CONSIDER RESOLUTION AUTHORIZING SALE OF A PART OF PERSON AVENUE, OWNERS. TO THE CITY OF IOWA CITY, TO THE ABUTTING _ BLACKS PARK ADDITIO COMMENT:The Legal Department requests the City Council pass this > Resolution. Resolution 77-435, passed and approved on November 8, 1977, although it purported to authorize the sale of the property in question, did not actually contain the appropriate language to the effect that the Council authorizes the sale of the parcels and authorizes the Mayor to sign..the appropriate quitclaim deeds. The passage of this Resolution would remove any potential title objec- tions in this property transfer. ACTION: I b.. CONSIDER AN ORDINANCE AMENDING THE ZONING CODE OF THE CITY OF IOWA CITYIOWA, BY ADDING A DEFINITION OF ELDERLY HOUSING AND SPECIAL , CONDITIONS'FOR ELDERLY HOUSING IN THE CB ZONE TO SECTION 8.10.3 AND 8.10.19 (first consideration). eetCOMMENT: The Planning and Zoning Commission, at a regular m of)ag held on February 9, 1978, recommended by a 6-0 vote app proposed ordinance to amend the zoning ordinance by, establishing special provisions in the CB zone. CONSIDER RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION TO APPROVE THE FINAL PLAT OF E.L. KESSLER SUBDIVISION, PART II (S-7804).' COMMENT: The Planning and Zoning Commission at a regular meeting held on March 9, 1978, recommended by a 5-0 vote approval of the subject subdivision located one and one-third miles west of Mormon Trek Blvd., off Rohret Road, and six hundred feet south of the City limits. To be approved subject to the following contingencies: (1) that the utility companies' signatures be provided, (2) that the'legal,papers be'approved ,by the legal staff, and (3) that an agreement ;'between the City of Iowa City'and Johnson County be entered into which would require that the County not issue any building permits until a registered professional engineer certifies that the stormwater management facilities have been constructed according to the City Plans and specifications. This recommendation is consistent with the staff's recommendation presented in a staff report dated March 9, 1978, which is attached to this agenda. The purpose of the agreement is to effectuate installation of the storm - water management facilities within ,the subdivision and the County. The legal staff has prepared a proposed agreement with the County. The 60 day limitation period terminates March 27, 1978. With or without entering into an agree- ment with the County, the Council must necessarily act upon this subdivision :unless the applicant chooses to waive the 60 day limitation period. The staff will attempt to acquire a waiver of this limitation from the applicant.' If it is not possible to j acquire a; waiver, it will be proposed that the developer agree not to begin other construction until the`stormwater detention facility is completed. The Council will be informed, as to action taken. Page 5 b.City Attorney 'Item No. 10 CONSIDER RESOLUTION ACCEPTING SANITARY SEWER IN VILLAGE GREEN SOUTH. COMMENT: This resolution will accept the sanitary sewer in Village Green South except for the lift station which isnot complete at this time. The work was performed by Dave Schmitt Construction Company of Cedar Rapids, Iowa. Public Works recommends acceptance. ACTION: (2.e:i/2.C.(t.,v.cr S -/U Item No. 11 CONSIDER AN ORDINANCE PROHIBITING SMOKING IN DESIGNATED PLACES IN IOWA', CITY; REQUIRING ENFORCEMENT BY PERSONS HAVING' CONTROL` OF THE PREMISES,I AND PRESCRIBING PENALTIES FOR VIOLATIONS OF ITS PROVISIONS (second consideration). COMMENT: This ordinance will restrict smoking to a designated area in municipal buildings, meeting rooms, and other public places. As a result of the discussion last week, it appears that amendments should be considered. It has not been possible to complete the amendments. .Therefore, it is suggestedthatthe Council defer action on this item for one week. ACTIONt Cali/// e r _ ✓Lre� n-�<G le: rc.% , v Ln Item No. 12 CONSIDER AN ORDINANCE AMENDING ORDINANCE NO. 77-2835 BY PROVIDING FOR THE DESIGNATION OF COMMERCIAL VEHICLES AND CLARIFYING THE TIME LIMITATIONS FOR LOADING OR UNLOADING IN CERTAIN LOADING ZONES BY REPEALING SECTION 6.15.03.A AND 6.01.09 OF ORDINANCE NO, 77-2835 AND ENACTING NEW PRO- VISIONS IN LIEU THEREOF (first consideration).' COMMENT: This ordinance provides for a manner of designating vehicles which are used primarily for commercialpurposes. Commercial vehicles pursuant to Ordinance No. 77-2835are allowed to park in certain zones for the purpose of loading and unloading property. This ordinance also clarifies time limitations for loading or unloading in various loading zones. Then Finance Director recommends approval of this ordinance. The resolution establishing rules and regulations governing the issuance of stickers to commercial vehicles will be on the agenda for the, Council meeting on March 28, 1978.
