HomeMy WebLinkAbout2007-10-02 Public hearing MidAmerican Energy Company Terry Smith Director, Community Relations State Regulated Utility · Iowa Utilities Board jurisdiction - Rates - Service territory - Policies - Energy efficiency programs - Low income assistance programs Key Points of Proposed Franchise Renewals Key Points of Franchise Renewals · Section 2 - Term - Franchise shall run for 10 years. - City has the right to terminate, by council vote between years 8 and 9 of the initial period. - If the city does not exercise this right, the agreement will extend an additional 10 years with the city retaining the right to terminate, by council vote between years 18 and 19. - If not terminated, continues for 5 years. Key Points of Franchise Renewals · Section 5 - Right-of-Way - Company has the right to erect poles, wires, etc. as necessary to serve the community. - Company must secure city approval to place any substation or transmission line operating above 15,000 volts. Key Points of Franchise Renewals · Section 7 - Customer notification - Prior to undertaking any significant construction or maintenance project, the company shall use best efforts to notify affected customers. - Examples of notification methods include, door hangers, telephone calls and direct mail postcards or letters. Key Points of Franchise Renewals · Section 8 - Protecting trees - The company must follow nationally accepted tree trimming standards. - The company cannot remove any tree on public grounds without prior permission. - The company shall not dig directly under tree canopies unless using trench-less technologies or directional boring. Key Points of Franchise Renewals · Section 9 - Indemnification - The company shall indemnify and protect the city from claims and damages caused by the company's negligence. Key Points of Franchise Renewals · Section 14 - Community support - The company will continue to support quality of life issues. - The company will annually provide a report to the council of the most current and three prior years of participation. Key Points of Franchise Renewals · Section 15 - Pole attachments - With 3D-day advance written notice, the city may use the company's distribution poles for: · City alarms, control and communications functions free of charge. Key Points of Franchise Renewals · Section 16 - Franchise fees - The city reserve the right to implement franchise fees. - No franchise fees are included in the agreement. - If the city were to enact a franchise fee, it agrees to provide the company with gO-day written notice before going into effect. Key Points of Franchise Renewals · Section 20 - Disaster and emergency response preparedness - Company agrees to participate in the disaster and emergency response communications task force under a separate agreement. Key Points of Franchise Renewals · Section 21 - Renewable energy - The company agrees to participate in a city task force to identify and utilize city generated renewable energy options subject to statutory requirements and regulations.
