Action: (f2V/ '!~ Comment: In the event that the City adopts Ordinance No. VAC07-00004, thereby vacating the portion of the City right-of-way along Court Street West of Madison Street, and Front Street South of Burlington Street, the University has requested that the City convey these vacated parcels to it as the adjacent property owner. The University owns all property between Burlington, Madison, Front and Harrison Streets and desires to construct a new recreation center on this property. The City would retain a blanket utility easement over the vacated parcels. This resolution declares the City Council's intent to consider the conveyance of the above property to the University of Iowa and sets a public hearing on the proposed conveyance for September 18, 2007. Comment: At its August 16 meeting, by a vote of 6-0 (Smith absent) the Planning and Zoning Commission recommended approval. Approval of this vacation will allow the property to be incorporated into the Hieronymus Square development. Comment: In 2006, Council vacated the above-referenced East-West alley (Ordinance 06-4239) and is presently considering the vacation of a portion of the North-South alley. These actions have been taken in anticipation of these parcels being conveyed to Hieronymus Square Associates for private development. In the event that these parcels are conveyed to HSA, HSA has agreed to grant a public access and utility easement, and perform snow removal for the entire length of the North-South alley, including those portions not otherwise vacated or conveyed. The Staff supports this conveyance without monetary consideration due to the restrictions and obligations HSA has agreed to undertake. This Resolution declares the City Council's intent to consider the conveyance of the above property to HSA, and sets a public hearing on the proposed conveyance for September 18,2007. (SECOND CONSIDERATION) Comment: At their meeting on July 19, by a vote of 5-0 (Freerks recused; Plahutnik absent), the Planning and Zoning Commission recommended approval of these rezonings. In a staff report dated June 21 and a memo dated July 12, staff recommended approval subject to conditions to ensure that the proposed church can be integrated successfully into an area intended for a residential neighborhood with interconnected streets and a public square as a neighborhood focal point. Approval will allow the possibility for development of a new St. Patrick Church and acknowledge public ownership of property that will be developed as a public square along Lower West Branch Road. Applicant recommends expedited action. Comment: The project will involve the demolition of the existing fire station at 301 Emerald Street, and the construction of a new free-standing LEED-certified fire station facility on the same site. The work includes site work, general building construction, mechanical, including a ground-source heat pump system, electrical, communication and security and specialty systems. Comment: The project will involve the renovation and remodeling of seven public restrooms for handicap accessibility in accordance with A.D.A Guidelines, the installation of two public restrooms required by code, and two new shower facilities in the Senior Center, located at 28 South Linn Street. (FIRST CONSIDERATION) Comment: The boundary of precinct 16 needs to be changed to reflect the annexation of the Rellim Farms / St. Patrick's Church property along Lower West Branch Road. ~f~-) t.h~ Is;. ~ c:Li-) y'" Action: CONSIDER ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "USE OF PUBLIC WAYS AND PROPERTY, "CHAPTER 3, ENTITLED, "COMMERCIAL USE OF SIDEWALKS, "SECTION 3, ENTITLED "USE FOR SIDEWALK CAFES," TO ALLOW FENCING TO REMAIN YEAR ROUND ON CAFES LOCATED ON CONCRETE PLATFORMS AND TO CLARIFY THAT CAFES MAY BE LOCATED ON PUBLIC RIGHT-OF-WAY. (SECOND CONSIDERATION) Comment: The current definition of sidewalk cafe provides that the cafe is located on the sidewalk whereas other provisions of the ordinance do not limit cafes to the sidewalk. This ordinance clarifies that cafes can be located on portions of the right-of-way other than the sidewalk. Additionally, staff recommends that the public works director have the discretion to approve a cafe on a concrete platform in the right-of-way that is not the sidewalk and that the fencing for those cafes need not be taken down from December through February. Staff recommends expedited action. Action: ~~/~ Il/~~d'd$,?jft" p{; CONSIDER AN ORDINANCE AMENDING TITLE 16 OF THE CITY CODE, ENTITLED "PUBLIC WORKS," CHAPTER 3, ENTITLED, "CITY UTILITIES," ARTICLE G, ENTITLED "STORM WATER COLLECTION, DISCHARGE AND RUNOFF," TO DELETE THE EXEMPTION FOR CONCRETE TRUCK WASH OUT. (SECOND CONSIDERATION) Comment: The illicit discharge ordinance, which controls storm water runoff, exempts from regulation certain types of discharge including "concrete truck wash out." Federal law and the City's national pollutant discharge elimination system (NPDES) general permit require the City to control concrete truck wash out. Staff initially anticipated regulating concrete truck wash out with another ordinance, but now recommends deleting the exemption for concrete truck wash out. Staff recommends expedited action. Action ~~~:::t (LJ~~"",u~ .~~ ,pl!f?d o....A. ~.I ~ Z ~ September 4,2007 City of Iowa City Page 10 ITEM 11. 07- ~"11 CONSIDER A RESOLUTION APPROVING THE FOURTH AMENDMENT TO THE PENINSULA NEIGHBORHOOD DEVELOPMENT AGREEMENT BETWEEN THE CITY OF IOWA CITY AND PENINSULA DEVELOPMENT COMPANY, L.L.C. Comment: Pursuant to the Peninsula Neighborhood Development Agreement as amended, the parties established deadlines for the Developer's purchase of successive phases within the Peninsula Neighborhood, (i.e. Second through Sixth Addition), with failure to meet said conveyance deadlines constituting a default under said Agreement. Subsequent to establishing said deadlines for conveyance, the rate of sales within the Peninsula Neighborhood has been slower than anticipated. However, PDC has increased its marketing efforts and, given its significant investment in the Peninsula Neighborhood, PDC remains committed to building out the Peninsula Neighborhood as envisioned by the City and PDC. Therefore, PDC has requested a twenty-four (24) month extension of the January 1, 2008 closing deadline for conveyance of the Peninsula Neighborhood Third Addition to January 1, 2010, with closing dates all the remaining phases (four through six) to be set for closing at subsequent three (3) year intervals (per the terms of the existing second amended agreement). This Resolution authorizes the Mayor to sign and the City Clerk to attest the Fourth Amendment to the Peninsula Neighborhood Development Agreement. Staff memorandum included in Council packet. Action: 1&-/~r .sJ;i;0 ~ CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY ''/uJ If CLERK TO ATTEST A CHAPTER 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY, IOWA AND JOHNSON COUNTY, IOWA FOR THE PROVISION OF COMMERCIAL AND INDUSTRIAL ELECTRICAL INSPECTIONS. ~~~ ITEM 12. o7"'d.1a. Comment: City staff has negotiated a 28E agreement with the County for the City to provide electrical inspections on commercial and industrial structures. The County conducts very few commercial/industrial electrical inspections and the City should be able to provide support without negatively impacting city electrical inspections. This agreement can be terminated by the City (30 days notice) if the County inspections become a burden. The fees are based on City salaries, and the County will also pay for mileage. The proposed 28E agreement is on the agenda for the Board of Supervisors meeting on August 30. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN ADDENDUM TO THE IOWA DEPARTMENT OF TRANSPORTATION COOPERATIVE AGREEMENT FOR THE INSTALLATION AND USE OF AN INTELLIGENT TRANSPORTATION SYSTEM ITS-7480(333) - - 25-00. Comment: The Iowa Department of Transportation (IDOT) has installed cameras, sensors, and other related technology within the City, mainly along 1-80, 1- 380 and US Hwy 218 and the IDOT has provided access to this technology and use of conduits to the City. This addendum will allow the IDOT to attach equipment to City roadway lighting poles at the interchanges of US Hwy 218 and Highway 1 and US Hwy 218 and Melrose Avenue. The City will supply power to the equipment at these locations. Action: ~/~A/~~~ ~7/h / CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN IOWA DEPARTMENT OF TRANSPORTATION FUNDING AGREEMENT FOR THE MCCOLLISTER BOULEVARD PCC PAVEMENT (HDP- 3751(628) - -71-52) AND MCCOLLISTER BOULEVARD BRIDGE (HDP-3715(634) -- 71-52) PROJECTS. Comment: This agreement provides for an 80% HPP (High Priority Projects) TI (Transportation Improvements) funds and 20% local funding split.
