This recommendation is consistent, with the staff's recommendation',presented in a staff report dated February 23, 1978, which was attached to the agenda of March 7, 1978. The above deficiencies and discrepancies have now been resolved except that a'minor revision needs to be made in the legal papers. CONSIDER A RESOLUTION TO APPROVE A REVISED FINAL LARGE SCALE RESIDENTIAL DEVELOPMENT PLAN OF LOT 2 OF THE "WESTWINDS" (5-7811). COMMENT: Melrose Development Co., the developers of the Westwinds Addition, proposed to make a slight change in the location of two buildings on Lot 2 o the subject addition located south of Melrose Avenue and east of West High School. Since the LSRD ordinance does not provide for making minor alterations to an approved LSRD plan, the plan approved must be revised and again submitted to the Planning and Zoning Commission and the City Council for approval.The applicant has requested that; the Planning and Zoning Commission take action on this item on March 9, 1978, and by the City Council on March 14, 1978, (see attached letter). The Planning and Zoning Commission expects to take action on this item on March 9, and to expedite approval of the revised plan, this item is being placed on the agenda for Council consideration at' the meeting of ,March 14. ACTION:: l r, . J I?, C. PUBLIC HEARING TO ESTABLISH PROVISIONS FOR ELDERLY HOUSING IN THE CB ZONE. COMMENT: The Planning and Zoning Commission at a regular meeting held on February 9, 1978, recommended by a 6-0 vote approval of a'proposed ordinance to amend the zoning ordinance by establishing special provisions in the CB zone. This ordinance would particularly benefit the City's elderly housing facility on the - old Post Office site. COMMENT: Principal maturities for outstanding special assessment bond issues are payable on June l annually. This year $24,000 of street improvement bond issues will mature on 6/1/78; this will leave an outstanding special assessment bond indebtedness of $13,000 which matures on 6/1/79: Because there is a sufficient special assessment fund balance to call and mature all outstanding bonds on 6/1/78 and because we will save $650 in interest costs by calling the 6/1/79 bonds a year early, the Finance// Director recommends approval of this resolution': ACTION: Item No. 9 CONSIDER RESOLUTION AUTHORIZING EXECUTION OF A CONTRACT BETWEEN JOHN R. COMMENT: The proposed contract with John Suchomel is identical to the previous contract, except that the new contract, has no specific termination date. This area was taken by the widening of Highway 218 in 1974, andisno longer, used by the Army Reserve. COMMENT: This resolution establishes the electrical permit fees, examination fees,' and electrician's license fees for the Iowa City Electrical Code. The staff is suggesting an increase of $15 for master electrician and $5 for all other electrician licenses. PLACES IN IOWA CITY; REQUIRINGENFORCEMENT BY PERSONS HAVING CONTROL OF THE PREMISES, AND PRESCRIBING PENALTIES FOR VIOLATIONS OF ITS, PROVISIONS (first consideration). COMMENT: The Ordinance will restrict smoking to designated area in municipal buildings,` restaurants,' retail stores and other commercial establishments !' and meeting rooms. Not, more than 50% of a public place will be designated as a smoking area. This ordinance will not regulate smoking in offices, private social functions or public meetings of other governmental bodies. COMMENT: In earlier years the City cooperated with BDI in the financing of development by special assessments. However, since 1970 the Subdivision Code has precluded this practice.
