Comment: It is required by State law that a', public hearing be held to discuss the City's application for a grant 'under the State transit assistance, program. A memorandum from the Transit Manager is attached. (2) CONSIDER RESOLUTION AUTHORIZING THE CITY CLERK TO PUBLISH NOTICE AND SET A PUBLIC HEARING ON JUNE 6, 1978, ON A j PROPOSED AMENDMENT TO A LEASE BETWEEN THE CITY OF IOWA 7 [V CITY, IOWA, AND UNION BUS DEPOT OF IOWA CITY, INC. 1r Comment: On December 1, 1974, the City entered into a lease agreement with Union Bus Depot of Iowa City, Inc. leasing to Union Bus Depot property owned by the City on the corner of Gilbert Street and, Col- lege Street. The tenant has asked that the lease be amended so i that he be granted a, right to lease the premises until December, , 1984. The amendment also contains a rent escalator clause which ! assures rent will reflect market value. Because the amendment involves a lease in excess of three years, a public hearing should be held prio(rj to any disposition of theatter. n I e. Correspondence. (1) Letter of thanks from Jean M. S-7818 Comment: The Planning & Zoning Commission at a regular meeting approval, held on May 4, 1978, recommended by a unanimous, vote of the subject subdivision located east of Raven Street be- tween Court and Washington Streets. This recommendation is t consistent with the staff's recommendation presented in a Staff Report dated May 4, 1978, which .is attached to this ' — agenda. The applicant had earlier requested that the storm - water detention facility for this subdivision be permitted to be located in the existing right-of-way of Scott Boulevard to the when Scott Boulevard is realigned according proposed Comprehensive Plan. Contours be shown at intervals of at least five feet, 2. Utility companies', signatures being provided, 3. Private water'supply being approved by the County Health Department, 4. Private sewage disposal being approved by the County Health Department, , 5. -Necessary legal papers being submitted for review, 6. Side lot lines being between 80 and 100 degrees to street lines (the Commission recommended that a',waiver of this requirement be granted since the lots are large), 7. Comment: The above-mentioned architectural firm was chosen for the purpose of the old Iowa City of providing the designs for the remodeling Post Office into a Senior Citizens Center at a cost not to exceed Housing $67,500. This finn also has been hired by the Ecumenical of designing the contiguous Elderly Corporation for the purpose Housing project. The City Manager recommends approval of this contract. Action: dr, 0- Item Item No. 11 - CONSIDER RESOLUTION OF INTENT TO OFFER PROPERTY FOR SALE FOR ELDERLY HOUSING TO THE ECUMENICAL HOUSING CORPORATION. Comment: The Ecumenical Housing Corporation (EHC) must have control of the parking _lot immediately', east of the old Iowa City Post Office for the purpose of constructing 100 units of subsidized housing for'< the elderly prior to tentative approval of the housing application by the Department of Housing and Urban Development. The attached resolution commits the City to give EHC the first option to purchase this land at fair market value to be determined later. The City'is presently in the process of having this site appraised and the City Council will set the fair market value of this property subsequent to the receipt of land appraisals. The City Manager recommends adoption of this resolution: Action: I Item No. 12 - CONSIDER RESOLUTION APPROVING THE PRELIMINARY DESIGN PLANS FOR RE- DEVELOPMENT ON URBAN RENEWAL PARCEL 102-1. Comment: The redeveloper of Parcel 102-1 has presented Preliminary Design Plans for the two story office building to be constructed on this parcel. The Design Review Committee reviewed the plans and recom- mended approval'. A memorandum on this subject accompanies this agenda. R. r Item No. 13 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT WITH THE IOWA CITY ROTARY CLUB FOR THE LEASING OF CAMP CARDINAL BY ?, THE CITY OF IOWA' CITY. Comment: By this agreement, the Rotary Club will lease Camp Cardinal to the City at no cost. The City will agree to use the premises for educa- tional and recreational purposes, primarily supervised nature hikes. The 'City ,is agreeing to be liable for claims arising from our use ofthe property. Comment: The original contract provided for preparation of a schematic master plan which the Council received in their packet sent out May 5. Comment: This resolution authorizes the Mayor, to execute an agreement with the Iowa City Chamber of Commerce whereby the Chamber will distribute bus coupons to shoppers and pay the City fifteen cents for each cmon which the City redeems at the Iowa State Bank. Action: 1 Item No. 20 - CONSIDER AN ORDINANCEAMENDING THE HOUSING OCCUPANCY AND MAINTENANCE 1 CODE TO INCLUDE A STATEMENT THAT FEES FOR PERMITS IN THE LICENSING OF MULTIPLE DWELLINGS' SHALL BE ESTABLISHED BY RESOLUTION OF THE CITY COUNCIL _�-/�.. Comment: The original draft of the Housing Occupancy and Maintenance Code had the suggested fees for licensing multiples and rooming houses contained in the language of the text of the Code. At the recom- mendation of Council and the Housing; Commission, the fees were de- leted from the Code with the understanding they would be by resolution, however, inadvertently the necessary language author- izing the Council to establish fees by resolution was not contained in the text of the Code as it was adopted by Council. We regret the omission and respectfully request the Council to consider this amendment and waive the requirement for readings to allow the Code to be executed on time without a gap in the licensing procedures. Comment: The previous Housing Code language required the Council to adopt fees by resolution. THIS RESOLUTION STATES BY NAME THE APPOINTEES AS FIVE REGULAR MEMBERS AND TWO AL- TERNATES. THISRESOLUTION WILL MEET THE REQUIREMENTS OF THE RECENTLY PASSED HOUSING OCCUPANCY AND MAINTENANCE CODE REQUIRING A FIVE - MEMBER BOARD OF APPEALS. I Comment: The seven -member Housing Commission has served as the Housing Ap- peals Board under the old Housing Code. The new Housing Occupancy and. Maintenance Code requires a five -member Board of Appeals and therefore the composition of the Housing Commission can meet the requirements of the Housing Appeals Board and still provide two alternates to assure quorum. The Housing Commission , at the time of the drafting of this resolution,is short two members. This resolution will appoint all five members as the regular members of the Housing Appeals Board:` They are as follows: Stephen Lombardi, Carole Ivie, Jerald W. Smithey, Cora B. Pollock, and Mary P. Owens. A number of disorderly conducts charges have been written for urination in public and the present disorderly conduct ordin- ance has been held invalid by magistrate court judges in the past. Therefore we feel this amendment is necessary for enforcement. The provision for exposure of female, breasts has been added because there presently is no such prohibition for public streets while there is such a prohibition for the inside of: bars and taverns.
