Consider motion adopting a policy in regard to access to Highway 6
' Bypass.
The Planning and Zoning Commission at a regular meeting hold on .June
16, 1977 voted 4-1 to recommend a policy establishing the status of
Ilighway 6 as a limited access arterial road with new accesses allowed .I
where considered to be desirable and beneficial. : The City Council
•p subsequently discussed the issue at the lust informal mectiig and!
,requested:that tho'following policy statement,be.brought before the
City Council for consideration: "It is hereby the Policy of the

PUBLIC HEARING ON AN ORDINANCE MIENDING IIIE ZONING ORDINANCE, CHAVTIiR 8.10.
Comment:
The Planning and Zoning Commission at a regular meeting held on June 2,
1977,',recomnended by a 6-0 vote approval of the proposed ordinance.
The Staff Report on this item and the proposed ordinance was presented
to:the City Council. This ordinance adds definitions of restaurant,
drive'' -in or carry -out restaurant, and stacking space to the definitional
section of Chapter 8.10. In addition, it amends the parking space
requirements for churches, auditoriums and other places of assembly.
It adds parking space', requirements for several types of businesses which
had not been treated individually. The duties of the Board of Adjust-
ment are amended to allow the Board to vary the parking regulations when
an applicant can demonstrate the required number' of; spaces is unnecessary,;
to waive the screening requirements when the cormnercial use is wholly
confined within the building, to waive the required parking spaces for
as use to municipal' parking facilities.

Comment:'
This ordinance allows the Council to set landfill disposal fees and
refuse collection charges by resolution rather than ordinance.

Between'July 1 and when this ordinance is finally adopted, the City of
Iowa, City may be absorbing all; landfill charges for the next two to
three weeks, Based on the tonnage figures for May,: the Citywill lose
revenue of $1650 per week under the old contract terms unless the other
communities pay`: for charges under the terms of the previous contracts,

now terminated.'

THE IOIVA CITY SANITARY LANDFILL.
Comment::
This resolution needs to be passed at or after adoption of the ordinance
listed above. As budget adoption occurred in March 1977, it was

anticipated that this, resolution and the previous ordinance were simply
housekeeping 'tasks similar to setting up procedures, to charge at the
landfill.

(Second consideration)
Comment:
The Planning and Zoning Commission recommended by a 6-0 vote approval
of the above vacation request. This recommendation is consistent with
the Staff's recommendation presented in a Staff Report dated April 27,
1977, which was attached to the agenda of the May 3, 1977, meeting. It
should be noted that:a petition has been submitted in objection to the
action recommended by the Planning and Zoning Commission. '111c petition
was included in the May 3, 1977 Council packet. A public hearing on
this vacation was held May 17, 1977.

consideration)
Comment:
The Planning and Zoning Commission, at a regular meeting held on June 2,
1977, recommended by a 5-0 vote with one abstention vacation and
disposition of the subject right-of-way. This recommendation is
"consistent with the staff's recommendation. The Staff had also reconMondcd°
that a $100 filing fee be charged to the applicant to recover adminis-
trative costs in reviewing the application. The Staff Report concerning

Comment:

Item No. 15 CONSIDER A RESOLUTION ESTABLISHING A SCHEDULE OF FEES h'11H RI: TO
DELINQUENT WATER SERVICE ACCOUNTS.
Comment: As Ordinance No. 76-2801 has been amended to allow for the charging
of a service fee for delinquent accounts, it is suggested that the Council
approve the setting of $3.00 as the fee to be charged to each water
service account which has not been paid within thirty days of the
billing date. After thirty days a certified letter is sent as a final
noticc.which establishes a hearing date. The $3.00 covers the cost of
preparing the delinquent lists and the certified notice. Every customer
receives thebillingand another notice before the certified letter is
sent. Ibis resolution was attached to the. June 14 agenda and was
deferred from the June 28 Council meeting.

Comment:
The contract is in accordance with the Council's decision to fund Johnson
County Council 'on Aging in the amount of $17,500 for FY78. 'These
funds are budgeted in Aid to Agencies in the ,approved FY78 budget.
Revenue sharing monies will be transferred to support this.

Addition located west of Heinz Road, subject to submission of an
agreement for installation of public, improvements and signatures of the
