C g0.Y<4t� Pe 1 Motions: (1) Consider motion to approve disbursements for the period July 1-31, 1977, in the amount of $1,230,856.78, as recommended by the Finance Director, subject to audit. (2) Consider motion approving Petition for Suspension or Remission of Taxes on Account of Age or Infirmity for Opal D. Hochstetler, 808 6th Avenue, as recommended by City Clerk and City Attorney. e. Correspondence: (1) Letter from Richard A Lahr, Secretary, Board of Education, regarding the Board's appointment to the Parks and Recreation Commission for the 1977-78 school year: Ruth Skelley, 224 Fairview, Iowa City, IA. END OF CONSENT CALENDAR Item No. 4 RECOMMENDATIONS TO THE CITY COUNCIL: a. Consider recommendation of the Planning and Zoning Commission to approve S-7741, final plat of Village Green South Located east of Mercer Park and north of the CRI&P Railroad, contingent upon: (a) that a legal description, necessary easements, and a plat showing the location of the proposed sanitary sewer and lift station be provided with the required legal papers, (b) that back lot lines of lots (approximately Lots 49-56) be extended so as to "obliterate" Parcel A, and (c) that Parcel B be dedicated to the City according to the recom- mendation of the Parks and Recreation Commission. The Planning and Zoning Commission at a regular meeting held on September 15, 1977, recommended by a 6-0 vote approval of the above subdivision subject to contingencies noted above. This recommendation with the exception of contingencies (b) and (c) are consistent with the Staff's recommendation presented in a Staff Report dated September 15, 1977, which is attached to this agenda. This subdivision has been referred to the Parks and Recreation Commis- sion which had recommended the latter two contingencies. Specifically, the City upon approval of the preliminary plat of this addition had indicated to the developer that the City would accept the dedication Agenda Regular Council Meeting Sept. 27, 1977 7:30 P.M. Page 3 0 0 of a 40' strip of land between this subdivision and the railroad tracks. The Parks and Recreation Commission did not feel it would be advantageous for the City to own and maintain this strip as 20 feet of the strip would be occupied by several utilities. This item will be placed on the agenda for final consideration at the next regular City Council meeting pending resolution of the first contingency and discussion of the second and third contingencies by the Citv Council. b. Consider recommendation of the Parks and Recreation Commission that the Parks and Recreation Commission and the Riverfront Commission reaffirm their previous stand and vote in favor of acquisition of the Showers property. Comment: This public hearing is being held to receive public input on three sites south of Iowa City which are being proposed for a sewage treatment plant. The Staff will make a short presentation for the public, if desired. Action: Item No. 8 CONSIDER ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF IOWA CITY, IOWA, BY ADDING AN EXEMPTION FOR CHARTER TRANSPORTATION FROM THE TAXICAB ORDINANCE REGULATIONS TO CHAPTER 5.16.1(h) OF THE MUNICIPAL CODE (second consideration). Comment: This would allow individuals or groups of individuals to obtain trans- portation (Charter Operations) for the group to various points within the City. Action:l�onJ ! a "—� A a �/ iw /� ee s/� %/O�%n �M 1,2,f .4 /u *..-t 3 $ 6 Item No Comment 9 Action: R -r Item No. CONSIDER RESOLUTION RELEASING THE MELROSE CORPORATION FROM CERTAIN TERMS OF A SUBDIVISION AGREEMENT UPON THE DEPOSIT OF ESCROW MONIES. On March 18, 1977, the City and the Melrose Corp, entered into a sub- division agreement concerning "The Westwinds" subdevelopment. The agreement is a standard one used for subdivision development and basically provides that the subdivider install certain Improvements with various remedies available to the City for enforcement (e.g., liens, assessment waivers, building permits, escrow accounts, etc.). This development involves condominiums and for the most part the Improvements called for have been installed. These Improvements are not complete although the subdivider has posted escrow monies pursuant to the agreement and has obtained building permits. The City Engineer has found that the amount deposited in escrow is sufficient to complete the remainder of the Improve- ments. The subdivider wishes a release of any possible liens the City may have as a result of this Agreement for the building located in Lot 1 which have now been completed and are ready for sale. This release would not limit any other rights the City has resulting from the agreement, including liens, against the remaining subdivisions. 10 CONSIDER RESOLUTION ACCEPTING WORK ON THE FY78 LANDFILL EXCAVATION PROJECT. Comment: This resolution accepts the work done by Barkers Inc. of Iowa City, Iowa, for this year's excavation program. The final contract amount was $75,024. The budgeted was $90,000. Page 5 Item No. 11 CONSIDER RESOLUTION APPROVING FINAL PLAT OF A RESUBDIVISION OF A PORTION OF LOT 2 OF STURGIS CORNER ADDITION SUBMITTED BY SOUTHGATE DEVELOPMENT COMPANY (5-7729). Comment: The Planning and Zoning Commission, at a regular meeting held on July 21, 1977, recommended by a 5-0 vote approval of the subject subdivision subject to the following waivers and contingencies: (a) reduction to right-of-way width of 45'; (b) reduction of pavement width to 25'; (c) installation of sidewalks along the street proper; (d) installation of a 4"x6' asphaltic concrete walkway along the river; and (e) signatures of the utility companies. This recommendation is consistent with the staff's recommendation presented in a Staff Report dated July 21, 1977, which was attached to the agenda of August 2, 1977. The signatures of the utility companies have been received. This item was deferred from the Council meeting of September 20 because the dedication of easements had not been submitted. Since the legal owner of the site lives in Des Moines, there has been a time delay in getting his signature. Reportedly the easements will be received prior to the Council meeting. As the staff expects no problems with these documents, this item is being placed on the agenda for final consideration. Action: Item No. 12 MOTION APPROVING SUBMISSION FOR STATE TRANSIT GRANT ASSISTANCE. Comment: This motion will finalize City Council direction on the items to be included for application on the State Transit Grant Assistance. y^- lq,R o Action: ,Item No. .13 RESOLUTION AMENDING PERSONNEL RULES AND REGULATIONS WITH REGARD TO IMPROPER POLITICAL ACTIVITY, AND AMENDING RESOLUTION NO. 76-238. Comment: The effect of this resolution is to require that any City employee who becomes a candidate for election to any public office shall be required to take a leave of absence from his/her duties commencing with announcement of the candicacy and continuing until the date of the primary or general election. The leave of absence shall continue until the person is eliminated as a candidate. The person is required to return to work immediately upon being eliminated as a candidate. If the person should be elected to the public office, or if the person should be appointed to a public office, he/she shall be required to resign immediately upon certification of the election or appointment.
