'Consider an ordinance establishing a planned area development plan of 'a tract of land located at the northwest corner of ?,, I Rochester Avenue and Seventh Avenue (first consideration). j Comment: The Planning and Zoning, Commission, at a regular meeting held on'April,20, 1978,' recommended by a six to zero vote approval of a preliminary and final Planned Area Development Plan and'subdivision plat of Hicko ry ,Corner to develop four lots at the above address for single family dwellings. Contingent upon this recommendation was that the legal, papers be reviewed by the legal staff, that the 'side yard for one of the dwellings, be adjusted, and that signatures to the legal papers be provided. These contingencies have now been resolved. This recommendation is consistent with a staff recommendation presented in a' Staff Report dated April 20, 1978, which is attached to the agenda of June 6. 'The ,purpose.'of this Plan is to allow flexibility �> in the provisions of the Zoning Ordinance by placing single family dwellings on smaller lots and maintain the integrity of the setback of dwellings along Rochester Avenue. ' (second consideration) Comment: The Planning and Zoning Commission, at a regular meeting held on April 20, 1978,recommended by a 6/0 vote approval of an application submitted by Gary Abrams to rezone a 1.4 acre tract located at the above address from an existing C2 to CBS zone to develop an apartment complex on the site. Item No. 5 - _ PUBLIC HEARING TO CONSIDER AN ORDINANCE AMENDING ORDINANCE No. 77-2859 ADOPTING THE UNIFORM BUILDING CODE AS MODIFIED AS THE IOWA CITY' BUILDING CODE. AMENDMENT MODIFIES THE BUILDING CODE BY DELETING DRYWALL AND LATH INSPECTIONS AS THE REQUIRED MINIMUM INSPECTION, ALLOWS AN EXCEPTION IN THE HANDRAIL REQUIREMENTS FOR STEPS HAVING LESS THAN FOUR RISERS, ESTABLISHES DEFINITION OF ENGINEERED TRUSSES. AND'ESTABLISHES LIMITATIONS AND REGULATIONS ON FIELD MODIFICATION OF USSES AND TO ADD SECTIONS TO THE CODE PROVIDING G DEF I- ENGINEERED TRUSSES, NITIONS, STANDARDS, AND INTERPETATIONS NECESSARY TO PERMIT THE DEVELOPMENT OF ENCLOSED SHOPPING MALLS. Comment: The Board of Appeals met on June 1, 1978 and endorsed Section 304D, I eliminateddrywall and lath inspections as part of the mandatory inspections; endorsed Section 421 defining an engineered truss; Section 1718 establishing code standards for field handling of engineered trusses; endorsed 3305J allowing an exemption of handrails. ' in stairs of less than four risers, DID NOT CONCUR in Section 1305A and 1405A which reduced the UBC requirement of windows in kitchens and specifying the requiring size as 10% of the gross ,floor area of the kitchen. The Building Official had recommended that the code require windows in kitchens but that the—size, be-not—less than �s 3% of the gross floor area. The Board suggested that kitchens not be required to have windows. The Board felt that apartment construction would be hampered if the windows were mandated. Apartments with kitchens on interior walls have 'usually not been designed as "blind rooms" but have counter room dividers instead of the fourth wall to allow light and ventilation to be contributed from adjoining habitable rooms. The Building Official also suggests that eliminating windows in, kitchens may result in higher energy consumption since lights and ventilating fans would have to be ,used continuously when the room was used; The Building Official does not agree with the Board on 1305A e. The Board met on June 8, 1978 to discuss appendix 11 defining and regulating Covered Mall Buildings., The Board endorsed the inclusion of this appendix as part of the Iowa City Building Code. T• �. Ite l'� - Action: � Item No. 6 - PUBLIC HEARING TO ACCEPT INPUT REGARDING THE CITY'S PROPOSED APPLICATION FOR AN IOWA DEPARTMENT OF TRANSPORTATION TRANSIT ASSISTANCE GRANT.' Comment: It is required by State law that a public hearing be held to discuss the City's application for a grant under the State transit assistance program. A copy of the proposed application is attached to the agenda. Comment: This project consists of an alley located east of Madison Street between Burlington and Court along the west side of the Pentacrest Apartments. The estimated 'cost is, approximately $19,000: Action: Q� Qin Item No. 8 - PUBLIC HEARING ON AN AGREEMENT TO CONVEY 1,901 SQUARE FEET FROM IOWA CITY TO THE IOWA DEPARTMENT OF TRANSPORTATION TO PROVIDE FOR THE IMPROVEMENT OF THE INTERSECTION OF HIGHWAY 218 AND HIGHWAY 6. Comment: This gives the State a small strip of land on Highway 218 directly adjacent to the Service Building. The strip of land is shown as the shaded portion on a drawing attached to the agenda. It is ,intended that the land be transferred to the State at no charge. Improvement of the intersection mutually benefits bothlthe City and State. Consider recommendation of the Riverfront Commission that the screening, to be used on the pond side of the Gordon Russell crushing operation off US 218 include a tight; solid fence at least six 'feet 'high and ,20`feet, back from the edge of the pond with an additional evergreen buffer planting with amature height of at least eight r. feet between the fence and :the pond. wee.. rr'{2 ni Item No. 13'- CONSIDER RESOLUTION AWARDING CONTRACT FOR BRIDGE IMPROVEMENTS TO CONCRETE TREATMENTS OF IOWA. Comment: Proposals were opened on the rebid of this project on June 61 1978. Attached is a bid tabulation showing the original bid and the rebid which was again bid only by Concrete Treatments of, Iowa. The bid is approximately 3% over the engineer's estimate. The �- reason for rebidding the project was due lspecifically rto items 6, 7, and'8 which were deemed to be excessively high." On the rebid, the price for these three, items pertaining to the Washington Street bridge still amount to approximately $83,500 as compared to the estimated cost'lof $45,000. It is Public Works' opinion that even though the materials cost is only '$25,000'for this work, it will be impossible for the Street crews to perform the work due to the existing workload. Therefore,'it is: recommended I/ that the contract be awarded to Concrete Treatments of Iowa for the total project in the amount of $315,650.10. Page 9 Item No. 15 - CONSIDER A RESOLUTION AMENDING A CONTRACT WITH CITY CARTON FOR NEWSPRINT PICKUP BY PLACING SUCH CONTRACT IN ABEYANCE UNTIL SUCH TIME AS BOTH PARTIESMUTUALLY AGREE TO REINITIATE PERFORMANCE ON SUCH CONTRACT. Comment: This item was deferred from the agenda of June 6,'1978. City Carton has requested that they be allowed to terminate newsprint pickup. The bad publicity on the fire hazards of cellulose insulation has completely terminated the newsprint market. Neither City Carton nor Capitol Oil Company will accept, newsprint from ' any source. This precludes the City from having the refuse crews pick up newsprint at this time. City Carton has cooperated fully with the City, and Public Works believes it is desirable, to'allow 'them to terminate their arrangements for the present. Comment: This authorizes the Mayor to sign an agreement statin that the City will accept the discharge froma major industry Oscar Mayer) and accept responsibility for treatment. This is a standard agreement. 'The discharge. from Oscar Mayer will create no undue treatment, problems. 'It is recommended the Mayor be authorized to sign. 'After signature by the Mayor, it will be signed by a representative of the contributing industry and will be submitted to the Department of Environmental Quality. Action: Item No. '17 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE - CITY CLERK TO CERTIFY AN AMENDMENT' TO A LEASE BETWEEN THE CITY )3Ll ` OF IOWA CITY, IOWA AND UNION BUS DEPOT OF IOWA CITY, IOWA. Comment: On December '1, 1974, the City entered into a lease agreement with Union Bus Depot of Iowa City, Inc; leasing to Union Bus Depot property awned by, the City on the corner of Gilbert Street and College Street:- The tenant has asked that the lease be amended so that he be granted a right to lease the premises until December, 1984. The amendment also contains a rent escalator clause which assures rent will reflect market value. 'A public hearing on this subject was held June 6, 1978. Action: T' �! Page 10 Item No. 18 -CONSIDER RESOLUTION ON UNCLASSIFIED SALARIES AND COMPENSATION FOR FISCAL YEAR 1979 BEGINNING JULY 1, 1978. / Comment: This resolution establishes compensation for the City Attorney, City Clerk and City, Manager for FY 1979, in 'accordance with the adopted budget. Comment: It has become apparent that the demand for parking permits is greatly increased, and the frequencing of reissuing permits due 1978 is also to lost or stolen permits (12 since', January, ) increasing.', It is felt that a,reissue fee may act as a deterrent to lax control of permits by permit holders. ,The Finance Director I recommends approval of this resolution.
