Resolutions (1) Consider resolution directing the City Clerk to republish notice to bidders and fixing time and place for receipt of bids for f-ivestormwater projects in the City of Iowa City. This resolution will legally change the date for receipt of bids to provide additional time for bidders to prepare their bids. All prospective aad bidders have been notified. 3"B e. Setting Public Hearings (1) Consider setting a public hearing on July, 26, 1977, for an ordinance to amend-the'Municipal Code of Iowa City, Iowa, by adopting the !Pnifdm B'uilding'..Code^edited'by the International Conference of Building Officials; to provide for the protection of the health, welfare and safety, of the citizens of Iowa City, Iowa; to repeal Ordinances No. 2709 and 75-2775, and to provide for its enforcement. Comment; This ordinance adopts the 1976.Uniform Building Code. Most of the amendments are the same as in.the 1973 ordinance. However, a new uniform appeal procedure has been provided for all the Uniform Codes. (See 5204, A eals,'in this ordinance.) S1307(b) and 991407(b) have been amended to provide a minimum of 80 square feet"of floor area, rather than 70 square feet;to conform ` with the Minimum' Housing Chapter,' Chapter 413, Iowa Coder 51404 - Exit Facilities was amended so that the City can continue to allow, a,20". wide window as provided in the 1973 Uniform Building Code: The 1976 Edition requires a`24" width. 'S3205(a) was emended to prevent the placement of the attic access in closets. Comment: The amendments are the same'as the l 973 edition. The new uniform, appeal procedure has been added in.Section IV., (3) Consider setting,a public hearing on July 26, 1977, for an ordinance amending the Municipal Code of the ^of Iowa,;Ctty, Iowa, by :City adopting the ,1976tEdition,of-7the.U,ifbri:pl umbing,Codeiwith certain amendments;,repealing Ordinance No: 2710 and providing for its enforcement. '.' Comment: This Ordinance adopts the 1976 Uniform Plumbing Code. Setting Public Hearings (continued) (4) Considersetting a public hearing on July 26, 1977, for an ordinance amending the Municipal Code of the City of Iowa City, Iowa, by adopting the 1976 'edition of`,,the` Uniform Mechanical Codewith certain amendments thereto; repealing Ordinance No. 2708, and providing for its enforcement. Comment: The amendments are the same as those for the 1973 Code. An appeal procedure has been added to the Board of Appeals. (5) Consider setting a public hearing on July 26, 1977, for an ordinance amending the. Municipal Code, of Iowa, City, Iowa, by adopting the 1975,editiorr;of.the National ElectricaU Code...with certain additions and"amendments thereto; repealing Chapter 9.20 of the Municipal Code'of Iowa City, Iowa, and enacting anew chapter in lieu thereof. Comment: The 1975 Electrical Code is being readopted because there is no record of a public hearing at the time of its last adoption. Only ',the appeal procedure has been changed. There will be,a uniform procedure for all appeals. (6) Consider setting a public hearing on July 26, 1977, for an ordinance amending the Municipal Code of Iowa' City, Iowa, by adopting thef,197,6,''l ;edition of�,th"6 n-i.formB,..1re Code:'by the International Conference of Building Officials and Western Fire Chiefs Association; repealing Ordinance No. "2711; to Provide regulations governing conditions hazardous to life and property, and to, provide for its enforcement. I Comment: Sections III !through V are the same as'the prior ordinance. '. •,,, Section VI reduces the allowable capacity of a portable -tank from 600 to 3O0'gallons and 'allows, the chief to limit the number of: tanks if, there is a.hazard. The Appeal Board is changed from the Board of'Adjustment to the Board of Appeals which, it, is felt 'is more appropriate. The uniform procedure applies to all appeals. f.Correspondence. i (1) Letter from Carl F. Orgren regarding the Johnson 'County Regional Planning Commission's Area Transportation Study:' This letter has been referred to the City Manager for reply., (2) Letter from Marilyn Nickelsburg, Friends of the Children's Museum;' requesting ;'financial' aid for FY 79. 'Presently the principle ordinances affected will be the safety codes (i.e., building, electrical, plumbing and rhousing ,codes). It is anticipated that other health and safety ordinances will incorporate the provisions of,the ''administrative procedures ordinance. This ordinance is designed to promote greater utilization of administrative remedies by the ,public and by the City'. Action: , C,( Item No. 9 - CONSIDER AN ORDINANCE AMENDING THE SOLID WASTE ORDINANCE TO PROVIDE THAT THE COUNCIL, BY RESOLUTION,` MAY ESTABLISH FEES FOR THE STORAGE, COLLECTION, _ % 7 - ZS Y{51 TRANSPORTATION, PROCESSING AND DISPOSAL OF SOLID WASTE, AND AMENDING ORDINANCE NO, 2790; SECTION VI,' BY ADDING A NEW SUBSECTIONTHERETO. J '. �.. �. .. .. ,' -7 i 1 .I 1 i r� rr 1 i x 1 i 1 I 1; I'. 1 t t� I 1 Agenda Regular Council Meeting July 12, 1977 7:30 PM Page 6 Item No. 12 - CONSIDER AN ORDINANCE REGULATING THE OPENING AND EXCAVATING OF PUBLIC PLACES:REQUIRING A PERMIT AND PAYMENT OF A PERFORMANCE DEPOSIT: IMPOSING REQUIREMENTS FOR THE PROTECTION OF LIFE AND PROPERTY IN CONNECTION WITH EXCAVATING WORK, INCLUDING TRAFFIC AND PEDESTRIAN SAFEGUARDS: REGULATING THE BACKFILLING AND RESURFACING OF EXCAVATIONS: AND PRE- SCRIBING PENALTIES FOR VIOLATIONS OF THESE PROVISIONS (second consideration). Comment: This ordinance will regulate excavating in public places by requiring a permit and payment of a performance bond. It will impose requirements for the ,protection 'of life and property in connection with excavation' work', including traffic and pedestrian safeguards. The ordinance will also regulate the backfillingandresurfacing of excavations and pre- scribe penalties for violations of its provisions. Action: Item No. 13 - I CONSIDER AN ORDINANCE VACATING PART OF PARSONS AVENUE IN IOWA CITY, IOWA, NEAR WILLIAM WHITE BOULEVARD IN WASHINGTON STREET PLACE (second consideration). Comment: The Planning and Zoning Commission, at a regular', meeting held on June 2, 1977, recommended by,a 5-0 vote' with; one abstention vacation and dis- position of'the subject right-of-way. This recommendation is consistent with the staff's recommendation. The staff had also; recommended that a $100 filing fee be charged to ,the applicant to recover administrative costs`.in reviewing ,the application. The Staff Report' concerning this item was presented to the City Council prior to the public hearing, on June 28, 1977.' Action: �77ca -�� Item No. 14 - CONSIDER AN ORDINANCE AMENDING CHAPTER 8.10, THE ZONING ORDINANCE, BY ADDING' DEFINITIONS FOR A RESTAURANT,'A DRIVE-IN OR CARRY-OUT'RESTAURANT, ANDA STACK -SPACE, BY AMENDING AND ADDING SPACE REQUIREMENTS FOR SEVERAL QV TYPES OF BUSINESSES AND BY ADDING TO THE DUTIES OF THE'BOARD'OF ADJUSTMENT. (first consideration).;' ' Comment: The Planning and Zoning Commission, at a regular meeting held on June 2, 1977, recommended by a,6-0 vote approval of the proposed ordinance. The Staff Report on this item and the proposed ordinance was presented to the City Council. This ordinance' adds, definitions of restaurant drive-in or carry -out restaurant, and stacking space to the definitional section of Chapter 8.10;` In addition, it amends the parking space requirements for churches auditoriums and other places of assembly. 'It adds parking space requirements for several types' of.businesses`which had not been treated individually. ;.The 'duties of the Board of Adjustment are amended to allow " the Board to 'vary the parking regulations when an applicant can demonstrate the required number of spaces is unnecessary, to waive the screening requirements when the commercial use is 'wholly confined within the building, to waive the required parking spaces for a use located adjacent to muni- cipal,;parking facilities. Action: Agenda RegularCouncil Meeting July 12 1977 7:30 PM Page 7 Item NoJ 15 - CONSIDER A RESOLUTION ESTABLISHING CERTAIN FEES AND CHARGES FOR THE USE OF MUNICIPAL TENNIS COURTS. ent: The Parks and Recreation Commission recommends that a reservation fee of $1.00 be established for tennis courts located in Mercer Park and City Park.Three courts may be reserved during the weekday and five o6,the weekend. The reservation fee will be instituted one week after passage of this resolution. Parks and Recreation recommends adoption of this resolution. The Council deferred this matter for one week. • Action: 1 Item No. 16 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE: AND THE CITY CLERK TO CERTIFY AN AGREEMENT WITH UNIVERSITY HEIGHTS. -77-7-57- Comment- This is a resolution authorizing the 'City of Iowa City and University Heights to enter into''an agreement that will permit the Iowa City Housing Authority to make housing assistance payments on behalf of eligible families to owners of ',property located within' the city', limits of University Heights. Comment:� Under the terms of an agreement signed November 1, 1976, the University <--,d-of Iowa purchased and installed the traffic signal at the intersection of Melrose and'Woolf, The City then agreed to take over responsibility and maintenance for this traffic signal. Public Works recommends adoption of this resolution. A copy of the agreement with the University is attached. Action: Item No. 19 CONSIDER RESOLUTION ACCEPTING THE WORK ON THE WASHINGTON STREET AMENITIES `77'253 PROJECT. Comment: This resolution accepts work done by O'Brien Electric Company on the Washington Street amenities.. There are a couple:trees and shrubs that need replacement. However, these have been determined to be the responsibility of the City. The,.fin al cost of the job was $223,794.60. Public Works recommends acceptance of the work. Action: C� I I I ley ei, Item No. �.20_ RESOLUTION AUTHORIZING AND PROVIDING FOR THE ISSUANCE OF $3,015,000 77- 2.5 ; 1 GENERAL OBLIGATION BONDS AND LEVYING:A TAX TO PAY I SAID BONDS. 3, Convent- This final resolution involved in the City's recent bond sale authorizes 0 atax levy:and,collection,schedule for financing the bond principal and fi interest payments. It also establishes the bond and coupon format and payment Procedures which will be used. Action i:� L) Item No. 21 CONSIDER RESOLUTION AWARDING CONTRACT FOR COLLEGE/DUBUQUE MALL SANITARY AND STORM SEWER PROJECT. Comment: This resolution will award the contract toDave Schmitt Construction Company, Cedar Rapids, Iowa, for their low:bid of $91,658.00 (see bid: t6bulati6n). This bid,`is approximately 15% over the engineer's estimate. ,i rol I However', this can:be attributed to the fact that contractors are busy:' this time of year ',and there isn't as high degree of competition currently. Also, the contractors were aware that we received no bids on the first advertisement. Furthermore, it will be a difficult project due to its proximity in the business district. The low bid was slightly irregular in that they provided a bid bond rather thanthe stipulated cashier or certified check.
