L ` 62- COMMENT: This resolution would accept the improvements to Muscatine Avenue (FAUS M4052(829)--81-52) as constructed by Metro Pavers. Public Works recommends adoption of this resolution. 79—/3 (2) Consider Resolution Accepting Sanitary Sewer Improvements at 9 —/3 American College Testing Program, Inc. COMMENT: This resolution would accept the sanitary sewer improvements at American College Testing Program Inc., LSNRD as constructed by Gordon Russell, Inc. of Iowa City, Iowa. Public Works recommends adoption of this resolution. r/ D _ 4/ (3) Consider Resolution Approving Plans and Specifications for FY78 Alley Paving Project 1-A and Authorizing the City Clerk to Advertise for Bids Due February 1, 1978. COMMENT: This resolution would allow for formal contract Procedures to complete the paving project behind Iowa State Bank Drive-in facilities. A public hearing on this item was held January 10, 1978. Setting Public Hearings: (1) Consider setting a public hearing on February 7 to revise the Moratorium Ordinance for Northcentral Iowa City. The Planning and Zoning Commission at a regular meeting held on January 5, 1978, unanimously recommended that the subject ordinancebe revised to limit construction to the following: (a) the construction and expansion of single family dwellings, (b) the conversion of single family homes to duplexes, and of commercial uses to other permitted commercial uses, and (c) the remodeling and repairing of any building so long as the use does not change except as otherwise provided in (b) above. A proposed ordinance amending the moratorium is attached to this agenda. f. Correspondence: (1) Letter from City Attorney regarding Windsor Heights, Part Five. (2) Letter from M.N. Braverman, President, Iowa City Cable Television, Inc. This letter has been referred to the City Manager for reply. (3) Letter from Dr. Arthur E. Schmidt regarding a parking problem. This letter has been referred to the City Manager for reply. (4) Letter from Iowa State Historical Department regarding the placement of south Summit Street District on the National Register of Historic Places. This letter has been referred to the City Manager for reply. (5) Memorandum from Johnson County Regional Planning Commission regarding report of the Transportation Committee concerning Iowa City central business district transit interchange. Item No. 4 PLANNING AND ZONING MATTERS i a. CONSIDER A RECOMMENDATION FROM THE PLANNING AND ZONING COMMISSION THAT THE CITY COUNCIL APPROVE COUNTY DOWNS SUBDIVISIONS -7756). Comment: The Planning and Zoning Commission, at a regular meeting held on January 5, 1978, unanimously recommended that the City Council recommend to the City of Coralville approval of the final plat of the above subdivision located within Coralville's extra-territorialjurisdiction and within the City's annexation area, subject to: IIICBOM.M 0 BY JURM MICR+LAB CLOAR RAPIDS • BES IdOINES Agenda Regular Council Meeting January 17, 1978 7:30 P.M. Page 3 (1) the length of the cul-de-sac being waived contingent upon the lots within the subdivision not being further subdivided, (2) dedication documents provided to the City of Iowa City include the signatures of all the parties involved, and (3) the signatures of the registered and land surveyor and those of the utility companies be provided. This recommendation is consistent with the Staff's recommendation presented in�a�Staff Report dated January 5, 1978, which is attached to this agenda. Action: i LL b. CONSIDER RESOLUTION APPROVING THE FINAL PLAT FOR WINDSOR HEIGHTS, PART V (S-7751). Comment: The Planning and Zoning Commission, at a regular meeting held on December 15,, 1977, recommended by a 5-0 vote approval of the subject subdivision located east of Hickory Hill Park and north of Rochester Avenue, subject to (1) that the legal papers be revised and reviewed by the legal staff, and (2) that the utility companies signatures be added to the plat. There were two final plats which had been submitted, one which showed the extension of Seventh Avenue north to the north boundary line common with the Regina Property and the other which showed the termination of Seventh Avenue within the subdivision. The Planning and Zoning Commission recommended that the plat showing the extension of Seventh Avenue north to the boundary line be approved, but also indicated that the termination of Seventh Avenue would be satisfactory if the City acquires the Regina Property. Their recommendation is consistent with the Staff's recom- mendation presented in a Staff Report dated December 1, 1977, which was attached to the agenda of January 3, 1978. The subdivider, Pat Harding Construction Company, has now revised the plat to delete the northerly portion of the subdivision that would otherwise have required the Council to make a decision with respect to the alignment of Seventh Avenue. The revised plat will be presented to the City Council at the informal meeting for review. This item was deferred from the Council meeting of January 10, 1978. Action: a C. CONSIDER RESOLUTION APPROVING PRELIMINARY PLAT OF E.L. KESSLER SUBDIVISION, PART II (S-7753). Comment: The Planning and Zoning Commission, at a regular meeting held on December 15; 1977, recommended by a 5-0 vote approval of the subject preliminary plat located 1-1/3 miles west of Mormon Trek Boulevard off Rohret Road and south 600 feet of the City limits, with the contingency that storm water management be included with the final plat. This recommendation was consistent with the Staff's recommendation presented in a Staff Report dated December 15, 1977, which was attached to the agenda of January 3, 1978. Page 4 be waived for that portion of the plat located within Old Man Creek watershed (see attached memorandum from the City Engineer). This item is being placed on the agenda for Council review with respect to the stormwater management provisions. The Council may wish to take formal action on this item on Tuesday night's meeting if the plat is revised to be consistent with the Council's consideration of this subdivision. This item was deferred from the January 10 Council meeting. Action: 7 ff - G d• CONSIDER RESOLUTION APPROVING FINAL PLAT OF C.L. SUBDIVISION (5-7754). Comment: The Planning and Zoning Commission at a regular meeting held on December 15, 1977, recommended 5-0 i a vote approval of the above subdivision located 2 miles southwest of the City limits on Rohret Road, subject to the following contingencies: I (1) that the Stormwater Management Ordinance be enforced, (2) dedication documents be provided, and (3) utility companies signatures be added. This recommendation was consistent with the Staff's recommendation presented in a Staff Report dated December 15, 1977, which was attached to the agenda of January 3, 1978. The Planning and Zoning Commission, however, I at a subsequent meeting recommended to the City Council that the stormwater management be waived for this subdivision because it is located in Old Man Creek Watershed. The City Engineer has also recommended that storm - water management be waived. This Plat is being placed on the agenda with the expectation that the utility companies signatures will be provided on the plat prior to the formal Council meeting. This item was deferred from the January 10 Council meeting. Page 5 Item No. 6 RECOMMENDATIONS TO THE CITY COUNCIL a. Consider recommendations of the Riverfront Commission: (1) that the City Council approve the Neon ice Project (NIP); subject to written approval between the University of Iowa and the City Council, concerning the liability. (2) that the Riverfront Commission recommend the construction of the Rocky Shore Bikeway as being consistent with the Iowa River Corridor Plan. Comment: This resolution eliminates the Accountant position at range 11 and creates a position of Word Processing Supervisor in Group I of the Administrative Pay Plan.
