Previously the City paid for the State Inspection of each cab, $5.25, and the $10.00 covered this. Last week I read where inspection fees had risen to $10.75. I am assuming the City is still paying the inspection fee. Atty. Mayorl,ro tem ATTEST: City Clerk RECEIVED & APPROVED TH$,LEGAL $DE`gTMM T.I 3,soo 0 9h.ec ter THIRD AMENDMENT TO AGREEMENT (� WHEREAS, the City of Iowa City, hereinafter referred to as the City, has entered into an agreement with Veenstra & Kimm, Engineers & Planners, hereinafter referred to as the Consultant, for the preparation of a Facility Plan in accordance with Title 11 of the Federal Water Pollution Control Act Amendments of 1972 (Public Law 92-500), and WHEREAS, said Facility Plan includes three major components, an Infiltration/ Inflow Analysis, a Sewer System Evaluation Survey and a Complete Waste Treatment System Plan, and WHEREAS, the Consultant has completed the Infiltration/Inflow Analysis and is proceeding with work on the Sewer System Evaluation Survey, provided for by a Second Amendment to the original agreement, and WHEREAS, the scope of said Sewer System Evaluation Survey includes provision for system flow monitoring and furnishing, installing and maintaining sixteen (16) self -recording depth -of -flow meters for a maximum three-month period, and WHEREAS, it has been impossible to secure adequate flow data since initiation of said survey due to severe drought conditions, and WHEREAS, it may be possible to document flow data during an additional three-month period of flow monitoring, and WHEREAS, it is necessary to amend the amended agreement to extend the period for furnishing, installing and maintaining self -recording depth -of -flow meters for an additional three-month period, NOW, THEREFORE, it is hereby agreed by and between the parties hereto that the amended agreement shall be further amended by making the following changes to certain exhibits in the amended agreement, to wit: In Exhibit A, on Page A-4 of the amended agreement, under Item C. of Phase 3 - System Flow Monitoring, add the following paragraph: "In addition to the furnishing, installing and maintaining sixteen (16) self -recording depth -of -flow meters for a maximum three-month period, furnish and maintain fifteen (15) self -recording depth -of -flow meters for an additional three-month period." i C, In Exhibit D, on Page 0-2, add the following paragraphs: "In addition to the maximum amount chargeable for the actual costs of TWO HUNDRED SEVENTEEN THOUSAND, THREE HUNDRED NINETY-FOUR AND no/100 DOLLARS ($217,394.00) and the fixed fee of EIGHTEEN THOUSAND, EIGHT HUNDRED NINE AND no/100 DOLLARS ($18,809.00) set out in a previous paragraph for work on Phases 1 through 10, there shall be an additional fee for the additional work performed on Phase 3 set forth in this Third Amendment to Agreement. The City shall additionally compensate the Consultant for the work performed under this Third Amendment based on the actual costs incurred plus a fixed lump sum fee in accordance with EPA Form 5700-41 (2-76), attached to and made a part of this Third Amendment. The maximum amount chargeable for the work set forth in this Third Amendment for the actual costs is EIGHTEEN THOUSAND, SIX HUNDRED FIFTY-NINE AND no/100 DOLLARS ($18,659.00). The fixed fee for the work set forth in this Third Amendment is ONE THOUSAND, THREE HUNDRED FIFTY-SIX AND no/100 DOLLARS ($1,356.00). Whereas, the City of Iowa City wishes to provide its residents with special elderly and handicapped transit services; and Whereas, Johnson County, pursuant to its general powers, has in operation a special elderly and handicapped transit service for the unincorporated portions of .Johnson County, Iowa; and Whereas, Chapter 28E of the Code of Iowa provides, in substance, that any power exercisable by a public agency of this state may be exercised jointly with any other public agency of this state having such power; and Whereas the parties to this agreement desire to implement a Proposal for Iowa City-Coralville Urban Area Elderly and Handicapped Transportation Service, dated August, 1977, " prepared by the staff of the Johnson County Regional Planning Commission, which proposal is attached hereto as Exhibit "A" and by this reference made a part hereof; Now, therefore, be it agreed by and between Johnson County, Iowa, and the City of Iowa City, Town, as follows: 1. The original term of this agreement shall. commence September 1, 1977, and continue for ten months through and including June 30, 1978. 0 IWA Z. .Johnson County will administer the program by extending its special elderly and handicapped transporta- tion service, known and referred to as S.G.A.'r.S., into the corporate limits of the City of Iowa City. This service shall be available to persons over 60 years of age and accompanying spouses, and to persons with ambulatory, manual, visual, audi.al or mental impairments which seriously limit their ability to obtain adequate transportation and accompanying spouses. 3. .Johnson County agrees that operation of the program will be in full conformity with any and all rules and regulations established by the Iowa Department of Transportation for such elderly and handicapped transit service programs. A. The parties agree that the following service pro- visions shall apply: A. The County shall have available the equivalent of one vehicle within the Iowa City corporate limits for approximately 67 hours per week; actual hours of operation shall be set by Johnson County through its Board of Supervisors to maximize responsiveness to demand and productivity. B. The County shall make service available 7 days per week except for county holidays established by the Board of Supervisors. 0 0 -3- C. The County shall charge and retain a 50¢ one- way fare to defray operating costs for the next year; in the event this agreement is not renewed for future years, Johnson County will pay all accrued fares to the City of Iowa City. D. The service shall be subject, in all other respects, to operating policies and procedures as may from time to time be established by the Johnson County Board of Supervisors. No policy or procedure substantially at variance with the Proposal shall be established without the approval of the City of Iowa City. 5. All management and administration will be vested with the Johnson County Board of Supervisors and the Board shall see to the payment of all costs incurred as a result of this program. 6. In consideration of the County's agreement to provide special elderly and handicapped transit service as herein provided, the City of lowa City agrees to pay to .Johnson County the sum of $27,827.22 for the tcn month period covered by this contract. Payments shall be made upon receipt of funds from the Town Department of Transportation. In addition, the City of Iowa City agrees to provide Johnson County with one vehicle suitable for elderly and • handicapped transit services s Title to this vehicle shall be transferred to ,Johnson County. Acquisition of the aforesaid vehicle by the City of Iowa City shall be accomplished only following approval by .Johnson County of specifications for the vehicle to be so provided, which approval shall not be unreasonably withheld. In the event this agreement is not renewed for future years, Johnson County will re -convey title to the vehicle to the City of Iowa City. 7. It is further understood and agreed that the vehicle to be provided by Iowa City will become part of one operating system and that the vehicle so provided and owned by Johnson County will, at the county's discretion, also be utilized for special older.ly and handicapped transit services in other parts of: Johnson County as part of an integrated and fully coordinated county -wide service. B. This agreement is renewable for future one year terms provided the City of Iowa City has, at least 90 clays prior to the expiration of the current year, provided .Johnson County with notice of its desire to renew the agreement and further provided that Johnson County has not, more than 90 days prior to expiration of the current term, notified the City of Iowa City that it does not wish said agreement to be renoaed. In the event of renewal., this contract will remain :in rul.l -s - force and effect as to all terms hereof except for the amount of financial consideration to be paid hereunder. The financial consideration for any renewal term shall be subject to negotiation by and between the parties which negotiation must be concluded not less than 90 days before July 1 of each and every year hereafter. 9. The development of this proposed specialized transportation program has been guided by the Subcommittee on Specialized Trans- portation Services for the Elderly and Handicapped of the Johnson County Regional Planning Commission. Attachment A provides a listing.of those committee members who assisted in the develop- ment of this proposal. 'In developing a specialized transportation system for the elderly and handicapped the Subcommittee considered various alternatives for the administration and operation of the service in the Iowa City-Coralirille urban area. Five options were considered including: (1) Operation of the system through the Johnson County Specialized Elderly and Handicapped Transportation System (SEATS). (2) Operation through Iowa'City Transit. (3) Operation through the local taxi operator. (4) Operation through the University of Iowa motor pool and (5) Determining an operator through an informal bid procedure. Attachment B presents*a summarization of the analysis 0 0 provided by the Subcommittee to the concerned governmental agencies. After review and discussion, the Subcommittee voted to recommend Option (5), that of having local specialized transportation operators present proposals to the governmental agencies documenting the costs and level of service which they could provide on a contractual basis. In addition, it was suggested by the Subcommittee that the City of Iowa City and the City of Coralville allocate funds from the IDOT financial assistance program to finance the program. Subsequently, two local specialized transportation operators, Johnson County SEATS and the local taxi operator (Yellow Cab Co. and Super Cab Co.) presented proposals for the provision of services on a contractual basis. Attachment C documents an analysis of the Johnson County SEATS and local taxi proposals citing the important points of comparison. After a review of these proposals, the Iowa City Council recommended at an informal council meeting on June 6, 1977 to contract with the Johnson County SEATS program. Previously, the City of Coralville indicated .their willingness to purchase specialized transportation services from the same operator who contracted with Iowa City. Accordingly, the City of Coralville would be assessed on a basis of its total population relative to the total population in the Iowa City-Coralville metropolitan area according to the 1974 Special Census for Johnson County. 3 • PROPOSAL FOR THE PROVISION OF SPECIALIZED TRANSPORTATION SERVICES TO THE ELDERLY. AND HANDICAPPED RESIDENTS OF IOWA CITY AND CORAL— VILLE THROUGH THE JOHNSON COUNTY SEATS PROGRAM In order to describe the workings of this proposed inter- governmental coordination program, the following areas of system management and operations are considered: (a) Generalized description of the specialized trans- portation program for the Iowa City-Coralville urban area (b) Eligibility of persons (c) Priority of trip purposes (d) Hours of operation and the level of service (e) Area of service (f) Funding and budget considerations (g) Organization and management (h) Coordination of specialized transportation activities and (i) Monitoring of goals and objectives lized Description of the S ecialized Transportation m or the Iowa City-Coralville Ur an Area Based upon the decisions of the City of Iowa City and the City of Coralville, it is proposed that these municipalities contract with the Johnson County SEATS program to operate vehicles within the Iowa City-Coralville urban area to serve the elderly and handicapped on a demand -responsive basis. Currently, Johnson County SEATS operates one vehicle which • primarily serves rural elderly residents of Johnson County. Accordingly, through this proposal, the administrator of the Johnson County SEATS program will be contracted to operate one additional vehicle serving elderly and handicapped residents of the Iowa City-Coralville urban area. Dispatching arrangements will be handled in a similiar fashion to the current operations of Johnson County SEATS. Patrons will call in one day in advance to notify their intention to obtain service in which the administrator -dispatcher schedules routes for the subsequent days of service. Funding for the acquisition of a new Iowa City vehicle is to be provided through Housing and Community Development Assis- tance funds. It is estimated that one vehicle will be sufficient for meeting the present level of demand for specialized transpor- tation services. This vehicle will be equipped with a lift to accommodate persons confined to wheelchairs. Title of the vehicle will be transferred to Johnson County whereby Johnson County will have responsibility for insurance coverage and corrective and preventive maintenance. Delivery of this vehicle is expected in the spring of 1978. Table 1 provides a timetable of the proposed scheduling of operations. Service for the Iowa City-Coralville urban area is scheduled to commence on September 1. An existing Johnson County SEATS van equipped with a ramp will be utilized for the urban area service until delivery of the new Iowa City vehicle in 1978. I u ation Service March Apr May June r (b) Eligibility of Persons It is proposed that the elderly and handicapped residents of the Iowa City-Coralville urban area will be served by this specialized transportation system. An elderly person is defined as any individual over 60 years of age whereby a handicapped person is defined as any individual with ambulatory, manual, visual, audial, or mental impairments which seriously limits his or her ability to obtain adequate transportation either 'through the use of private automobiles or public transit. It is anticipated that non -handicapped persons under 60 years of age will utilize:.the fixed -route transit systems of Iowa City and Coralville. (c) Trip Purposes It has been recommended,by a citizens committee composed of members of the Johnson County Council on Aging and the Johnson =c: County Citizens' Committee for the Handicapped, that trips be assigned on a priority basis according to the suggested trip - purpose ordering: (1) Medical trips (2) Social service trips (3) Grocery shopping trips (4) Employment and volunteer service trips (5) Trips related to organized social and senior activities and (6) Other shopping dips 6 11 • Trips for other purposes will be referred by the system dispatcher to other transportation modes (i.e. public transit and taxis) and will be recommended for specialized service only if the vehicles are not operating for the above listed trip purposes. (d) Hours of Operation and the Level of Service - It is suggested that service be provided for approximately 67 hours per week according to the timetable illustrated in Table 2. The hours of allowable operational service will be directly dependent upon the efficiency of the system in the delivery of spedialized transportation services. The monitoring and.evaluation of the system's efficiency and productivity will determine any extension or limitation of the hours of service. With the initiation of service within this area, all elderly and handicapped residents in Johnson County will become eligible for specialized transportation services. (f) Funding and Budget Considerations Through this proposal Iowa City and Coralville will provide $31,585.84 to operate one vehicle for a ten-month period in the metropolitan area. Table 3 provides a budgetary breakdown of the fixed overhead, labor, and vehicular expenses of the system. (The total cost on an annual basis would be $37,902). The total projected annual.cost of $37;902 for this service equals $728.88 on a weekly basis. The estimated hourly cost is .$10.80. Assuming this level of service, the $68,100 which Iowa City and Coralville applied for through the IDOT Financial Assistance Program will provide approximately 93 weeks of service. The budget analysis does not include funds which will accrue from fares charged to patrons. It is suggested that a 50 cent fare be charged for one-way trips. It is estimated that enough ridership will be generated to provide from $4,000 to $5,000 wotth of revenue per year for the system. An accounting system shall be instated which will credit the accrued fares to the participating governmental units. The distribution of expenses is based upon the relative populations of Iowa City and Coralville. of service for the following year. The basis of accrual of distributing fares from trips to Coralville, Iowa City, or Johnson County shall be the origin of the trip(s). '(g) Organization and Management of Operations in the Public Sector Under this proposal the City of Iowa City and the City of Coral- ville will contract with the Johnson County SEATS program to provide administrative services in operating vehicles for the elderly and handicapped within the Iowa City-Coralville urban area. The level of service currently provided to the Johnson County rural elderly will be maintained through this proposal. However, it is expected that some ride and time 'sharing between the urban and rural vehicles will occur. For example, the rural Johnson County vehicle could service some Iowa City residents a's the van travels through Iowa City to the rural regions of the county. Likewise the urban vehicle could assist with the service the rural vehicle presently provides within the urban area. Improved arrangements could also be made regarding the transportation of Iowa City residents who attend congregate meals. It 'is proposed that thecoordination of specialized trans- portation service between the metropolitan and rural areas will lead to the following advantages and benefits over the present level of operation. • Through a coordination of existing transportation services, an increase of operations efficiency should occur. Through the sharing of administrative, dis- patching, and operational services an increase of system efficiency measured through a lowered cost per vehicle hour should occur. • An extension of specialized transportation services to the Iowa City metropolitan area should increase the level of ridership potential which could lead to in- creases in the rate of passengers/vehicle hour relative to the existing level of operation. 10 • 11 It will be the responsibility of the Johnson County SEATS coordinator to provide monthly and yearly reports regarding the ridership, revenue, expenses, hours of operation, and other relevant data for the program. (h) Coordination of Specialized Transportation Activities Through this proposal there is a coordination of funding from various sources. Table 4 illustrates that funding from five sources, the City of Coralville, the City of Iowa City, Johnson County, the Iowa Department of Transportation, and the Heritage Area Agency on Aging will be coordinated into the Johnson County SEATS program. Currently, two advisory committees, the Transit Advisory Committee and the Subcommittee on Specialized Transportation Services for the Elderly and Handicapped have assisted in the development of this program. In addition, a consumers advisory°committee will be established to provide input and advice for the program. The composition of this committee shall be established by the Johnson County Council on Aging. (i) Monitoring of Goals and Objectives In order to determine the level of efficiency and effec- tiveness of the system for ten months of Fiscal Year, 1978 (September 1, 1977 to June 30, 1978), there are certain effi- ciency indicators which will be monitored on a monthly basis. (1) Number of Trips per Month For the first ten months of operation, a goal of 800 trips per month is prescribed for the Iowa City-Coralville urban area service. This level is interpreted as a minimum benchmark whereby the level of ridership would be expected to increase during the following year of operation. (2) Average Cost per Trip Based upon the projected expenditures and the minimum 'monthly level of ridership objective, a maximum cost per trip of $3.95 is to be achieved for the first ten months of operation It is anticipated that due to improved efficiency of service and an increased level of ridership, that the•average cost per trip will decrease significantly during the second year of operation. For the second year of operation, the cost per trip is expected to attain a level in the range of $2.50-3.00, _- or as close as possible to the IDOT standard of $2.50/trip. (3) Level of Vehicle Productivity Based upon the projected total hours of service and the projected level of monthly ridership, the level of vehicle pro- ductivity, measured through the number of trips per operating hour, is expected to achieve a rate of 2.7 for the first ten months of service. 13 14 0 (4) Ratio of Fare Revenue to Total Expenditures Assuming a one-way fare of 50 cents, the ratio of fare revenue to total expenditures is expected to reach a level of 12 percent. Option 2: The administration and operations of the specialized system would be handled by Iowa City Transit. Option 3: The administration and operations of the system would be handled by the local private taxi companies. The city of Iowa City would subsidize a specified amount of rides for elderly and handicapped riders. Option 4: The administration and operations of the system would be shared by Iowa City Transit and the University of Iowa motor pool whereby the University motor pool would purchase vans and provide for maintenance and insurance matters. Option 5: With this option funding provided through the state transit assistance funds would be impounded for future use. A committee representing the interests of the elderly and handicapped would define the criteria and guidelines relating to the transportation service pro- vided. Once guidelines were established, different groups would competitively bid for the right to ini- tiate and operate a specialized van system. That group which could demonstrate the most efficient and effective service would be eligible for subsidization. Two separate plans are also considered. Plan I would approximate an allocation of $30,000 to $35,000 of state transit assistance funds. Plan II would provide for a somewhat higher level of service and would require funding in the range of $50,000 to $55,000 for the initial year of operation. The funding considerations and estimates for each option are detailed in a later section of the report. In order to facilitate understanding of the separate op- tions under each plan, information is presented in tabular form under the following headings: (1) Capital Equipment and Maintenance (2) Systems Operations and (3) Funding Considerations. 18 I. Fundine Consideratio The accompanying table summarizes cost projections. For each option the range of funds allocated from the state tran- sit assistance monies are similiar under each plan. It should be noted, however, that these figures only represent rough estimates and that the actual costs of the transpor- tation system could deviate from the projected costs. The footnotes listed on the table are explained below. (a) It is assumed under Option l that office space would be provided at the Senior Center. At this time accommodations under Options 2 and 4 have not been considered. (b) It is possible that labor expenses for a county -operated system as under Option 1 could be provided through the CETA program. (c) The labor expenses under Option 2 would have to be deter- mined through Iowa City Transit. (d) Possibilities of shared labor through Iowa City and the University of Ioiaa exist under Option 4. (e) The existing SEATS van has less than one year of operating life left. (f) A lease agreement from local automotive suppliers for a one-year term would range in cost from $200 to $250 a month per vehicle. (g) A lease agreement from the University of Iowa motor pool has been estimated at around $200 per month. (h) The costs of operating the vehicles would vary according — to the amount of miles traveled and the system of sub= sidization chosen. The estimates for Options 1 and 2 are based on a cost of 15 cents per mile for 25,000 miles of operation.' For Option 4 operating costs would be included in the leasing fee. The first- of these has been offered by the Johnson County SEATS program, hereafter referred to as the County. The second proposal has been made by Mr. Ralph Oxford, proprietor of the Yellow and Super Cab Companies, hereafter referred to as the Cab Company. Without going into great detail, these two proposals can be reviewed and compared on a number of levels, as outlined below: 1) .Cost per week - County - $728.88 Cab Co. - $867.37 2) Cost per year - County (without Coralville participation) - $37,902.00 Cab Co. - $45,103.24 3) Other -cost considerations County - The County proposal includes money for publicity and insurance. Cab Co. - The Cab Company provides none of the above, but does provide for a garage for the vehicle. 4) Level of service - County - The County already has existing channels of communication to senior citizens. The transportation of elderly and handicapped is SEATS' primary mission. Cab Co. - The Cab Company may experience conflicts between its contract service and its commercial taxicab service. 5) Monitoring - County - The City Transit Manager would be responsible for periodically reviewing the service being provided and the condition and operation of the vehicle. Cab ,Co. - The City Transit Manager could keep a watchful eye on the vehicle, but monitoring the service actually provided might be difficult. Control over personnel would be limited. 6) Advisory Committee - County - A local government agency should be responsive to the suggestions of an Advisory Committee. Cab Co. - The private operator may resent any attempts by an Advisory Committee to alter his methods of operation. 28 7) Maintenance - County - The County proposal provides for vehicle maintenance by an outside contractor. Cab Co. - The Cab Company will provide its own maintenance service. The profit motive may discourage proper maintenance of the City -owned vehicle. • 8) Hiring procedures - County - The County has an established EEOC program. Cab Co. - The Cab Company has no EEOC program, and in fact has had a complaint filed against it. 9) Contract - County - One year contract, renewable after one year. Cab Co. - One year contract, can be reopened after three months by either party. 10) Taxicab reimbursement - County - It is anticipated that some percentage of trips will be diverted from the taxicab company to the public elderly and handicapped transit. Discussion with the City Attorney's office reveals that the City and County have no legal exposures for loss of revenue by the taxicab company. The situation is similar to that with mass transit. Trips are diverted from private enterprise, but the City has no responsibility to reimburse the taxi company. Nonetheless there has been discussion about this matter and Council may wish to consider it further. Cab Co. - If the Cab Company got the contract no consideration would need to be given to compensation for loss trips. Based on the above considerations, it is our recommendation that the Johnson County SEATS proposal be accepted. It is also suggested that a fare of 50¢ be charged for each one-way trip. This will make the handicapped program similar in price to the existing SEATS program. If the handicapped program has a lower price than the SEATS program it .is felt confusion will result since many users who are eligible for either service will request only the handicapped service to take advantage of the lower price. All revenues collected under the handicapped program that are attributable to Iowa City residents should be reimbursed to the City of Iowa City.
