a. Consider a Resolution to approve the preliminary plat of Court
Hill - Scott Boulevard Addition, Part 4. S=7818
Comment: The Planning and Zoning Commission, at a regularmeeting
held on May 4, 1978, recommended by arunanimous vote approval of
the subject subdivision' located east of Raven Street between
Court and Washington Streets. This recommendation is consistent
with the staff's recommendation presented in a Staff Report
dated May 4, 1978, which was attached to the agenda of, May 16,
1978. The Commission had also requested that the Council 'insti-
gate what action is necessary to more firmly tie down the future
relocation of Scott Boulevard as indicated on the Comprehensive
Plan map so as not to interfere with the future location of storm- t
water detention basins for developments' in the same area as the ;
subject subdivision. This item is now ready for approval.

b. Consider a motion concerning the preliminary plat of Spring

Valley Subdivision, S-7822, City of Coralville.
Comment:" The subject subdivision is located two and one-half
miles north of the City ,limits on County Road W66 (Old Highway
I
218), within Coralville's two mile extraterritorial jurisdic-
tion, but within the City's annexation area. Although the,
Planning ,& Zoning Commission will not have formally acted upon ;
this item until Thursday, May 18, the City of Coralville has
requested that the City Council consider the subdivision at the
Council meeting of May123. The staff analysis of the subject
subdivision is presented in a Staff Report dated May 18, 1978,
which is attached to this agenda.'' The staff has recommended' {
that the subdivision be denied unless secondary access is pro-
vided to the subdivision at this time. The Commission's recom-
mendation will be presented to the Council prior to the formal ;
Council meeting.In'j

velop an apartment complex on the site. This recommendation is con-

Noel's'Tree Service holds the demolition contract for removal of the

site unless Council approves by formal action an alternate site.

Comment:
The redeveloper of Parcel 102.-1 has presented Preliminary Design
Plans for the two-storyoffice building to be constructed on this ,

parcel. The Design Review Committee reviewed the plans and 'recom-

mended approval.' The RedevelopmentlDivision.recormiends approval of
this resolution. This item was deferred from the agenda of May 16.
A memorandum on this subject was furnished with that agenda. The
minutes of the Design Review Committee meeting of May 10, 1978,
are included with this agenda.

7P j9 THE 'IOWA DEPARTMENT OF TRANSPORTATION TO MODIFY CERTAIN ACCESSES TO
HIGHWAY 6 LOCATED IN IOWA CITY, IOWA.
Comment` On May 9, 1978, the City Council approved the replat of Pepperwood
Subdivision Parts I'and II. In approving the re -plat, the City
Council approved a proposal to change an access point onto Highway 6
By-pass as well as to eliminate Hollywood Boulevard as a through
street. This proposal has been recommended by the City Traffic En-
gineer on the basis that it would provide better access and promote
an orderly development of the neighboring tracts.

Item No: 13 - CONSIDER RESOLUTION CALLING A SPECIAL CITY; ELECTION.

Comment: The City wishes to construct a new public library. Section, 384.26'
i j:' of the Code of Iowaprovides' that before the City may issue bonds
for a library, which is "a general corporate purpose, it shall call
a special City election to vote upon the proposition of issuing the
bonds. This resolution will'set the date for the special election
on Nov. 7 and will outline, theprocedures, for that election.

Item No. 14 CONSIDER AN ORDINANCE AMENDING ORDINANCE NO. 2238 BY REGULATING
THE LOCATION OF ADULT BUSINESSES IN IOWA CITY (first 'consideration).
Comment: Since the new criminal code went into effect in January of 1978,
bars have not been allowed to feature nude dancers. 'In a number of
Iowa communities, tavern owners have created a`separate business
adjacent to the tavern which features nude dancers but does not
serve liquor. Such an arrangements frustrates the intent of the
legislature and is a triumph of form over substance. it would create
law enforcement problems because there would be a -tendency of tavern
i
customers to want to take their drinks withthemnext door to watch
the dancing. While we might be able to prohibit the adjacent room
under the present code, this amendment will remove any doubt.
Therovision that adult businesses may not be within 500 feet from
eachotherhas been added to prevent aconcentration of such busi-
nesses in one area. Such a provision has-been upheld in other'juris-
dictions because it has been found desirable not, to create a "combat
zone
