IOWA CITY, A NATURAL GAS SYSTEM FOR A PERIOD OF TEN
YEARS, WITH A TEN YEAR AND FIVE YEAR RENEWAL
THEREAFTER, TO FURNISH, DELIVER AND SELL NATURAL GAS
TO SAID CITY AND ITS INHABITANTS.
Comment: The ordinances which govern the franchise with
MidAmerican Energy for providing both electric and gas utilities in Iowa
City expired in November 2001. MidAmerican Energy representatives
and staff have negotiated renewal of these franchises. This ordinance
will grant MidAmerican a franchise for a natural gas system for a period
of ten years, with a ten year and five year renewal thereafter. A public
hearing is required under Iowa Code section 364.2(4)(a) when a
municipality is considering whether to grant a franchise. Staff

CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR
OCTOBER 2, 2007 ON A PROPOSAL TO CONVEY A STORM
WATER MANAGEMENT DRAINAGE EASEMENT AND A STORM
SEWER PIPE EASEMENT AT THE IOWA CITY MUNICIPAL
AIRPORT.
Comment: John and Allegra Dane would like to purchase two
easements along the southwestern border of the airport. One is a storm
water management drainage easement (1.10 acres) and the second is a
storm water sewer pipe easement (.12 acres). The land within the
easements has been appraised at $14,100, which is the proposed
purchase price. The FAA does not object to the City granting the
easements, and the Airport Commission at its May 10 meeting passed a
resolution recommending that Council grant the easements.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN
AND THE CITY CLERK TO ATTEST AN AMENDMENT TO THE
AGREEMENT WITH IOWA REALTY COMMERCIAL TO SELL
AND/OR LEASE PROPERTY IN AVIATION COMMERCE PARK TO
CHANGE THE PRICING MODEL.
Comment: The listing agreement to sell and lease the property known
as Aviation Commerce Park ("ACP") executed by the Airport
Commission, the City Council, and Iowa Realty Commercial will expire
on January 22, 2008. The proposed amendment changes the pricing
model to provide that Iowa Realty will market ACP as individual lots,
rather than as an entire development. ACP can still be sold as one
development; the pricing model simply guides Iowa Realty's
marketing efforts. The Airport Commission will consider the
proposed amendment at its meeting on September 13.

REGARDING TWO MORTGAGES FOR THE PROPERTY LOCATED
AT 2221 HOLLYWOOD BOULEVARD, IOWA CITY, IOWA.
Comment: The owner of the property located at 2221 Hollywood
Boulevard received assistance through the City of Iowa City's Housing
Rehabilitation Program. The loans have been paid off; thus the liens
need to be released.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST TO A
SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA
CITY AND IOWA STATE BANK AND TRUST COMPANY, IOWA CITY,
IOWA FOR PROPERTY LOCATED AT 1150 CHAMBERLAIN DRIVE,
IOWA CITY, IOWA.
Comment: Iowa State Sank and Trust Company has requested that the
City approve a Subordination Agreement for property at 1150
Chamberlain Drive. On February 15, 2006, the owner of the property
received a loan from the City of Iowa City's HOME Investment
Partnership (HOME) funds. The property has enough equity to cover the
City's lien position.

d) AUTHORIZING CONVEYANCE OF THE VACATED PORTIONS OF COURT
STREET WEST OF MADISON STREET, AND FRONT STREET
SOUTH OF BURLINGTON STREET TO THE UNIVERSITY OF IOWA.
Comment: The Council vacated these portions of Court Street and Front Street
by adopting Ordinance No. VAC07-00004. In conjunction with this vacation, the
adjacent property owner, the University of Iowa, has requested the City convey to
it these vacated parcels for the purpose of constructing a new recreation center,
in exchange for granting the City a blanket utility easement over these parcels.
This resolution authorizes the City to convey the vacated portions of Court Street
and Front Street to the University of Iowa.

f) AUTHORIZING THE CONVEYANCE OF THE VACATED EAST-WEST AND
NORTH-SOUTH ALLEYS IN BLOCK 1 02, IOWA CITY, IOWA, TO
HIERONYMUS SQUARE ASSOCIATES.
Comment: Council has vacated the above-referenced alleys in anticipation of
conveying these parcels to HSA. In exchange for this vacation and conveyance,
HSA will construct and maintain east-west and north-south alleyways, grant to
the public a public access easement, grant a blanket utility easement, and agree
to perform snow removal along the entire length of the North-South alley,
including any section of the alley not vacated or herein conveyed to HSA. The
Staff supports this conveyance without monetary consideration in light of these
easements and obligations HSA has agreed to undertake. This Resolution
declares the City Council's authority to convey the above parcels to HSA.

INTERNATIONAL BUILDING CODE, 2006 EDITION, AND THE INTERNATIONAL
RESIDENTIAL CODE, INCLUDING APPENDIX F RADON CONTROL METHODS,
2006 EDITION, PUBLISHED BY THE INTERNATIONAL CODE COUNCIL AND
PROVIDING FOR CERTAIN AMENDMENTS THEREOF; TO PROVIDE FOR THE
PROTECTION OF THE HEALTH, WELFARE AND SAFETY OF THE CITIZENS OF
IOWA CITY, IOWA.
Comment: The Board of Appeals, at their public meeting on August 13, 2007, voted 4
to 2 to recommend approval of this code as amended. On September 13, 2007 the
Historic Preservation Commission will review the code amendments and their
recommendation(s) will be forwarded to Council for the public hearing. A memo
providing a description of notable changes is included in Council's packet. An
outstanding issue concerns the local amendment for "usability" requirements. The
"usability" requirements are recommended by the Board and supported by The
Johnson County Livable Community for Successful Aging Policy Board (letter of
support in this packet) but not by the Greater Iowa City Homebuilders Association. The
draft minutes of the August 13th Board of Appeals meeting was sent in Council's
August 16 information packet. These minutes are being redistributed for your
information at the time of public hearing. Staff will be present to discuss the merits of

AT TITLE 17 OF THE CITY CODE, ENTITLED "BUILDING AND HOUSING,"
CHAPTER 9, ENTITLED, "BUILDING CONSERVATION CODE," BECAUSE
THE PROVISIONS ARE NOW INCLUDED IN THE BUILDING CODE. (FIRST

Comment: Section 17-9 of the Code was passed in 1999, and it regulates existing
buildings. Those same provisions are now included in the City Building Code, and
because it is duplicative, staff recommends repealing it.

CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE
CITY CLERK TO ATTEST A LEASE AGREEMENT BETWEEN THE CITY OF
r IOWA CITY AND FOUR OAKS FAMILY AND CHILDREN'S SERVICES FOR
OPERATION OF A CHILD CARE CENTER AT 1516 SHERIDAN AVENUE.
Comment: The property was purchased by a non-profit, Eagles' Flight, Inc D.B.A.
Hannah's Blessing Childcare Center, with HUD Community Development Block Grant
(CDBG) funds in 2001. Hannah's Blessing Childcare Center no longer provides child
care services and the property was deeded to the City of Iowa City in 2005 for
repayment of the CDBG funds. Four Oaks Family and Children's Services, a non-
profit, signed a one-year lease in 2005, with an option to renew for one-year. They
would like to sign a new one-year lease in order to continue to provide child care
services for low-moderate income households at the facility. The rent was increased,
but all of the original provisions remain the same.

Comment: The City entered into a contract with Mullin & Lonergan Associates on May
1, 2007 to prepare an affordable housing market analysis. An amendment to the
original contract is requested to include additional services relative to the
preparation of an Analysis of Impediments to Fair Housing (AI). The AI document is
required by the US Department of Housing and Urban Development (HUD) and" much
of the information gathered for the affordable housing market analysis can be used for
the preparation of the AI. A memo is included in the Council packet.

existing building's exterior walls to match the new building.

Comment: The residents of Kimball Road between N. Governor Street and N.
Dubuque Street have successfully completed the City of Iowa City approved traffic
calming program. This resulted in a survey. of the neighborhood yielding 88% majority
of respondents in favor of speed humps on Kimball Road between N. Governor Street
and N. Dubuque Street. Forty households were surveyed; 25 responded and 15 were
not returned. Staff memorandum and correspondence included in Council packet.
