COMMENT: This resolution would accept storm sewer in Mt. Prospect Addition, Part III, as constructed by Sulzberger Excavating,Inc. of Muscatine, Iowa. It would also accept paving and 'inlets in Mt. Prospect Addition, Part III as constructed by Metro Pavers, Inc. of Iowa City, Iowa. d.'' Correspondence (1) Letter from Rhys VanDemark regarding Iowa City Animal Shelter. This letter has been referred to the City Manager for reply. END OF CONSENT CALENDAR Item No. 4 RECOMMENDATIONS TO THE CITY COUNCIL a. Consider recommendations of the Planning and Zoning Commission: (1) To approve S-7704 „final LSRD and PAD plans and platlof Ty'n - esidential'development 0.2 acre r Cae, Parts 1 and 2, a propose d4 located east of Mormon Trek Boulevard and north of the City limits,g contingencies: `with the followin (a) the LSRD plan should be amended to show 'the cross-section of the parking areas and driveways; (b) signatures of the utility companies and registered land surveyors should be provided; and (c) the legal papers should be reviewed by the Legal Staff. The above were approved by the City, Council at the meeting of November 22, 1977. The applicant, Earl Yoder, proposes to develop a 160 unit apartment complex on a 6.91 acre tract over a 5 year period. Comment: This: public hearing is being held to obtain further public input for the fiscal year 1979 budget for Housing and Community Development Act funds. (�SG Action: la. . '.'ji: ��oeN�i�r..✓�7'. �,l/��nwn.., Item No., 9 CONSIDER AN ORDINANCE AMENDING THE MUNICIPAL CODE OF IOWA CITY BY ADOPTING THE 1976 EDITION OF THE UNIFORM PLUMBING CODE WITH CERTAIN AMENDMENTS, REPEALING ORD. #2710, AND PROVIDING FOR ITS ENFORCEMENT (first consideration). - Comment: This Ordinance adopts the 1976 Uniform Plumbing Code. The amendments are the same as in the 1973 edition with the exception of Section 409(a) which allows administrative authority on backwater valves on basements below curb line, Section '608 which will allow loop vents for discharge lines on dishwashers, and the new uniform appeal: procedure in Section 5.D. These amendments have been approvedand recommended to Council for adoption by the Plumbing Board of Appeals. A, copy of this Ordinance was furnished with the v agenda of November 15, 1977. Action: 69ri V.e.d ^ / %e,� I/P � 1-4 1 Item No 10 CONSIDER AN ORDINANCE AMENDING SECTION 6.04.35.0 OF ORDINANCE N0. 77-2835 TO PROHIBIT' THE TRACKING OF MUD,' GRAVEL OR OTHER' MATERIALS ONTO PUBLIC' STREETS BY VEHICLES'(first consideration). Comment: The purpose of this!,ordinance is to prevent vehicles from tracking mud, gravel or other materials onto public streets. This ordinance will enable the Police to',ticket`vehicles tracking mud, gravel or other materials. See attached memorandum from Director of Public Works. Z� Action:Oxy (✓A r.>o.-:._._�. .. T.'r'.. - .cw)' OrC,U i. �tI•,�til1, d,1 Item No., 11 CONSIDER AN ORDINANCE CHANGING THE NAW OF WASHINGTON STREET TO JOYFIELD LANE FOR THAT PORTION OF WASHINGTON',STREET RUNNING WEST FROM WILSON STREET 8 7 rim_ (first consideration). Comment: One residence abuts this particular stretch of street and ambulances quite frequently' make calls; to the residence due to severe health problems. Due to the discontinuity of this portion of Washington Street it is difficultfor various emergency services to find this residence. Public Works recommends adoption of this ordinance. Page 6' Item No. 12 CONSIDER AN ORDINANCE AMENDING ZONING ORD. #2238 BY CHANGING THE USE REGULATIONS OF CERTAIN PROPERTY FROM COUNTY CH TO CITY CH ZONE (as 7 requested by Barker Dev. Co.) (passed and adopted). Comment: Barker and Barker Development Company had submitted a request to rezone a 2.7-acre tract of land located west of Highway 1 and Dane's Dairy and contiguous to the south City limits to a CH Zone. The Planning and Zoning Commission at a regular meeting held on August 4, 1977, recommended by a 3-2 vote', of an application to rezone this parcel to a CH Zone. This recommendation was not consistent with the Staff's recommendation presented in a Staff Report dated August 4, 1977, and was furnished with the agenda of August 16, 1977.: Essentially, the Staff had recommended that, the site be rezoned to a more restrictive commercial zone for philosophical reasons stated in the report including: (1) the negative impact a more intensive commercial use might have on abutting land zoned residential, and (2) a concern in the dispersement of such uses permitted in the CH Zone throughout the City than in condensed areas within; appropriate locations in the community. Action: /�i/ ib 9,e_ 42 Item No 13 CONSIDER A RESOLUTION TO APPROVE THE PRELIMINARY PLAT OF BARKER'S FIRST 7/ ADDITION. S-7730. Comment: The Planning and Zoning Commission at a regular meeting held on August 18, 1977, recommended by a 6-0 vote approval of; the subject subdivision located west of Highway l and west of Dane's Dairy and contiguous to the 'south City Limits, with;the following contingencies';to be resolved before final plat approval: (1) that the provisions of the Storm Water Management Ordinance be met; and d b , i (2) that the eveloper will su mit an agreement m t not tobuild on the 50x100 foot triangle in the southeast corner of Lot 4, that this triangle will not be used to compute the Storm WaterDetention area for'Lot 4, and that the applicant will not build on Lot 4 for a'period of ,three 'years. This is essentially the same recommendation that was presented in a Staff Report dated August 4, 1977,, and was furnished with the agenda of, August 16, 1977. Staff is concerned' about the reservation of. the "triangle" for °a future frontage road but, also felt it was the subdivider's obligation as part of the subdivision to construct said road. The subdivider, Barker and Barker Development Company, has now revised the plat to reserve the triangle both for a frontage road and a''Storm Water Detention site which is agreeable to the staff. Unless the Council deems it appropriate for the subdivider to provide for paving of the frontage road, the plat is now ready for approval. Page 7 Item No. 14 CONSIDER`A'RESOLUTION TO APPROVE THE, PRELIMINARY PLAT OF BRYN MAWR HEIGHTS, PARi' II.- S-7745 Comment: The Planning and Zoning Commission at a regular meeting held on October 20, 1977, recommended by a 3-2 vote approval of the subject subdivision subject to the following contingencies: (1) that curve data be provided, (2) that the lots be fully dimensioned; (3) that the 6" intergral curve be indicated in the cross section drawing, (4) that all easments be labeled, (5) that the legal'; description be corrected, and (6) that a north -south walkway be provided from Ealing to Wrexham Drive located approximately mid -way east -west in the proposed development. This recommendation was not consistent with the staff's recommendation presented in a Staff Report dated October 20, 1977, which was attached to the Council agenda of November 1, 1977, because the subdivision included two long ;continuous 'streets over 1000 feet in length which is highly undesirable i n residential development regard to safety considerations . p in 9 and sense of -neighborhood unity. The two negative votes by the Planning and Zoning Commissionwere for this reason. The applicant's engineer had submitted,a revised subdivision with`a different street layout which met with the staff's approval. The applicant, however, is opposed to the: revised layout and proposed some slight modifications to the original lay- out to present to the;Council for consideration. Even with the modifications: however,';there may be some question as to whether the plat would have to be referred back to;the Planning and Zoning Commission for their consideration in ,light of the City Attorney's opinion' regarding a sub- stantialchange to a plat. ',This item has been placed on the Council` agenda for further review and discussion at the applicant's request for resolution of the constraints indicated. / Get �.n u' lwb du-L•+-`I"c nJi�._l' AC tion: UJB' 9 4f . r Item No. 15, CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AMENDMENT TO THE BRIDGE DESIGN CONTRACT DATED JUNE 14, 1977,` / Comment: The initial desig1n contract with the consultant did not list design fees since the scope; of the work was so totally unknown. This amendment provides design fees for the Court and Muscatine Street bridge, the Governor Street bridge, and ,the Iowa Avenue bridge. As per, Council direction a', public hearing will be held on the Court and Muscatine bridge early,' in January and the consultant will not be authorized to start work until Council gives direction. This point is clearly stated in the, next, to the last, paragraph of the contract amendment.
