A bid tabulation is attached to this packet. _ (2) Consider resolution accepting sanitary sewer in Mt. Prospect 3 Part III. COMMENT: This resolution would accept sanitary sewers in Mt. Prospect Part III as constructed by Sulzberger Construction Company of Muscatine, Iowa. Public Works recommends adoption of the resolution. e. Setting Public Hearings: (1) Consider resolution setting public hearing on September 20, 1977, for Mormon Trek Boulevard Improvement Project (FAUS M-4039(1)--81-52). C014MENT: This resolution would set a public hearing on September 20, 1977, for the proposed plans, specifications, form of contract, and estimated cost for the Mormon Trek project. The State Department of Transportation is currently reviewing the plans which are scheduled for an October 11, 1977, opening date. Public Works recommends adoption of the resolution. f. Correspondence: (1) Letter from Jan Abbott regarding parking in the 2100 block of Davis Street. This letter has been referred to the City Manager for reply. O (2) Letter from Jim Donkerslokt regarding even -odd date regulations for on -street parking. This letter has been referred to the City Manager for reply. END OF CONSENT CALENDAR Item No. 4 RECOMMENDATIONS TO THE CITY COUNCIL: a. The Parks and Recreation Commission expresses to the Council its disappointment in actions taken by the Council regarding the Windsor Heights Addition. b. Consider recommendations of the Planning and Zoning Commission: 0 Agenda Regular Council Meeting September 13, 1977 7;30 P.M. Page 3 (1) To approve S-7736, final plat of Pepperwood Addition, Part I, located west of Taylor Drive and south of the K -Mart area, contingent upon approval of the legal papers by the Legal Staff and the submission of signatures of the utility companies prior to consideration by the City Council. The Planning and Zoning Commission, at a regular meeting held on September 1, 1977, recommended by a 7-0 vote approval of the above subdivision subject to the contingencies noted. This recommendation is consistent with the Staff's recommendation presented in a Staff Report dated August 18, 1977, which is attached to this agenda. This item will be presented to the City Council for consideration at the next regular meeting if the contingencies noted above are resolved. (2) To approve S-7742, final plat of Pepperwood Addition, Part II, located west of Taylor Drive and South of the K -Mart area, contingent upon approval of the legal papers by the Legal Staff and the submission of signatures of the utility companies prior to consideration by the City Council. The Planning and Zoning Commission, at a regular meeting held on September 1, 1977, recommended by a 7-0 vote approval of the above subdivision subject to the contingencies noted. This recommendation is consistent with the Staff's recommendation presented in a Staff Report for the above item (S-7136). Parts I and II of Pepperwood Addition comprise only a portion of the total area represented in a preliminary plat recently approved by the City Council. The reason for the two parts as submitted is to accommodate for the over -width street of Sandusky Drive to avoid special assessment procedures for construction of the street. This item will be presented to the City Council for consideration at the next regular meeting if the contingencies noted above are resolved. (3) To approve S-7739, final plat of Nendram Bluff located north of Linder Road and east of Old Highway 218 (North Dubuque Street) in Johnson County contingent upon: (1) a waiver of the length of the cul de sac, and (2) approval of the legal papers by the Legal Staff. The Planning and Zoning Commission at a regular meeting held on September 1, 1977, recommended by a 7-0 vote approval of the above subdivision subject to the contingencies noted. This recommendation is consistent with the Staff's recommendation presented in a Staff Report dated September 1, 1977, which is attached to this agenda. This item will be presented to the City Council for consideration at the next regular meeting if the legal papers are found acceptable by the Legal Staff. Comment: The Council has received a memoranda concerning the administrative, financial, and legal aspects of the proposal. Page 5 Item No. 8 PUBLIC HEARING ON THE DISPOSAL OF A PART OF FERSON AVENUE IN BLACK'S PARK ADDITION. Comment: The Council recently vacated the right-of-way for this parcel, and on August 30 approved a resolution to offer this land for sale to the abutting owners. These abutting owners had thought they owned these parcels but the purported vacation of this street in 1941 was invalid. The property was appraised by Russel Mann. After the public hearing a resolution will be presented for Council's consideration which will convey the parcels. At that time the Legal Staff will have completed an agreement to protect the water lines that traverse Parcel A. n, (� Action: to lln ,,. /•dam r! Ci +`•ie 't� �_,�.'�� '��-�J Qc: �.�f Item No. 9 CONSIDER AN ORDINANCE AMENDING ORDINANCE NO. 76-2807, THE STORM WATER A7 6-5� MANAGEMENT ORDINANCE (passed and adopted). Comment: As explained in a memo dated July 29, 1977, attached to the packet of August 30, 1977, the wording in the ordinance concerning administration of soil erosion control is fuzzy. On page two of that memo a new Section IV is listed. Essentially the ordinance change makes the original developer responsible for performance of erosion control from the time span from the start of preliminary grading until sale of lots or land to a purchaser. After commencement of lot or land sale the actual owner of the lot is responsible for the erosion control. This approach has been discussed with the major developers in town and they find this preferable to making the original developer responsible until occupancy of a completed structure. This ordinance is slightly different in Section A than the July 29 memo in an effort to further clarify intent. A letter from the City Attorney recounting events in connection with this matter is attached to the agenda. V -leI 1 `I / v CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST CONTRACT FOR THE CONSTRUCTION OF MERCER PARK BALL DIAMOND LIGHTS WITH FANDEL, INC. Comment: On August 9, 1977, Fandel, Inc., of Cedar Rapids, Iowa, was awarded the Mercer Park Ball Diamond Lighting Project for a sum of $34,943 subject to filing proper performance bonds and insurance certificate. RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND IOWA STATE BANK AND TRUST COMPANY, IOWA CITY, IOWA, TO PROVIDE FOR BOOKKEEPING AND ACCOUNTING SERVICES FOR THE REHABILITATION I LOAN PROGRAM. This resolution authorizes the City of Iowa City and the Iowa State Bank and Trust Company, Iowa City, Iowa, to enter into an agreement whereby the Iowa State Bank will provide a depository account with accounting and bookkeeping services for the Rehabilitation I Loan Program.
