This recommendation is consistent with the staff's recommendation presented in a staff report dated February 23, 1978, which is attached to this agenda., This item will be presented to the City Council for consideration at the next regular meeting if the above contingencies have been resolved. 3 b. Acknowledge the recommendation of the Planning and Zoning Commission to deny the preliminary plat of Prarie View Estates (5-7802). COMMENT: The Planning and Zoning Commission at a regular meeting held on February 23, 1978, recommended by a 4-0 vote denial of the subject subdivision located north of Interstate 80 and 'east of Prarie du Chien Road. This recommendation is consistent with k the staff s recommendation Presented in a staff reportort dated � February, 23,11978; which.is attached to this agenda. However, the Commission's reasons for denial were different from, the staff's reasons for denied because; the applicant did not want to comply i, with the adopted rural subdivision standards. The staff had recommended that the plat be denied because the subdivision had only one means of access to a dangerous curve on Prarie du Chien Road (see attached staff report). According to Council„ policy, this item will not be presented to the City Council for consideration unless the applicant should so request the Council to overrule the decision by the Planning and Zoning Commission. To date, no such <rgalJ request has been filed. Page 5 Item No 11 CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN A DESIGN AGREE- MENT WITH NNW, INC. Comment: This provides design services to prepare a layout design and contract documents for the service building addition. This is authorized in the FY '79 budget for $205,000. Public Works is going to try to have this under construction by June, 1978. There will be no payment to the consultant until after July l in the new fiscal year and the first payment to the contractor will not occur until after July 1. It will be noted that the preliminary phase calls for a payment not to exceed $1,200. Design and construction phase fees will be negotiated andsubmittedto Council at a later date due to the unusual nature of this job. Comment: This resolution establishes the building permit fees for the Uniform Building Code and exempts other governmental agencies from the i requirement to pay building permit fees. However, the agencies q ,would be required to pay the plan check fee and all other costs lincurred in the issuance of the permit. The fees are not changed In amount by this action. Comment: This ordinance amends Ordinance No. 77-2874 which adopted the 1976 Edition of the Uniform Plumbing Code with certain amendments by deleting the :schedule of fees for Master Plumber and Journeyman Plumber licenses and their renewal, and the schedule of fees for pp��llulImbi^�n//g work. Comment: This resolution establishes the schedule of fees for permit under theUniformPlumbing Code. In addition it exempts, governmental agencies, from the payment of; plumbing permit fees. However, the agencies will be required to pay the actual cost incurred by the City of Iowa City. The fees 'are ,not changed in amount by this action. Action: 11oM1, I)V?f "P_ a- s � j Item No. 16 CONSIDER AN ORDINANCE AMENDING THE MUNICIPAL CODE OF IOWA CITY, IOWA, BY ADOPTING THE 1978 EDITION OF THE NATIONAL ELECTRICAL CODE WITH 7 - �7/ 0q CERTAIN ADDITIONS AND AMENDMENTS THERETO; REPEALING CHAPTER 9.20 / OF THE MUNICIPAL CODE OF IOWA CITY, IOWA, AND ENACTING A NEW CHAPTER IN LIEU THEREOF (passed and adopted). Comment: The Electrical Board modified the existing,Electrical Code to adopt the 1978 NEC and edit the City regulations to simplify language and remove conflicting or obsolete requirements: Council suggested that the fee schedules•contained:in the draft code be eliminated and considered:as a separate', resolution. The code has been revised to delete the fee for licenses and permits. The proposed ordinance was attached to the agenda of February 14, 1978. Comment: This ordinance removes the former prohibition against hand-held candles in religious and ritualistic services and in other places of public assemblage. Comment: In earlier years the City cooperated with BDI in the financing of s development by special.assessments. However, since 1970 the Sub- division Code has precluded this practice.,,This'ordinance will amend the Subdivision Code to permit the; special assessment process to be utilized by "any not-for-profit corporation or association which sub divides a tract of land for the purpose of encouraging economic development."
