Consider recommendation of the Housing Commission that the City Council not approve the; Proposed Tenant landlord Ordinance for -tlie,reasons that-the'Ordinance is deficient in constitutional protection of landowners. Finally, from a policy standpoint that the Ordinance is not needed in this City for the reason that the enforcement of the Housing Maintenance and Occupancy Code presently before this Commission (Commission version) that we support the passage of that Ordinance and that we feel if it were properly enforced that the extraordinary remedies provided by the Tenant Landlord Ordinance would offer no benefit to the citizens of the City but could in fact cause a rapid and dramatic increase in cost of rental housing in the City of Iowa City. Page,4 Item No. B PUBLIC HEARING ON PROPOSED ORDINANCE ADOPTING MODEL CODE FOR ENERGY CONSERVATION IN NEW BUILDING CONSTRUCTION. Comment: The Resources Conservation Commission has recommended adoption of this modelcodefor Energy Conservation in New Building Construction of 100,000 cubic feet or larger. A copy of the proposed code was furnished in So the Council packet dated August 16, 1977. ` Action: 0�1r., , ` P i , r Item No. 9 CONSIDER ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF IOWA CITY, IOWA, BY ADDING AN EXEMPTION FOR CHARTER TRANSPORTATION FROM THE TAXICAB ORDINANCE REGULATIONS TO CHAPTER 5.16.1(h) OF THE MUNICIPAL CODE (passed �S E7 and adopted). Comment: This wouldl,allow individuals or groups of individuals to obtain trans -'I portation (Charter Operations)Ifor the group, to various points within the City. i Action: ro has Item No. 10 CONSIDER RESOLUTION APPROVING FINAL PLAT OF A RESUBDIVISION OF A PORTION OF LOT 2 OF STURGIS CORNER ADDITION SUBMITTED BY SOUTHGATE DEVELOPMENT COMPANY (S-7729). Comment:) The Planning and Zoning Commission, at regular meeting held on July 21, 1977, recommended by'ia 5-0 vote approval of thesubject subdivision subject to`,thejollowing,waivers and contingencies: a' (a), reduction of right-of-way width'of 45'; , eh,, (b) reduction of pavement, width to 25'; (c) ,installation of sidewalks along.the street3proper; Cern..(d) installation of a'4"x6' asphaltic concrete walkway along the river; and (ej signatures of the utility companies. This recommendation is consistent with the staff's recommendation presented in a Staff Report dated July 21; 1977, which was attached to the agenda of August 2, 1977. ;The signaturesofthe utility companies have been received. 'IThis item was deferred from the Council meeting of September 27 because the applicant was unable to obtain the signature of the county - recorder on the recorder's certificate prior to Council;consideration. Comment: The Planning and Zoning Commission at a regular meeting held on September 15, 1977, recommended by a 6-0 vote approval of the above subdivision subject to the following contingencies: (a) that a legal description, necessary easements,,', and a plat showing the location of the proposed sanitary sewer and lift station be provided with the, required legal papers, (b) that back lot lines of lots (approximately Lots 49-56) be extended so as to obliterate" Parcel A, and (c) that Parcel B be dedicated to, the City according to the recommendation of the Parks and Recreation Commission. This recommendation with the exception of contingencies (b) and (c) is consistent with the Staff's' recommendation presented in a 8taff.Report dated September 15, 1977, which was attached to .the Council agenda of September 27. This: subdivision had been referred to the Parks and Recreation Commission which had recommended the latter two contingencies. Specifically, the City upon _approval of the prelimiary plat:of'-this addition had indicated to the develo er`,that'the City,would acceptt the i dedication of a''40' strip of land between,this'subdivision and the railroad tracks.` The Parks' „and Recreation Commission did not feel it would be advantageous for the City; to own and maintain the strip as 20 feet of the strip would be occupied by several utilities'. This item was placed on the previous Council agenda for discussion.;and resolution of the latter two contingencies and completion and resolution of the 'first contingency. Because the Council had not reviewed:the above contingencies, you may wish to defer any consideration of this item until the next regular meeting. Comment: This is the same resolution which was presented to the City Council on September 13, 1977. The amount of rent in',paragraph 2 has been corrected (from $4,900 to $3;765) in accordance with the date bankruptcy petition 1 filed.I The City reserves the right to assert rent claim against any profit sharing due,Epstein's. Page 6 Item No. 14 RESOLUTION ADOPTING SEWAGE TREATMENT PLANT SITE IDENTIFIED AS THE "NORTH SITE" ON AN AERIAL PHOTO ENTITLED "PROPOSED TREATMENT PLANT SITES FOR — –L�— IOWA CITY', WASTE WATER TREATMENT PLANT DATED SEPTEMBER, 1977, AND GENERALLY DESCRIBED 'AS'A 53 -ACRE 'TRACT LYING DIRECTLY SOUTH OF THE SOUTH CITY LIMITS AND EAST OF SAND ROAD. Comment: This resolution allows the City's consultant to complete the Facility Plan for Iowa City. A'public hearing will be held on the Facility Plan when it is: completed. Action: rr _ Item No. 115 CONSIDER RESOLUTION AURHORIZING JOINT AGREEMENT BETWEEN THE, -IOWA CITY LIBRARY BOARD OF TRUSTEES AND THE COUNCIL OF THE CITY OF IOWA CITY TO i% COORDINATE NEGOTIATING PROCEDURES FOR PURPOSES OF COLLECTIVE BARGAINING. Comment:This resolution authorizes joint bargaining between the City and the Library Board. The Library Board has authorized the City Manager to represent them in collectivebargaining.
