CITY MANAGER'S CONFERENCE ROOM MEMBERS PRESENT: Cain, deProsse, Ogesen, Ferret, Vetter MEMBERS ABSENT: Blum, Jakobsen, Neuhauser STAFF PRESENT: Kraft, Simpkins GUESTS PRESENT: Barry Hokanson Chairman Ogesen called the meeting to order. The minutes for the June 14, 28, and 30 meetings were unanimously approved. Economics Report Members asked if they had been sent a final draft of the Economics Report. Kraft explained that all changes made to the last draft were minor except for the additional paragraphs as outlined in Debra Martzahn's memo of August 5, 1977. Committee members deferred approval of the report until copies of the final draft are distributed. It was agreed that the staff should mail copies to members and if no corrections are received from members within one week, the staff will assume that the report has been approved. Comprehensive Plan Schedule Kraft explained the Comprehensive Plan Schedule as presented in his memo of July 18, 1977 to City Council. It was the consensus of the committee that the Impact Analysis for Issues and Alternatives should be acted upon by the Planning and Zoning Commission in September. Cain stated that she will ask the other PSZ members to attend CPCC meetings where parts of the Comprehensive Plan that require formal action by the Planning and Zoning Commission are discussed. Ogesen asked if the map overlay technique will still be used in developing the Comprehensive Plan, and Kraft answered yes. It was asked if when the Comprehensive Plan is adopted, if the zoning of an area is changed from, for example, residential to industrial, will the zoning and the plan be changed, or only the zoning? Kraft replied that both would have to be changed. Barry Hokanson asked if the Comprehensive Plan policies to be formulated in December would include information from the county's Human Needs Study. Kraft asked if the county would have enough information by December to make this possible, and Hokanson stated that it probably would not. Committee members asked to receive copies of reports from the Human Needs Study. Kraft suggested that Connie Echternach be asked to appear at the September 13 meeting of CPCC to give an update of her work on this study, and members requested that this be done. Kraft recommended that the CPCC meeting scheduled for August 25 be cancelled since no further action on the Issues and Alternatives can be taken until Council finishes its review. The August 25 meeting was cancelled. The next CPCC meeting will be September 13, 1977 at 7:30 P.M. The meeting was adjourned. CIVIL: CENTER COUNCIL CIIAMBI'.RS MEMBERS PRESENT: Cain, Jakobsen, Kammermeyer, Lehman, Ogesen, Vetter MEMBERS ABSENT: Blum STAFF PRESENT: Boothroy, Kushnir, Simpkins RECOMMENDATIONS TO THE CITY COUNCIL: 2, To approve 5-7726, proposed extension of 7th Avenue north of Rochester Avenue as shown in the preliminary plat of Windsor []eights addition, Part S. To approve 5-7726, preliminary plat of Windsor Heights addition, Part 5, with the following additional contingencies: (I) that Plum Grove Inc. submit :an agreement dedicating a 50 foot right-of-way for the extension of 7th Avenue across their property; (2) that acceptance of the right-of-way is conditioned upon receipt of an agreement for its construction; (3) that an agreement be provided by Pat (larding Construction to the City for the construction of 7th Avenue, or the cost of construction of 7th Avenue be put in escrow; (4) that sidewalks are to be installed along both sides of the proposed exten- sion of 7th Avenue except for that eastern portion of 7th Avenue running between Rochester Avenue and the property of Plum Grove Inc.; (5) that an agreement be provided by Plum Grove Inc. respecting the integrity of the stormwater management basin before approval of the final plat. To approve 5-7730, preliminary plat of a 2.7 -acre tract of land located west of Highway 1 and Dane's hairy and contiguous to the south city limits, with the following contingencies for approval of the final plat: (1) that the provisions of the Stormwater Management Ordinance be met; and (2) that the developer will submit an agreement not to build on the 50 x 100 foot triangle in the southwest corner of Lot 4, that this triangle will not be used to compute the stormwater detention area for Lot 4, and that the applicant will not build on Lot 4 for a period of three years. To approve 5-7737, final plat of Ilawkeye Heights, located west of Mormon Trek Boulevard, north of Mark V1 apartments and approximately 500 feet south of Melrose Avenue. REQUESTS TO THE CITY MANAGER FOR INFORMIATION OR STAFF ASSISTANCE: None LIST OF MATTERS PENDING COMMISSION/COUNCIL DISPOSITION: 1. 11-7317. Creation of a University Zone (U). 2. P-7410. Creation of a Mobile home Residential Zone (RMI[). 3. 1'-7403. Revision of MI and M2 zones. SUMMARY OF DISCUSSION AND FORMAL ACTIONS TAKEN: Chairperson Cain called the meeting to order and asked if anyone wished to discuss I 3533 • -2- • items not included on the agenda. No one responded. Commissioners unanimously approved the minutes of the meetings held July 18, 1977 and August 4, 1977. The innovative parking area design plan submitted by Ted Pacha was unanimously approved. S-7726. Council referral of a preliminary plat of Windsor Heights Addition, Part 5, regarding a proposed extension of 7th Avenue north of Rochester Avenue. Chairperson Cain asked if the engineering staff had completed their review of the preliminary plat. Doug Roothroy, Assistant Planner, told the commission that the staff had finished the review, and that the waterline had now been extended to Rochester Avenue so that it runs in a complete circle. Ile stated that he had a list of concerns of the engineering, planning, and legal staffs. Ile recommended that the following be made conditions to approval of the preliminary plat: (1) that Plum Grove Inc. submit an agreement dedicating a 50 foot right-of-way for the extension of 7th Avenue across their property; (2) that acceptance of the right-of-way is conditioned on receipt of an agreement for its construction; (3) that an agreement be provided by Pat Harding Construction to the City for the construction of 7th Avenue, or the cost of construction of 7th Avenue be put in escrow. If it is agreed to escrow the cost of construction, then a waiver of the special assessment, Chapter 384 of the Iowa Code, must he provided; and (4) that sidewalks are to be installed along both sides of the propsoed extension of 7th Avenue running between Rochester Avenue and the property of Plum Grove Inc. Drug Roothroy also told the commission that the staff recommended that before approval of the final plat, an agreement respecting the integrity of the stormwater management area be provided by Plum Grove, Inc. so that this area is not destroyed in the grading of the Plum Grove Inc. property. Don Hoy , attorney for Pat Harding Construction, stated that an agreement was being prepared to either construct the 7th Avenue extension or to place the money for construction of 7th Avenue is escrow, but that a waiver of the special assessment could not be provided because the developer does not own the adjoining land. Ile told the Commission that they would also have a dedication from Plum Grove Inca of the portion of the right-of-way located on their property, and a written agree- ment between Plum Grove Inc. and Pat Harding Construction in which both parties will provide for maintinaing the integrity of the stormwater management area. He stated that Pat Harding Construction would agree to install sidewalks along both sides of the proposed extenison of 7th Avenue except for that eastern portion of 7th Avenue running between Rochester Avenue and the property of Plum Grove Inc. Mr. Hoy stated that they intend to have the necessary legal documents prepared by Monday, August 22, 1977. Doug Roothroy told the commissioners that Dennis Showalter, Parks and Recreation Director, Flo Stockman, Chairperson of the Parks and Recreation Commission, and he had toured the location for the 7th Avenue extension. Mr. Showalter and Ms. Stockman asked him to suggest for discussion that when the sidewalk is constructed along the extension, a spur be run to the small bridge which crosses the drainage ditch. 0 -3- Tony Kushnir, Assistant City Attorney, commented that this sidewalk spur would be more than what is normally required, and it' tIit, developer agreed to provide it, he would be doing so :is gratis. Chairperson Cain suggested that it' it wns decided that this spur of sidewalk running to the drainage ditch bridge was necessary, perhaps the city would choose to pay a portion of the costs with Parks and Recreation Department funds. The Commission unanimously recommended approval of the proposed extension of 7th Avenue north of Rochester Avenue, and added to its recommendation for approval of the preliminary plat of Windsor Heights Addition, Part 5 the conditions as outlined by Doug Boothroy with the deletion of requiring a waiver of the special assessment. The Commission also recommended that an agreement be provided by Plum Grove Inc. respecting the integrity of the stormwater management area as a condition to approval of the final plat. Chairperson Cain stated that the developer had met her objections in voting against the preliminary plat of Windsor Heights Addition, Part 5 at the last Planning and Zoning Commission meeting. Commissioner Jakobsen commented that if, in fact, a subdivision is not developed on this, property and the City does buy this land for an extension to Hickory Hill Park, she would recommend that an entrance to the park in addition to Winston Drive be provided. S-7730. Review of a preliminary plat of a 2.7 -acre tract of land located west of Highway 1 and Dane's Dairy and contiguous to the south City limits; 45 -day limitation Chairperson Cain stated that this was the tract of land recently recommended to Council for annexation and that the recommended zone for it was CII. Doug Boothroy explained that per the Commission's request he had attempted to contact Maurie Burr, Resident Engineer, Iowa Department of Transportation (DOT), and DOT officials concerning'the alignment of the frontage road for Highway 1. He explained that he had been unable to speak with Mr. Burr personally, however he had contacted Bob 1lenely, District Chief for DOT. Doug Boothroy stated that a court injunction was a continuing cause for the delay in going ahead with plans for the Highway 1 improvements. The original environmental impact statement filed on the 518 - Highway 1 project was rejected. A second statement has been filed and when it is accepted DOT will move ahead with the Highway 1 - 518 Improvements Program. Boothroy stated that DOT is using the plans regarding alignment of the frontage road as developed several years ago, and that he had been told that approximately $800,000 has been alotted in the fiscal year 1979 budget for Highway 1 rights-of-way acquisition. Doug Boothroy outlined the following recommendations of the engineering staff as discussed in two memos he had received from Gene Dietz, City Engineer: (1) that the 50 x 100 foot SIV corner of Lot 4 be dedicated right-of-way; and (2) that stormwator drain west toward Willow Crock Drive and not into the ditch along Highway 1. lie stated that Gone Dietz was concerned that regrading and other improvements to Highway 1 might jeopardize the stormwater detention basin of Lot 4. Gene Shoemaker, engineer for Barker Development Co., responded to Doug Boothroy's • -4- 0 comments. Ile stated that. Mr. Barker would agree to hold in reserve the 50 x 100 Ct. triangle of Lot 4, and to not build on that portion of the lot. Ile stated that is was difficult to proceed with the final dcclgn of the lot without knowing if that triangle is the specific piece of land that will be required for Highway 1. In response to Gene Dietz's request that the stormwater be made to flow west toward Willow Creek Drive, Mr. Shoemaker told the commission that the topography of the land is such that the ridge line is near the center of Lot 1, and that Gene Dietz was asking that the developer somehow force stormwater flowing towards the highway to flow upstream. lie stated that the stormwater from Lot 1 could be made to flow west, but he could not drain the stormwater from Lots 2, 3, and 4 without major regrading anywhere but to the highway. With these comments he requested that the commission take action on the preliminary plat at this time. Commissioner Ogesen asked Mr. Shoemaker if he thought it would be possible to design the stormwater detention on Lot 4 so that the 50 x 100 foot triangle would not be needed to meet the requirements of the Stormwater Management Ordinance. Mr. Shoemaker stated that is was possible and that the actual design plans would be formulated between the preliminary and final plats. Commissioner Lehman expressed concern about the price the city would have to pay for the corner of Lot 4 if its value is assessed after a structure is built on the lot. Ile pointed out that the corner of a vacant lot is worth far less than the corner of a lot upon which there is a structure, and that the City should be protected from paying an inflated price at some future time. Tony Kushnir stated that it was within the City's power to require dedication or right-of-way of this land. Chairperson Cain stated that although plans for the alignment of the frontage road exist in the minds of people, the highway department has not decided on a particular alignment, and thus the City does not know what specific piece of Lot 4 to require for dedication. Commissioner Lehman stated that he did not think the City could legitimately ask for dedication of property that may or may not be bought, but he did feel that the City should be able to condemn the property later at its present value. Mr. Shoemaker stated that Mr. Barker was willing to reserve the 50 x 100 foot triangle of Lot 4, to not consturct any buildings on that corner, and, if necessary, would agree to not build on Lot 4 for a period of three years. Ile stated that three years would presumably be enough time for someone to decide where the road was going to be put, and emphasized that he was speaking of a written agreement, not a dedication, because to date no final plans exist to determine that a dedication is needed. Doug Boothroy restated the need for satisfying the engineering departments concerns regarding stormwater management. lie emphasized that Gone Dietz had now written two memos concerning stormwater detention on Lot 4 and drainage of the stormwater west toward Willow Creek rather than towards Highway 1. The Commission unanimously recommended approval of 5-7730, preliminary plat of u 2.7 -acre tract of land located west of Highway 1 and Dane's Dairy and contiguous to the south city limits, with the following contingencies for approval of the final plat: (1) that the provisions of the Stormwater Management Ordinance be met; and (2) that the developer will submit an agreement not to build on the 50 x 100 foot triangle in the southwest corner of Lot 4, that this triangle will not be • -5- • used to compute the stormwuter detention area for Lot 4, and that the applicant will not build on Lot 4 for a period of three years. Review of an application submitted by Iowa City Warehousing, I of a (arae Scale Non -Residential Development plan of Lot 3 of Auditor's 7. Doug Boothroy stated that the applicant had requested deferral and had submitted a waiver of the 45 -day limitation period. The Commission deferred consideration of S-7731, application submitted by Iowa City Warehousing, Inc. for approval of a Large Scale Non -Residential Development plan of Lot 3 of Auditor's Plat No. 32. S-7736. . Public discussion of a final located Chairperson Cain noted that all deficiencies and discrepancies of the preliminary plat have been corrected. Doug Boothroy explained that because Sandusky Drive is an over -width street and the $10,000 amount which the City matches for construction had been exceeded, in order to receive City funds the final plat would have to be divided into two final plats. Ile noted that this was in the process of being done. Commissioner Ogesen requested clarification of the City's role in the covenants. Tony Kushnir explained that the City was merely a third party beneficiary whose express consent was need to change any of the covenants. The Commission deferred consideration of S-7736, final plat of Pepperwood Addition, Part I. of located west of Mormon 500 feet south of Chairperson Cain stated that no deficiencies or discrepancies had been noted on this plat. She mentioned that stormwuter detention would be provided by the applicant on an adjacent piece of land through a written agreement with Westwinds. Commissioner Ogesen asked why the recreation area in the preliminary plat had been eliminated in the final plat. The developer answered that because stormwuter detention would now be provided by an agreement with Westwinds,this area was no longer needed to meet the requirements of the Stormwater Management Ordinance. Ogesen stated that he would not object to the deletion of the recreation area, however, in his opinion an area developed including a recreation area improved the quality of life, and in this way the final plat shows a development that is not as nice as the preliminary plat. The Commission unanimously voted to recommend approval of S-7737, final plat of Hawkeye Heights. 0 -t,- 0 Doug Boothroy informed the Commission that the current planning staff had been asked to make a presentation before the School Board meeting on October 11, 1977 concerning new developments in the City which will require changes in schools to service these a rens. Chairperson Cain stated that the Planning and Zoning Commission had unsuccessfully tried to arrange such a meeting with the School Board last year. She asked Doug Boothroy to inform the Board that if they wished to organize a joint Planning and Zoning Commission - School Board meeting, to have commission members present at the October it meeting, or if the Planning and Zoning Commission could offer any assistance to please let them know. Chairperson Cain told the commission that she had received a copy of the first report from the Northside Neighborhood Preservation Study to be circulated among the commissioners. Chairperson Cain asked if anyone wished to attend the Historic Preservation Conference at Iowa State University in Ames on September 20 and 21, 1977. She requested that Doug Boothroy find out if anyone on the Community Development staff was planning to attend. I`; The meeting adjourned.
