ORDINANCE NO. 78-2875 AN OF HINCE AMENDING SECTION 6.04.35, i ORDI- NANCE W. 77-2835 TO PROHIBIT THE TRACKING OF MUD, GRAVEL OR OTHER MATERIALS ONTO PUBLIC STREETS BY VEHICLES. SECTION 1. PURPOSE. The purpose of this ordinance is to prevent vehicles from tracking mud, gravel or other materials onto public streets. SECTION 2. AMENDMENT. Section 6.04.35.0 is hereby amended to read as follows: C. No vehicle shall be driven or moved on any highway unless such vehicle is so constructed or loaded as to prevent any of its load from dropping, sifting, leaking, or otherwise escap- ing therefrom, except that sand or other materials may be dropped for the purpose of securing trac- tion, and water or other substance may be sprin- kled on a roadway in cleaning or maintaining such roadway. It shall be unlawful for vehicles to deposit from their wheels or track quantities of mud, gravel or other materials onto paved public streets. SECTION 3. SEVERABILITY If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjud- ged invalid or unconstitutional. SECTION 4. EFFECTIVE DATE. This Ordinance shall be in effect after its final passage, approval and pub- lication as required by law. Passed and adopted this 3rd day of January,, 1978. KU0tK1 A. RE: Mud on the Streets Every spring and fall when the construction season and the rainy season coincide, the City receives numerous complaints about mud being tracked on streets by construction vehicles. Some of this mud being tracked onto streets is unavoidable and generally in a brand new subdivision with only a few houses the City asks that the mud be cleaned up once a week on Friday. In built up areas it is desirable for the mud to be cleaned at the end of each work day. Under the present City ordinances the only remedy is to file a complaint and have the matter taken to court. This is an unworkable solution since several weeks can pass until the matter reaches court. The ordinance being considered by Council will give the Police Dept. the discretion to issue tickets inmediately to the offending truck driver when conditions get completely out of hand. Between the truck driver, the building contractor, and the land owner, it is anticipated the situation will be worked out so that a clean street is obtained. At the present time the City is dispatching a street sweeper to the scene and is cleaning the area. Theoretically, the cost of sweeping should be recoverable from someone though once again the money is impossible to collect. The Police Dept. will have to use discretion in this matter since some mud tracked on streets is unavoidable.
