PROTEST
CEDAR RAPIDS AND DES MOINES, IOeIA
COME NOW Larry P. Waters and Jeanette Waters, the owners
of property located at 1538 Rochester Avenue, Iowa City, Iowa,
through counsel, and, in accordance with Section 414.5 of the
Iowa Code, make protest against the proposed preliminary and
final Planned Area Development Plan and subdivision plat of
Hickory Corner.
Protest is made on the following grounds:
1. This proposal contains less than two acres in violation
of Section 8.10.20(A) of the municipal code.
2. The action of the Board of Adjustment in granting a
variance is in excess of its authority and violates both
Section 8.10.28(H)(1) of the municipal code and Section 414.7
of the Iowa Code.
3. Approval of this proposal would be in the nature of
spot zoning as to lot size and contrary to the provisions of
Section 8.10.1 of the municipal code and Section 414.3 of the
Iowa Code in that the proposed lot sizes are inconsistent with
the character of the area otherwise established.

j Ladies & Gentlemen:
5 On behalf of Edgar Colony, owner of Hickory Corner
_I P.A.D., we hereby request that the City Council suspend their
rules and waive the requirement of 3 separate readings of the
ordinance approving the P.A.D. at 3 separate meetings. As you
know,a public hearing was set for May 16, but it was discover-
ed that that date did not allow proper notice. On May 16, a
new hearing date was set for June 6.
t Had the hearing been properly scheduled for May 23, the
final reading of the ordinance would thefault of the June 13. request
that, since this delay was in no way
the final readings and action be taken no later than June 13.

MEMO TO: Iowa City Council Members
FROM: Lawrence R. and Mary M. Howsare
RE: Rezoning of our 900 North Dodge property
I will not review all of the circumstances and all of our individual
and group protests of the construction of the 29—Unit apartment
building on the 900 block of North Dodge.
We feel that we were, above all others in that neighborhood, the
victims of the construction of that monsterous building. It not
only devalued our property considerably making it impossible for
us to even sell, but because of a complete lack of privacy for our
family, gave us no alternative but to move from the home that we
all loved.
A single family will never want to occupy that house again for
obvious reasons if you have ever visited the site in question. We
therefore at this time file a protest with the Iowa City Council
against any rezoning of our 900 North Dodge property from R3B.
The council must realize it is too late to rezone any of that
property back to R2, the damage to the Northend has been done.
