CONSIDER RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION TO APPROVE THE PRELIMINARY AND FINAL LARGE SCALE NON-RESIDENTIAL DEVELOPMENT PLAN OF PLAYMORE LANES ADDITION (S-7758). SAr,�4 h.epdti,J . COMMENT: The Planning and Zoning Commission at a regular meeting held on January 19, 1978, recommended by a 4-2 vote approval of the subject plan contingent upon: 1) That asigned statement of intent from the applicant be provided, and 2) that the signatures of the utility companies be provided. This recommendation is consistent with the staff's recommendation presented in a staff report dated January 19, 1978, which is attached to this agenda. The Council should be informed that because of a "loop -hole" in the Tree Regulations (see memorandum from the City Attorney attached to the staff report), this development does not have to comply with the Tree Regulations Some members of the Planning and Zoning Commission felt that in lieu of PI Cm01 I i.MED BY JORM MICRO LAS UDAR IWIDS • DES MOINES Agenda Regular Council Meeting January 31, 1978 7:30 P.M. Costs incurred by the City $175.65. were Z�L (2) Consider setting a public hearing on February 14, 1978, to adopt the 1978 edition of the National Electrical Code with certain additions and amendments thereto. COMMENT: The Iowa City Electrical Board at a special meeting held on January 23, 1978, unanimously recommended that this completely revised ordinance be considered. (3) Consider setting a public hearing on February 14, 1978, on an 1 ordinance amending Ordinance No. 77-2874, which adopted the Uniform Plumbing Code, with certain amendments, of the Municipal Code of Iowa City. COMMENT: A typographical error in Section IX of Ordinance No. 77-2874 reduced the apprenticeship of a Journeyman Plumber from four years to one year. This amendment merely corrects this error to make the ordinance conform with the current practice. e. This provision has only been applied where commercial uses are adjacent to residential uses. However, the legal staff is being consulted for an opinion as to whether any LSNR Development should comply with this section. Consistent with the City Council's policy, this item will be deferred until the next regular meeting. b. CONSIDER SETTING A PUBLIC HEARING FEBRUARY 21, 1978, TO ESTABLISH REGULATIONS FOR COUNTY SUBDIVISIONS. The Planning and Zoning Commission at a regular meeting held on January 19, 1978, recommended by a 6-0 vote approval of a proposed ordinance to establish regulations for subdivisions within the City's extraterritorial Jurisdiction. Sia(,t The Planning and Zoning Commission at a regular meeting held on January 19, 1978, recommended by a 6-0 vote approval of the subject subdivision located west of Sunset Street extended and south of Denbigh Drive as presented. The subdivision has been revised to eliminate two long continuous streets over 1000 feet in length which the staff was opposed to as addressed in a staff report dated October 20, 1977, attached to the Council Agenda of November 1, 1977. Since this subdivision has been delayed for a considerable length of time, has been revised to meet with staff approval, and meets with all the requirements of the subdivision ordinance for a preliminary plat, this item is being placed, on the agenda for consi/deration at the next regular meeting. j�r L d. Page 4 several county regulations, the Council deferred action on this item until those discrepancies were resolved. Specifically, County regulations require that: 1. Lots which will be privately sewered must be not less than 40,000 square feet. Some lots within this subdivision are less than the minimum requirement. 2. Lots within flood plains must not be less than one acre and that there be a minimum of 40,000 square feet within each lot above the flood plain level. Several lots along the Willow Creek flood Plain do not meet these provisions. The plat has been approved by the County Board of Adjustment. The County Board of Adjustment has now approved variances to the discrepancies in the county regulations. All deficiencies and discrepancies have been corrected and the plat is now ready for Council approval. ACTION:411. J e• CONSIDER RESOLUTION TO APPROVE THE PRELIMINARY PLAT OF OAKS MEADOW r ADDITION (S-7744). :a COMMENT: The Planning and Zoning Commission at a regular meeting held on October 21 1977, recommended by a 5-0 vote approval of the subject subdivision' f located north of Muscatine Avenue and west of Southlawn Drive. This j recommendation was not entirely consistent with the staff's recommendation presented in a Staff Report dated October 6, 1977, which was attached to the agenda of November 1, 1977. THe staff has recommended that j+I l l` continunity be provided from Muscatine Avenue to Meadow Street at Friendship Street (see memorandum fromwas the Traffic Engineer which angle ttu of t urnsdproposedto the awithinothehsubdilvision, �Specificallye astwo MeadowrStreet I and Brookside Drive are the only streets which cross Ralston Creek between First Avenue and proposed Scott Boulevard on the east, the staff is of the opinion that a more direct access to the neighborhood should be provided via a reversed curve. This it was deferred from the agenda of January 24, 1978, to allow (1) the applicant's attorney to respond to the legal staff's opinion, and (2) to enable the applicant the opportunity to meet with the contiguous land owner to the south to reach an agreement on the extension of Carver Street. This item is being placed on the agenda for discussion at the informal meeting. And, unless there is a resolution to the access i problem the Council is not expected to take any action on this item at the formal meeting.
