Public Hearing on an application submitted by Wagner -Murphy land from A2 County Foundation to rezone an 80 acre tract of Resort to M1 and C1 zones and to consider a resolution to annex the area (Z-7801). ( Comment: The Planning & Zoning Commission, at a special meeting held on March 16, 1978, recommended by a unanimous vote approval of an application to annex an 80 -acre tract of land located adjacent to the southerly City limits on the — east side of Highway 218 and to rezone said property to M1 and C1 zones. This recommendation is consistent with a staff recommendation presented in a staff report dated'February 23, 1978, which was attached to the agenda of March 28, 1978. According to the zoning ordinance the Council must act upon a resolution annexing an area at the time of the Public 1 Hearing on the zoning classification. If the Council passes the resolution, the annexation proposal must then be submitted to the City Development Board in Des Moines for acknowledge- ment of the annexation. Consideration for rezoning the area must necessarily be deferred until acknowledgement is re- ceived by the City Development Board. Action ` '�e 4ly��tt'1L�1. b. Consider a Resolution to'approve final plat of E.L. Kessler 79 3 S— Subdivision, Part II (S-7804). This recommendation was consistent with the staff's recommendationlpresented in a staff report dated (March 9 1978, which was attached to the agenda of March 21, 1978. The purpose of the agreement is to effectuate installation of the stormwater management facilities within the subdivision. The subdivider has pro- vided'both the city and the county with an agreement which would stipulate that no building, permits will be issued by the county until the stormwater management facilities have been installed. Other deficiencies and discrepancies above- mentioned; have been resolved and the plat is now ready for approval. \; Q Action: U 20 - 36 C. Consider a Resolution to approve the preliminary plat of BDI Third Addition (5-7812). ! Comment: The Planning & Zoning Commission, at a'regular< meeting held on April 6; 1978, recommended by a 7/0 vote approval, of the subject subdivision located north of High- way 6 By-pass and west of Scott Boulevard subject to exclusion of lot 2 from the'plat and that the following deficiencies and discrepancies be resolved: (1) that the location of Scott Boulevard be shown along the entire subdivision, (2) that additional right-of-way for Scott Boulevard will be i dedicated upon paving the street, (3) that the location map is corrected, and (4) that all existing and proposed utility easements be shown. This recommendation is consistent with the staff's recommendation presented in a slaff—repor-t_dated April '6; 1978, which is attached to this agenda', with the ex- ception of the deletion of lot 2 of the subdivision. The ' Commission's purpose in approving the plat with',the exclusion of lot 2 was so the question of access to Scott Boulevard did not have to be resolved at this time. Since time is of the essence to the applicant in obtaining approval of the subdivision, a letter requesting the City Council to approve the plat at this Council meeting has been submitted (see attached letter). A revised preliminary plat has been sub- mitted and the staff is now in the process of reviewing it for compliance prior to the Council meeting. Page 7 Item No. 11 CONSIDER A RESOLUTION AMENDING THE HOUSING REHABILITATION FINANCING HANDBOOK TO REFLECT INCREASES IN THE INCOME ELIGIBILITY OF GRANT CASES (ELDERLY AND/OR HANDICAPPED APPLICANTS). Comment: HUD proposed new median income figures for the current Community Development Block Grant fiscal year. After researching typical retirement incomes in Iowa City, the staff is suggesting new income ceiling figures which are 4% higher than those proposed by HUD. Action: Item No. 12 CONSIDER A RESOLUTION ESTABLISHING PROCEDURE FOR CONSIDERATION OF CABLE TELEVISION FRANCHISES: Comment: This resolution sets forth the recommended procedure to be fol- lowed by the City in of applications for cable tele- vision. ORDINANCE PROHIBITING SMOKING ^IN DESIGNATED PLACES 9 _ ?,8 9 IN IOWA CITY (passed and adopted); Comment: A new section 7 has been added to: the ordinance, providing that violation of the ordinance is not a misdemeanor. This section is deemed necessary because the Municipal Code contains a general provision to the effect that the violation of any ordinance is a misdemeanor.
