The memorandum referred to above is attached to the July 12 minutes of the Resources Conservation' Commission which are a part of this agenda under, the Consent Calendar. (2) That the City Council adopt an energy code for buildings 100,000 cubic feet and greater at an earliest possible date. The Resources Conservation,Commi'ssion will recommend'a code for adoption within sixty days..' (3) That the City Council approve'a motion supporting the Mikulski Amendment to the,National Energy Plan, H.R. 6831, and communicate that support to our'Senators Congressman Leach, the Chairman of the Interstate and 'Foreign .Commerce Committee,'HarleylO. Staggers, and to Congresswoman Mikulski. A copy of this amendment is attached to, the ,agendas. CONSIDER MOTION TO SUPPORT THE MIKULSKI AMENDMENT TO THE NATIONAL ENERGY PLAN, HOUSE REPORT `6831, AND TO ,COMMUNICATE THIS SUPPORT TO THE ABOVE MENTIONED INDIVIDUALS BY LETTER FROM THE MAYOR. Action: (4) That the City Council approve the bylaws of the Resources Conservation Commission. A copy of the proposed bylaws''-is i attached to the minutes of the June 28, 1977, meeting of the Resources Conservation Commission which are a, part of this agenda under the Consent Calendar. w' (5) That the City Council, pursue the University of Iowa's offer of providing the Delta 2000 system for the control of, the proposed new heating,, ventilating, and air conditioning system in the Civic Center building. b. Recommendations of the Planning and Zoning Commission (continued): (4) That the City Council waive the requirements of the Storm Water Management Ordinance as they 'apply to the Mount Prospect Addition, Part IV, for the following reasons: The problems pertaining to storm water management in Mount Prospect Addition, PartIIV, have been brought to the attention of the Planning and Zoning Commission; some problems concerning the timetable regarding the adoption of the Storm Water Management Ordinance seem to have some merit as to this development; the reason for the delays was beyond the power of the applicant. Attached to this agenda is v a'list of the chronological events which occurred from the original submission of Mount Prospect Addition. CONSIDER MOTION TO WAIVE REQUIREMENTS OF THE STORM WATER MANAGEMENT II, ORDINANCE AS THEY APPLY TO MOUNT PROSPECT ADDITION, PART IV. This recom- mendation is consistent with the staff's recommendation. The above stipulation would require that property owners within the subject subdivision relinquish access to Gilbert Street (Sand Road), a major arterial street, upon annexation and gain access via a public access easement being provided within the subdivision. An analysis of the subject subdivision was presented in a Staff Report dated June 16, 1977, which is attached tothisagenda. This item will be presented for Council consideration at the next regular Council meeting. (2) To approve a curb cut and signalized intersection at the location proposed by',HyVee Food Stores, Inc., i.e., approxi- mately halfway between Gilbert and Keokuk Streets on Highway 6 Bypass, with the understanding that the `cost of the :construc- tion of the intersection would be borne by HyVee Food Stores, Inc. The Planning and Zoning Commission, ata regular meeting held on July 7, 1977, recommended by a 3-2 vote approval of the above request for an intersection with Highway 6 Bypass. 'This recom-. mendation is not consistent with the'` staff's, recommendation presented in a Staff Report dated July 7, 1977, which .is attached to this, agenda. ;Basically the staff ,is opposed to another inter- section with Highway,6 Bypassrwhich will further impede the flow of traffic on this essential east -west arterial street. (3) To approve 5-7725, public discussion of a preliminary plat of Pepperwood Addition,.a proposed subdivision of'a 47 -acre tract of land located west of Taylor Drive andlsouth of the'K-Mart area. The Planning and Zoning Commission, at at regular meeting held on July 7, 1977, recommended by a 5-O vote approval of, the subject r subdivision. This recommendation is consistent with the staff's' recommendation. An 'analysis of the subject subdivision was included in'a Staff Report 'dated July ,7, 1977, which is attached to this agenda, This' ',isla'revised plat of the Pepperwood Addition which was initially delayed; by the City Council pending, resolution of a` potential problem with a drainage ditch located along the' north boundary of the subdivision. The'subdivider does plan to use ',a portion of the ditch for storm water management, relocate a'portion `of the ditch, and fill those sections of the ditch not used for storm water management. The Council may wish to secure, a letter from the subdivider indicating that this is his proposal - prior to approval of, the ,plat. Item No 8 - PUBLIC HEARING ON AN ORDINANCE ADOPTING THE UNIFORM CODEFOR THE ABATEMENT OF DANGEROUS BUILDINGS, 1976 EDITION, AS PREPARED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS WITH CERTAIN AMENDMENTS THERETO AND TO PROVIDE FOR THE ENFORCEMENT THEREOF AND PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ORDINANCE NO. 2712. Comment: The amendments are the same as the 1973 edition. The new uniform appeal procedure has been added in Section IV. !Action: Item No., 9 - PUBLIC'` HEARING ON AN ORDINANCE ADOPTING THE 1976 EDITION OF THE UNIFORM PLUMBINGICODE WITHCERTAINAMENDMENTS; REPEALING ORDINANCE NO. 2710 AND PROVIDING FOR ITS' ENFORCEMENT. Comment: This Ordinance adopts the 1976 Uniform Plumbing Code.' The amendments are the, same as in'the 1973 edition with the exception of the new uniform appeal procedure in Section V.D. -1 Action: Item No. 10'., - PUBLIC HEARING ON AN ORDINANCE ADOPTING THE 1976 EDITION OF THE.UNIFORM FIRE CODE Bt THE INTERNATIONAL` CONFERENCE OF BUILDING OFFICIALScAND WESTERN.FIRE CHIEFS ASSOCIATION; 'REPEALING ORDINANCE NO. 2711; TO PROVIDE' REGULATIONS'GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY'! r I AND TO PROVIDE FOR ITS ENFORCEMENT. t Comment: Sections III through V are the same as the prior ordinance. Section VII .reduces the allowable capacity of a portable tank from 600 to 300 gallons and allows the chief to limit the number of tanks if there is a, hazard.' I 1 I I 1 I If I I I Agenda • • Regular Council Meeting July 26;'1977 ,7:30 PM' Page 8 Item No. 11 - PUBLIC HEARING ON AN ORDINANCE ADOPTING THE 1975 EDITION OF THE NATIONAL ELECTRICAL CODE WiTH CERTAIN ADDITIONS AND AMENDMENTS THERETO; REPEALING CHAPTER 9.20 OF THE MUNICIPAL CODE OF IOWA CITY, IOWA, AND ENACTING A NEW CHAPTER IN LIEU THEREOF. Comment: The 1975 Electrical Code is being readopted because there is no record of a public hearing at the time of its last adoption. Only the appeal procedure has been changed. There will be a uniform procedure for all appeals. Action: Item No. !12 - PUBLIC HEARING ON AN ORDINANCE ADOPTING THE 1976 EDITION OF THE UNIFORM MECHANICAL CODE WITH CERTAIN AMENDMENTS THERETO; REPEALING ORDINANCE NO. 2708, AND PROVIDING FOR ITS ENFORCEMENT. Comment: The amendments are the same as those for the 1973 Code. An appeal procedure has been added to the Board of Appeals. Action: Item No. `13 - CONSIDER AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A UNIFORM ADMINISTRATIVE'PROCEDURE 'FOR THE rENFORCEMENT _OF:VARIOUS'MUNICIPAL i ORDINANCES (second consideration). ` Comment: This is an ordinance, providing for the establishment of a uniform administrative procedure for the enforcement of various municipal ordinances. Presently, the principle ordinances affected will be the safety codes '(i.e ,, building, electrical, plumbing and, housing codes). Itis anticipated; that other health and safety ordinances will incor- porate the provisions of the administrative procedures ordinance. J t' ,—w� S Item No. 14 -'CONSIDER AN ORDINANCE VACATING PART "OF PARSONS AVENUE IN IOWA CITY, IOWA, NEAR WILLIAM WHITE BOULEVARD IN WASHINGTON STREET PLACE (passed and adopted). Conment: The Planning and Zoning Commission, at a regular meeting held on June 2, 1977, recommended,iby a 5-0 vote with one abstention vacation and dis- position of the subject right-of-way. This recommendation is consistent with the staff's 'recommendation. The staff had also recommended that a ^$100 filing fee be charged to the applicant to recover administrative costs in reviewing the; application. The Staff Report concerning this item was presented to the City Counci l prior :to the public hearing on June 28, 1/9/7,7, ani-�• Acti on: c 1! d eb • • • Agenda Regular Council Meeting July 26, 1977 7:30 PM Page 9 Item No.15 - CONSIDER AN ORDINANCE AMENDING CHAPTER 8.10, THE ZONING ORDINANCE, BY / ADDINGDEFINITIONS, FOR A RESTAURANT, A DRIVE-iN OR CARRY -OUT RESTAURANT, AND A STACK -SPACE, BY AMENDING AND ADDING SPACE REQUIREMENTS FOR SEVERAL TYPES OF BUSINESSES AND BY ADDING TO THE DUTIES OF THE BOARD OF ADJUSTMENT (first' consideration). Comment: This item was deferred from the July 12, 1977, Council meeting. The Planning and Zoning Commission, at a regular meeting held on June 2, -1977, recommended by a 6-0 vote approval of the proposed ordinance. The Staff Report on this item and the proposed ordinance was presented to the City Council. This ordinance adds definitions of restaurant, drive-in or carry -out restaurant, and stacking space to the definitional section of Chapter 8.10. " In addition,', it amends the parking space requirements for 'churches, auditoriums and other places of assembly. It adds, parking space requirements for several types of businesses which had not been treated individually. The duties of the Board of Adjustment are amended to allow the Board to vary,the parking regulations when an'' applicant cam demonstrate the required number of spaces is unnecessary, to waive the required parking spaces for a use located adjacent to muni- uni- cipal, cipal,„parking facilities. !A public hearing, on this item was held July 5, 1977. ` Action:/i_e D //, t e, ai./ !l -,7ek C•c-7�� .�.—cJ Item No. 16,- CONSIDER,AN'ORDINANCE REGULATING THE OPENING AND EXCAVATING OF PUBLIC PLACES; REQUIRING A PERMIT AND PAYMENT OF A PERFORMANCE DEPOSIT; IMPOSING,REQUIREMENTS FOR THEj;PROTECTION OF LIFE AND PROPERTY IN CONNECTION WITH EXCAVATING WORK, INCLUDING TRAFFIC AND PEDESTRIAN rSAFEGUARDS; REGULATING THE BACKFILLING' AND RESURFACING OF EXCAVATIONS;” AND PRESCRIBING PENALTIES FOR'VIOLATIONS OF THESE PROVISIONS (passed and adopted)'. Comment: This ordinance will regulate excavating in public places by requiring a permit and payment of a.'performance bond.'. It will impose requirements,' for the protection of life and property in'connection with excavation work, including traffic and pedestrian safeguards. The ordinance will', also regulate the backfilling and resurfacing of excavations and pre- scribe penalties for violations of its provisions. 0 Action: i v Item No. 17 -CONSIDER RESOLUTION ADOPTING PERFORMANCE DEPOSIT SCHEDULE FOR EXCAVATION ORDINANCE. ` Comment: In connection with the third and final reading of the Excavation Ordinance, the proposed resolution depicting amounts for performance deposits needs 6S' adoption. Comment: As required by the Excavation. Ordinance Council must specify the limits of 'liability insurance to be carried by potential contractors. Public Works recommends adoption of the attached resolution., Action: Item No. 19 - CONSIDER RESOLUTION APPROVING FINAL PLAT OF MAKADA SUBDIVISION, 5-7721. a.bti Comment: The Planning and Zoning Commission, at a regular meeting held June 16, 1977, recommended, by a 5-0 vote approval of the final plat of Makada Subdivision located one-half mile south of the city limits and east of the southerly, extension of Sycamore Street. subject to (1) review of the legal papers by'the 'Legal staff, and (2) signatures of the utility companies.' This recommendation is consistent with the staff's recommendation presented in 'a staff report dated June,16, 1977, which was attached to the agenda' of 'June 28.The above-noted contingencies' have been resolved. ,The legal papers have been submitted and areinorder. This item was', deferred from the July 12 Council' meeting due to the lack of the utility companies' signatures. These signatures have since been obtained. P — Comment: Under the terms of an agreement signed November 1,1976, the University of Iowa purchased and installed the'traffic'signal at the intersection of f Melrose and Woolf.' The City then agreed to,take over'responsibility'and , maintenance for this traffic signal. 'Public Works recommends adoption • of this resolution.'-A copy of, the agreement with the University, was attached to the July 12 agenda. Comment: On July 19, 1977, bids were received by the Iowa D.O.T. for FAUS Project No. M-4030(1)- 82-52. J. F. Edwards Construction Company of Geneso, Illinois,'was the only bidder with a bid of $94,834.48. This bid exceeded the engineer's' estimate of $76,413.00 by 24%. Iowa D.O.T. has determined 01 that this bid is unacceptable and has suggested that the project be relet on August 16, 1977. Comment: This project will provide lights for diamonds No. 2 and 3 which lie to the south of the two existing lighted diamonds in Mercer Park. The project will provide a,suitable level of light for!both Babe Ruth baseball and slo-pitch softball. The lighting fixtures are metal halide for low energy consumption; The estimated cost of the project is $52,000 and has been �a funded with H.C.D.A.'funds.
