JUNE 7, 1977
7:30 P.M.
Iowa City Council, reg. meeting, 6/7/17, 7:30 P.M., at the Civic
Center. Councilmembers present: Balmer, deProsse, Foster, Perret,
Selzer, Vevera. Absent: Neuhauser. Mayor Pro tem deProsse presiding.
Mayor Pro tem deProsse introduced Connie Echternach, Johnson Co.
Human Servs. planner. Kenneth Kinyon, 1628 Hollywood Blvd., reported
that VFW Post 3949 wants an airplane returned to the airport. Willard
Freed, 516 S. Gilbert, appeared for VFW Post 2581 and noted their concur-
rence. Irvin Pfab, 1610 Rochester, voiced conc. re difficulty seeing
the traffic light on Dodge coming south at Market. The City Mgr. will
investigate the problem. Agnes Kuhn, 1185 E. Jefferson, appeared concern-
ing the problem of inadequate housing in Iowa City and expressed concern
over Council's decision at Informal Session and requested that they
reconsider. David Smithers, 1810 Calvin Court, read letter re opposition
to parking ramp and desire to keep mini -parks. Councilman Vevera responded
to the issues presented. Ronald Osbourne,.120 N. Dubuque, appeared
conc. need for public hearing on issue of whether or not to have public
housing. Mayor Pro tem deProsse advised that there would be an attempt
to set a public hearing later.

Council noted the Resources Conservation Comm.'s recomm. that Council
defer action on the air conditioning study until the Comm. has reviewed
the report.
In response to Councilman Selzer's question, the City Manager advised
that there had been no response from Project Green on replacement of the
jet at the airport. Bob Kleese, 2220 A St., voiced his concerns.
Council discussed availability of replacements and noted that salvage
rights would be a matter for the legal department to address. Council
will be requesting that the Subcommittee for Replacement take minutes of
their meetings and forward them to Council. Councilman Vevera who will
be attending a conference in Tucson will investigate availability of a
plane from the air force base there.
Moved by Selzer, seconded by Foster to adopt RES. #77-178, Res. Bk.
40, p. 342, APPROVING THE PRELIMINARY PLAT FOR COURT HILL -SCOTT BLVD.
PART V, subject to correction of minor deficiencies. Affirmative roll
call vote was unanimous, 6/0, Neuhauser absent.
Moved by Vevera, seconded by Foster to adopt RES. #77-179, Res. Bk.
40, p. 343-345, AUTHORIZING MAYOR TO EXECUTE AND THE CITY CLERK TO SIGN
AN ACKNOWLEDGEMENT OF AN OPTION TO PURCHASE THE FORMER POST OFFICE WHICH
IS PRESENTLY OWNED BY THE UNITED STATES POSTAL SERVICE. Affirmative
roll call vote was unanimous, 6/0, Neuhauser absent.
Councilman Perret reported that he had called Mayor Neuhauser, and
she advised she would support public housing, and would return from
vacation,.if necessary, to vote.on the issue. It was moved by Perret
and seconded by Foster,that a public hearing be set for the purpose of
obtaining public input on the proposition that the City of Iowa City,
Iowa participate in a Public Housing Program pursuant to the United
States Housing Act of 1937, said public hearing to be held on 6/28/77,
at 7:30 P.M. in the Council Chambers at the Civic Center, and the City
Clerk was directed to publish notice of said hearing at least 15 days
prior to 6/28/77. Motion carried, 4/2, Selzer and Vevera voting 'no'.
City Mgr. Berlin asked for a clarification on the number of votes for
authorization to submit the application which will be on 6/14 agenda.
Three Councilmembers still opposed submitting an application, so the
Mayor will be called back to attend the meeting on the 14th.
Councilman Perret called attention to the tour of the John Deere
Incinerator Plant in Dubuque on 7/8, sponsored by Mayor Meyers of Coral-
ville, and stated he would attend. He will also make the Resources
Conservation Comm. aware of the tour. According to House File 210,
adopted by the last legislature, 3 Iowa City Councilmembers are to be
appointed to the Johnson County Land Use Policy Comm. This will be
discussed at the next informal Council meeting. Perret volunteered to
serve'.
City Manager Berlin advised that after Council deferred action on the
Conway Subdivision, the developer questioned the legal authority. He
also advised that it would be difficult for the City to sustain their
position, and asked that Council reconsider their position. Council
decided to discuss the sewer capacity at the next informal meeting.

City Attorney John Hayek explained the Federal Court Jury award of
$69,159 to Korshoj Constr. They had sued for $620,000 concerning con-
struction in 1971 for the Sewage Treatment Plant expansion. He will
recommend and Council will discuss future action at an executive session
next Monday.
Betty Gerber appeared stating she was a satisfied customer of the Cab
Company.. Mayor Pro tem deProsse explained action at informal session,
noting that the second reading of the ordinance would be deferred.
Mayor Pro tem deProsse opened the public hearing on the FY78 Asphalt
Resurfacing Proj. There being no one present to speak, the hearing
closed. Moved by Balmer, seconded by Foster, to adopt RES. #77-180,
Res. Bk. 40, pp. 346-347, APPROVING PLANS, SPECIFICATIONS, FORM OF
CONTRACT, AND ESTIMATE OF COST FOR THE CONSTR. OF FY78 ASPHALT PROJ.,
ESTABLISHING AMOUNT OF BID SECURITY DIRECTING CITY CLERK TO PUBLISH
NOTICE TO BIDDERS, AND FIXING TIME & PLACE FOR RECEIPT OF BIDS, AS 6/21.
Affirmative roll call vote unanimous, 6/0, Neuhauser absent. Councilman
Foster pointed out that Magowan Ave. was added to the proj., and it
would need more than overlay.
Moved by Vevera, seconded by Selzer, that the ORD. AMENDING ORD. #76-
2801 BY PROVIDING FOR THE ESTABLISHMENT OF CERTAIN FEES WITH REGARD TO
WATER SERV. WHICH HAS BEEN DISCONTINUED PURSUANT TO ORD. #77-2801 be
passed and adopted. Negative roll call vote unanimous, 6/0, Neuhauser
absent. A discrepancy was discovered in the Ord.; therefore, a corrected
'Ord. will be submitted for consideration at a later date.
Moved by Foster, seconded by Selzer, that the ORD. AMENDING ZONING
ORD. 2238 BY CHANGING USE REGS. FOR CERTAIN PROPERTY FROM C2 ZONE TO R3B
ZONE, Vogel request, be considered and given 2nd vote for passage.

INFORMAL COUNCIL DISCUSSION: June 6, 1977, 1:00 P.M. in the Conference
Room at the Civic Center.

ZONING APPLICATIONS
Senior Planner Don Schmeiser was present to discuss the following items:
Iovetinsky Subdivision - Schmsiser requested deferral because of problems
with location of the section line
Court Hill /Scott Blvd. V - City Manager Berlin reported that the developer
Ed resubmitted the storm water management program, and there were
no significant problems with it, so the approval of the preliminary
plat would be on the agenda on Tuesday.
Councilman Perret arrived, 1:15 P.M.
AGFSIDA ,
The City Manager advised that the Resource Conservation Commission
recaammendation on the air conditioning would be one of the first items
worked on by the Commission.
It was pointed out that Union Road was on the asphalt overlay program,
�r and,, it-hadnotbeen paved very long ago, possibly a result of not.being
properly, inspected when installed. Council also discussed the bad
"condition of the surface of the Summit Street Bridge. It has adequate
load capacity, and the City Manager reported that there was no way the
railroad wouldpay for any improvement. He will investigate.
COUNCIL BUSINESS
A sight problem on Mormon Trek, when entering from Bartelt
,distance
Road, was pointed out. You cannot see approaching cars fmn the south.
Also on Highland Avenue, going west across Keokuk, you cannot see north.
Discussion ofhousing inspection at 512 North Gilbert was held. The
City,Manager will look into the problem, and asked that when Council
reviews the housing code, to see if they approve of the criteria and

procedure being used.
Complaints were received about getting Comprehensive Plan Committee
agendas by mail. Also material from the Johnson County Arts Council and
the Library Board.

Mayor Pro ten deProsse advised she would not be able to attend the
National League of Cities Transportation Committee meeting on Friday,
June 10th in Phoenix and asked for Council representation. This will be
deteimi.ned later.
City Manager Berlin advised that the architect would be here on June
20th to present the mall development in the central business district.
Councilman Balmer advised he would be absent on June 14th, as will
Councilman Vevera who will attend the Mayor's Conference in Tucson.

The City Manager introduced the new Transit Superintendent Hugh Mose.
Also present were Ralph Oxford, for the Cab Companies, and his attorney
Jerry Lovelace, and Bill Hoekstra representing SEATS. The City Manager
pointed out that in the May 25th mom from Plastino, the recommendation
of the staff was for the SEATS proposal. Each proposal was discussed.
Doris Bridgeman and Thea Sando spoke concerning the quality of service
needed. Under SEATS proposal, the sharing of vehicles with other entities
at a later date was suggested. A majority of Councilmmenbers preferred
the SEATS proposal, with a review in six months.
TAXICAB ORDINANCE
Receipt of the letter outlining points of objection to the proposed
ordinance made by Attorney Lovelace was noted. He also presented a
survey regarding persons favoring and opposing meters for cabs. Assistant
Attorney Tony Kushnir was present for the discussion. Council agreed to
" the deletion of the wearing of caps, Section 5.16.14. After discussion
of the mechanics of how the taximeters would work, and information from
previous cab company owner Russ Cress, it was decided that the fares
would be posted in the cabs, and that the drivers would state the fare,
within 1/2 mile -45¢, to the passengers, and see if the member of complaints
was lessened (5.16.16).
In regard to Section 5.16.1(d), there was consensus by Council to delete
the use of work "time" from the definition. Section 5.16.7 concerning
suspension and revocation of certificate will be reworded to make clearer
the procedure to be used. Section 5.16.12 will be reworded also to
reflect present practice of passing state inspection.
Oxford asked that Section 5.16.1(h), Definition of Taxicab, that the
words "point to point" be added. Attorney Kushnir suggested that licensing
of charter coaches depended upon if the general public was being solicited.
The airport transportation advertises and has an office in Iowa City, so
are soliciting public'patronage and would be required to have a license
under the new ordinance. An amended ordinance will be provided as soon
as possible.
INNOVATIVE PROJECT GRANT
Doug Lee, Institute of Urban and Regional Research, presented written
goals, objectives, methods and results expected for the North Side
Neighborhood Preservation Study. He reported on meetings held in the

neighborhood, and introduced the student who would be working on the
project, and in turn they explained what portion of the project they
would be working with. Their reports should be ready by the end of
summer, and can be discussed then with the neighborhood, P & Z and
Council. Each segment is set up so their report will be produced before
Council deliberates on that portion of the Comprehensive Plan.
PUBLIC HOUSING
The mem from Housing Coordinator Lyle Seydel explaining the program was
pointed out. The City Manager noted that an allocation is available for
public housing, federally funded, and the City has certain commitments
under .the Housing Plan. These are areas where the City has not been
able to meet the need, and this is an alternative way of meeting it.
The City would own the buildings, constructed under the 'turnkey' arrange-
ments, 100% funded by federal government. Seydel explained the 40 year
Annual Contributions Contract. HUD sells bonds to pay the ACC to pay
off the mortgage. Part of the ACC will pay the operating expenses that
exceed the rental income gotten from the property. Average rental
income for 40 units would be $49.15 per month per unit and $41.94 for
operating expenses. Possibly there could be an $8 per month profit per
unit the first year. If Council proceeds, a public hearing would have
to be set for June 21st. The City would not need to have an option or
control of a site. Director Kraft noted that HUD had provided inform-
tion for determination of number of units. If the project did not
reach the ACC stage, the PHA would have to pay approximately $8,000 of
the preliminary loan. These units are not property taxable, but a
'
payment is made in lieu of taxes, 10% of the cash contract rent. This
is similar to the Ione Tree project, except the sites are scattered and
not only for elderly. Commissioners Bob Hibbs and Fredine Branson and
Robert Welsh offered information.
Councilmenbers Selzer, Balmer and Vevera expressed opposition to the
program. This made a consensus of 3/3 for the program. Councilman
'Perret requested permission to call Mayor Neuhauser for her position.
There were no objections. Seydel announced that the Annual Cont. Contract
,.,,,,...
had been 'approved for next year, conversion of 72 units approved for an
amount of $520,580.
CITY MANAM
City Manager Neal Berlin made two announcements: (1) Approval by HUD
of the Block Grant Application, in the amount of $2,061,000 for next
year, and (2) the arbitrator had decided in favor of the Fire Department.
REM IRAN PROGRAM
Mike:Kucharzak, Project Consultant, and Rehab. Consultant Jim Leighton
made the final presentation and brought Council up-to-date on the past
six months activities. They have spent 18% of the money allocated for
grants and forgivable loans, and need to get the loan program underway.
In response to concern expressed about city involvement after the grant
runs out, Kucharzak noted that they had tried to avoid administrative
carryover to putting the program together. The bank will be providing
many services to the City. A small monthly fee will be charged the
borrower.

ZONING APPLICATIONS
Asst. Planner, Doug Boothroy was present for discussion of the following

Conway Subdivision - Boothroy noted that the vacation of Virginia Drive
was an important part of the preliminary approval for this sub-
division. Council discussed the waiver for 25' streets instead of
28'. The future extension for Foster Road was discussed. City
Manager Neal Berlin reiterated the staff position concerning sewer,
noting that it would be difficult to sustain the position of voting
against this subdivision, and pointed out that the staff had recom-
mended the vacation of Virginia Drive and the 25' width for streets.

NATIONAL AAU JR. OLYMPIC TOURNAMENT
Jim Casey appeared asking for a contribution from the City for the 8
boys'who will be representing Iowa City at the National AAU Jr. Olympic
Tournament. After a short discussion, Mayor Pro tem deProsse presented
her objections, & it was decided that the matter would be brought up at
the formal Tuesday night meeting.
AGENDA
City Manager Berlin distributed a new page 18 for the AFSCME Fire Contract,
a paragraph had been omitted. He also pointed out that a new Resolution,
as presented, would place certain positions in proper categories. Mayor
Pro tem asked that the unclassified personnel salaries be discussed in
executive session along with the acquisition of property.

the bids for the College/Dubuque sewer project, previously, and all
would be contacted again.- He advised that the 'ugly' barricades used
downtown and at the cemetery that he had received complaints about were
required by the National Traffic Code.

HUMAN SERVICES CONTRACT
Regional Planning Comm. Director Emil Brandt, Human Services Planner
Connie Echternach, and Johnson County Supervisors Don Sehr, Lorada
Cilek, and Harold Donnelley were present for discussion. Brandt gave an
overview of how and why the program for Human Services was evolved. He
noted that the funding could possibly go down from 75/25 match to a
50/50 match due to help from CETA program and practicum students being
assigned to the project and from University of Iowa Research assistance.
Echternach described the flow of work, the groups involved, and the
criteria for selecting service systems for study. The four sub -areas
are: Mental Health/Chemical Dependency, Justice, Family & Individual
Life, and Emergency Assistance. She identified several problems that
are developing even before the data is completed. These included: no
drug and alcoholism counseling for youth; lack of resources to aid
transients; funding arrangements that boggle the mind; need for coordination
and cooperation between the agencies; lack of recreational opportunities
for certain groups; and concern over care for sick children where the
mother is employed.
Council and Supervisors discussed justification for funding, use of a
standard questionnaire by all agencies requesting funds, a smaller index
of services that would be easier to use, whether or not there would be a
ratio between city, county & out of Johnson Co. cases. Echternach
'
stated that it should be a policy decision of each agency as to how, far
they should go and which agencies to fund.
PARKING"METERS AT COURTHOUSE
Mayor Pro tem deProsse explained that altho the County had asked for
parking signs on Harrison Street, the Council had decided to put in
meters,and that apparently the meters did solve the problem. Supervisor
Donnelley noted that the meters were installed before the County received'
the letter advising them of Council's decision. Mayor Pro tem deProsse
also asked for.the support of the Supervisors in investigation by City
Staff and the County Auditor of appropriate levels of joint funding for
programs; and determining the dollar participation of city residents in
t
programs, such as Ambulance Service, Health Board, Elections, Voter
Registration, Visiting Nurses, Fire Dept. Services. There were no
definite objections, but some persons asked that not a lot of time be
.spent on the investigation.
ANIMAL SHELTER '
City Manager Neal Berlin advised that he would have a proposal for
expansion of the Animal Shelter building soon, and would like to talk to
the Supervisors at that time. Supervisor Cilek pointed out that the

OWNERSHIP OF STREETS AND ALLEYS IN ORIGINAL TOWN
Attorney John Hayek called attention to the question of who owns the fee
title to streets and alleys in the Original Town, the City or the State.
He will send written material to Council in the Friday packet regarding
his meeting with the State people, and would like to discuss it on
Monday. He did not think that this would affect the timing of the
disposition documents which will come out the first week in July.
There was discussion concerning whether or not the three hours allowed
on June 28th would be enough time for discussion both with Don Zuchelli
and for the Sasaki and Associated Engineers presentation. The City
Managerwill investigate when the Hwy. 6/1/218 signalization project
will be started.
URBAN RENEWAL PROPERTY TAX LITIGATION
Attorney Hayek discussed the tax litigation with Johnson County on some
of the urban renewal properties. A Declaratory Judgment action was
filed to determine the liability of the City in February. A Court Order
today stopped the County Treasurer from selling this property at tax
sale. The County officials were most cooperative. He stated that there
were no serious problems regarding sale of this property, as the tax
money in question could be put in an escrow account or some other arrange-
ment made. He was not aware of any problems this would cause in getting
out from under HUD regulations.
BUDGET AMENDMENTS

The City Manager pointed out the memo received in the packet of the 17th

regarding explanation of the budget amendments. Finance Director Rosemary
Vitosh explained why the Mass Transit budget was amended, particularly
becausepersonnel costs and rental of buses and maintenance of buses.

TRAVEL POLICY
The City Manager called attention to the memo of May 6th included in the
June 17th packet. In the proposed policy on Page 3 in the Pre -Employment
Interview, judgment is reserved for the City, elsewhere it is reserved
for the City Manager." Berlin stated that it would be appropriate to add
this change here and in paragraph 2 of Section 6, which has been changed
so that noon meals within Iowa City area will not be allowed. Some
changes have been made in the Travel Request Forms, but Council should
adopt the policy as amended. This item will be added to next week's
agenda.
