.50 of the
Subdivision Code, crosswalks may be required in blocks over eight hundred
(800) feet long and, if required, shall be constructed by the developer.
The intent of this requirement is to assure that adequate internal pedestrian
circulation will be provided in the subdivision as required in unusually
long blocks. Both Buresh and Oaklawn Avenues exceed 800 feet in length and
the continuation of these streets requires some provided means for pedestrian
movement between them other than that which might occur through a private
yard. The vacation which would have provided this internal circulation should
the street have been constructed, now becomes part of the proposed subdivision.
It is for this reason and Chapter 9.50 that the developer should be required
to construct a sidewalk between Buresh and Onklawn Avenues.
RCC0MENDATION
It is the Staff's recommendation that:
1. The City vacate and dispose of 50 feet of an east -west street ROW
running from Prairie du Chien Road to Oaklawn Avenue;
2. The City retain 10 feet for a walkway, and that the walkway be located
in the center of the 60 -foot ROW; and
3. The City require the developer to construct a sidewalk in that portion
of the dedicated walkway which runs between Buresh Avenue and Oaklawn
Avenue.

Notice is hereby given that there is now on file in
the office of the City Clerk in the Civic Center of
Iowa City, Iowa, a plan of a proposed planned area
development for Hamm's Second Addition to Iowa City,
Iowa, and described as follows:

of Iowa City, Iowa also described as follows:
Commencing at a point 919.96 feet South and 2329.99
feet East of the NW corner SW 1/4 Section 13, T79N,
R6W, of the 5th P.M., said point being the point
of beginning; Thence East 273.30 feet to the East

AN ORDINANCE ESTABLISHING A PLANNED
AREA DEVELOPMENT IN IOWA CITY, IOWA.
BE IT ENACTED BY THE CITY COUNCIL
OF IOWA CITY, IOWA.
SECTION I PURPOSE. The Purpose of this Ordinance is to
approve a planned area development in the City of Iowa City,
Iowa, pursuant to Ordinance No. 2996.
SECTION II APPROVAL
Hamm Second Addition, a subdivision of a portion of
Tract C of Townerest Addition Part IV to
the City of Iowa City, Iowa, also described
as follows:

Recorder, Johnson County, Iowa a copy of this Ordinance after
its final passage, approval and publication as provided by law.
