Setting Public Hearings: (l) Consider setting a public hearing on November 15 on the rezoning of Mount Prospect Addition, Part IV. COMMENT: The Planning and Zoning Commission at a regular meeting held on September 16, 1976, recommended by a 7-0 vote approval of an application submitted by Frantz Construction Company to rezone an 18.6 acre undeveloped tract of land located south of Highway 6 Bypass and east of Sycamore Street from an R1A Zone to 6:2 acres of',R16 and 12.4 acres of R2'. On August 4, 1975; the 'applicant had petitioned to rezone a 31.5 acre undeveloped tract of land at the above location from an R1A Zone to 19.1 acres'of R18 and 12.4 acres of R2. The application was recom- mended .for approval by th e Comm ission_on,,September ll, 1975,. but was 'subsequently ;denied by the City Council. The appli cant later requested that 12.9 acres be rezoned to RIB which was granted by the City Council. The applicant has now requested he remaining,18.6 acres be rezoned as indicated. Comment: This public hearing was set by the City Council at the request of John Morrissey. Action: Y.%LCL^ Jwii }� Item No. 9 CONSIDER AN ORDINANCE TO AMEND ORDINANCE NO. 75-2783 AND NO. 77-2826, THE IOWA CITY MUNICIPAL ELECTION CAMPAIGN FINANCE ORDINANCE BY, REQUIRING DISCLOSURE OF CONTRIBUTIONS TO AND EXPENDITURES BY A POLITICAL COMMITTEE _ FOR THE PURPOSE OF SUPPORTING OR OPPOSING'A BALLOT ISSUE AND BY IMPOSING LIMITATIONS ON THE AMOUNT AN INDIVIDUAL OR COMMITTEE CONTRIBUTES TO'A POLITICAL COMMITTEE FOR THE PURPOSE OF SUPPORTING OR'OPPOSING !A BALLOT ISSUE (passed and adopted). Comment: This ordinance is to amend the Iowa City Municipal Election Campaign;` Finance Ordinance by 'extending the requirements for disclosure of contributions and expenditures to ballot 'issues and to imposelimitations on the amount an individual or committee may ,contribute to a;'political "committee for the purpose of supporting or opposing a ballot issue. Action: ' Item No. 10 CONSIDER RESOLUTION TO APPROVE A LARGE SCALE NON-RESIDENTIAL DEVELOPMENT PLAN OF LOT 3 OF AUDITOR'S` PLAT, NO. 32. (S77731) Comment: The Planning and Zoning Commission, at a regular meeting held on October 6, 1g77, recommended by a 4-O'vote approval of the subject LSNRD plan submitted; by Iowa City Warehousing,, Inc. and located east ofSIndustrial Park Road, subject to the following contingencies: (1) that a waiver of assessment for the future construction of a sanitary sewer to the!lot be submitted, and (2) that,a waiver in construction of sidewalks along .,, Park Road be waived. This recommendation is consistent with ,r.Industrial the Staff's recommendation "presented in a!Staff Report dated August 4, 1977, and a'revised Staff, Report, both.of,which were: attached' to the Council' ' agenda ofOctober,18, 1977:; The legal papers have been submitted and ran assessment waiver forthe future eviewed by the Legal Department and ` construction of a' sanitary sewer is also being worked out with the Legal Department (see attached letter). .1'D I Action: in Item No. 11 IICONSIDER A RESOLUTION TO 'APPROVE THE PRELIMINARY LARGE SCALE NON-RESIDENTIAL ' DEVELOPMENT PLAN AND PRELIMINARY PLAT SUBMITTED BY HY-VEE FOOD STORES, ' --- INC: (S-7720). Comment: The Planning and Zoning Commission at a regular meeting held on July 21, !:1977, recommended'by a 5-0 vote approval of the subject'LSNRD plan and .Agenda Regular Council Meeting October 25,'1977 7:30 P.M. Page 5 preliminaryplat. This recommendation is consistent with the Staff's recommendation presented in a Staff Report dated July 7, 1977, which was attached to the Council agenda of July 26, 1977, except that the. Staff had recommended against the request for an intersection with Highway 6 Bypass. Minor revisions are being made to the plan with respect to the design of an intersection to Highway 6 Bypass which the Council' had approved at a regular meeting on October 18, 1977. The applicant has indicated that the necessary changes will have been made by the time Council considers this item, at their formal meeting. Action' Item No. 12 CONSIDER RESOLUTION AWARDING CONTRACT FOR THE NEWSPAPER RECYCLING PROJECT. Comment: A public hearing on this project had been scheduled for October 25, 1977. �3 However,.at Ithe October 18 meeting the Council decided not to have the public hearing and instead authorized the Public; Works Department to advertise for bids. This resolution awardsthe bid for newspaper recycling to the City Carton Co., Inc. They have requested no subsidy from the City. A memo is attached. Action: s. Item No. 13 CONSIDER' RESOLUTION ADOPTING POLICY'ON DIRT AND GRAVEL STREETS. Comment: This policy resolution closely follows the general policy approved by Council for an approximate expenditure of $10,000 per year on tiling ' —- — of streets. The resolution lists the exact streets to be oiled. Comment: This resolution would accept sanitary sewers in Village Green, Part VI, as constructed by Knowling,Brothers ;Contracting Company of Coralville, Iowa.
