RESOLUTION APPROVING CLASS "B"
BEER PERMIT APPLICATION
BE IT RESOLVED BY THE CITY COUNCIL OF IOWA CITY, IOWA,
that a Class "B" Beer Permit Application is hereby approved
for the following named person or persons at the following
described location:
Taco Grande of Southeast Iowa, Inc. dba/Taco Grande, 331 East
Market St.
Said approval shall be subject to any conditions or re-
strictions hereafter imposed by ordinance or State law.
The City Clerk shall cause a recommendation for
approval to be endorsed upon the application and forward

RESOLUTION SETTING PUBLIC HEARING ON BUDGET ESTIMATE
FOR THE FISCAL YEAR JULY 1, 1978 THROUGH JIINE 30,1979
BE IT RESOLVED by the City Council of Iowa City, Iowa
that a Public Hearing be held in the Civic Center at
7:30 p.m. February 28, 1978, to permit any taxpayer to
be heard for or against the proposed FY79 Budget for the
year ending June 30, 1979.
The City Clerk is hereby directed to give notice of
public hearing and the time and place thereof by
publication in the Iowa City Press -Citizen, a newspaper
of general circulation in Iowa City, at least four (4)
days before the time set for such hearing.

WHEREAS, the Iowa City Housing Commission has undertaken a study to determine
the need for housing for low income families and has determined that such a need does
exist and has recommended that the City Council make application for funds for such
a program, and
WHERE,kS, the Iowa City Housing Authority has received an invitation fron the
Department of Housing and Urban Development to submit an application to administer
a Section 8 Existing Housing Program, and
WHEREAS, Iowa City presently as a contract under the Section 8 Existing Housing
Program, Contract No. KC 9033-E, with the Deparbnent of Housing and Urban Development,
and wishes to expand this program.
NOW THEREFORE BE IT RESOLVED By THE CITY COUNCIL Or IOWA CITY, ICMA.
1. That the Mayor and City Clerk are hereby authorized and directed to make
application to the Department of housing and Urban Development for a fifty-one
(51) units of low income family housing under the Section 8 dousing Assistance
Payments Plan.
2. That said application shall be a request for funds under the Section 8
Housing Assistance Payments Plan for existing units.
3. That the City Clerk is hereby authorized and directed to certify appropriate
copies of this resolution together with any necessary certifications as may be
required by the Department of Housing and Urban Development.

AGREEMENT
'n Cae, Inc. is the Developer
of the Ty'n Cae Addition Part I, __ sekdixisian, an Addition to
the City of Iowa City, Iowa, according to the recorded Plat thereof, and
WHEREAS, the City Council and the Planning & Zoning Commission of Iowa City,
Iowa, have required, as a condition of the approval of said subdivision, that the
Developer shall improve Aber Avenue _
by paving said street
36 feet wide, back-to-back of the curb, respectively, and
WHEREAS, the City of Iowa City has agreed to reimburse the Developer for the
cost of said improvement which is in excess of 28 feet in width and said cost has
been determined to be less than Ten Thousand Dollars ($10,000), and that no bids
are required, pursuant to Chapter 384 of the Code of Iowa, and the City of Iowa
City has determined that the cost of $9.85 per sq. yd., but not to exceed four
thousand four hundred seventeen
and 73/100 dollars ($ 4,417.73 ) is a fair and
reasonable price for the cost of the additional pavement required.
IT IS THEREFORE AGREED, by and between the parties as follows:
1. That the Developer shall contract for the paving of said street and shall
be responsible for seeing that it is paved, pursuant to the Ordinances, rules,
regulations and specifications of the City of Iowa City, Iowa.
2. That upon completion of the paving improvement and the acceptance of the
work and the street by the City of Iowa City, that the City of Iowa City shall pay
to the Developer, the sum of S9.85 per sq vd but not to exceed four thousand four
hundred seventeen and
73/100 dollars as full payment for its share of the improvement in excess of the
width of 28 feet.
3. It is understood and agreed by and between the parties that nothing
herein contained, nor shall the entering into of this agreement by the City of
Iowa City be deemed to constitute in any way a waiver of any of the Ordinances,
rules, regulations or specifications of the City of Iowa City, and the Developer
hereby agrees to comply with all Ordinances, rules, regulations and specifications
of the City of Iowa City, and all of the laws of the State of Iowa.

RESOLUTION AUTHORIZING THE MAYOR TO SIGN A LETTER OF AGREEMENT
WITH CARL WALKER AND ASSOCIATES FOR SCHEMATIC DESIGN SERVICES
FOR THE PARKING GARAGE ON BLOCK 64
WHEREAS, the City of Iowa City, Iowa, has negotiated a Letter of
Agreement with Carl Walker and Associates, a copy of said Letter of
Agreement being attached to this Resolution and by this reference made
a part hereof, and,
WHEREAS, the City Council deems it in the public interest to
enter into said Letter of Agreement for schematic design services for
the parking garage on Block 64.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL:
1. That the Mayor and City Clerk are hereby authorized and directed
to execute the Letter of Agreement with Carl Walker and Associates.
2. That the City Clerk shall furnish copies of said Letter of
Agreement to any citizen requesting same.
It was moved by Neuhauser and seconded by Balmer the

Dear Mr. Arons:
We have exchanged two letters regarding the above project. This letter
will consolidate all correspondence related to this matter.
We would like you to begin the schematic planning phase for the parking
structure on Block 64.
The Scope of Services for this phase of the study will be integrated into
an overall contract at a later date. The Scope at this time should read
as follows:
"In this phase of the study, the Consultant will meet with
representatives of the Dey Corporation, representatives of
the prime tenant, and representatives of the City to
coordinate the design of the City's parking garage with
the motel development.
The Consultant shall prepare schematic layouts and designs
and a preliminary cost estimate as part of this phase. The
cost estimate shall include a construction contingency cost
estimate. Such design will take into account all previous
City Council policy decisions, traffic studies, parking
characteristics, the type and use of the facility, elevator
location, pedestrian movements, location of traffic generators,
method of operation, architectural and structural requirements,
and site configurations as well as other factors influencing
the operation of this parking facility.
The Consultant will study the design of the interface with
the motel.

All preliminary designs and studies in this phase shall be
closely coordinated with the City and shall be submitted to
the City for review and approval. The Consultant will
provide ten copies of a written report of his findings and
recommendations."
We agree to reimburse Carl Walker and Associates, Inc., at an hourly rate
of 2.75 x Direct Personal Expense plus reimbursable expenses with a not
to exceed lump sum of $15,000 which includes four trips to Iowa City. This
lump sum maximum fee parallels the existing agreement vie have on the 900
car parking facility.
It is understood that this letter of agreement may be terminated by either
side upon written notification with payment to be made for all services
satisfactorily completed to date of termination.

WHEREAS, City Property Corp. owns the property at 1309 E. Court St.,
Iowa City, which is more particularly described in the appraisal done by
the Mears Agency, Inc. dated February 14, 1978, as attached to this
Resolution as Exhibit A and by this reference made a part hereof, and
WHEREAS, the City desires to acquire this site for a public purpose,
to improve the intersection of Court Street and Muscatine Ave.
NOW, THEREFORE, be it resolved by the City Council of the City of
Iowa City, Iowa:
1. That the acquisition of said real property is in the public interest.
2. That the City Manager is hereby authorized to enter into negotiations
with City Property Corp. for the purchase of the property at 1309 E.
Court St., Iowa City and is authorized to make a formal offer of
$18,550.
