3d. Setting Public Hearings.
(1) Consider setting a public hearing on June 28, 1977, ,for the
vacation of a portion of Parsons Avenue.
The Planning 9 and Zoning Commission, at a regular meeting held

on June 2; 1977, recommendedy a 5-0 vote with one abstention
vacation and disposition of the subject right-of-way. This
recommendation is consistent with the staff's recommendation.
The staff had also recommended that a $100 filing fee be charged
�s to the applicant to recover administrative costs in reviewing
the application. The Staff Report concerning this item will be
presented to the City Council prior to the public hearing.
(2) Consider setting a public hearing on July 5, 1977, on an ordinance
amending Chapter 8.10,the Zoning Ordinance,:of-the Municipal
Code of the City of Iowa City by adding definitions for restau-
rant,'a drive-in or carry -out restaurant, and a:stack-space, by
amending and adding space requirements for several types of
businesses and by adding to the duties of the Board of Adjustment.

ordinance. :The Staff Report on this item and the proposed ordinance

Chapter 8.10. -In addition, it,amends the parking space,requirements

Adjustment are amended'to allow the Board to vary the parking regu—

on the north side of Wayne Street. The Council will be advised
of such actions routinely in accordance with the newly adopted
Model Traffic Ordinance.

a. Considerrecommendations of the Human Rights Commission contained
in the 'Outreach/Advocacy Committee Report which is attached to the
Human Rights Commission minutes of May 23 1977.
i b. 'Consider' recommendations of the Housing Commission that the PHA
proceed with application' for Traditional.Public Housing. Application
to be made for forty units, consisting of single family dwellings,
duplexes, and four-plexes,`with sites scattered throughout the City.
These units tobe directed to large, low income families; elderly
would not be 'included. A' public -hearing ,on'this item has been set

(2) That the City vacate and dispose of that portion of Parsons

formerly known as William White Boulevard (V-7703).
The Planning and Zoning Commission, at a regular meeting held
on June 2,'1977, recommended by a 5-0 vote with one abstention

Item No. 10 - CONSIDER AN ORDINANCE AMENDING THE SOLID WASTE ORDINANCE TO PROVIDE THAT
THE COUNCIL, BY RESOLUTION, MAY ESTABLISH FEES FOR THE STORAGE, COLLECTION,
TRANSPORTATION, PROCESSING'AND DISPOSAL OF SOLID WASTE, AND AMENDING
ORDINANCE NO 2790, SECTION VI', BY ADDING A NEW SUBSECTION THERETO
(first consideration).
Comment: This. ordinance allows the Council to set landfill disposal fees and
refuse collection charges by the simple process of resolution rather
than',ordinance. After the ordinance is passed, a resolution will be
submitted finalizing landfill and refuse collection charges for FY 78.

Comment: The City Council discussed this matter at the informal meeting of April
18,1977. The ordinance, presented was modified at the direction of the
Council. A memo from the legal staff was attached to the May 31 agenda
which explains the proposed ordinance. This subject was; again discussed
at the informal meeting of June 8 and the suggested changes will be
incorporated into •the 'ordinance. The revised ordinance has not been
received from the Legal Department and the second consideration should
be deferred.

of;a'service fee for delinquent' accounts, it is suggested that the
Council approve the setting of $3.00 as the fee,to be charged to each

Item No. 16 - CONSIDER RESOLUTION TO APPROVE S-7718, PRELIMINARY AND FINAL SUBDIVISION
rj PLAT OF LOVETINSKY SUBDIVISION.
Comment: This subdivision is located one and ane-half miles south of Iowa City
on a County road which would be a southerly extension of Scott Boulevard.
The Planning; and Zoning Commission approved the subdivision, subject to
certain deficiencies and discrepancies, all,of which have been resolved.
This item was deferred from'.the previous meeting of the City Council because
of a discrepancy which was ,discovered in the right-of-way width and
location of the section line common to the centerline of the County road
noted on the plat. fThis discrepancy has been corrected.

Item No. 17 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT WITH SHIVE-
���; HATTERY AND'ASSOCIATES, CONSULTING ENGINEERS, FOR BRIDGE DESIGN SERVICES.
Comment: This agreement includes a preliminary investigation, design, and
construction inspection of the Iowa Avenue Bridge over the Iowa River,
the Governor street' Bridge over Ralston Creek, and the Court and Muscatine
Bridge over Ralston Creek. It is expected that the first two bridges will
have remedial repairs 'done while the last bridge at Court and Muscatine
may either be rehabilitated i)(r replaced, depending upon the Engineer's
investigation'. Compensation, is specified as $7,000 for the preliminary
investigation.Additional fees will be'negot;iated, depending ,upon the

Comment: This resolution would award the contract for the Muscatine Avenue Improvement
Project to Metro Pavers, Inc.,'Iowa City, subject to the approval of the
Federal Highway, Administration. Two bids were received and opened by the
State DOT on June 7111977, as follows:'

Comment: This resolution authorizes the Mayor to execute the Sixth Amendatory to
Annual Contributions Contract No. C-765 dated June 30, 1969. The amendatory
transfers 72.units from Section 23 Leased Housing Program to Section 8
Housing Assistance Program. This conversion' must be completed prior to
June' 30,1978, and will be:accomplish'ed by ;that date. `Funds to cover those
72 units will continue to be provided by, HUD until they are converted to

Item No. 23 - CONSIDER RESOLUTION APPROVING APPLICATION FOR PRELIMINARY LOAN FOR LOW -
RENT PUBLIC HOUSING.
Comment: This resolution approves application for Preliminary Loan for Low Rent
Public Housing. " The request for preliminary loan is a part of the basic
application. A loan in the amount of $4,000 is being requested to cover
"costs of planning, surveys,
and related items in connection with the
development of the program.

1 Item No. 24 -,CONSIDER A RESOLUTION OF COOPERATION.
Comment: This resolutions is a required supporting document with the application
for public housing. ',It is,an agreement that: no special assessments will
be made against the property; that a' payment in lieu; of taxes equal to 10
percent of, shelter rent will be paid on an annual basis; that the City will
cause an ,equal number of units to be: 'repaired 'or, improved to eliminate
unsafe, unsanitary' conditions (this will be handled through the 'code
enforcement program); that the City will provide public services and
'
facilities of the same character and to the same extent as furnished to
other dwellings.
