RENT ESCROW, THE PROCEDURES FOR DEPOSITING &
WITHDRAWING MONIES INTO THE ESCROW ACCT. & THE
RULES GOVERNING THE TERMINATION OF THE RENT ES-
CROW. Citizens objecting included Bob Johnston
& Dick Shepardson. Councilmembers explained
proposed votes. Roll call: Ayes: deProsse,

City Manager Berlin noted that the Resolution
Authorizing the Acceptance of a Grant Offer from
the United States Relating to the Preparation of a
Master Plan Study for the Iowa City Municipal
Airport would be executed in the name of the
Airport Commission. Moved by deProsse, seconded
by Neuhauser, that the Resolution be deleted from
the agenda. Motion carried unanimously, 7/0.

the ORD. PROVIDING FOR THE PUBLIC & PRIVATE USE OF
CITY PLAZA, ESTABLISHING REGULATIONS GOVERNING
SUCH USE, & PRESCRIBING PERMIT & LEASE PROCEDURES
FOR SUCH USE be considered and given 2nd vote for
passage. Motion to consider carried, 5/2, Balmer
& Vevera voting "no". Roll call on 2nd vote for
passage: Ayes: Neuhauser, Perret, Roberts,
deProsse, Erdahl. Nays: Vevera, Balmer. Second
consideration given, 5/2.
Moved by Balmer, seconded by Perret, that the
rule requiring that ordinances must be considered
& voted on for passage at 2 Council meetings prior
to the meeting at which it is to be finally passed
be suspended, that the second consideration and
vote be waived, and that the ordinance be voted
upon for final passage at this time. Motion to
suspend carried unanimously, 7/0. To waive 2nd
consideration, affirmative roll call vote unani-
mous, 7/0, all Councilmembers present. Moved by
Roberts, seconded by Perret, to adopt ORD. 78-
2892, Bk. 13, pp. 81-82, AMENDING ORD. 77-2835 BY

CITY'S INTENT TO DEVELOP AND MANAGE A MULTI-
PURPOSE" SENIOR CENTER. Affirmative roll call vote

Councilwoman deProsse stated that Ed Zastrow,
Bushnell's Turtle, had advised her that the State
Historical Society had reviewed their request for
a $5,000 grant for restoration of College Block
Building, and thru Adrian Anderson's efforts, an
additional $5,000 grant had been awarded them.
City Manager Berlin announced that on Wednesday
morning, 9 AM, at the Chamber of Commerce office,
Business Development,Inc. would announce the new
industry to locate in Iowa City.

the ORDINANCE ESTABLISHING A HOUSING OCCUPANCY AND
MAINTENANCE CODE be considered and given first
vote for passage. Those appearing included Adrian

City Mgr. Berlin advised that the trees in the College St. mini -park
will be relocated by Project Green. Moved by deProsse, seconded by Neu-
hauser, to adopt RES. 78-142., Bk. 47, p. 316, ESTABLISHING CITY'S INTENT
TO DEVELOP AND MANAGE. A MULTI-PURPOSE SENIOR CHITER. Affirmative roll
call vote unanimous, 6/0, Balmer absent. The need to define the manage-
ment role at this time was explained.
Concerning Atty. Mullen's request re lease for Bus Depot. the City
Manager commented that the Comprehensive Plan did not affect the bus
depot area, & staff felt that it is an ideal location for a bus depot.
City Atty. Hayek advised that the legal department would review the lease
before it is added to Council's agenda. The City Manaqer stated that he
did not have all the costs for moving of "Old Jet", but would furnish
thein to Council later. Councilwoman deProsse noted that she had already
observed "No Smoking" signs in a restaurant. Ed Zastrow, Bushnell's
Turtle, had advised her that the State historical Society had reviewed
their request for a $5,000 grant for restoration of College Block Build-

d. City Mgr. Berlin explained action necessary to adjourn
the meeting to May 1, for setting public hearing -moratorium
e. Councilwoman deProsse called attention to material on
the Russell matter sent to her by Fisher.
f. Answer sent to Regina will be included in Fri. packet.
g. City Mgr. Berlin noted that there was nothing in the
Comprehensive Plan affecting the bus depot area, and
staff continues to feel that it is an ideal location
for a bus depot.
h. The proposed alley paving project,of alley between
Court St. F, Burlington adjacent to Pentacrest Apts.
F, Breese Automotive, bid Procedure was discussed.
IIGF,Ewould not take bids for the whole project F,
let the City pay them.
i. Inflation F, cost of Transit Barn Ventilation Project

c. Berlin advised that it was important that in Program
development, emphasis be on the Board of Directors,
who will be responsible to all citizen groups.
d. Consensus was that it was a very good memo, it would
give staff a clear position, also future councils.
C. The City Dlgr. was directed to draft this memo into a
Resolution for Council to pass.
f. It was noted that this will probably not be as much
of a joint effort as was first envisioned.
SCREENING FOR GORDON RUSSELL PROPERTY Bowlin, llonohan

a. City Mgr. Berlin called attention to the proposal in
letter from Atty. lionohan representing Gordon Russell..
b. Ile also called attention to the Previous 1974 agreement
which discussed conditions in excess of the zoning
requirements.
c. Councilwoman deProsse commented on material sent to her
by Fisher. Previous proposal was discussed.
d. lionohan outlined their proposal, to move the cars which
are in violation f, construction of a berm in May.
e. Council questioned if this screening would be adequate.
f. Item 96 in Flonohan's letter re east side screening will
be referred to the Riverfront Commission.
g. lionohan was asked to present an agreement in regard
to provisions for screening as discussed today.
h. Councilmombers agreed that if the berm was not a satis-

Blum called the meeting to order and asked if anyone present wished to discuss any
item other than the Land Use Map. Several interested individuals responded, but
their concerns were related to the map and Blum asked them to wait and express their
concerns at the appropriate time.
.lakobsen then reviewed the actions of the meeting of March 9, 1978, for Blum who
was absent at that time.
The meeting then turned to the Land Use Nap. Ogesen expressed a concern with the
large number of parks shown in the southeast quadrant of the map within the
twenty year goal rango. Ile stated that parks were great and everybody was in favor
of then, but you still have to pay for them. Gcshwiler explained the reasons for
the parks and the adjustments made in the southeast corner of the map. A discussion
followed, and the Staff agreed to report back on this question.
ogeson also stated that he was concerned with the area south of Burlington Street
and west to Van Buren Street, including Governor Street, lie noted that on the map
sent out to the public this area was shown as being recommended for 113 type density
and now it was being shown as 113A type density. A discussion followed. Ogesen moved
that the arca south of Burlington Street, including both sides of Governor, he
designated for 8-16 dwelling units per acre. Jakobsen seconded the motion and it
was carried unanimously.
.lakobsen raised the question whether the meeting was It Planning and Zoning meeting
in conjunction with a CPCC meeting. A discussion followed. Blum stated that the
CPCC had been organized to assist the Planning and Zoning Commission and obtain input
from City Council until Pr,Z was in a position to proceed on its own. Ile noted that
I'$Z was now ready to proceed and proposed that CPCC adjourn itself to some future
call and that P$Z deal with the rest of the map. Ile extended an invitation to the
CPCC members and any member of City Council to come and give their input at the
meetings. NeIVIUSCr indicated her agreement with Blum's proposal. A discussion
followed. It was decided, however, that the meeting would be considered ❑ joint
meeting.
Ogesen moved that the arca near the 'Town and Campus Apartments be changed from
commercial to 18-24 units per acre of residential. Jakobsen seconded the motion
and it was carried unanimously.
0gesen then expressed his concern for the near north side which had been converted
from a residential density of 8-16 units per acre to 2-8 dwelling units per acre. A
discussion of the question followed. Blum called for a vote to change the density

A discussion of the North Dodge Street arca followed. Vetter stated that North
Docl)gc Street was the cut-off point for "parkcrs" who walked to the Campus. She
stated that she could see residential development at 8-16 dwelling units per acre
for this arca to allow for more people to live within walking distance of the
campus.
Oguson noted that in the area on North Dodge Street and east of Prairie du Chien
I(ond and south of North Summit Street the 18-24 units per acre density was too
large and extended too far south. Ile indicated that a half block away was a single
family arca and'that this density might be too dense for a single family arca. A
discussion Followed. Ogesen moved that the area south of Dodge Street he
designated for 8-16 dwelling units per acre. deProsse seconded the motion and it
was unanimously approved.
deProsse expressed concern about the area of Muscatine Avenue and College Street
and moved that the 2-8 dwelling units per acre 'density be extended up to Summit
Street. A discussion followed. Ogesen seconded the motion and it was unanimously
carried.
deProsso also expressed concern about the Englert Tract. Blum noted that he had
received a phone call from some members of the lilks Country Club who asked for the
arca to be cltangod from 2-8 or up to 24 units per acre density. Schmeiser noted
that it would be better to have the arca remain as single family to facilitate the
high generation of elementary school-age students to support the proposed elementary
school. A discussion followed.
1'110 discussion then turned to the cast by-pass and the two alternatives shown on
Lite mop. Jakobsen moved that the two alternative routings he allowed to remain on
the map. Ogesen seconded the motion and Blum called for a vote. There were two
opposed (Kammermeyer and deProsse), two abstentions (Pcrret and Ncuhauscr) and
four in favor. The motion carried.
Schmeiser showed a map and explained that the new sewage treatment plant could
provide sanitary sewer service from one to two miles south of the existing City
limits. A discussion followed. ogesen moved that an alternate route be shown on
the map for the by-pass. It was seconded by Jakobsen and unanimously approved.
Jakobsen expressed concern with the near north side commercial area and the wary it
was shown on the map. She noted that it was designated as residential but should he
commercial because of the businesses in the area. Ncuhauscr suggested that it new
designation of commercial and residential stripe be used to indicate the commercial./
residential areas. Lehman moved that the near north side area shown on the map as
commercial he designated commercial and residential striped to indicate commercial
nsc on the ground floor and residential use above. Jakobsen seconded tile motion and

A discussion on the arca west of Hancher Auditorium followed. Jakobsen noted that

density. Vetter seconded the motion and it was unanimously approved.
J(rkohscn also noted some concern for the Ralston Crock floodway as it was shown on
the map. A discussion followed. Vetter moved that the floodway be shown on the
map by a green line designating open space. Ogesen seconded the motion and it was
carried unanimously.
The discussion then turned to the block bounded by Linn, Prentiss and Dubuque
Streets and whether it should be designated for commorcial. Kammermoyer moved that
the area be shown as commercial on the map. Vetter seconded the motion. Blum
called for a vote. Four were in favor and two opposed (Blum and Jakobsen). The
motion carried.
.Jakobson asked what was happening at First and Rochester Avenues and wondered if it
needod to be changed. Bruce Glasgow, a developer, presented a picture of his plan
For commercial development of the area. lie asked that the area be retained as
commercial. Blum noted that this had been discussed at a previous meeting and that
his request had been granted then.
.Jakobson also expressed concern for the area of Mormon 'Trek and West Benton. Ilium
noted that people in the arca well ld like to see it returned to 2-8 dwelling units
per acre. .Iikol)scn stated that the area had seen the biggest objections from the most
people. A discussion followed.
.Jim Schintler requested permission to speak on the subject. Ile stated that lie and
his brother own property near the West High tract and that the land was adjacent to
the 20 year plan for the area. Ile said that they were in the process of developing
the area and were concerned because the sewer lines ended short of the property.
Neuhauser stated that she thought the situation needed to be looked at more closely
before a decision could be made. A further discussion followed.
Kammormeyor moved that the area of West Benton and Mormon Trek be changed back to a
designation of 2-8 dwelling units per acre density. Ogesen seconded the motion.
The motion failed with four opposed and two in favor.
Kammermeycr moved that the southwest corner of Highway G and Gilbert Street
Ile designated for commercial. It was seconded by Ogesen and carried unanimously.
The meeting was adjourned.

2. Kushnir reported that all owners of property which fronts
on Hollywood Blvd. between the intersection of Keokuk
and Taylor had been contacted, and all but one had agreed
to closings shown on the map, F, one owner was not contacted.
Councilman Perret arrived, (1:35 PM).
3. Not obtaining consent of one property owner has previously
influenced the Highway Dept.'s decision on whether or not
to close a street.
4. Letter from Dept. Of Transportation, re special public
road connection for Hy -Vee Stores was presented. They
had denied the request.
Councilman Erdahl arrived, (1:40 PM).
5. Berlin pointed out reconsideration of application only if
information from ily-Vee would show that they would not
survive if they did not have direct access.
6. Traffic Engr. Brachtel reported on the effect of traffic
patterns on residential F, commercial development.
7. Connection of 11roadway to Sandusky was discussed.
8. Mayor Vevera commented that a majority of Councilmembers
were in favor of the proposed alignment as shown on the
map.
AGENDA
1. City Clerk Stolfus advised that the Resolution implementing
the Housing Ordinance would need to be considered after
the Ordinance is adopted, not as Item 13.
2. City Manager Berlin called attention to the fact that the
Legislature had adopted the hill regarding lighting for
the Interstate, but the Res. on the agenda needed to be
adopted to cover the time Frame from now until the
legislation takes effect.

1. Bleckwenn asked that Council delete Items 14 $ 15 from their
agenda, citing the opinion received from Attorney General
Turner on May 3rd, which was presented, F, the telegram
from Federal Aviation Administrator Bush.
2. Atty. General's opinion stated that the City would be
held responsible for Airport Commission contracts, even
if the Commission was abolished.
3. Bush's telegram stated that the Airport Commission would
be an eligible sponsor to contract for Federal Aid.
4. A majority of the Airport Commission voted to accept
sponsorship of the Master Plan, May 4th, fa adopt the
revised contract. He asked FAA to reissue the grant
in the name of the Commission, & Bush asked for a
Council consensus that the study was needed.
5. Several Councilmembers discussed concern over
autonomous powers for boards and commissions, h no
one spoke in favor of the Airport Comm. hiring indepen
dent legal counsel.
6. During discussion Berlin stated that the $84,000 from
sale of land should be used for permanent improvements
not operational expenses.
7. The consensus of Council was that the Master Plan study
should be done, and there was a 3-3 indication that
the contract should not be deleted from Council's agenda.
8. City Dlgr. Berlin suggested a 3 party agreement,
Kimbal7,Airport Comm. ✓a Council. Council would concur
that FAA put the grant in the name of Airport Comm.
as sponsor.
9. As there were no objections, Council indicated that because
of time constraints, the Mayor should sign the agreement
if Bleckwenn received approval from the other Commissioners
for this procedure.

Regional planning transit documents to be attached to
Comp. Plan as appendices, or made reference to.
Hoy -area involunary annexed, today Council has decided
to designate it residential, 1 DU/A.
Meardon-Staff is looking into questions raised, will
need additional research. Kraft stated the City will
use the power of eminent domain, not police power,
for acquisition of land. He outlined processes to
be used regarding notification, not individual notices.
A discussion of parks and bikeways will be scheduled when
Neuhauser is present, along with Parks F1 Rec. Comm. Chairman
and Director of P$R. Bikeways could be an element of the
Plan.
Concern was expressed on how to deal with parking in area
between Dubuque $ Clinton. Berlin advised that it would
take a year to complete the zoning ord. I,, subd. regulations,
I, other regulatory ordinances, then can look at area
(neighborhood) planning. Funding has not definitely been
allocated from the HCDA funding for planning.
Melrose 'bubble' route, around University Heights.
Council consensus previously was that the University
should have a plan for a way into the hospital complex.
A majority agreed to remove the 'bubble' from the Compre-
hensive plan I,, suggest to the Univ. an access from

AIRPORT AGREEMENT -KIMBALL
A majority o Council members reiterated their approval of
the Mayor signing the agreement on Mon. before adoption of
